		<section id="HB877B5CA3F49449E9D89B150B6D24AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gas Price Relief for Schools Act of
			 2008</short-title></quote>.</text>
		</section><section id="H8E22AC3A06234B94927D4701DC9B3423" section-type="subsequent-section"><enum>2.</enum><header>School bus emergency
			 fuel grant program</header>
			<subsection id="H59626583CB2248CFB0F243A53200BB56"><enum>(a)</enum><header>General
			 authority</header><text display-inline="yes-display-inline">The Secretary of
			 Transportation may make grants to eligible recipients to assist the recipients
			 in offsetting increases in school bus transportation operating costs
			 attributable to higher fuel prices.</text>
			</subsection><subsection id="H8177DC5C771F4104AA6BD3B869AFEBCB"><enum>(b)</enum><header>Applications</header><text>An
			 eligible recipient seeking a grant under this section shall submit to the
			 Secretary an application that is in such form and contains such information as
			 the Secretary may require.</text>
			</subsection><subsection id="H4CED1D52FC644CD1BD36F1DF5EABC7CA"><enum>(c)</enum><header>Criteria for
			 awarding grants</header>
				<paragraph id="HD530878EA3534715B5C7D96A5FE6637"><enum>(1)</enum><header>In
			 general</header><text>In awarding grants under this section, the Secretary
			 shall consider the extent to which an eligible recipient has been adversely
			 affected by increases in fuel costs in providing school bus
			 transportation.</text>
				</paragraph><paragraph id="HB8A87ECB40D84B688E44D8D209E5D0CB"><enum>(2)</enum><header>Factors</header><text>For
			 purposes of paragraph (1), the Secretary, at minimum, shall consider—</text>
					<subparagraph id="HB8AC3251162D40FDA5D024DEACF08EAE"><enum>(A)</enum><text>whether a public
			 school system served by the eligible recipient has implemented cuts to school
			 bus transportation services as a result of increased school bus transportation
			 fuel costs;</text>
					</subparagraph><subparagraph id="HCF72EACA84C047BC99A64CF3E822D5C6"><enum>(B)</enum><text>whether a public
			 school system served by the eligible recipient has implemented changes or cuts
			 in school operations, such as a shorter school week, as a result of increased
			 school bus transportation fuel costs; and</text>
					</subparagraph><subparagraph id="HB612D1304815455499AED600C1AA05CA"><enum>(C)</enum><text>the distances
			 traveled by school buses operated by the eligible recipient, particularly for
			 public school systems located in rural areas where school buses travel greater
			 distances to transport students.</text>
					</subparagraph></paragraph></subsection><subsection id="H42F5FADDA7624783A0E6BF37D47CCD1"><enum>(d)</enum><header>Grant
			 allocations</header>
				<paragraph id="HBA0C1695A70C4C7EBAD68862CEC2E69D"><enum>(1)</enum><header>Solicitation of
			 applicants</header><text>The Secretary shall conduct a national solicitation
			 for applications for grants under this section.</text>
				</paragraph><paragraph id="H7C53CA78F87A4978BCBFCF1D96809833"><enum>(2)</enum><header>Geographic
			 distribution</header><text>To the maximum extent practicable, the Secretary
			 shall ensure a broad geographic distribution of grant awards under this
			 section.</text>
				</paragraph><paragraph id="HCE6775F1A4844AC9ADC387A06E935E3F"><enum>(3)</enum><header>Distribution
			 among States</header><text>Not to exceed 5 percent of the grants funds awarded
			 under this section in a fiscal year may be awarded to eligible recipients in
			 any State.</text>
				</paragraph></subsection><subsection id="H2F0231F2E657451A86632072C36323EE"><enum>(e)</enum><header>Suballocations
			 to private entities</header><text>An eligible recipient that receives a grant
			 under this section may allocate all or any portion of the amounts provided
			 under the grant to a private entity providing school bus transportation to a
			 public school system for the eligible recipient on a contract basis.</text>
			</subsection><subsection id="H7A95EE6DF4FE41A2A468FD024079A434"><enum>(f)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph id="H0316916266474298B02FF06031CC2E46"><enum>(1)</enum><header>Eligible
			 recipient</header><text display-inline="yes-display-inline">The term
			 <quote>eligible recipient</quote> means a unit of State or local government
			 responsible for providing school bus transportation to a public school
			 system.</text>
				</paragraph><paragraph id="H817B4479BF7E4DF4B253EF8F8F2FEFEC"><enum>(2)</enum><header>School bus
			 transportation</header><text display-inline="yes-display-inline">The term
			 <quote>school bus transportation</quote> means the transportation of
			 preprimary, primary, or secondary students of a public school system to or from
			 school or an event related to school by a school bus or multifunction school
			 activity bus.</text>
				</paragraph></subsection><subsection id="H7055DDF310324ED9A1F77231A26199F3"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary to carry out this section such sums as may be necessary for each of
			 fiscal years 2008 and 2009. Such sums shall remain available until expended
			 .</text>
