		<section display-inline="no-display-inline" id="HFA952BC782C54F4C84DE16247288242E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Social Security Uninsured Children’s
			 Entitlement Act of 2008</short-title></quote>.</text>
		</section><section id="H82351173EF9E4AF292479E3477A0B705"><enum>2.</enum><header>Benefits for
			 certain uninsured children</header>
			<subsection id="HBE55FD7AB42246F8B92CEB354964EF64"><enum>(a)</enum><header>In
			 general</header><text>Title II of the <act-name parsable-cite="SSA">Social
			 Security Act</act-name> is amended by adding after section 234 (<external-xref legal-doc="usc" parsable-cite="usc/42/434">42 U.S.C. 434</external-xref>)
			 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H600C1BA04436404BBA244BE36E1CFD43" other-style="archaic" style="other">
					<section id="H2CC75AB46C664DE6B2BEE00000C300BD"><enum>235.</enum><header>Benefits for certain uninsured children</header><subsection commented="no" display-inline="yes-display-inline" id="H8F72DB7FC8294648A8467979541E484E"><enum>(a)</enum><header>Eligibility</header><text>Every individual who
				would not be entitled to child’s insurance benefits under section 202(d) upon
				filing application therefor and who—</text>
							<paragraph id="HDEB3CBEB8CA047D798008031937D2297"><enum>(1)</enum><text>has not attained
				the age of 18 and has not married,</text>
							</paragraph><paragraph id="HFBB29839BB31429E904EA48FE31E33A"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H24CA0F6845B645739BE48610DA5EAE15"><enum>(A)</enum><text>has no living parent or
				(B) with respect to each parent (including an adoptive parent) who is living,
				has provided to the Commissioner of Social Security (in such form and manner as
				shall be prescribed in regulations of the Commissioner) a notarized statement
				that such individual has had no contact with such parent for at least 2 years
				and that reasonable attempts by a guardian or appropriate government agency to
				locate such parent have not been successful,</text>
								</subparagraph></paragraph><paragraph id="HFF5645DAB35B4C6FBFDF7FABF6B2ADCB"><enum>(3)</enum><text>is a resident of
				the United States (as defined in subsection (c)), and is (A) a citizen of the
				United States or (B) an alien lawfully admitted for permanent residence who has
				resided in the United States (as defined in subsection 210(i)) continuously
				during the 5 years immediately preceding the month in which he or she files
				application under this section, and</text>
							</paragraph><paragraph id="H3CA9823796AD4FFC8C84C8EE01BBEFF3"><enum>(4)</enum><text>has filed
				application for benefits under this section,</text>
							</paragraph><continuation-text continuation-text-level="subsection">shall
				(subject to the limitations in this section) be entitled to a benefit under
				this section for each month beginning with the first month in which he or she
				becomes so entitled to such benefits and ending with the month preceding the
				month in which he or she attains 18 years of age or marries. No application
				under this section which is filed by an individual more than 3 months before
				the first month in which he or she meets the requirements of paragraphs (1),
				(2), and (3) shall be accepted as an application for purposes of this
				section.</continuation-text></subsection><subsection id="H657942FE7FBA41C987F3905E68CDE407"><enum>(b)</enum><header>Benefit
		  amount</header><text>The benefit amount
				to which an individual is entitled under this section for any month shall be
				the larger of $200 or the amount most recently established in lieu thereof
				under section 215(i).</text>
						</subsection><subsection id="HECD2D89E9F3F475BB9007EE556EC4BB"><enum>(c)</enum><header>Suspension where individual is residing
		  outside the United States</header><text>The benefit to
				which any individual is entitled under this section for any month shall not be
				paid if, during such month, such individual is not a resident of the United
				States. For purposes of this subsection, the term <term>United States</term>
				means the 50 States and the District of Columbia.</text>
						</subsection><subsection id="HB9FC7A4A25954E9C815E671FF5C08BFD"><enum>(d)</enum><header>Treatment as monthly insurance
		  benefits</header><text>For purposes of
				subsections (t) and (u) of section 202, a monthly benefit under this section
				shall be treated as a monthly insurance benefit payable under section
				202.</text>
						</subsection><subsection id="HDB88894668CC4FEF9B323CAE828A600"><enum>(e)</enum><header>Annual reimbursement of Federal Old-Age
		  and Survivors Insurance Trust Fund</header><text>There are
				authorized to be appropriated to the Federal Old-Age and Survivors Insurance
				Trust Fund for the fiscal year ending September 30, 2006, and for each fiscal
				year thereafter, such sums as the Commissioner of Social Security deems
				necessary on account of—</text>
							<paragraph id="HF596024B11DF473483C86C42B8B3258"><enum>(1)</enum><text>payments made under
				this section during the second preceding fiscal year and all fiscal years prior
				thereto to individuals entitled to benefits under this section,</text>
							</paragraph><paragraph id="H3152BE9C5F0F463CAF1500F0969EE6F8"><enum>(2)</enum><text>the additional
				administrative expenses resulting from the payments described in paragraph (1),
				and</text>
							</paragraph><paragraph id="H2D2CD8154A174FD4AA9BF5F18D5E7FF1"><enum>(3)</enum><text>any loss in
				interest to such Trust Fund resulting from such payments and expenses, in order
				to place such Trust Fund in the same position at the end of such fiscal year as
				it would have been in if such payments had not been
				made.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7F5584A74D274994B0A3C6D244FBEBB2"><enum>(b)</enum><header>Cost of living
			 adjustments</header><text>Section 215(i)(2)(A)(ii)(I) of such Act (42 U.S.C.
			 415(i)(2)(A)(ii)(I)) is amended by striking <quote>section 227 or 228</quote>
			 and inserting <quote>section 227, 228, or 235</quote>.</text>
			</subsection></section><section id="H29A35D8643ED4C5EA2C414E03C3CFD72"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect with respect to applications filed on or after
			 January 1, 2009.</text>
