<official-title display="yes">To provide financial support for the operation of the law library of the Library of Congress, and for other purposes.</official-title>

<section id="HD282AC44C5DE435BA7CDC8526DDDDB9C" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Charles H.W. Meehan Law Library Improvement and Modernization Act</short-title></quote>.</text> </section>
<section id="H482AD4993CE647C6968D7552856089A4" section-type="subsequent-section"><enum>2.</enum><header>Financial Support for Law Library of Library of Congress</header> 
<subsection id="H3BD5AFE7847440B0BEF7BB1FD8BEEF50"><enum>(a)</enum><header>Financial Support</header><text display-inline="yes-display-inline">In addition to any other amounts made available for the salaries and expenses of the Library of Congress, there are authorized to be appropriated to the Librarian of Congress $3,500,000 for <deleted-phrase reported-display-style="strikethrough" committee-id="HHA00">building, maintaining, and administering</deleted-phrase> <added-phrase reported-display-style="italic" committee-id="HHA00"> maintaining and administering</added-phrase> the operations of the law library of the Library of Congress, including the cataloguing of the collections of the law library. Any amounts appropriated pursuant to the authority of this subsection shall remain available without fiscal year limitation until expended.</text> </subsection>
<subsection id="HE4C7059E63E34A5988F519D324E7C6EB"><enum>(b)</enum><header>Electronic Cataloging of Nonproprietary Material</header><text display-inline="yes-display-inline">To the extent practicable, in using any funds appropriated pursuant to the authority of subsection (a) to catalog and archive nonproprietary material in the collections of the Law Library after the date of the enactment of this Act, the Law Librarian of Congress shall catalog and archive the material electronically in a nonproprietary and nondiscriminatory format. Nothing in the previous sentence may be construed to affect any cataloging and archiving activities carried out with funds which are not appropriated pursuant to the authority of subsection (a).</text> </subsection></section>
<section display-inline="no-display-inline" id="HCE1C8FA043044A0A86902C0900D6FAD3" section-type="subsequent-section"><enum>3.</enum><header>Separation of Law Library Salaries and Expenses in Preparation of Annual Library of Congress Budget</header> 
<subsection id="HE97D78F0C863493EA421904F8D590036"><enum>(a)</enum><header>Separate Budget Treatment of Law Library</header><text display-inline="yes-display-inline">In preparing the annual budget for the Library of Congress which will be submitted by the President under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/11">chapter 11</external-xref> of title 31, United States Code, and in preparing the annual budget and related materials for the Library of Congress for the use of the Committees on Appropriations of the Senate and House of Representatives, the Librarian of Congress shall ensure that all amounts attributable to salaries and expenses of the law library of the Library of Congress are set forth separately as a separate line item from other salaries and expenses of the Library of Congress.</text> </subsection>
<subsection id="H6B464DF272A846CE95A808C8CF006970"><enum>(b)</enum><header>Effective Date</header><text>This section shall apply with respect to fiscal year 2010 and each succeeding fiscal year.</text> </subsection></section>
<section id="H8137B20EBB6849BC823C008FB20055D3"><enum>4.</enum><header>Charles H. W. Meehan Program to Support the Mission of the Law Library of the Library of Congress</header> 
<subsection id="H0409E189164E4AA9A663BA810015E14D"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H5090A03D6B594D8EBDB1796DF333BB64"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Librarian of Congress, acting through the Law Librarian of Congress, shall establish and operate a program to be known as the <quote>Charles H. W. Meehan Law Library Support Program</quote> (hereafter in this section referred to as the <quote>Program</quote>), which will—</text> 
<subparagraph id="H87C7C48DA1C14358B4F0205D4605AC1C"><enum>(A)</enum><text>provide enhanced or special services and programs for the Law Library; and</text> </subparagraph>
<subparagraph id="H88FD442ADC8244079CF5BC3B88502D"><enum>(B)</enum><text>otherwise support the mission of the Law Library.</text> </subparagraph></paragraph>
<paragraph id="H30B1C8F96C564B9D852BCAD761B6B6E"><enum>(2)</enum><header>Relation to other programs</header><text>The Librarian shall operate the Program in a manner which ensures that the resources of the Program are not commingled with the resources used to carry out the program operated under section 2.</text> </paragraph></subsection>
<subsection id="H6F94511F534F4293A71D3435BCD8ED2B"><enum>(b)</enum><header>Role of Other Entities</header><text display-inline="yes-display-inline">The Librarian may carry out the Program through agreements and partnerships entered into with other government and private entities, including the American Association of Law Libraries and the American Bar Association.</text> </subsection>
<subsection id="HDB5928DF71DF40E09BE404A094760100"><enum>(c)</enum><header>Private Support</header> 
<paragraph id="H46B7462CFB6A432C9CDC64B1D1F9001D"><enum>(1)</enum><header>Acceptance of donations</header><text display-inline="yes-display-inline">Donations of funds and in-kind contributions in support of the Program may be accepted—</text> 
<subparagraph id="HC6D45969745E41B182E397A449DC5648"><enum>(A)</enum><text>by the Library of Congress Trust Fund Board, as provided under the Act entitled <quote>An Act to create a Library of Congress Trust Fund Board, and for other purposes</quote>, approved March 3, 1925 (<external-xref legal-doc="usc" parsable-cite="usc/2/154">2 U.S.C. 154 et seq.</external-xref>); and</text> </subparagraph>
<subparagraph id="H392D28A65A914D02A6E2C954F38528D2"><enum>(B)</enum><text>by the Librarian of Congress, as provided under section 4 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/160">2 U.S.C. 160</external-xref>).</text> </subparagraph></paragraph>
<paragraph id="H9BCCECDF6D234055B289868F80036E44"><enum>(2)</enum><header>Use of amounts</header><text display-inline="yes-display-inline">Notwithstanding the second paragraph of section 2 of the Act entitled <quote>An Act to create a Library of Congress Trust Fund Board, and for other purposes</quote>, approved March 3, 1925 (<external-xref legal-doc="usc" parsable-cite="usc/2/157">2 U.S.C. 157</external-xref>), or the third sentence of section 4 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/160">2 U.S.C. 160</external-xref>), any amounts accepted by the Library of Congress Trust Fund Board or the Librarian of Congress in support of the Program shall be subject to disbursement by the Librarian only upon the recommendation of the Law Librarian (except to the extent otherwise provided under any terms and conditions on the use of the amounts which are imposed by the person making the donation).</text> </paragraph>
<paragraph id="H7012CBA9632D4CBEAED328D5FD90E753"><enum>(3)</enum><header>Acceptance of other voluntary services</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1342">section 1342</external-xref> of title 31, United States Code, the Librarian of Congress may accept voluntary and uncompensated services in support of the Program.</text> </paragraph></subsection>
<subsection id="HC92F74BD16E44605B500D0988E562646"><enum>(d)</enum><header>Establishment of separate account</header> 
<paragraph id="HF8B2A3282A914BE89FF900A64967EB7"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury (among the accounts of the Library of Congress) a separate account for the Program, which shall consist of—</text> 
<subparagraph id="H5C381F5FB5E144AEBC18639C7649EE09"><enum>(A)</enum><text>amounts accepted by the Library of Congress Trust Fund Board in support of the Program as described in subsection (c)(1)(A), together with any income earned on such amounts;</text> </subparagraph>
<subparagraph id="H22E4436234FF446783225D1DCB6882DC"><enum>(B)</enum><text display-inline="yes-display-inline">amounts accepted by the Librarian of Congress in support of the Program as described in subsection (c)(1)(B), together with any income earned on such amounts;</text> </subparagraph>
<subparagraph id="H6DEBCFDE50284EFB81099DB0FED784C9"><enum>(C)</enum><text>amounts appropriated pursuant to the authorization under subsection (f); and</text> </subparagraph>
<subparagraph id="HA5E81F3EF5744EFD9D1DB30003A459D1"><enum>(D)</enum><text>interest on the balance of the account.</text> </subparagraph></paragraph>
<paragraph id="H2119E6DC85D8489E83A0A39663CE1E2F"><enum>(2)</enum><header>Use of amounts</header><text>The funds contained in the account established under this subsection shall be used solely by the Law Librarian of Congress to carry out the Program.</text> </paragraph></subsection>
<subsection id="H09BE9DA24FAB4C5B9743C75FDB2CBE3F"><enum>(e)</enum><header>Annual Report</header><text display-inline="yes-display-inline">Not later than April 30 of each year (beginning with 2009), the Librarian of Congress shall submit a report on Program funding and activities to the Committee on House Administration of the House of Representatives, the Committee on Rules and Administration of the Senate, the American Bar Association, and the American Association of Law Libraries. The report shall include—</text> 
<paragraph id="H25E727B431434897AF5F028539A3BAF2"><enum>(1)</enum><text>a listing of all donations received in support of the Program during the previous year;</text> </paragraph>
<paragraph id="H3DA7E78EDA1B4E9FA987337BC50094B5"><enum>(2)</enum><text>the total obligations during the previous year for each Program activity;</text> </paragraph>
<paragraph id="H60EF192E79144CEEA40067BCEF1EE00"><enum>(3)</enum><text>the amount appropriated pursuant to the authorization under subsection (f) for the fiscal year beginning on the previous October 1;</text> </paragraph>
<paragraph id="H40EFD41BAA1343269F021C36F504DA17"><enum>(4)</enum><text>a list of Program activities, with budget information for each such activity, planned for the calendar year in which the report is submitted; and</text> </paragraph>
<paragraph id="H154E9AAB799241A88908B8F6199D8FAE"><enum>(5)</enum><text>any findings in the most recently completed audit conducted with respect to the Law Library or Program funds or investments.</text> </paragraph></subsection>
<subsection id="H380B7FDF40584BD69B5E77EE98BFEEA1"><enum>(f)</enum><header>Authorization of Appropriations</header><text display-inline="yes-display-inline">In addition to any other amounts authorized to be appropriated to the Librarian of Congress for the Law Library of Congress for a fiscal year, there are authorized to be appropriated for deposit into the account established under subsection (d) an amount equal to 40 percent of the amount of the donations accepted by the Library of Congress Trust Fund Board in support of the Program under subsection (c)(1) during the previous fiscal year.</text> </subsection></section>
