			 purposes</header>
			<subsection id="HD8C30E89FE394786007057D41DC7AEEE"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="HB4B9C4B377A3481B87EC59114DA4B64E"><enum>(1)</enum><text>the United States
			 has distinct legal, treaty, and trust obligations to provide for the public
			 safety of tribal communities;</text>
				</paragraph><paragraph id="H740A01551BC64D5B90C421A366DF7FD1"><enum>(2)</enum><text>several States
			 have been delegated or have accepted responsibility to provide for the public
			 safety of tribal communities within the borders of the States;</text>
				</paragraph><paragraph id="H6A970DFC180D4F0DA2DF53BDE0C9142B"><enum>(3)</enum><text>Congress and the
			 President have acknowledged that—</text>
					<subparagraph id="H9B199AA75D334B45848CC004E02EF99C"><enum>(A)</enum><text>tribal law
			 enforcement officers are often the first responders to crimes on Indian
			 reservations; and</text>
					</subparagraph><subparagraph id="H3B054132053042DCB5D5BF702457A31E"><enum>(B)</enum><text>tribal justice
			 systems are ultimately the most appropriate institutions for maintaining law
			 and order in tribal communities;</text>
					</subparagraph></paragraph><paragraph id="H12209CED386B4790BDF8018CFD6270D6"><enum>(4)</enum><text>less than 3,000
			 tribal and Federal law enforcement officers patrol more than 56,000,000 acres
			 of Indian country, which reflects less than <fraction>1/2</fraction> of the law
			 enforcement presence in comparable rural communities nationwide;</text>
				</paragraph><paragraph id="HC99607FEE5264A8280CD141CBD104827"><enum>(5)</enum><text>on many Indian
			 reservations, law enforcement officers respond to distress or emergency calls
			 without backup and travel to remote locations without adequate radio
			 communication or access to national crime information database systems;</text>
				</paragraph><paragraph id="HCE2887AA771F45FB8B55BA8F8950CA29"><enum>(6)</enum><text>the majority of
			 tribal detention facilities were constructed decades before the date of
			 enactment of this Act and must be or will soon need to be replaced, creating a
			 multibillion-dollar backlog in facility needs;</text>
				</paragraph><paragraph id="H9713C37B6E5C49498B78FDAFFA99C2B"><enum>(7)</enum><text>a
			 number of Indian country offenders face no consequences for minor crimes, and
			 many such offenders are released due to severe overcrowding in existing
			 detention facilities;</text>
				</paragraph><paragraph id="HADCBDE456C4C41989ED90074C95CE648"><enum>(8)</enum><text>tribal
			 courts—</text>
					<subparagraph id="H75E1245E933D479E89E000AA78CB17EC"><enum>(A)</enum><text>are the primary
			 arbiters of criminal and civil justice for actions arising in Indian country;
			 but</text>
					</subparagraph><subparagraph id="HA2B6B04037304B718592B80171D94204"><enum>(B)</enum><text>have been
			 historically underfunded;</text>
					</subparagraph></paragraph><paragraph id="HE9DE1A6F87A841B6B8E0CA7D13FD674"><enum>(9)</enum><text>tribal courts have
			 no criminal jurisdiction over non-Indian persons, and the sentencing authority
			 of tribal courts is limited to sentences of not more than 1 year of
			 imprisonment for Indian offenders, forcing tribal communities to rely solely on
			 the Federal Government and certain State governments for the prosecution
			 of—</text>
					<subparagraph id="HE8443A1403034A778293EDDC705918F"><enum>(A)</enum><text>misdemeanors
			 committed by non-Indian persons; and</text>
					</subparagraph><subparagraph id="H052410A22408409D8B00B35E48A7DD2B"><enum>(B)</enum><text>all felony crimes
			 in Indian country;</text>
					</subparagraph></paragraph><paragraph id="H862442BB86F1450BA0B7BC03C47215F9"><enum>(10)</enum><text>a significant
			 percentage of cases referred to Federal agencies for prosecution of crimes
			 allegedly occurring in tribal communities are declined to be prosecuted;</text>
				</paragraph><paragraph id="H803846F1F72F473E800029277D6586BA"><enum>(11)</enum><text>the complicated
			 jurisdictional scheme that exists in Indian country—</text>
					<subparagraph id="H6591624ED215405C948989EC677FD784"><enum>(A)</enum><text>has a significant
			 negative impact on the ability to provide public safety to Indian communities;
			 and</text>
					</subparagraph><subparagraph id="HC909826841364E2C937224FC24416572"><enum>(B)</enum><text>has been
			 increasingly exploited by criminals;</text>
					</subparagraph></paragraph><paragraph id="HAF07CB15F75A4068A598DC21D23E07F5"><enum>(12)</enum><text>the violent crime
			 rate in Indian country is—</text>
					<subparagraph id="H6ADA9CF416DF44908D49001EA31041BD"><enum>(A)</enum><text>nearly twice the
			 national average; and</text>
					</subparagraph><subparagraph id="H81DFBCE680264BCBA09BA832C124719"><enum>(B)</enum><text>more than 20 times
			 the national average on some Indian reservations;</text>
					</subparagraph></paragraph><paragraph id="HA9741311CEF04FF99B229197BBA7D5A4"><enum>(13)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H9C367C2D1DBE4D2183F34D6D0725D3C0"><enum>(A)</enum><text>domestic and sexual
			 violence against Indian and Alaska Native women has reached epidemic
			 proportions;</text>
					</subparagraph><subparagraph id="H32FE619C352440EF8837B9281EAC3958" indent="up1"><enum>(B)</enum><text>34 percent of Indian and Alaska Native
			 women will be raped in their lifetimes; and</text>
					</subparagraph><subparagraph id="H7C5763108C914FC59D6496006052AA9" indent="up1"><enum>(C)</enum><text>39 percent of Indian and Alaska Native
			 women will be subject to domestic violence;</text>
					</subparagraph></paragraph><paragraph id="H7A7C965D50AE4C2800CFB3F1D55452E1"><enum>(14)</enum><text>the lack of
			 police presence and resources in Indian country has resulted in significant
			 delays in responding to victims' calls for assistance, which adversely affects
			 the collection of evidence needed to prosecute crimes, particularly crimes of
			 domestic and sexual violence;</text>
				</paragraph><paragraph id="HBAA7C0031CF84CEB808F35A267019153"><enum>(15)</enum><text>alcohol and drug
			 abuse plays a role in more than 80 percent of crimes committed in tribal
			 communities;</text>
				</paragraph><paragraph id="H0DD8F224552B4D7100171EAFFDF3DF4F"><enum>(16)</enum><text>the rate of
			 methamphetamine addiction in tribal communities is 3 times the national
			 average;</text>
				</paragraph><paragraph id="H64B37F52626242C2AE00DD91BAC83B00"><enum>(17)</enum><text>the Department of
			 Justice has reported that drug organizations have increasingly targeted Indian
			 country to produce and distribute methamphetamine, citing the limited law
			 enforcement presence and jurisdictional confusion as reasons for the increased
			 activity;</text>
				</paragraph><paragraph id="H3E8C04F791FC4091B21476CD35CAF219"><enum>(18)</enum><text>tribal
			 communities face significant increases in instances of domestic violence,
			 burglary, assault, and child abuse as a direct result of increased
			 methamphetamine use on Indian reservations;</text>
				</paragraph><paragraph id="H4939625C40CD4FAFAF5B25DF2872C518"><enum>(19)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H211D9FB62D1E454DB0BE21B8E5084631"><enum>(A)</enum><text>criminal jurisdiction in
			 Indian country is complex, and responsibility for Indian country law
			 enforcement is shared among Federal, tribal, and State authorities; and</text>
					</subparagraph><subparagraph id="H1D273B75A7EF48D18C6E07809B150022" indent="up1"><enum>(B)</enum><text>that complexity requires a high degree
			 of commitment and cooperation from Federal and State officials that can be
			 difficult to establish;</text>
					</subparagraph></paragraph><paragraph id="H4AC742A2DD38467BA089E7D138E7463"><enum>(20)</enum><text>agreements for
			 cooperation among certified tribal and State law enforcement officers have
			 proven to improve law enforcement in tribal communities; and</text>
				</paragraph><paragraph id="H4D71C4558D3146E8BA18C2EB5BB14E7"><enum>(21)</enum><text>crime data is a
			 fundamental tool of law enforcement, but for decades the Bureau of Indian
			 Affairs and the Department of Justice have not been able to coordinate or
			 consistently report crime and prosecution rates in tribal communities.</text>
				</paragraph></subsection><subsection id="H9A417120C6D346E29E3E00DA190727DA"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="H2833E0C365FB4B4291FCD53320A0A4B5"><enum>(1)</enum><text>to clarify the
			 responsibilities of Federal, State, tribal, and local governments with respect
			 to crimes committed in tribal communities;</text>
				</paragraph><paragraph id="H16C3D7E485C74E3793C744B0850053EF"><enum>(2)</enum><text>to increase
			 coordination and communication among Federal, State, tribal, and local law
			 enforcement agencies;</text>
				</paragraph><paragraph id="H5598F572A3014E8291127C7186F5DC3D"><enum>(3)</enum><text>to empower tribal
			 governments with the authority, resources, and information necessary to safely
			 and effectively provide for the safety of the public in tribal
			 communities;</text>
				</paragraph><paragraph id="H9AC8682D209942CCBDF97CD270982D"><enum>(4)</enum><text>to
			 reduce the prevalence of violent crime in tribal communities and to combat
			 violence against Indian and Alaska Native women;</text>
				</paragraph><paragraph id="H84EB4DF47E6B45DF9E1C9800EB845989"><enum>(5)</enum><text>to address and
			 prevent drug trafficking and reduce rates of alcohol and drug addiction in
			 Indian country; and</text>
				</paragraph><paragraph id="H75D922328F8E4B0F9D238EE1D31B5AC"><enum>(6)</enum><text>to
			 increase and standardize the collection of criminal data and the sharing of
			 criminal history information among Federal, State, and tribal officials
			 responsible for responding to and investigating crimes in tribal
			 communities.</text>
				</paragraph></subsection></section><section id="H1019C5628DF04A1F84D04C3BF1918DD9"><enum>3.</enum><header>Definitions</header>
			<subsection id="H7EF4C356AB2044CCB376D8B1B3234F71"><enum>(a)</enum><header>In
			 general</header><text>In this Act:</text>
				<paragraph id="H654F6F4CF7884804AFD07F87BB63D3F5"><enum>(1)</enum><header>Indian
			 country</header><text>The term <term>Indian country</term> has the meaning
			 given the term in <external-xref legal-doc="usc" parsable-cite="usc/18/1151">section 1151</external-xref> of title 18, United States Code.</text>
				</paragraph><paragraph id="H4B603719DF3A475FA35FC0CE62FE36D2"><enum>(2)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 102 of the Federally Recognized Indian Tribe List Act of
			 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a">25 U.S.C. 479a</external-xref>).</text>
				</paragraph><paragraph id="id651074F5E4704C56B247FA139E23B544"><enum>(3)</enum><header>Indian
			 community</header><text>The term <term>Indian community</term> means a
			 community of a federally recognized Indian tribe.</text>
				</paragraph><paragraph id="H064CB66A6AC1434BB520003648F9EE01"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph><paragraph id="HB6EAB3DC119B4E43842EDA00D277786E"><enum>(5)</enum><header>Tribal
			 government</header><text>The term <term>tribal government</term> means the
			 governing body of an Indian tribe.</text>
				</paragraph></subsection><subsection id="H3815794888E64AAA8848219D6E4FE600"><enum>(b)</enum><header>Indian law
			 enforcement reform Act</header><text>Section 2 of the Indian Law Enforcement
			 Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2801">25 U.S.C. 2801</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H385D4E3705F9412BA8148E6CA5009066" style="OLC">
					<paragraph id="HE2B43EAE669B4F85B00046D243B55169"><enum>(10)</enum><header>Tribal justice
				official</header><text>The term <term>tribal justice official</term>
				means—</text>
						<subparagraph id="H9526834A0F934196884B00BF7374EFA5"><enum>(A)</enum><text>a tribal
				prosecutor;</text>
						</subparagraph><subparagraph id="H642ECB586DD84A40A6529B9DDF27A1D7"><enum>(B)</enum><text>a tribal law
				enforcement officer; or</text>
						</subparagraph><subparagraph id="HB6568884DBFE44CBB2F841000064CDC5"><enum>(C)</enum><text>any other person
				responsible for investigating or prosecuting an alleged criminal offense in
				tribal
				court.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idF85308240870441BAF776B3E1050198E"><enum>4.</enum><header>Severability
			 clause</header><text display-inline="no-display-inline">If any provision of
			 this Act, an amendment made this Act, or the application of such provision or
			 amendment to any person or circumstance is held to be unconstitutional, the
			 remainder of this Act, the amendments made by this Act, and the application of
			 the provisions of such to any person or circumstances shall not be affected
			 thereby.</text>

			 accountability and coordination</header>
			<section id="H7184EEC55D0C47828F30005FB7F2EBE6"><enum>101.</enum><header>Office of
			 Justice Services responsibilities</header>
				<subsection id="H9F7C7A63BD944196A738AF739E00BFD"><enum>(a)</enum><header>Additional
			 responsibilities of Division</header><text display-inline="yes-display-inline">Section 3 of the Indian Law Enforcement
			 Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2802">25 U.S.C. 2802</external-xref>) is amended—</text>
					<paragraph id="H14A57D4D8CF744D0820063516CAF118D"><enum>(1)</enum><text>in subsection
			 (c)—</text>
						<subparagraph id="H26F210E898D4400E8E429EEF528C8700"><enum>(A)</enum><text>in paragraph (8),
			 by striking <quote>and</quote> at the end;</text>

				residents of Indian land on a regular basis regarding public safety and justice
				concerns facing tribal communities;</text>
								</paragraph><paragraph id="H48C6E3884A344D9C81ED7B3E4500BAF7"><enum>(11)</enum><text>conducting
				meaningful and timely consultation with tribal leaders and tribal justice
				officials in the development of regulatory policies and other actions that
				affect public safety and justice in Indian country;</text>
								</paragraph><paragraph id="H7C85A295E0DC4EEBB32714C4C15BA30"><enum>(12)</enum><text>providing
				technical assistance and training to tribal law enforcement officials to gain
				access and input authority to utilize the National Criminal Information Center
				and other national crime information databases pursuant to section 534 of title
				28, United States Code;</text>
								</paragraph><paragraph id="H3EEC5086C71D4AC2B7C8BBD19675EA16"><enum>(13)</enum><text>in coordination
				with the Attorney General pursuant to subsection (g) of section 302 of the
				Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3732">42 U.S.C. 3732</external-xref>),
				collecting, analyzing, and reporting data regarding Indian country crimes on an
				annual basis;</text>
								</paragraph><paragraph id="H0848AC5013484DE5A1FB3083B62E3FA6"><enum>(14)</enum><text>submitting to the
				Committee on Indian Affairs of the Senate and the Committee on Natural
				Resources of the House of Representatives, for each fiscal year, a detailed
				spending report regarding tribal public safety and justice programs that
				includes—</text>
									<subparagraph id="H7A31C3F8E24B487181C553894BD8BF85"><enum>(A)</enum><text>the number of
				employees and amounts spent by category, including a breakdown by position of
				direct Bureau and tribal government employees, for each of—</text>
										<clause id="H41FC7AEC9A054F808E2091D011758CD6"><enum>(i)</enum><text>criminal
				investigators;</text>
										</clause><clause id="H93856088DEB94D9FA987A8061D9689EC"><enum>(ii)</enum><text>uniform
				police;</text>
										</clause><clause id="H93D7FA2D213040DE9E9748EA8797209"><enum>(iii)</enum><text>dispatchers;</text>
										</clause><clause id="H70BA5294D1F64B98B81CD697248CDB9"><enum>(iv)</enum><text>detention
				officers; and</text>
										</clause><clause id="HE92B952E3B994AB18DB926FFB1F3502B"><enum>(v)</enum><text>executive
				personnel, including special agents in charge, and directors and deputies of
				various offices in the Office of Justice Services;</text>
										</clause></subparagraph><subparagraph id="HC514EFF796D24BCEA13D63CF53F5104"><enum>(B)</enum><text>an itemized list of
				spending by the Secretary on law enforcement and corrections personnel,
				vehicles, related transportation costs, equipment, inmate transportation costs,
				inmate transfer costs, improvement and repair of facilities, personnel
				transfers, detailees and costs related to their details, emergency events,
				public safety and justice communications and technology costs, and other public
				safety and justice-related expenses;</text>
									</subparagraph><subparagraph id="H826B467914DB49EDB6A9E784BDBE5341"><enum>(C)</enum><text>a list of, and
				relevant details regarding, the unmet staffing needs of law enforcement and
				corrections personnel at tribal and Bureau of Indian Affairs police departments
				and corrections facilities, the backlog in corrections facilities, public
				safety and justice communications and technology needs, and other public safety
				and justice-related needs; and</text>
									</subparagraph><subparagraph id="H40518AB1E1D4449FA4C67F6D59C5E350"><enum>(D)</enum><text>the formula,
				priority list or other methodology used to determine the method of disbursement
				of funds for the public safety and justice programs of the Office of Justice
				Services;</text>
									</subparagraph></paragraph><paragraph id="HDEC5CCED46BC4CDAB4823D988C8EE3B7"><enum>(15)</enum><text>submitting to
				Congress, for each fiscal year, a report summarizing the technical assistance,
				training, and other support provided to tribal law enforcement and corrections
				agencies that operate relevant programs pursuant to self-determination
				contracts or self-governance compacts with the Bureau of Indian Affairs;
				and</text>
								</paragraph><paragraph id="H0D5A0C23688841F3860958B057A41568"><enum>(16)</enum><text>promulgating
				regulations to carry out this Act, and routinely reviewing and updating, as
				necessary, the regulations contained in subchapter B of title 25, Code of
				Federal Regulations (or successor
				regulations).</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H225701921E034BE39CF0EDD3B4412E03"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H666BB361FD534D76B487B9A20007A81C" style="OLC">
							<subsection id="HB46426B303FA4B44A8E39387CDE0A616"><enum>(d)</enum><header>Long-term plan
				for tribal detention programs</header><text>Not later than 1 year after the
				date of enactment of this subsection, the Secretary, acting through the Bureau,
				in coordination with the Department of Justice and in consultation with tribal
				leaders, tribal law enforcement officers, and tribal corrections officials,
				shall submit to Congress a long-term plan to address incarceration in Indian
				country, including a description of—</text>
								<paragraph id="H94B09203A9F041AAA5073390A6767B89"><enum>(1)</enum><text>proposed
				activities for the construction of detention facilities (including regional
				facilities) on Indian land;</text>
								</paragraph><paragraph id="H8F77049AFA094D99B6D91DAD13EC3151"><enum>(2)</enum><text>proposed
				activities for the construction of additional Federal detention facilities on
				Indian land;</text>
								</paragraph><paragraph id="HD1E928579C284A1582F36B2578AE3189"><enum>(3)</enum><text>proposed
				activities for contracting with State and local detention centers, upon
				approval of affected tribal governments;</text>
								</paragraph><paragraph id="HA0F5A15A0CB04FDFB1D09C95152699E8"><enum>(4)</enum><text>proposed
				activities for alternatives to incarceration, developed in cooperation with
				tribal court systems; and</text>
								</paragraph><paragraph id="HE70CD25956F949D4A12F7F7669F08D75"><enum>(5)</enum><text>other such
				alternatives to incarceration as the Secretary, in coordination with the Bureau
				and in consultation with tribal representatives, determines to be
				necessary.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H4816F090FC62432AA5E4BA14CBF5688E"><enum>(b)</enum><header>Law enforcement
			 authority</header><text>Section 4 of the Indian Law Enforcement Reform Act (25
			 U.S.C. 2803) is amended—</text>
					<paragraph id="HE2E50E65669545CDA74500C77B59C031"><enum>(1)</enum><text>in paragraph
			 (2)(A), by striking <quote>), or</quote> and inserting <quote>or offenses
			 committed on Federal property processed by the Central Violations Bureau);
			 or</quote>; and</text>
					</paragraph><paragraph id="H40ED3DD3AE82433C8B783C512857FB7C"><enum>(2)</enum><text>in paragraph (3),
			 by striking subparagraphs (A) through (C) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HFD8764FB8F1245CDB624497F11D2EA2E" style="OLC">
							<subparagraph id="H59417785726B4ABE835789340885015D"><enum>(A)</enum><text>the offense is
				committed in the presence of the employee; or</text>
							</subparagraph><subparagraph id="HDE9D233DF0CD47D3A07F4D821C97B0D3"><enum>(B)</enum><text>the offense is a
				Federal crime and the employee has reasonable grounds to believe that the
				person to be arrested has committed, or is committing, the
				crime;</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="HDDD324A78B174A47B43C8CD471173D74"><enum>102.</enum><header>Declination
			 reports</header><text display-inline="no-display-inline">Section 10 of the
			 Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2809">25 U.S.C. 2809</external-xref>) is amended by striking
			 subsections (a) through (d) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H36F04CC6E8334CDA8F61DA9B85A99840" style="OLC">
					<subsection id="HDFCA75BA629B4007BD129DCF8DD5AC99"><enum>(a)</enum><header>Reports</header>
						<paragraph id="HF058873B4F5D46779CD2B2E983FDC6D"><enum>(1)</enum><header>Law enforcement
				officials</header><text>Subject to subsection (d), if a law enforcement officer
				or employee of any Federal department or agency declines to initiate an
				investigation of an alleged violation of Federal law in Indian country, or
				terminates such an investigation without referral for prosecution, the officer
				or employee shall—</text>
							<subparagraph id="H0148C341D1094F75895868970039A5B4"><enum>(A)</enum><text>submit to the
				appropriate tribal justice officials a report describing each reason why a case
				was not opened or an investigation was declined or terminated; and</text>
							</subparagraph><subparagraph id="HF164A1B3F8E1425400A1ABB747B1DF20"><enum>(B)</enum><text>submit to the
				Office of Indian Country Crime relevant information regarding all declinations
				of alleged violations of Federal law in Indian country, including—</text>
								<clause id="H1F96B6DDDC314158812011A54BAEF103"><enum>(i)</enum><text>the type of crime
				alleged;</text>
								</clause><clause id="H14D0306AC237409595EFDCE624C85CBD"><enum>(ii)</enum><text>the status of the
				accused as an Indian or non-Indian;</text>
								</clause><clause id="HC18ED0B1F3BF4E89AB77A90490A96CCA"><enum>(iii)</enum><text>the status of
				the victim as an Indian; and</text>
								</clause><clause id="H2DD2FCCF6F604A10B06639004931412E"><enum>(iv)</enum><text>the reason for
				declining to initiate, open, or terminate the investigation.</text>
								</clause></subparagraph></paragraph><paragraph id="H6178949C37DE430BB1FF03D8F2D30229"><enum>(2)</enum><header>United States
				Attorneys</header><text>Subject to subsection (d), if a United States Attorney
				declines to prosecute, or acts to terminate prosecution of, an alleged
				violation of Federal law in Indian country referred for prosecution by a law
				enforcement officer or employee of a Federal department or agency or other law
				enforcement officer authorized to enforce Federal law, the United States
				Attorney shall—</text>
							<subparagraph id="H9DF46A40134545979DD00D9857C9F42"><enum>(A)</enum><text>coordinate and
				communicate with the appropriate tribal justice official, sufficiently in
				advance of the tribal statute of limitations, reasonable details regarding the
				case to permit the tribal prosecutor to pursue the case in tribal court;
				and</text>
							</subparagraph><subparagraph id="H415E077233EB469788D2748DB9934B5F"><enum>(B)</enum><text>submit to the
				Office of Indian Country Crime and the appropriate tribal justice official
				relevant information regarding all declinations of alleged violations of
				Federal law in Indian country, including—</text>
								<clause id="H24AA8689F9744A60A83C302E5862884C"><enum>(i)</enum><text>the type of crime
				alleged;</text>
								</clause><clause id="H5A957EF835D34728894D32D49546B500"><enum>(ii)</enum><text>the status of the
				accused as an Indian or non-Indian;</text>
								</clause><clause id="H21B6D503D19C4180962019580832DB3C"><enum>(iii)</enum><text>the status of
				the victim as an Indian; and</text>
								</clause><clause id="H4E5A1D0817424695A67BEB68F638992"><enum>(iv)</enum><text>the reason for the
				determination to decline or terminate the prosecution.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="HB514488D381F474EBF9792F014A8DE3B"><enum>(b)</enum><header>Maintenance of
				records</header>
						<paragraph id="H6BB185CD4DCB4E3293CF16A48B679800"><enum>(1)</enum><header>In
				general</header><text>The Director of the Office of Indian Country Crime shall
				establish and maintain a compilation of information received under paragraph
				(1) or (2) of subsection (a) relating to declinations.</text>
						</paragraph><paragraph id="H0A8058D5192C478DAF565F6CB719557C"><enum>(2)</enum><header>Availability to
				Congress</header><text>Each compilation under paragraph (1) shall be made
				available to Congress on an annual basis.</text>
						</paragraph></subsection><subsection id="HDE66ED9F4F9C436F8255F224D408162C"><enum>(c)</enum><header>Inclusion of
				case files</header><text>A report submitted to the appropriate tribal justice
				officials under paragraph (1) or (2) of subsection (a) may include the case
				file, including evidence collected and statements taken that could support an
				investigation or prosecution by the appropriate tribal justice
				officials.</text>
					</subsection><subsection id="HAF83A7F75A43488D98FAAD2D4EBA75E"><enum>(d)</enum><header>Effect of
				section</header>
						<paragraph id="H9AA66D12DC01400EBA005FD08E59B681"><enum>(1)</enum><header>In
				general</header><text>Nothing in this section requires any Federal agency or
				official to transfer or disclose any confidential or privileged communication,
				information, or source to an official of any Indian tribe.</text>
						</paragraph><paragraph id="HA161A314264543CF9DEDF4FB5B135B95"><enum>(2)</enum><header>Federal Rules of
				Criminal Procedure</header><text>Rule 6 of the Federal Rules of Criminal
				Procedure shall apply to this section.</text>
						</paragraph><paragraph id="HA60574FC344348E69D73DB9BDADDDCA3"><enum>(3)</enum><header>Regulations</header><text>Each
				Federal agency required to submit a report pursuant to this section shall
				adopt, by regulation, standards for the protection of confidential or
				privileged communications, information, and sources under paragraph
				(1).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H3A372AC41ED24FC48054EEFB1C1EC4F6"><enum>103.</enum><header>Prosecution of
			 crimes in Indian country</header>
				<subsection id="H68C7F6CFAA0C46C79D48A1375C4215CA"><enum>(a)</enum><header>Appointment of
			 special prosecutors</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/543">Section 543(a)</external-xref> of title 28, United States
			 Code, is amended by inserting before the period at the end the following:
			 <quote>, including the appointment of qualified tribal prosecutors and other
			 qualified attorneys to assist in prosecuting Federal offenses committed in
			 Indian country</quote>.</text>
				</subsection><subsection id="HC80A8B1B7E9A48FEAE5C7B4EC023FBEE"><enum>(b)</enum><header>Tribal
			 liaisons</header><text>The Indian Law Enforcement Reform Act (25 U.S.C. 2801 et
			 seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD9CCE7CB05674B13AE935FB34D9BE227" style="OLC">
						<section id="H03505575390F402BB900A96D9D16A32"><enum>11.</enum><header>Assistant United
				States Attorney tribal liaisons</header>
							<subsection id="H7832E0567AB0424B8097BE6F9499DDCF"><enum>(a)</enum><header>Appointment</header><text>Each
				United States Attorney the district of which includes Indian country shall
				appoint not less than 1 assistant United States Attorney to serve as a tribal
				liaison for the district.</text>
							</subsection><subsection id="HE8B8BF0AF7114D059BE9C43BDAABEB3"><enum>(b)</enum><header>Duties</header><text>A
				tribal liaison shall be responsible for the following activities in the
				district of the tribal liaison:</text>
								<paragraph id="H7B469F13CB1F4260A6294FA234E300AF"><enum>(1)</enum><text>Coordinating the
				prosecution of Federal crimes that occur in Indian country.</text>
								</paragraph><paragraph id="HA8E1237CBBD7401A82FA317978862E83"><enum>(2)</enum><text>Developing
				multidisciplinary teams to combat child abuse and domestic and sexual violence
				offenses against Indians.</text>
								</paragraph><paragraph id="H916A85CED64A4C269029339D7B12B12F"><enum>(3)</enum><text>Developing working
				relationships and maintaining communication with tribal leaders, tribal
				community advocates, and tribal justice officials to gather information from,
				and share appropriate information with, tribal justice officials.</text>
								</paragraph><paragraph id="H86214F4A6B574456958586C3F6B282B3"><enum>(4)</enum><text>Coordinating with
				tribal prosecutors in cases in which a tribal government has concurrent
				jurisdiction over an alleged crime, in advance of the expiration of any
				applicable statute of limitation.</text>
								</paragraph><paragraph id="H6FAEAE87A751419187591905128D20E0"><enum>(5)</enum><text>Providing
				technical assistance and training regarding evidence gathering techniques to
				tribal justice officials and other individuals and entities that are
				instrumental to responding to Indian country crimes.</text>
								</paragraph><paragraph id="H2DC80C1B997048AEA5417ED8B6DA3496"><enum>(6)</enum><text>Conducting
				training sessions and seminars to certify special law enforcement commissions
				to tribal justice officials and other individuals and entities responsible for
				responding to Indian country crimes.</text>
								</paragraph><paragraph id="HB99C58A2B0064302A129D5B7C5881BD3"><enum>(7)</enum><text>Coordinating with
				the Office of Indian Country Crime, as necessary.</text>
								</paragraph><paragraph id="H82247239BAD74A2688365B3DDFB0415"><enum>(8)</enum><text>Conducting such
				other activities to address and prevent violent crime in Indian country as the
				applicable United States Attorney determines to be appropriate.</text>
								</paragraph></subsection><subsection id="H408B40EAE2AC4020AFDBB3EFDA093E36"><enum>(c)</enum><header>Sense of
				Congress regarding evaluations of tribal liaisons</header>
								<paragraph id="HFEFD1BA68F1A42469413588E26437334"><enum>(1)</enum><header>Findings</header><text>Congress
				finds that—</text>
									<subparagraph id="H3A5786080C64461B8274C54FC635D3D9"><enum>(A)</enum><text>many tribal
				communities rely solely on United States Attorneys offices to prosecute felony
				and misdemeanor crimes occurring on Indian land; and</text>
									</subparagraph><subparagraph id="H5CDED707F94B424AB53BAC00B2FB3257"><enum>(B)</enum><text>tribal liaisons
				have dual obligations of—</text>
										<clause id="HB1FE6CB2AE564278A0194F38B9C32E44"><enum>(i)</enum><text>coordinating
				prosecutions of Indian country crime; and</text>
										</clause><clause id="H7178CBF967B342A4949B443441CA0098"><enum>(ii)</enum><text>developing
				relationships with tribal communities and serving as a link between tribal
				communities and the Federal justice process.</text>
										</clause></subparagraph></paragraph><paragraph id="H2DEEC449A9F94722A79DD5E1F9C5088B"><enum>(2)</enum><header>Sense of
				Congress</header><text>It is the sense of Congress that the Attorney General
				should—</text>
									<subparagraph id="H439BCBA4FE5E4084BD34664BBF6188F6"><enum>(A)</enum><text>take all
				appropriate actions to encourage the aggressive prosecution of all crimes
				committed in Indian country; and</text>
									</subparagraph><subparagraph id="H9251F64FDFC44D66B1611025DA6B6BCF"><enum>(B)</enum><text>when appropriate,
				take into consideration the dual responsibilities of tribal liaisons described
				in paragraph (1)(B) in evaluating the performance of the tribal
				liaisons.</text>
									</subparagraph></paragraph></subsection><subsection id="HBAFAB3227C0440318D8D02DAAE3CF259"><enum>(d)</enum><header>Enhanced
				prosecution of minor crimes</header><text>Each United States Attorney serving a
				district that includes Indian country is authorized and encouraged—</text>
								<paragraph id="HEF6261E973784DD3AE3B209FD468B78F"><enum>(1)</enum><text>to appoint Special
				Assistant United States Attorneys pursuant to <external-xref legal-doc="usc" parsable-cite="usc/28/543">section 543(a)</external-xref> of title 28,
				United States Code, to prosecute crimes in Indian country as necessary to
				improve the administration of justice, and particularly when—</text>
									<subparagraph id="H0DB1F77C7E394614B258CD118CAAFE6"><enum>(A)</enum><text>the crime rate
				exceeds the national average crime rate; or</text>
									</subparagraph><subparagraph id="HC39A77C97AB949DFA58C75602047C699"><enum>(B)</enum><text>the rate at which
				criminal offenses are declined to be prosecuted exceeds the national average
				rate;</text>
									</subparagraph></paragraph><paragraph id="H55C66DFE9F6D46D79C1D6D7826BA9EC3"><enum>(2)</enum><text>to coordinate with
				applicable United States magistrate and district courts—</text>
									<subparagraph id="H1219CB55EF9E4B96A8B74C7BA1A302F5"><enum>(A)</enum><text>to ensure the
				provision of docket time for prosecutions of Indian country crimes; and</text>
									</subparagraph><subparagraph id="H864870A42BDE4708BDCEE5FCB456C98F"><enum>(B)</enum><text>to hold trials and
				other proceedings in Indian country, as appropriate;</text>
									</subparagraph></paragraph><paragraph id="HAD2AF8B427074D59B8864D92B04789FE"><enum>(3)</enum><text>to provide to
				appointed Special Assistant United States Attorneys appropriate training,
				supervision, and staff support; and</text>
								</paragraph><paragraph id="H688DFBE0365B45D991953C00233271C"><enum>(4)</enum><text>if an agreement is
				entered into with a Federal court pursuant to paragraph (2), to provide
				technical and other assistance to tribal governments and tribal court systems
				to ensure the success of the program under this
				subsection.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H6E45EABD693A4DB9B51BD2976C5B18B8"><enum>104.</enum><header>Administration</header>
				<subsection id="H8FC8920A6AAC443697739C599971A0E2"><enum>(a)</enum><header>Office of Tribal
			 Justice</header>
					<paragraph id="H7A55524FCA4348D5BE2D92D8289E6D92"><enum>(1)</enum><header>Definitions</header><text>Section
			 4 of the Indian Tribal Justice Technical and Legal Assistance Act of 2000 (25
			 U.S.C. 3653) is amended—</text>
						<subparagraph id="H681BCCEF636B461E94230011FBCAB0DF"><enum>(A)</enum><text>by redesignating
			 paragraphs (2) through (7) as paragraphs (3) through (8), respectively;
			 and</text>

			 I of the Indian Tribal Justice Technical and Legal Assistance Act of 2000 is
			 amended—</text>
						<subparagraph id="HD3BECFFD8A974FBDB3C8ECBFA200AE51"><enum>(A)</enum><text>by redesignating
			 section 106 (<external-xref legal-doc="usc" parsable-cite="usc/25/3666">25 U.S.C. 3666</external-xref>) as section 107; and</text>
						</subparagraph><subparagraph id="HF36CA0D2B1F0422A8E3D942C18BFDF31"><enum>(B)</enum><text>by inserting after
			 section 105 (<external-xref legal-doc="usc" parsable-cite="usc/25/3665">25 U.S.C. 3665</external-xref>) the following:</text>

				Tribal Justice</header>
									<subsection id="HD9C085B595DE4923A2AF403200A1B920"><enum>(a)</enum><header>In
				general</header><text>Not later than 90 days after the date of enactment of the
				<short-title>Tribal Law and Order Act of
				2008</short-title>, the Attorney General shall modify the status of the Office
				of Tribal Justice as the Attorney General determines to be necessary to
				establish the Office of Tribal Justice as a permanent division of the
				Department.</text>
									</subsection><subsection id="H1D6CC4E26A2B47B98D2B6CEF5FFEE3C3"><enum>(b)</enum><header>Personnel and
				funding</header><text>The Attorney General shall provide to the Office of
				Tribal Justice such personnel and funds as are necessary to establish the
				Office of Tribal Justice as a division of the Department under subsection
				(a).</text>
									</subsection><subsection id="H0E230F50AFC545B0BB2D8F5598D228B"><enum>(c)</enum><header>Additional
				duties</header><text>In addition to the duties of the Office of Tribal Justice
				in effect on the day before the date of enactment of the
				<short-title>Tribal Law and Order Act of
				2008</short-title>, the Office of Tribal Justice shall—</text>
										<paragraph id="H87A8EB7072FE4554BC60E3AEB6A143D5"><enum>(1)</enum><text>serve as the
				program and legal policy advisor to the Attorney General with respect to the
				treaty and trust relationship between the United States and Indian
				tribes;</text>
										</paragraph><paragraph id="H9BB8545537114565878004DAE387FA11"><enum>(2)</enum><text>serve as the point
				of contact for federally recognized tribal governments and tribal organizations
				with respect to questions and comments regarding policies and programs of the
				Department and issues relating to public safety and justice in Indian country;
				and</text>
										</paragraph><paragraph id="HD7A74DEE9C904ECB95FF008F82C68901"><enum>(3)</enum><text>coordinate with
				other bureaus, agencies, offices, and divisions within the Department of
				Justice to ensure that each component has an accountable process to ensure
				meaningful and timely consultation with tribal leaders in the development of
				regulatory policies and other actions with tribal
				implications.</text>
										</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H70531D081526464BAD3CC55C2240A2B4"><enum>(b)</enum><header>Office of Indian
			 Country Crime</header><text>The Indian Law Enforcement Reform Act (25 U.S.C.
			 2801 et seq.) (as amended by section 103(b)) is amended by adding at the end
			 the following:</text>

				to be known as the <quote>Office of Indian Country Crime</quote>.</text>
							</subsection><subsection id="H2D20ECB670654DD3AED60051F816EB2D"><enum>(b)</enum><header>Duties</header><text>The
				Office of Indian Country Crime shall—</text>
								<paragraph id="HF95E1B48DBF74737AEE14D8B2CB94811"><enum>(1)</enum><text>develop, enforce,
				and administer the application of Federal criminal laws applicable in Indian
				country;</text>
								</paragraph><paragraph id="HEB2347E0DF934E589185B0E228C4CC17"><enum>(2)</enum><text>coordinate with
				the United States Attorneys that have authority to prosecute crimes in Indian
				country;</text>
								</paragraph><paragraph id="HDCBE018B2427476A9C74EC8B28995F7D"><enum>(3)</enum><text>coordinate
				prosecutions of crimes of national significance in Indian country, as
				determined by the Attorney General;</text>
								</paragraph><paragraph id="H82629E2B21CE429EB80800F19228FD9F"><enum>(4)</enum><text>develop and
				implement criminal enforcement policies for United States Attorneys and
				investigators of Federal crimes regarding cases arising in Indian country;
				and</text>
								</paragraph><paragraph id="H5DD1E47A72DF4C5C9C8D571D83C3E300"><enum>(5)</enum><text>submit to the
				Committee on Indian Affairs of the Senate and the Committee on Natural
				Resources of the House of Representatives annual reports describing the
				prosecution and declination rates of cases involving alleged crimes in Indian
				country referred to United States Attorneys.</text>
								</paragraph></subsection><subsection id="H2961A6CEF22141009537C0CECC427158"><enum>(c)</enum><header>Deputy Assistant
				Attorney General</header>
								<paragraph id="HA7C3123ADFD24BCC99C0000080667BF5"><enum>(1)</enum><header>Appointment</header><text>The
				Attorney General shall appoint a Deputy Assistant Attorney General for Indian
				Country Crime.</text>
								</paragraph><paragraph id="HB4D747ACAD8E43F4AB00D2B157ECF01"><enum>(2)</enum><header>Duties</header><text>The
				Deputy Assistant Attorney General for Indian Country Crime shall—</text>
									<subparagraph id="HA2F861656D9F4543A6BA66A080519074"><enum>(A)</enum><text>serve as the head
				of the Office of Indian Country Crime;</text>
									</subparagraph><subparagraph id="H02A561CBA3BE498595D0F13E1600BDA1"><enum>(B)</enum><text>serve as a point
				of contact to United State Attorneys serving districts including Indian
				country, tribal liaisons, tribal governments, and other Federal, State, and
				local law enforcement agencies regarding issues affecting the prosecution of
				crime in Indian country; and</text>
									</subparagraph><subparagraph id="H659DCCCE40CA434383D21F7C1E11BE30"><enum>(C)</enum><text>carry out such
				other duties as the Attorney General may
				prescribe.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section></title><title id="H7351469DF8094877A27D17008151FD57"><enum>II</enum><header>State
			 accountability and coordination</header>

			 jurisdiction and resources</header>
				<subsection id="H6BC0D82065BB4DC4AFC6C0F5CD38B131"><enum>(a)</enum><header>Concurrent
			 authority of United States</header><text>Section 401(a) of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref>

				</subsection></section><section id="H2F3958DA6F274377BD189B302DC47FC2"><enum>202.</enum><header>Incentives for
			 State, tribal, and local law enforcement cooperation</header>
				<subsection id="HFADC6B9F9C484E548BD80075E22115F"><enum>(a)</enum><header>Establishment of
			 cooperative assistance program</header><text>The Attorney General may provide
			 grants, technical assistance, and other assistance to State, tribal, and local
			 governments that enter into cooperative agreements, including agreements
			 relating to mutual aid, hot pursuit of suspects, and cross-deputization for the
			 purposes of—</text>
					<paragraph id="HF1B8467D1A97484B8CE89B00B928D95D"><enum>(1)</enum><text>improving law
			 enforcement effectiveness; and</text>
					</paragraph><paragraph id="H8C1A014DDDEE4AF8ACC50830A832ED3"><enum>(2)</enum><text>reducing crime in
			 Indian country and nearby communities.</text>
					</paragraph></subsection><subsection id="H4F3ADB7118E1415792B2046BD1E2F244"><enum>(b)</enum><header>Program
			 plans</header>
					<paragraph id="H1A8D4B349F89441886E0CE29997125AB"><enum>(1)</enum><header>In
			 general</header><text>To be eligible to receive assistance under this section,
			 a group composed of not less than 1 of each of a tribal government and a State
			 or local government shall jointly develop and submit to the Attorney General a
			 plan for a program to achieve the purpose described in subsection (a).</text>
					</paragraph><paragraph id="H7B3B881DA83A4094BA001E0098F6CE25"><enum>(2)</enum><header>Plan
			 requirements</header><text>A joint program plan under paragraph (1) shall
			 include a description of—</text>
						<subparagraph id="HD4D8A082108C4171B7877CB1C1824996"><enum>(A)</enum><text>the proposed
			 cooperative tribal and State or local law enforcement program for which funding
			 is sought, including information on the population and each geographic area to
			 be served by the program;</text>
						</subparagraph><subparagraph id="HF442041EBA514DCB950032DC7C84B84C"><enum>(B)</enum><text>the need of the
			 proposed program for funding under this section, the amount of funding
			 requested, and the proposed use of funds, subject to the requirements listed in
			 subsection (c);</text>
						</subparagraph><subparagraph id="H932FC5B9066642528E012526CEF6D569"><enum>(C)</enum><text>the unit of
			 government that will administer any assistance received under this section, and
			 the method by which the assistance will be distributed;</text>
						</subparagraph><subparagraph id="HF2CAAE03D72B422F8BBDD2809F004FAC"><enum>(D)</enum><text>the types of law
			 enforcement services to be performed on each applicable Indian reservation and
			 the individuals and entities that will perform those services;</text>
						</subparagraph><subparagraph id="H1A94DF3E5EF64198BE8C45B7B142BCE3"><enum>(E)</enum><text>the individual or
			 group of individuals who will exercise daily supervision and control over law
			 enforcement officers participating in the program;</text>
						</subparagraph><subparagraph id="H64C3B8FCFDA743FE868802D8587285D3"><enum>(F)</enum><text>the method by
			 which local and tribal government input with respect to the planning and
			 implementation of the program will be ensured;</text>
						</subparagraph><subparagraph id="H5CB31DCEB2574E8500B68FD5297D2983"><enum>(G)</enum><text>the policies of
			 the program regarding mutual aid, hot pursuit of suspects, deputization,
			 training, and insurance of applicable law enforcement officers;</text>
						</subparagraph><subparagraph id="H4D25E6398EC549F6A1A0B008C45045D"><enum>(H)</enum><text>the recordkeeping
			 procedures and types of data to be collected pursuant to the program;
			 and</text>
						</subparagraph><subparagraph id="HC3E62A6C2EEC4C2B9FF9E55187C333CD"><enum>(I)</enum><text>other information
			 that the Attorney General determines to be relevant.</text>
						</subparagraph></paragraph></subsection><subsection id="HA9E1075DFC5C4EA7AB015D80CD788779"><enum>(c)</enum><header>Permissible uses
			 of funds</header><text>An eligible entity that receives a grant under this
			 section may use the grant, in accordance with the program plan described in
			 subsection (b)—</text>
					<paragraph id="H75DAE95BB6984C05B959EFAEDD091F75"><enum>(1)</enum><text>to hire and train
			 new career tribal, State, or local law enforcement officers, or to make
			 overtime payments for current law enforcement officers, that are or will be
			 dedicated to—</text>
						<subparagraph id="H297BB5E628C348639DD3CCF0FC698CA1"><enum>(A)</enum><text>policing tribal
			 land and nearby lands; and</text>
						</subparagraph><subparagraph id="H9FF374FC06534BDE9DDE5BF63E17D426"><enum>(B)</enum><text>investigating
			 alleged crimes on those lands;</text>
						</subparagraph></paragraph><paragraph id="HD7F1404EE57A427690A4C206DE11709"><enum>(2)</enum><text>procure equipment,
			 technology, or support systems to be used to investigate crimes and share
			 information between tribal, State, and local law enforcement agencies;
			 or</text>
					</paragraph><paragraph id="H19C9C3E7A91247459703D8E58C8D7447"><enum>(3)</enum><text>for any other uses
			 that the Attorney General determines will meet the purposes described in
			 subsection (a).</text>
					</paragraph></subsection><subsection id="HFFEBE7C5B615411280F7B4F43BA0078"><enum>(d)</enum><header>Factors for
			 consideration</header><text>In determining whether to approve a joint program
			 plan submitted under subsection (b) and, on approval, the amount of assistance
			 to provide to the program, the Attorney General shall take into consideration
			 the following factors:</text>
					<paragraph id="H8BED75FE9B33490BBABDD4AAF079CABE"><enum>(1)</enum><text>The size and
			 population of each Indian reservation and nearby community proposed to be
			 served by the program.</text>
					</paragraph><paragraph id="H11D3174546314760AA211E42E6ECFEE5"><enum>(2)</enum><text>The complexity of
			 the law enforcement problems proposed to be addressed by the program.</text>
					</paragraph><paragraph id="H53AA6E0D31F54DF19DBD68ACF4687ED0"><enum>(3)</enum><text>The range of
			 services proposed to be provided by the program.</text>
					</paragraph><paragraph id="H9E66348D00C34358A4012FD2F0E604F4"><enum>(4)</enum><text>The proposed
			 improvements the program will make regarding law enforcement cooperation beyond
			 existing levels of cooperation.</text>
					</paragraph><paragraph id="HFA1066A2F2EB42FEBA9FD697CA68D32"><enum>(5)</enum><text>The crime rates of
			 the tribal and nearby communities.</text>
					</paragraph><paragraph id="HCE0F5087727B474D008516001847BA7E"><enum>(6)</enum><text>The available
			 resources of each entity applying for a grant under this section for dedication
			 to public safety in the respective jurisdictions of the entities.</text>
					</paragraph></subsection><subsection id="H03F4494467334BAB876C8ECDE07C874B"><enum>(e)</enum><header>Annual
			 reports</header><text>To be eligible to renew or extend a grant under this
			 section, a group described in subsection (b)(1) shall submit to the Attorney
			 General, together with the joint program plan under subsection (b), a report
			 describing the law enforcement activities carried out pursuant to the program
			 during the preceding fiscal year, including the success of the activities,
			 including any increase in arrests or prosecutions.</text>
				</subsection><subsection id="H7C81E3773A284699AEDE45DF46D946D0"><enum>(f)</enum><header>Reports by
			 Attorney General</header><text>Not later than January 15 of each applicable
			 fiscal year, the Attorney General shall submit to the Committee on Indian
			 Affairs of the Senate and the Committee on Natural Resources of the House of
			 Representatives a report describing the law enforcement programs carried out
			 using assistance provided under this section during the preceding fiscal year,
			 including the success of the programs.</text>
				</subsection><subsection id="HB9A1C677579A431FBAA9B00075012011"><enum>(g)</enum><header>Technical
			 assistance</header><text>On receipt of a request from a group composed of not
			 less than 1 tribal government and 1 State or local government, the Attorney
			 General shall provide technical assistance to the group to develop successful
			 cooperative relationships that effectively combat crime in Indian country and
			 nearby communities.</text>
				</subsection><subsection id="H01BE800F28644358BC37185CC7F7EF89"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as are necessary to carry out this section for each of fiscal years 2009
			 through 2015.</text>
				</subsection></section></title><title id="H3550EDBBDBBF461B9BB2C2BA05A03E22"><enum>III</enum><header>Empowering
			 tribal law enforcement agencies and tribal governments</header>

			 Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2804">25 U.S.C. 2804</external-xref>) is amended by striking the section heading and all
			 that follows through subsection (e) and inserting the following:</text>

				encouraged to enter into agreements for the use (with or without reimbursement)
				of personnel and facilities of Federal, tribal, State, or other government
				agencies to assist in the enforcement or administration in Indian country of
				Federal law or the laws of an Indian tribe that authorizes the Secretary to
				enforce tribal law.</text>
								</paragraph><paragraph id="HC75BB927695544C2A3CFF7F478BCA79F"><enum>(2)</enum><header>Certain
				activities</header><text>Pursuant to an agreement described in paragraph (1),
				the Secretary shall authorize the law enforcement officers of any applicable
				government agency to carry out any activity authorized under section 4.</text>
								</paragraph><paragraph id="H19C0E8CC3E9349D0AC9D7D3E917257F4"><enum>(3)</enum><header>Requirement</header><text>An
				agreement under paragraph (1) shall be in accordance with any applicable
				agreement between the Secretary and the Attorney General.</text>
								</paragraph></subsection><subsection id="H82D3A851BF1C482DB3D740ADC8C8F1EA"><enum>(b)</enum><header>Program
				enhancement</header>
								<paragraph id="H48980A53B24445AD918DA6886B94B1D9"><enum>(1)</enum><header>Training
				sessions in Indian country</header>
									<subparagraph id="H7F39A51755ED4CBCB5BB04DCFB1C4CF"><enum>(A)</enum><header>In
				general</header><text>The Secretary (or a designee) and the Attorney General
				(or a designee) shall develop a plan to enhance the certification and provision
				of special law enforcement commissions to tribal law enforcement officials,
				and, subject to subsection (d), State and local law enforcement officials,
				pursuant to this section.</text>
									</subparagraph><subparagraph id="H901395107DB14B7A00CFF5FA4E004EB6"><enum>(B)</enum><header>Inclusions</header><text>The
				plan under subparagraph (A) shall include the hosting of regional training
				sessions in Indian country, not less frequently than biannually, to educate and
				certify candidates for the special commissions.</text>
									</subparagraph></paragraph><paragraph id="H482A5142B02F4328B1F94EED49AB67A6"><enum>(2)</enum><header>Memoranda of
				agreement</header>
									<subparagraph id="H60F95DE21D0C4CB999BA46857D1D5F6F"><enum>(A)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				the <short-title>Tribal Law and Order Act of
				2008</short-title>, the Secretary, in consultation with Indian tribes and
				tribal law enforcement agencies, shall develop minimum requirements to be
				included in special law enforcement commission agreements pursuant to this
				section.</text>
									</subparagraph><subparagraph id="HE3FC19110FF24673AE99D43531E4B6D5"><enum>(B)</enum><header>Agreement</header><text>Not
				later than 60 days after the date on which the Secretary determines that all
				applicable requirements under subparagraph (A) are met, the Secretary shall
				offer to enter into a special law enforcement commission agreement with the
				applicable Indian tribe.</text>
									</subparagraph></paragraph></subsection><subsection id="H8B6479E14AC94AC5AE1FFA60D5F953F0"><enum>(c)</enum><header>Limitation on
				use of certain personnel</header>
								<paragraph id="HD3723A818A0F47B5AFA9935585532102"><enum>(1)</enum><header>Consultation</header><text>The
				Secretary shall consult with each affected Indian tribe before entering into
				any agreement under subsection (a) with a non-Federal agency that will provide
				personnel for use in any area under the jurisdiction of the Indian
				tribes.</text>
								</paragraph><paragraph id="HCEF652A0C87D4836A7F75404F53F536B"><enum>(2)</enum><header>Prohibition</header><text>The
				Secretary shall not use the personnel of a non-Federal agency under this
				section in an area of Indian country if the Indian tribe with jurisdiction over
				that area has adopted a resolution objecting to the use of personnel of the
				non-Federal agency.</text>
								</paragraph></subsection><subsection id="H8BD641ECEDF149E0A095D8E4F17986B1"><enum>(d)</enum><header>Coordination by
				Federal agencies</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1535">section 1535</external-xref> of title 31, United
				States Code, the head of a Federal agency with law enforcement personnel or
				facilities shall coordinate and, as needed, enter into agreements (with or
				without reimbursement) with the Secretary under subsection (a).</text>

				Federal agency with law enforcement personnel or facilities to enter into
				agreements (with or without reimbursement) with an Indian tribe relating
				to—</text>

				violations of Federal or tribal criminal law in Indian

				</subsection></section><section id="H67746A299F0D45139FDB5EE3EBF6BA19"><enum>302.</enum><header>Drug
			 enforcement in Indian country</header>
				<subsection id="H16E64C4D64F544C4BE00C8629690C1F2"><enum>(a)</enum><header>Education and
			 research programs</header><text>Section 502 of the Controlled Substances Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/21/872">21 U.S.C. 872</external-xref>) is amended in subsections (a)(1) and (c), by inserting
			 <quote>tribal,</quote> after <quote>State,</quote> each place it
			 appears.</text>

				and enter information into Federal criminal information databases; and</text>

					</paragraph><paragraph id="HCECEC54707FE454AA94BD1109BDA7C8F"><enum>(3)</enum><text>in subsection
			 (f)(2), in the matter preceding subparagraph (A), by inserting <quote>,

					</paragraph></subsection><subsection id="HB14F784DF1B54EA5AA2400B0A0004DF6"><enum>(b)</enum><header>Requirement</header>
					<paragraph id="H457B688832A54D6D9391983E3FFD410"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall ensure that tribal law
			 enforcement officials that meet applicable Federal or State requirements have
			 access to national crime information databases.</text>
					</paragraph><paragraph id="H03EA0D8EE01A41EAB6F219AB11EB3668"><enum>(2)</enum><header>Sanctions</header><text>For
			 purpose of sanctions for noncompliance with requirements of, or misuse of,
			 national crime information databases and information obtained from those
			 databases, a tribal law enforcement agency or official shall be treated as
			 Federal law enforcement agency or official.</text>
					</paragraph></subsection></section><section id="H9459ED317F944BE985B991A2E8F42FD"><enum>304.</enum><header>Tribal court
			 sentencing authority</header><text display-inline="no-display-inline">Section
			 202 of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1302">25 U.S.C. 1302</external-xref>) is amended—</text>
				<paragraph id="HF4CB027EEF2C44ECAB1369EFBDE1B905"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>No Indian tribe</quote> and
			 inserting the following:</text>

				and prisoners</header>
							<paragraph id="HF398415668C1461F94141817F77CCF56"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding paragraph (7) of subsection (a) and in
				addition to the limitations described in the other paragraphs of that
				subsection, no Indian tribe, in exercising any power of self-government
				involving a criminal trial that subjects a defendant to more than 1 year
				imprisonment for any single offense, may—</text>
								<subparagraph id="HF2FD8E7ED1C64C08AAAB3810835BE73"><enum>(A)</enum><text>deny any person in
				such a criminal proceeding the assistance of defense counsel;</text>
								</subparagraph><subparagraph id="H6901B08CDB8C44CD9701AE615672D4EA"><enum>(B)</enum><text>require excessive
				bail, impose an excessive fine, inflict a cruel or unusual punishment, or
				impose for conviction of a single offense any penalty or punishment greater
				than imprisonment for a term of 3 years or a fine of $15,000, or both;
				or</text>
								</subparagraph><subparagraph id="HEC7B7F63985D427893E13C23D1F98300"><enum>(C)</enum><text>deny any person in
				such a criminal proceeding the due process of law.</text>
								</subparagraph></paragraph><paragraph id="HFEA49A3FD74B4903A034755CA82BF82"><enum>(2)</enum><header>Authority</header><text>An
				Indian tribe exercising authority pursuant to this subsection shall require
				that each judge presiding over an applicable criminal case is licensed to
				practice law in any jurisdiction in the United States.</text>
							</paragraph><paragraph id="H337D99694443456681006808F6C1BEC"><enum>(3)</enum><header>Sentences</header><text>A
				tribal court acting pursuant to paragraph (1) may require a convicted
				offender—</text>
								<subparagraph id="H7BF7A2A66AB94071999E9DA654844528"><enum>(A)</enum><text>to serve the
				sentence—</text>
									<clause id="HB2F45BF041584739006447ABD91D94D7"><enum>(i)</enum><text>in
				a tribal correctional center that has been approved by the Bureau of Indian
				Affairs for long-term incarceration, in accordance with guidelines developed by
				the Bureau of Indian Affairs, in consultation with Indian tribes;</text>
									</clause><clause id="H5D704A55DC624E9897F294681FE9B790"><enum>(ii)</enum><text>in the nearest
				appropriate Federal facility, at the expense of the United States pursuant to a
				memorandum of agreement with Bureau of Prisons in accordance with paragraph
				(4);</text>
									</clause><clause id="HE534DB9ED4564D65A0086B7100F7E1BE"><enum>(iii)</enum><text>in a State or
				local government-approved detention or correctional center pursuant to an
				agreement between the Indian tribe and the State or local government; or</text>
									</clause><clause id="HF2D509B071BD439092AAC42B7B52E99F"><enum>(iv)</enum><text>subject to
				paragraph (1), in an alternative rehabilitation center of an Indian tribe;
				or</text>
									</clause></subparagraph><subparagraph id="HAE86EF23AE304A2594F661A2D6C5319F"><enum>(B)</enum><text>to serve another
				alternative form of punishment, as determined by the tribal court judge
				pursuant to tribal law.</text>
								</subparagraph></paragraph><paragraph id="HFEA9481DACE64CE195D2E77BE7001B54"><enum>(4)</enum><header>Memoranda of
				agreement</header><text>A memorandum of agreement between an Indian tribe and
				the Bureau of Prisons under paragraph (2)(A)(ii)—</text>
								<subparagraph id="HFF5793D0DA8342BA935C72577024DC35"><enum>(A)</enum><text>shall acknowledge
				that the United States will incur all costs involved, including the costs of
				transfer, housing, medical care, rehabilitation, and reentry of transferred
				prisoners;</text>
								</subparagraph><subparagraph id="H0683764125F6420BA9D2277BE564C69"><enum>(B)</enum><text>shall limit the
				transfer of prisoners to prisoners convicted in tribal court of violent crimes,
				crimes involving sexual abuse, and serious drug offenses, as determined by the
				Bureau of Prisons, in consultation with tribal governments, by
				regulation;</text>
								</subparagraph><subparagraph id="H70C42C20E29F4792A0666D2D953E2322"><enum>(C)</enum><text>shall not affect
				the jurisdiction, power of self-government, or any other authority of an Indian
				tribe over the territory or members of the Indian tribe;</text>
								</subparagraph><subparagraph id="HA4BB702912BA452885EDFD00FE16B357"><enum>(D)</enum><text>shall contain such
				other requirements as the Bureau of Prisons, in consultation with the Bureau of
				Indian Affairs and tribal governments, may determine, by regulation; and</text>
								</subparagraph><subparagraph id="HC35AA82024384D37B7387D1111C1398B"><enum>(E)</enum><text>shall be executed
				and carried out not later than 180 days after the date on which the applicable
				Indian tribe first contacts the Bureau of Prisons to accept a transfer of a
				tribal court offender pursuant to this subsection.</text>
								</subparagraph></paragraph></subsection><subsection id="HC84C497D946E4199B456D6274EFCEB5"><enum>(c)</enum><header>Effect of
				section</header><text>Nothing in this section affects the obligation of the
				United States, or any State government that has been delegated authority by the
				United States, to investigate and prosecute any criminal violation in Indian
				country.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HC0F70A5706EE46D484DEC81DB9E1C91"><enum>305.</enum><header>Indian law and
			 order commission</header>
				<subsection id="HC1023337B2C14687BB8F76C2A3E3C2F2"><enum>(a)</enum><header>Establishment</header><text>There
			 is established a commission to be known as the Indian Law and Order Commission
			 (referred to in this section as the <quote>Commission</quote>).</text>
				</subsection><subsection id="HE0791D6F83DE44DBB1C47E5091B9809F"><enum>(b)</enum><header>Membership</header>
					<paragraph id="H15091AA53DEC4322B17465F350DF7B31"><enum>(1)</enum><header>In
			 general</header><text>The Commission shall be composed of 9 members, of
			 whom—</text>
						<subparagraph id="H4DE31E28F49A4876B1CFEE36F7D8CEF8"><enum>(A)</enum><text>3 shall be
			 appointed by the President, in consultation with—</text>
							<clause id="HE453D77A28804874A6FB7E57D0EF6967"><enum>(i)</enum><text>the
			 Attorney General; and</text>
							</clause><clause id="H13B1560AE64C40848B8B103B6C5EDB56"><enum>(ii)</enum><text>the
			 Secretary of the Interior;</text>
							</clause></subparagraph><subparagraph id="HCE98E5986A5C440593342DD9CC923048"><enum>(B)</enum><text>2 shall be
			 appointed by the majority leader of the Senate, in consultation with the
			 Chairperson of the Committee on Indian Affairs of the Senate;</text>
						</subparagraph><subparagraph id="H172BAEBD91E842BCA117E948A265227C"><enum>(C)</enum><text>1 shall be
			 appointed by the minority leader of the Senate, in consultation with the Vice
			 Chairperson of the Committee on Indian Affairs of the Senate;</text>
						</subparagraph><subparagraph id="HBBC665A11D7B4442A75100BC61581F47"><enum>(D)</enum><text>2 shall be
			 appointed by the Speaker of the House of Representatives, in consultation with
			 the Chairperson of the Committee on Natural Resources of the House of
			 Representatives; and</text>
						</subparagraph><subparagraph id="H4E1FE3931E9C4ACAAD575D079021DACE"><enum>(E)</enum><text>1 shall be
			 appointed by the minority leader of the House of Representatives, in
			 consultation with the Ranking Member of the Committee on Natural Resources of
			 the House of Representatives.</text>
						</subparagraph></paragraph><paragraph id="H4F3EAB60FC8E46219E8565B8DA49870"><enum>(2)</enum><header>Requirements for
			 eligibility</header><text>Each member of the Commission shall have significant
			 experience and expertise in—</text>
						<subparagraph id="H4C43799D190C42FFB448202E1BD23D5C"><enum>(A)</enum><text>the Indian country
			 criminal justice system; and</text>
						</subparagraph><subparagraph id="HAAD5D4A421C94BF0ADEDDFCF7DC858DC"><enum>(B)</enum><text>matters to be
			 studied by the Commission.</text>
						</subparagraph></paragraph><paragraph id="H8456F8E8B92C47B6BA57C15CF3006038"><enum>(3)</enum><header>Consultation
			 required</header><text>The President, the Speaker and minority leader of the
			 House of Representatives, and the majority leader and minority leader of the
			 Senate shall consult before the appointment of members of the Commission under
			 paragraph (1) to achieve, to the maximum extent practicable, fair and equitable
			 representation of various points of view with respect to the matters to be
			 studied by the Commission.</text>
					</paragraph><paragraph id="H14BF4EB668924A67B4D7F93F9C4F7315"><enum>(4)</enum><header>Term</header><text>Each
			 member shall be appointed for the life of the Commission.</text>
					</paragraph><paragraph id="H32C2492C01C74F9ABF47DA5CD0BE816D"><enum>(5)</enum><header>Time for initial
			 appointments</header><text>The appointment of the members of the Commission
			 shall be made not later than 60 days after the date of enactment of this
			 Act.</text>
					</paragraph><paragraph id="HB35C99DA9F2F48A7A0F214A1E566351B"><enum>(6)</enum><header>Vacancies</header><text>A
			 vacancy in the Commission shall be filled—</text>
						<subparagraph id="H8F56238789814C839F5331F1FA795F8F"><enum>(A)</enum><text>in the same manner
			 in which the original appointment was made; and</text>
						</subparagraph><subparagraph id="H8DB743CF22C841A8B012386C5942FE"><enum>(B)</enum><text>not later than 60
			 days after the date on which the vacancy occurred.</text>
						</subparagraph></paragraph></subsection><subsection id="HC058115BAC6942BF94A34CC7F21FF9ED"><enum>(c)</enum><header>Operation</header>
					<paragraph id="H7B3AFA26FE0B456394397D2618FEE686"><enum>(1)</enum><header>Chairperson</header><text>Not
			 later than 15 days after the date on which all members of the Commission have
			 been appointed, the Commission shall select 1 member to serve as Chairperson of
			 the Commission.</text>
					</paragraph><paragraph id="HF1CFD7EE7A3C400D9C00E01D525DEFE4"><enum>(2)</enum><header>Meetings</header>
						<subparagraph id="HE4344BC6526D4FEA8E08DA00135E141B"><enum>(A)</enum><header>In
			 general</header><text>The Commission shall meet at the call of the
			 Chairperson.</text>
						</subparagraph><subparagraph id="H5A57ECC7CBA14F3499A884A838D8056"><enum>(B)</enum><header>Initial
			 meeting</header><text>The initial meeting shall take place not later than 30
			 days after the date described in paragraph (1).</text>
						</subparagraph></paragraph><paragraph id="HE5948B2D5CE24887B3EB0034C8DDA399"><enum>(3)</enum><header>Quorum</header><text>A
			 majority of the members of the Commission shall constitute a quorum, but a
			 lesser number of members may hold hearings.</text>
					</paragraph><paragraph id="HCC63C790380844BEA4CE80E1CD1516AA"><enum>(4)</enum><header>Rules</header><text>The
			 Commission may establish, by majority vote, any rules for the conduct of
			 Commission business, in accordance with this Act and other applicable
			 law.</text>
					</paragraph></subsection><subsection id="H6F7D30E6DA6E4D788857FC2132A584A5"><enum>(d)</enum><header>Comprehensive
			 study of criminal justice system relating to Indian country</header><text>The
			 Commission shall conduct a comprehensive study of law enforcement and criminal
			 justice in tribal communities, including—</text>
					<paragraph id="H3BB42596EFB94B5F96FDE2EE9AE5CE9"><enum>(1)</enum><text>jurisdiction over
			 crimes committed in Indian country and the impact of that jurisdiction
			 on—</text>
						<subparagraph id="H88FAAEE142234D389CA2C110799EE589"><enum>(A)</enum><text>the investigation
			 and prosecution of Indian country crimes; and</text>
						</subparagraph><subparagraph id="H26216D3B31A1405A98DBB8B642C72EBB"><enum>(B)</enum><text>residents of
			 Indian land;</text>
						</subparagraph></paragraph><paragraph id="H83FB38FC99A448A5B015B1E185571200"><enum>(2)</enum><text>the tribal jail
			 and Federal prisons systems and the effect of those systems with respect
			 to—</text>
						<subparagraph id="HE9804366DC70491293005F017E65FDC"><enum>(A)</enum><text>reducing Indian
			 country crime; and</text>
						</subparagraph><subparagraph id="H13D16F6D18E24F0D80AD74B73B06A7C8"><enum>(B)</enum><text>rehabilitation of
			 offenders;</text>
						</subparagraph></paragraph><paragraph id="HD336AC0297984CD1847543B4C6484185"><enum>(3)</enum><text>the impact of the
			 Indian Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/25/1301">25 U.S.C. 1301 et seq.</external-xref>) on—</text>
						<subparagraph id="H0E352DEB9DB941329397F2BA5532DC1E"><enum>(A)</enum><text>the authority of
			 Indian tribes; and</text>
						</subparagraph><subparagraph id="HE485E796E8614CE89868C16628D956F9"><enum>(B)</enum><text>the rights of
			 defendants subject to tribal government authority; and</text>
						</subparagraph></paragraph><paragraph id="H4D0B0DD464B14F73B8475277154524D6"><enum>(4)</enum><text>a
			 study of such other subjects as the Commission determines relevant to achieve
			 the purposes of the <short-title>Tribal Law and Order Act
			 of 2008</short-title>.</text>
					</paragraph></subsection><subsection id="H7EC821FC2D4D42C087609B0594BC5D89"><enum>(e)</enum><header>Recommendations</header><text>Taking
			 into consideration the results of the study under paragraph (1), the Commission
			 shall develop recommendations on necessary modifications and improvements to
			 justice systems at the tribal, Federal, and State levels, including
			 consideration of—</text>
					<paragraph id="H07B7B9C3999642128EAE1E112F77AEE7"><enum>(1)</enum><text>simplifying
			 jurisdiction in Indian country;</text>
					</paragraph><paragraph id="H61C691B5CFF3465EB5CD5B5BF8C45C9"><enum>(2)</enum><text>enhancing the penal
			 authority of tribal courts and exploring alternatives to incarceration;</text>
					</paragraph><paragraph id="HB4BFC21AD3CA4ED492E7EB3ED892B76F"><enum>(3)</enum><text>the establishment
			 of satellite United States magistrate or district courts in Indian
			 country;</text>
					</paragraph><paragraph id="HCB5F5A3A22324B37B72ECFBB573CA5DF"><enum>(4)</enum><text>changes to the
			 tribal jails and Federal prison systems; and</text>
					</paragraph><paragraph id="H196F34E2035749379646F4C7BEB5A4E"><enum>(5)</enum><text>other issues that,
			 as determined by the Commission, would reduce violent crime in Indian
			 country.</text>
					</paragraph></subsection><subsection id="HCABE81DB13104D53BF4C489EA5FAF21F"><enum>(f)</enum><header>Report</header><text>Not
			 later than 2 years after the date of enactment of this Act, the Commission
			 shall submit to the President and Congress a report that contains—</text>
					<paragraph id="HAA8810A2DC144132B9ED5BBBB536EEA4"><enum>(1)</enum><text>a
			 detailed statement of the findings and conclusions of the Commission;
			 and</text>
					</paragraph><paragraph id="H9B229FF0969B4472B1F7410CE3394A2"><enum>(2)</enum><text>the recommendations
			 of the Commission for such legislative and administrative actions as the
			 Commission considers to be appropriate.</text>
					</paragraph></subsection><subsection id="H8D63F465B9BE42D8B6579C20192F1121"><enum>(g)</enum><header>Powers</header>
					<paragraph id="HBADC78AD307D44E0B57C26877900B763"><enum>(1)</enum><header>Hearings</header>
						<subparagraph id="HEC20FB31342B44E887823BDAA43D55FE"><enum>(A)</enum><header>In
			 general</header><text>The Commission may hold such hearings, meet and act at
			 such times and places, take such testimony, and receive such evidence as the
			 Commission considers to be advisable to carry out the duties of the Commission
			 under this section.</text>

			 requirement</header><text>The hearings of the Commission under this paragraph
			 shall be open to the public.</text>
						</subparagraph></paragraph><paragraph id="H421B2CA8EFCD45410077EBD46083F52B"><enum>(2)</enum><header>Witness
			 expenses</header>
						<subparagraph id="H5924E6104F9F4F76B940D35EC1D77294"><enum>(A)</enum><header>In
			 general</header><text>A witness requested to appear before the Commission shall
			 be paid the same fees as are paid to witnesses under <external-xref legal-doc="usc" parsable-cite="usc/28/1821">section 1821</external-xref> of title 28,
			 United States Code.</text>
						</subparagraph><subparagraph id="H32A12F3B7B524C71BB3BE22DDC67B379"><enum>(B)</enum><header>Per diem and
			 mileage</header><text>The per diem and mileage allowance for a witness shall be
			 paid from funds made available to the Commission.</text>
						</subparagraph></paragraph><paragraph id="H7D694AC3511641B4BA43D365F3C6699F"><enum>(3)</enum><header>Information from
			 Federal, tribal, and State agencies</header>
						<subparagraph id="H23DC95F3A25F4533A9A435DF614EFBE0"><enum>(A)</enum><header>In
			 general</header><text>The Commission may secure directly from a Federal agency
			 such information as the Commission considers to be necessary to carry out this
			 section.</text>
						</subparagraph><subparagraph id="H51A7FB0D9C2042B08EFF7392B39433E7"><enum>(B)</enum><header>Tribal and State
			 agencies</header><text>The Commission may request the head of any tribal or
			 State agency to provide to the Commission such information as the Commission
			 considers to be necessary to carry out this section.</text>
						</subparagraph></paragraph><paragraph id="H4B684F97565B4748BF9720B6A120DD32"><enum>(4)</enum><header>Postal
			 services</header><text>The Commission may use the United States mails in the
			 same manner and under the same conditions as other agencies of the Federal
			 Government.</text>
					</paragraph><paragraph id="HFACFAEC3ED0241BC9BE7AC875DD62DEF"><enum>(5)</enum><header>Gifts</header><text>The
			 Commission may accept, use, and dispose of gifts or donations of services or
			 property.</text>
					</paragraph></subsection><subsection id="H07B79E462D634296A688FCD3941B4119"><enum>(h)</enum><header>Commission
			 personnel matters</header>
					<paragraph id="HD726D12741C94AF2BBEE1D8FB891C2A"><enum>(1)</enum><header>Travel
			 expenses</header><text>A member of the Commission shall be allowed travel
			 expenses, including per diem in lieu of subsistence, at rates authorized for an
			 employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United
			 States Code, while away from the home or regular place of business of the
			 member in the performance of the duties of the Commission.</text>
					</paragraph><paragraph id="HC76F6EAC5BDB4CC49EE889B8ECF4F9C"><enum>(2)</enum><header>Detail of Federal
			 employees</header><text>On the affirmative vote of <fraction>2/3</fraction> of
			 the members of the Commission and the approval of the appropriate Federal
			 agency head, an employee of the Federal Government may be detailed to the
			 Commission without reimbursement, and such detail shall be without interruption
			 or loss of civil service status, benefits, or privileges.</text>
					</paragraph><paragraph id="HED6574B09FC243439CEE8F14D79C0709"><enum>(3)</enum><header>Procurement of
			 temporary and intermittent services</header><text>On request of the Commission,
			 the Attorney General and Secretary shall provide to the Commission reasonable
			 and appropriate office space, supplies, and administrative assistance.</text>
					</paragraph></subsection><subsection id="H5D864A74757A492284D5F8D3045C0034"><enum>(i)</enum><header>Contracts for
			 research</header>
					<paragraph id="H354E57E5E8FA48D500212EBAB3941692"><enum>(1)</enum><header>Researchers and
			 experts</header>
						<subparagraph id="HF4F947E6BA484365AB269ED3064D5D3"><enum>(A)</enum><header>In
			 general</header><text>On an affirmative vote of <fraction>2/3</fraction> of the
			 members of the Commission, the Commission may select nongovernmental
			 researchers and experts to assist the Commission in carrying out the duties of
			 the Commission under this section.</text>
						</subparagraph><subparagraph id="H780943D4EA164BD7BD6575CFFADA9C34"><enum>(B)</enum><header>National
			 Institute of Justice</header><text>The National Institute of Justice may enter
			 into a contract with the researchers and experts selected by the Commission
			 under subparagraph (A) to provide funding in exchange for the services of the
			 researchers and experts.</text>
						</subparagraph></paragraph><paragraph id="H51EAD830E9884CE6BB68E7B16117EF7B"><enum>(2)</enum><header>Other
			 organizations</header><text>Nothing in this subsection limits the ability of
			 the Commission to enter into contracts with any other entity or organization to
			 carry out research necessary to carry out the duties of the Commission under
			 this section.</text>
					</paragraph></subsection><subsection id="H855AD63C00B3454D87EE6AFA3B26CA8"><enum>(j)</enum><header>Tribal Advisory
			 Committee</header>
					<paragraph id="HEE0C3D2E200E487E94C59300122DC6D3"><enum>(1)</enum><header>Establishment</header><text>The
			 Commission shall establish a committee, to be known as the <quote>Tribal
			 Advisory Committee</quote>.</text>
					</paragraph><paragraph id="HE8CED8A9404447BD8FD5A53D8FAFF2D7"><enum>(2)</enum><header>Membership</header>
						<subparagraph id="HA2A679F0BACE4DC0BDAB12A4FDD1888C"><enum>(A)</enum><header>Composition</header><text>The
			 Tribal Advisory Committee shall consist of 2 representatives of Indian tribes
			 from each region of the Bureau of Indian Affairs.</text>
						</subparagraph><subparagraph id="H3556A0F021054DF29FB300D3D200ABF3"><enum>(B)</enum><header>Qualifications</header><text>Each
			 member of the Tribal Advisory Committee shall have experience relating
			 to—</text>
							<clause id="H6C8A8EA51AF24FDD944ED97C4570F805"><enum>(i)</enum><text>justice
			 systems;</text>
							</clause><clause id="HBD436B2E17B64919B31C200005B7B7C4"><enum>(ii)</enum><text>crime prevention;
			 or</text>
							</clause><clause id="H834FEA5A2E4A4D0EA088D94553DE38AD"><enum>(iii)</enum><text>victim
			 services.</text>
							</clause></subparagraph></paragraph><paragraph id="H507FA74D677848A29387CA9812BA6E82"><enum>(3)</enum><header>Duties</header><text>The
			 Tribal Advisory Committee shall—</text>
						<subparagraph id="H42BF3E0CF9254FC3B34FDE28F8AADD7E"><enum>(A)</enum><text>serve as an
			 advisory body to the Commission; and</text>
						</subparagraph><subparagraph id="HA37919C3B1E945F800D0EBEB2D4F00CE"><enum>(B)</enum><text>provide to the
			 Commission advice and recommendations, submit materials, documents, testimony,
			 and such other information as the Commission determines to be necessary to
			 carry out the duties of the Commission under this section.</text>
						</subparagraph></paragraph></subsection><subsection id="H8F3CDA6E0E8B4EF185544600AAE36BAE"><enum>(k)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as are necessary to carry out this section, to remain available until
			 expended.</text>
				</subsection><subsection id="H9D0E1D027DF94021965195BB70BDCF28"><enum>(l)</enum><header>Termination of
			 commission</header><text>The Commission shall terminate 90 days after the date
			 on which the Commission submits the report of the Commission under subsection
			 (c)(3).</text>
				</subsection><subsection id="H72A18BE4B9134847B69982D6AC6875E1"><enum>(m)</enum><header>Nonapplicability
			 of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall
			 not apply to the Commission.</text>

				assistance to the affected agencies to establish effective and permanent
				interagency communication and coordination; and</text>
											</clause><clause id="H445F6364C51E4A3EA8D2B4416CEEE426"><enum>(v)</enum><text>determines whether
				collaboration is feasible, cost-effective, and within agency
				capability.</text>
											</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
								</subclause></clause><clause id="H9D46A9051B75446CA6A758D38219A613"><enum>(iii)</enum><text>by
			 striking paragraph (3) and inserting the following:</text>

							</paragraph><paragraph id="HB81967CFA047422987FDFB6B3B564466"><enum>(2)</enum><header>Costs</header><text>The
				Assistant Secretary shall defray all costs associated with the actual operation
				and support of the pilot program in a school from funds appropriated to carry
				out this subsection.</text>
							</paragraph><paragraph id="HE7A0BF4D23044411BBB6E384A33EE5DE"><enum>(3)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out the pilot programs under this subsection such sums as are necessary for

			 shelters</header><text>Section 4213(e) of the Indian Alcohol and Substance
			 Abuse Prevention and Treatment Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/25/2433">25 U.S.C. 2433(e)</external-xref>) is
			 amended—</text>

				and prosecution of offenses relating to illegal narcotics; and</text>
									</subparagraph><subparagraph id="H955751C2A95F42AF915265B227C71B31"><enum>(B)</enum><text>alcohol and
				substance abuse prevention and treatment.</text>
									</subparagraph></paragraph><paragraph id="H92C46A284AA04E1FAF9C95B0B9B842BC"><enum>(2)</enum><header>Youth-related
				training</header><text>Any training provided to Bureau of Indian Affairs or
				tribal law enforcement or judicial personnel under paragraph (1) shall include
				training in issues relating to youth alcohol and substance abuse prevention and
				treatment.</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HF495AC2BC64C4676A2397BC8EBFA01AA"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>as may be necessary</quote> and all that follows through the

				enforcement activities on Indian land to provide the non-Federal share of the
				cost of a program or project under this
				section.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H9C3F91FD20D7499D95422F4632E126F6"><enum>(3)</enum><text>in subsection (i),
			 by striking <quote>The authority</quote> and inserting <quote>Except as

				grants under this section to Indian tribal governments, for fiscal year 2009
				and any fiscal year thereafter, for such period as the Attorney General
				determines to be appropriate to assist the Indian tribal governments in
				carrying out the purposes described in subsection (b).</text>
							</paragraph><paragraph id="HB0B9168097D84C7091722DAA65FA48F2"><enum>(2)</enum><header>Priority of
				funding</header><text>In providing grants to Indian tribal governments under
				this subsection, the Attorney General shall take into consideration reservation
				crime rates and tribal law enforcement staffing needs of each Indian tribal
				government.</text>
							</paragraph><paragraph id="HC420852D70034E04B7F9DAB8BC4200DC"><enum>(3)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated such sums
				as are necessary to carry out this subsection for each of fiscal years 2009
				through 2013.</text>
							</paragraph></subsection><subsection id="H7E3A8104964740EC8773BF008900B6B3"><enum>(k)</enum><header>Report</header><text>Not
				later than 180 days after the date of enactment of this subsection, the
				Attorney General shall submit to Congress a report describing the extent and
				effectiveness of the Community Oriented Policing (COPS) initiative as applied
				in Indian country, including particular references to—</text>
							<paragraph id="H3FC23934299B49B29FC7BE737066449"><enum>(1)</enum><text>the problem of
				intermittent funding;</text>
							</paragraph><paragraph id="HDC8795774AF04EF49D48CAA1706BE986"><enum>(2)</enum><text>the integration of
				COPS personnel with existing law enforcement authorities; and</text>
							</paragraph><paragraph id="H65528C7608F44E94B303AA50D79192AE"><enum>(3)</enum><text>an explanation of
				how the practice of community policing and the broken windows theory can most
				effectively be applied in remote tribal
				locations.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H1AB0CE24197F4C8400625C36905C6676"><enum>404.</enum><header>Tribal jails
			 program</header>
				<subsection id="H1C91293A971B4E13B6F8981CB321E8D3"><enum>(a)</enum><header>In
			 general</header><text>Section 20109 of the Violent Crime Control and Law
			 Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13709">42 U.S.C. 13709</external-xref>) is amended by striking subsection (a)
			 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H43BC1F0DDE4D4F13B828ABA18D59642B" style="OLC">

			 detention centers</header>

			 general</header><text>Section 20109 of the Violent Crime Control and Law
			 Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13709">42 U.S.C. 13709</external-xref>) is amended by striking subsection (b)
			 and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1C93FD9FBF7441ADA4EA9DED02652FCA" style="OLC">
							<subsection id="H0F382D529B3D41609C836ECC7EA71324"><enum>(b)</enum><header>Grants to indian
				tribes</header>
								<paragraph id="HC0C5245D0E7740E19FE4F413C7147436"><enum>(1)</enum><header>In
				general</header><text>From the amounts reserved under subsection (a), the
				Attorney General shall provide grants—</text>
									<subparagraph id="HF907B4BFF77D414F8C12CBA99CE01946"><enum>(A)</enum><text>to Indian tribes
				for purposes of—</text>
										<clause id="HE237573DEFB14DD9932E80E17FF49FC"><enum>(i)</enum><text>construction and
				maintenance of jails on Indian land for the incarceration of offenders subject
				to tribal jurisdiction;</text>
										</clause><clause id="H9D220B883EF646ECBA11F700E694D077"><enum>(ii)</enum><text>entering into
				contracts with private entities to increase the efficiency of the construction
				of tribal jails; and</text>
										</clause><clause id="HE5E744E9148548278BAAF7A260AC4BBD"><enum>(iii)</enum><text>developing and
				implementing alternatives to incarceration in tribal jails; and</text>
										</clause></subparagraph><subparagraph id="H670B538E862E42839F148173DAD70045"><enum>(B)</enum><text>to consortia of
				Indian tribes for purposes of constructing and operating regional detention
				centers on Indian land for long-term incarceration of offenders subject to
				tribal jurisdiction, as the applicable consortium determines to be
				appropriate.</text>
									</subparagraph></paragraph><paragraph id="H1A37F9882212480C932554F14DE99886"><enum>(2)</enum><header>Priority of
				funding</header><text>In providing grants under this subsection, the Attorney
				General shall take into consideration applicable—</text>
									<subparagraph id="H612E2F15C1EB4CB482E3AE9900735B11"><enum>(A)</enum><text>reservation crime
				rates;</text>
									</subparagraph><subparagraph id="HF9AF47C9E76B434194E6BABC35863ED9"><enum>(B)</enum><text>annual tribal
				court convictions; and</text>
									</subparagraph><subparagraph id="H69FB9CB9238749608961D4A6BC00FFA3"><enum>(C)</enum><text>bed space
				needs.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HE75E7E756C6B4C518820A0AECBA31FA8"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 20109(c) of the Violent Crime Control and Law
			 Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13709">42 U.S.C. 13709(c)</external-xref>) is amended by inserting <quote>or
			 consortium of Indian tribes, as applicable,</quote> after <quote>Indian
			 tribe</quote>.</text>
					</paragraph><paragraph id="HE6D94EA1E9234A948D00F578C4DF1BCD"><enum>(3)</enum><header>Long-term
			 plan</header><text>Section 20109 of the Violent Crime Control and Law
			 Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13709">42 U.S.C. 13709</external-xref>) is amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H828AF4ECA72B4FE6003D598FB844CE55" style="OLC">
							<subsection id="HF8014DCAF198419BA20017F6FCA58584"><enum>(d)</enum><header>Long-term
				plan</header><text>Not later than 1 year after the date of enactment of this
				subsection, the Attorney General, in coordination with the Bureau of Indian
				Affairs and in consultation with tribal leaders, tribal law enforcement
				officers, and tribal corrections officials, shall submit to Congress a
				long-term plan to address incarceration in Indian country, including a
				description of—</text>
								<paragraph id="H9CB3CEE60FB34A7BB8EF5AC7DA2532B"><enum>(1)</enum><text>proposed activities
				for construction of detention facilities (including regional facilities) on
				Indian land;</text>
								</paragraph><paragraph id="HC4ADEDBB01A54784AD3555D7C9F1B2D2"><enum>(2)</enum><text>proposed
				activities for construction of additional Federal detention facilities on
				Indian land;</text>
								</paragraph><paragraph id="H14CB8ABD2A4D49EF86D9290070AA428B"><enum>(3)</enum><text>proposed
				activities for contracting with State and local detention centers, with tribal
				government approval;</text>
								</paragraph><paragraph id="HCA78F0EF740247CE939D0026CE7515CB"><enum>(4)</enum><text>proposed
				alternatives to incarceration, developed in cooperation with tribal court
				systems; and</text>
								</paragraph><paragraph id="H5BBF339F2E2C494796672C3DC56064DE"><enum>(5)</enum><text>such other
				alternatives as the Attorney General, in coordination with the Bureau of Indian
				Affairs and in consultation with Indian tribes, determines to be
				necessary.</text>

					</paragraph></subsection></section><section id="HF79BC6F1D801480D846FE3ACB2EC36BD"><enum>405.</enum><header>Tribal
			 probation office liaison program</header><text display-inline="no-display-inline">Title II of the Indian Tribal Justice
			 Technical and Legal Assistance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/3681">25 U.S.C. 3681 et seq.</external-xref>) is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H93E652B7EB014ED38F6EE5908927E613" style="OLC">
					<section id="H4C4582D21B40405DA379D9C947C24EB7"><enum>203.</enum><header>Assistant
				parole and probation officers</header>
						<subsection id="HBDDF2CEFD0A64DF9862F51B9033675F3"><enum></enum><text>To the maximum
				extent practicable, the Director of the Administrative Office of the United
				States Courts shall appoint individuals residing in Indian country to serve as
				assistant parole or probation officers for purposes of monitoring and providing
				service to Federal prisoners residing in Indian
				country.</text>

			 program</header>
				<subsection id="H7048C18A51034BA39DB7EC8BE271856B"><enum>(a)</enum><header>Incentive grants
			 for local delinquency prevention programs</header>
					<paragraph id="H57C257A39D9045498D66A3B777F8B6B3"><enum>(1)</enum><header>In
			 general</header><text>Section 504 of the Juvenile Justice and Delinquency
			 Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5783">42 U.S.C. 5783</external-xref>) is amended—</text>
						<subparagraph id="HF167F2A300F440749D6D00FD22DFC026"><enum>(A)</enum><text>in subsection (a),
			 by inserting <quote>, or to Indian tribes under subsection (d)</quote> after
			 <quote>subsection (b)</quote>; and</text>
						</subparagraph><subparagraph id="H73403D4F4A1E418986DDCC4316E97400"><enum>(B)</enum><text>by adding at the

				general</header><text>The Administrator shall make grants under this section,
				on a competitive basis, to eligible Indian tribes or consortia of Indian
				tribes, as described in paragraph (2)—</text>
										<subparagraph id="H54C4821B2A314058B0A85D4B3EBF8B00"><enum>(A)</enum><text>to support and
				enhance tribal juvenile justice systems; and</text>
										</subparagraph><subparagraph id="HBBB9D7567D474E7C989990484825B770"><enum>(B)</enum><text>to encourage
				accountability of Indian tribal governments with respect to juvenile
				delinquency responses and prevention.</text>
										</subparagraph></paragraph><paragraph id="H37C33928B1594090AB4EBDA2B8603FCD"><enum>(2)</enum><header>Eligible indian
				tribes</header><text>To be eligible to receive a grant under this subsection,
				an Indian tribe or consortium of Indian tribes shall submit to the
				Administrator an application in such form and containing such information as
				the Administrator may require.</text>
									</paragraph><paragraph id="H92B01C16F42943FE88AB3184DFD80020"><enum>(3)</enum><header>Priority of
				funding</header><text>In providing grants under this subsection, the
				Administrator shall take into consideration, with respect to the reservation
				communities to be served—</text>
										<subparagraph id="HFEBF37A20CD0408EB94E669444548F33"><enum>(A)</enum><text>juvenile crime
				rates;</text>
										</subparagraph><subparagraph id="H1B5807DA53B94BD9A2D3B98D55522769"><enum>(B)</enum><text>dropout rates;
				and</text>
										</subparagraph><subparagraph id="HB996352345C643C4913C3BF9A707779C"><enum>(C)</enum><text>percentages of
				at-risk
				youth.</text>
										</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="HCE521577B5AE41F595CC1D3300BC2222"><enum>(2)</enum><header>Authorization of
			 appropriations</header><text>Section 505 of the Juvenile Justice and
			 Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5784">42 U.S.C. 5784</external-xref>) is amended by striking

			 Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2802">25 U.S.C. 2802</external-xref>) is amended by adding at the end the
			 following:</text>

					<subsection id="HE5AC5E4EE24447E089806715696C39D5"><enum>(f)</enum><header>Grants To
				improve tribal data collection systems</header>

				program</header><text>The Secretary, acting through the Director of the Office
				of Justice Services of the Bureau and in coordination with the Attorney
				General, shall establish a program under which the Secretary shall provide
				grants to Indian tribes for activities to ensure uniformity in the collection
				and analysis of data relating to crime in Indian country.</text>
						</paragraph><paragraph id="H90E93CB696D94024925C49B856199C1E"><enum>(2)</enum><header>Regulations</header><text>The
				Secretary, acting through the Director of the Office of Justice Services of the
				Bureau, in consultation with tribal governments and tribal justice officials,
				shall promulgate such regulations as are necessary to carry out the grant
				program under this
				subsection.</text>

			 <quote>, tribal,</quote> after <quote>State</quote>.</text>

						</clause></subparagraph></paragraph></section><section id="HFFF2C092B3364BEF93121C4C6DF8CAC7"><enum>602.</enum><header>Domestic and
			 sexual violent offense training</header><text display-inline="no-display-inline">Section 3(c)(9) of the Indian Law
			 Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2802">25 U.S.C. 2802(c)(9)</external-xref>) (as amended by section 101(a)(2))
			 is amended by inserting before the semicolon at the end the following: <quote>,
			 including training to properly interview victims of domestic and sexual
			 violence and to collect, preserve, and present evidence to Federal and tribal
			 prosecutors to increase the conviction rate for domestic and sexual violence
			 offenses for purposes of addressing and preventing domestic and sexual violent
			 offenses</quote>.</text>
			</section><section id="H79971A24A1FD4A69B82CC067F8B86A8"><enum>603.</enum><header>Testimony by
			 Federal employees in cases of rape and sexual assault</header><text display-inline="no-display-inline">The Indian Law Enforcement Reform Act (25
			 U.S.C. 2801 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEE19325A0E5D4219ADCBB17B4CDFF730" style="OLC">
					<section id="HA3C429A8C2E94985A17412A2C0D96098"><enum>11.</enum><header>Testimony by
				Federal employees in cases of rape and sexual assault</header>
						<subsection id="HE9130D8BC1B04AA3BE92EF219CF15FB2"><enum>(a)</enum><header>Approval of
				employee testimony</header><text>The Director of the Office of Justice Services
				or the Director of the Indian Health Service, as appropriate (referred to in
				this section as the <term>Director concerned</term>), shall approve or
				disapprove, in writing, any request or subpoena for a law enforcement officer,
				sexual assault nurse examiner, or other employee under the supervision of the
				Director concerned to provide testimony in a deposition, trial, or other
				similar proceeding regarding information obtained in carrying out the official
				duties of the employee.</text>
						</subsection><subsection id="H704BECF2475641859F95D5D49E6B91E2"><enum>(b)</enum><header>Requirement</header><text>The
				Director concerned shall approve a request or subpoena under subsection (a) if
				the request or subpoena does not violate the policy of the Department of the
				Interior to maintain strict impartiality with respect to private causes of
				action.</text>
						</subsection><subsection id="H24D177CE7EEE413F8CD5425FE849FA4F"><enum>(c)</enum><header>Treatment</header><text>If
				the Director concerned fails to approve or disapprove a request or subpoena by
				the date that is 30 days after the date of receipt of the request or subpoena,
				the request or subpoena shall be considered to be approved for purposes of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HCBA6F759DDA04781B480D8B29BDE2EFA"><enum>604.</enum><header>Coordination of
			 Federal agencies</header><text display-inline="no-display-inline">The Indian
			 Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2801">25 U.S.C. 2801 et seq.</external-xref>) (as amended by section 603)
			 is amended by adding at the end the following:</text>

					<section id="HD6600366CAB34DBC8635A5CC00AC6C59"><enum>12.</enum><header>Coordination of
				Federal agencies</header>
						<subsection id="H7ABF782FB7D34598BF05716E821FF3FF"><enum>(a)</enum><header>In
				general</header><text>The Secretary, in coordination with the Attorney General,
				Federal and tribal law enforcement agencies, the Indian Health Service, and
				domestic violence or sexual assault victim organizations, shall develop
				appropriate victim services and victim advocate training programs—</text>
							<paragraph id="HD59F655D856B4D388853E29B41C11DE0"><enum>(1)</enum><text>to improve
				domestic violence or sexual abuse responses;</text>
							</paragraph><paragraph id="H94BD6140FB9C4ACA94EFD4FA10F42454"><enum>(2)</enum><text>to improve
				forensic examinations and collection;</text>
							</paragraph><paragraph id="H0B462BAC0D634A5A877BC88B3E31C9D"><enum>(3)</enum><text>to identify
				problems or obstacles in the prosecution of domestic violence or sexual abuse;
				and</text>
							</paragraph><paragraph id="H52238E890DA749BD8188C832D7FD5272"><enum>(4)</enum><text>to meet other
				needs or carry out other activities required to prevent, treat, and improve
				prosecutions of domestic violence and sexual abuse.</text>
							</paragraph></subsection><subsection id="H16AAA3C48C144C359BA5CD14A20032C7"><enum>(b)</enum><header>Report</header><text>Not
				later than 2 years after the date of enactment of this section, the Secretary
				shall submit to the Committee on Indian Affairs of the Senate and the Committee
				on Natural Resources of the House of Representatives a report that describes,
				with respect to the matters described in subsection (a), the improvements made
				and needed, problems or obstacles identified, and costs necessary to address
				the problems or obstacles, and any other recommendations that the Secretary
				determines to be
				appropriate.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H5FDC8ACE800048758E80B6516F3820A5"><enum>605.</enum><header>Sexual assault
			 protocol</header><text display-inline="no-display-inline">Title VIII of the
			 Indian Health Care Improvement Act is amended by inserting after section 802
			 (<external-xref legal-doc="usc" parsable-cite="usc/25/1672">25 U.S.C. 1672</external-xref>) the following:</text>

					<section id="HE19578B9D06D4B989139FB1F9C37D672"><enum>803.</enum><header>Policies and
				protocol</header><text display-inline="no-display-inline">The Director of
				Service, in coordination with the Director of the Office on Violence Against
				Women of the Department of Justice, in consultation with Indian Tribes and
				Tribal Organizations, and in conference with Urban Indian Organizations, shall
				develop standardized sexual assault policies and protocol for the facilities of
				the Service, based on similar protocol that has been established by the
				Department of
				Justice.</text>
