		<official-title>To amend the Social Security Act and the Internal Revenue
		  Code of 1986 to exempt certain employment as a member of a local governing
		  board, commission, or committee from Social Security tax
		  coverage.</official-title>

		<section id="HF70549BDEE354D208E4236666600CAA9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Local Officials Tax Relief Act of
			 2008</short-title></quote>.</text>
		</section><section id="H8FF9B20D9F4A4701BA28C974079C2800"><enum>2.</enum><header>Exemption of
			 certain local governing board employment from social security tax
			 coverage</header>
			<subsection id="H18537FB2006D4329A15E414FFBEBD15D"><enum>(a)</enum><header>Amendments to
			 Social Security Act</header><text>Section 210(a)(7)(F) of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/410">42 U.S.C. 410(a)(7)(F)</external-xref>) is amended by striking <quote>or</quote> at the
			 end of clause (iv), by adding <quote>or</quote> at the end of clause (v), and
			 by inserting after clause (v) the following new clause:</text>
				<quoted-block id="H4BBF9428CD854C8F9C86A7A443A13124" style="OLC">
					<clause id="H8A9B262E18504D569938852019C14508"><enum>(vi)</enum><text>by any elected or
				appointed member of a general governing board, commission, or committee of any
				political subdivision of a State if the remuneration paid in a calendar year
				for such service is not more than—</text>
						<subclause id="HC665A97D5F8F4FF4882FE565A2AB0072"><enum>(I)</enum><text>$1,300, with
				respect to service performed during any calendar year commencing on or after
				January 1, 2008; and</text>
						</subclause><subclause id="H24038AE44F2C4AB200D177DEA2470511"><enum>(II)</enum><text>the adjusted
				amount determined under section 218(c)(8)(B) for any calendar year commencing
				on or after January 1, 2010, with respect to service performed during such
				calendar
				year;</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H892587B695A0434B9172CF75804068E"><enum>(b)</enum><header>Amendments to
			 Internal Revenue Code of 1986</header><text>Section 3121(b)(7)(F) of the
			 Internal Revenue Code of 1986 (defining employment) is amended by striking
			 <quote>or</quote> at the end of clause (iv), by adding <quote>or</quote> at the
			 end of clause (v), and by inserting after clause (v) the following new
			 clause:</text>
				<quoted-block id="H152A7CE451064754AAEC0360759D6E34" style="OLC">
					<clause id="H47C5E7204DFE4C2CAB222B9023B0765F"><enum>(vi)</enum><text>by any elected or
				appointed member of a general governing board, commission, or committee of any
				political subdivision of a State if the remuneration paid in a calendar year
				for such service is not more than—</text>
						<subclause id="H36D52606B2484D8A8060F01C4BA6A9A4"><enum>(I)</enum><text>$1,300 with
				respect to service performed during any calendar year commencing on or after
				January 1, 2008, and</text>
						</subclause><subclause id="HD57F3B8ADFD34BED9DDEDB4FB54C15EA"><enum>(II)</enum><text>the adjusted
				amount determined under section 218(c)(8)(B) of the Social Security Act for any
				calendar year commencing on or after January 1, 2010, with respect to service
				performed during such calendar
				year;</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEEB0873A96C649C9B0982CAA36CE8528"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to service performed during calendar years commencing on or after January 1,
			 2008.</text>
