		<official-title>To amend title 18, United States Code, to prohibit
		  certain conduct relating to the use of horses for human
		  consumption.</official-title>

		<section id="HD1B8A3EC8FB7457B8D12DF781D9FC000" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Prevention of Equine Cruelty Act of
			 2008</short-title></quote>.</text>
		</section><section id="HBDE692C561E84CA89BDE50629B6C98"><enum>2.</enum><header>Slaughter of horses
			 for human consumption</header>
			<subsection id="H0322AFE92BC44154950617006895B7E7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 3 of title
			 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H25BB813DFAD442498447B90015DB4BF2" style="USC">
					<section id="HC22984FFCD5949BCB3AE170078F97D68"><enum>50.</enum><header>Slaughter of
				horses for human consumption</header>
						<subsection id="H9F6117503D3F4360B7B74809F9048F4E"><enum>(a)</enum><text display-inline="yes-display-inline">Except as provided in subsection (b),
				whoever knowingly—</text>
							<paragraph id="H4987622719904816ACC30737167623F7"><enum>(1)</enum><text>possesses, ships,
				transports, purchases, sells, delivers, or receives, in or affecting interstate
				commerce or foreign commerce, any horse with the intent that it is to be
				slaughtered for human consumption; or</text>
							</paragraph><paragraph id="HE74AB897FE1C41D1B96D25B0C56245B6"><enum>(2)</enum><text display-inline="yes-display-inline">possesses, ships, transports, purchases,
				sells, delivers, or receives, in or affecting interstate commerce or foreign
				commerce, any horse flesh or carcass or part of a carcass, with the intent that
				it is to be used for human consumption;</text>
							</paragraph><continuation-text continuation-text-level="subsection">shall be
				fined under this title or imprisoned not more than three years or both.</continuation-text></subsection><subsection id="H56E327DA87B84472AB74D6FFE07D1C08"><enum>(b)</enum><text display-inline="yes-display-inline">If—</text>
							<paragraph id="H8FA551CD70B94BADBFC3836061CD80D3"><enum>(1)</enum><text>the defendant
				engages in conduct that would otherwise constitute an offense under subsection
				(a);</text>
							</paragraph><paragraph id="HAF4CA6CA8C2F4BED8C85DAB025BC7DC0"><enum>(2)</enum><text>the defendant has
				no prior conviction under this section; and</text>
							</paragraph><paragraph id="H4CAEEA087EEF4F37AC8740EE2D459D91"><enum>(3)</enum><text>the conduct
				involves less than five horses or less than 2000 pounds of horse flesh or
				carcass or part of a carcass;</text>
							</paragraph><continuation-text continuation-text-level="subsection">the
				defendant shall, instead of being punished under that subsection, be fined
				under this title or imprisoned not more than one year, or both.</continuation-text></subsection><subsection id="HB3B4B6E6486A41D78DE9458F980000AC"><enum>(c)</enum><text>The Attorney
				General shall provide for the humane placement or other humane disposition of
				any horse seized in connection with an offense under this section.</text>
						</subsection><subsection id="H2E884D18CA784E14B3912081EC80004D"><enum>(d)</enum><text>As used in this
				section, the term <quote>horse</quote> means any member of the family Equidae.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2FC08F1D66E14949002623CDDB4CEE62"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/3">chapter 3</external-xref> of title 18, United States Code, is amended by adding at
			 the end the following new item:</text>
