		<official-title>To ensure the fair treatment of a member of the Armed
		  Forces who is discharged from the Armed Forces, at the request of the member,
		  pursuant to the Department of Defense policy permitting the early discharge of
		  a member who is the only surviving child in a family in which the father or
		  mother, or one or more siblings, served in the Armed Forces and, because of
		  hazards incident to such service, was killed, died as a result of wounds,
		  accident, or disease, is in a captured or missing in action status, or is
		  permanently disabled, to amend the Internal Revenue Code of 1986 to repeal the
		  dollar limitation on contributions to funeral trusts, and for other

			 of bonuses and similar benefits for members of the Armed Forces who receive
			 sole survivorship discharge</header>
			<subsection id="H5409B4CCD4574D1796B621400EA3562"><enum>(a)</enum><header>Effect of sole
			 survivorship discharge</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/37/303a">Section 303a(e)</external-xref> of title 37, United States
			 Code, is amended—</text>
				<paragraph display-inline="no-display-inline" id="HB787947A68E94F60A2008DC49B2569C0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>A
			 member</quote> and inserting <quote>(A) Except as provided in paragraph (2), a
			 member</quote>;</text>
				</paragraph><paragraph id="H6839A3D37D79476A82412CCB94124F19"><enum>(2)</enum><text>by redesignating
			 paragraph (2) as subparagraph (B) of paragraph (1); and</text>
				</paragraph><paragraph id="H51AF9721054B4E8B89D5335E00349600"><enum>(3)</enum><text>by inserting after
			 paragraph (1), as so amended, the following new paragraph (2):</text>
					<quoted-block display-inline="no-display-inline" id="H08BDEAE6FDF2499AA8CD9CC12B7D7FA4" style="OLC">
						<paragraph id="H1AFE1B2924E04F35B29D5F3098BBB82" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H818D6AA54BAD48A79EBA8C864D26C65F"><enum>(A)</enum><text display-inline="yes-display-inline">If a member of the uniformed services
				receives a sole survivorship discharge, the Secretary concerned—</text>
								<clause id="H612CA9A91E0A4199AD1F3B2BC9B5584C" indent="up1"><enum>(i)</enum><text>shall not require repayment by the
				member of the unearned portion of any bonus, incentive pay, or similar benefit
				previously paid to the member; and</text>
								</clause><clause id="HE903A8E4B0014428AC53A07734E34828" indent="up1"><enum>(ii)</enum><text>may grant an exception to the
				requirement to terminate the payment of any unpaid amounts of a bonus,
				incentive pay, or similar benefit if the Secretary concerned determines that
				termination of the payment of the unpaid amounts would be contrary to a
				personnel policy or management objective, would be against equity and good
				conscience, or would be contrary to the best interests of the United
				States.</text>
								</clause></subparagraph><subparagraph id="H22927BF3DEAE499200030066AB738E3E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In this paragraph, the term <term>sole
				survivorship discharge</term> means the separation of a member from the Armed
				Forces, at the request of the member, pursuant to the Department of Defense
				policy permitting the early separation of a member who is the only surviving
				child in a family in which—</text>
								<clause id="H40DE4994F0D14AC4BEA672C971063599"><enum>(i)</enum><text>the father or mother or one or more
				siblings—</text>
									<subclause id="H1B69EEB632974EEDA28EFFDDA7E561CA"><enum>(I)</enum><text>served in the Armed Forces;
				and</text>
									</subclause><subclause id="H26C068EE3B5A4266B2DFE8A13858D6B5"><enum>(II)</enum><text display-inline="yes-display-inline">was killed, died as a result of wounds,
				accident, or disease, is in a captured or missing in action status, or is
				permanently 100 percent disabled or hospitalized on a continuing basis (and is
				not employed gainfully because of the disability or hospitalization);
				and</text>
									</subclause></clause><clause id="HB60C7B6CF4F84E0892FB6E6DAA8E06F0"><enum>(ii)</enum><text display-inline="yes-display-inline">the death, status, or disability did not
				result from the intentional misconduct or willful neglect of the parent or
				sibling and was not incurred during a period of unauthorized
				absence.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9E89D7418D614EF2B439C1908100074D"><enum>(b)</enum><header>Sense of
			 congress</header><text display-inline="yes-display-inline">In light of the
			 extraordinary discretion granted to the Secretary of a military department by
			 statute and policy to continue to pay the unpaid amounts of a bonus, incentive
			 pay, or similar benefit otherwise due to a member of the Armed Forces under the
			 jurisdiction of the Secretary who receives a sole survivorship discharge, it is
			 the sense of Congress that the Secretaries of the military departments should
			 aggressively use such discretion to the benefit of members receiving a sole
			 survivorship discharge.</text>
			</subsection></section><section id="HC11562694DD64647833283BCF4BE422"><enum>3.</enum><header>Availability of
			 separation pay for members of the Armed Forces with less than six years of
			 active service who receive sole survivorship discharge</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/1174">Section 1174</external-xref> of title 10, United States
			 Code, is amended—</text>
			<paragraph id="H882D90A04B854A84B33DAEDE456D537B"><enum>(1)</enum><text>by redesignating
			 subsection (i) as subsection (j); and</text>
			</paragraph><paragraph id="H407BCA929D8044D39C67AB1160E0468D"><enum>(2)</enum><text>by inserting after
			 subsection (h) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H358FCF31CD7642639F0020FBBB1E0166" style="OLC">
					<subsection id="H117C858E58EA45F781D15CCE1FA8E0DE"><enum>(i)</enum><header>Special rule for
				members receiving sole survivorship discharge</header><paragraph commented="no" display-inline="yes-display-inline" id="HFAF52696C4DA4C12A75510A3168D52BF"><enum>(1)</enum><text display-inline="yes-display-inline">A member of the Armed Forces who receives a
				sole survivorship discharge shall be entitled to separation pay under this
				section even though the member has completed less than six years of active
				service immediately before that discharge. Subsection (e) shall not apply to a
				member who receives a sole survivorship discharge.</text>
						</paragraph><paragraph id="H63A240234CF74EA7BA498BC03C227043" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The amount of the separation pay to be paid
				to a member pursuant to this subsection shall be based on the years of active
				service actually completed by the member before the member’s sole survivorship
				discharge.</text>
						</paragraph><paragraph id="H392C3DBCB3BD49189200A9E9962BA21B" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>sole
				survivorship discharge</term> means the separation of a member from the Armed
				Forces, at the request of the member, pursuant to the Department of Defense
				policy permitting the early separation of a member who is the only surviving
				child in a family in which—</text>
							<subparagraph id="H0F12ECDFF6644A56AFF6B9B0885F7167"><enum>(A)</enum><text>the father or mother or one or more
				siblings—</text>
								<clause id="H396B95F1CC394BB487552592C7BDC405"><enum>(i)</enum><text>served in the Armed Forces;
				and</text>
								</clause><clause id="H4F49769F554C45AAB74FC66E7867174B"><enum>(ii)</enum><text display-inline="yes-display-inline">was killed, died as a result of wounds,
				accident, or disease, is in a captured or missing in action status, or is
				permanently 100 percent disabled or hospitalized on a continuing basis (and is
				not employed gainfully because of the disability or hospitalization);
				and</text>
								</clause></subparagraph><subparagraph id="H4AD0BB5A490A41C8AEE0F0500F30044"><enum>(B)</enum><text display-inline="yes-display-inline">the death, status, or disability did not
				result from the intentional misconduct or willful neglect of the parent or
				sibling and was not incurred during a period of unauthorized
				absence.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB15DFB409BC744C0A090B58F473FCFA5"><enum>4.</enum><header>Transitional
			 health care for members of the Armed Forces who receive sole survivorship
			 discharge</header><text display-inline="no-display-inline">Section 1145(a)(2)
			 of title 10, United States Code, is amended by adding at the end the following
			 new subparagraph:</text>
			<quoted-block display-inline="no-display-inline" id="H4BE7D8243D5144FD9BA34F87B2AA6001" style="OLC">
				<subparagraph id="HDB7E20096CB842D58F265EEE39B37BAE" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">A
				member who receives a sole survivorship discharge (as defined in section
				1174(i) of this
				title).</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF9583C9B8A9040778FDDF3815B00631C"><enum>5.</enum><header>Transitional
			 commissary and exchange benefits for members of the Armed Forces who receive
			 sole survivorship discharge</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/1146">Section 1146</external-xref> of title 10, United States
			 Code, is amended—</text>
			<paragraph id="H6D210F62768D416792DD757DA480D019"><enum>(1)</enum><text>by striking
			 <quote>The Secretary of Defense</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB2E8AC856F894A80A50011E8AEF864FB" style="OLC">
					<subsection id="HECBF431F4D484D4D91CB66B43D1380E5"><enum>(a)</enum><header>Benefits for
				members involuntarily separated</header><text display-inline="yes-display-inline">The Secretary of
				Defense</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HCDC00611C9E1446E88F9486701A54DE6"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HB1AA95CD57DC47CDA0DF9BAFC5C8FB5" style="OLC">
					<subsection id="HB5A8FE2F12F04AD6A5DB757091E2FC6E"><enum>(b)</enum><header>Benefits for
				members receiving sole survivorship discharge</header><text display-inline="yes-display-inline">A member of the Armed Forces who receives a
				sole survivorship discharge (as defined in section 1174(i) of this title) is
				entitled to continue to use commissary and exchange stores and morale, welfare,
				and recreational facilities in the same manner as a member on active duty
				during the two-year period beginning on the later of the following
				dates:</text>
						<paragraph id="H65F512DEECBE4E69BC76C790E6D22434"><enum>(1)</enum><text>The date of the
				separation of the member.</text>
						</paragraph><paragraph id="H3C44854CA0404D8193C500626FDA31DD"><enum>(2)</enum><text display-inline="yes-display-inline">The date on which the member is first
				notified of the members entitlement to benefits under this
				section.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H19FED7D6A37F4AE7BED9FD0CCFDDDC"><enum>6.</enum><header>Veterans benefits
			 for members of the Armed Forces who receive sole survivorship
			 discharge</header>
			<subsection id="H7DDF61F5593F4657ADDB7CFFA7AB2BEB"><enum>(a)</enum><header>Housing loan
			 benefits</header><text display-inline="yes-display-inline">Section 3702(a)(2)
			 of title 38, United States Code, is amended by adding at the end the following
			 new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H552F51B815FC4B52B0B9ABE262E8374B" style="USC">
					<subparagraph id="HD4E238195A574AF8BBD6494000820CB" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">Each veteran who was discharged or released
				from a period of active duty of 90 days or more by reason of a sole
				survivorship discharge (as that term is defined in section 1174(i) of title
				10).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE6BC5D0DFBC84324BF7CF42D00668D2D"><enum>(b)</enum><header>Employment and
			 training</header><text>Section 4211(4) of such title is amended—</text>
				<paragraph id="H2373102DDFAD461C91AD26BA139C794F"><enum>(1)</enum><text>in subparagraph
			 (B), by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="H076ECD903F864299868573964600EF8"><enum>(2)</enum><text>in
			 subparagraph (C), by striking the period at the end and inserting <quote>;
			 or</quote>; and</text>
				</paragraph><paragraph id="H1C952A3876EB47989B9B60F9161C9F23"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HDCC3F4F4BDB049BF829CD239B93096F8" style="USC">
						<subparagraph id="H87BF4505F0C74960001FAA232B6BA1"><enum>(D)</enum><text display-inline="yes-display-inline">was discharged or released from active duty
				by reason of a sole survivorship discharge (as that term is defined in section
				1174(i) of title
				10).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE9F0479456AA4125A405F924097FE11F"><enum>(c)</enum><header>Existing basic
			 educational assistance</header>
				<paragraph id="H03BFB509353147758B7E62546C400280"><enum>(1)</enum><header>Service on
			 active duty</header><text>Section 3011(a)(1) of such title is amended—</text>
					<subparagraph id="HC060944C8ECB4A609FB0088F888EC7"><enum>(A)</enum><text>in subparagraph
			 (A)(ii), by inserting after <quote>service-connected disability,</quote> the
			 following: <quote>by reason of a sole survivorship discharge (as that term is
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/10/1174">section 1174(i)</external-xref> of title 10),</quote>;</text>
					</subparagraph><subparagraph id="H52769F48204742ECBA10F6DE2ED3AA4B"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii), by inserting after
			 <quote>service-connected disability,</quote> the following: <quote>by reason of
			 a sole survivorship discharge (as that term is defined in section 1174(i) of
			 title 10),</quote>; and</text>
					</subparagraph><subparagraph id="H8CA91F9EA5E54791B9BE514D8D46B200"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (C)(iii)(II), by inserting
			 after <quote>service-connected disability,</quote> the following: <quote>by
			 reason of a sole survivorship discharge (as that term is defined in section
			 1174(i) of title 10),</quote>.</text>
					</subparagraph></paragraph><paragraph id="HDF039C3B7BFC46AE88006977273B24E"><enum>(2)</enum><header>Service in the
			 Selected Reserve</header><text>Section 3012(b)(1) of such title is
			 amended—</text>
					<subparagraph id="H34F5D0FDC625476EBC69370000DEDAC3"><enum>(A)</enum><text>in subparagraph
			 (A)—</text>
						<clause id="HC0A872EFAF0D4742BC3E007234505665"><enum>(i)</enum><text>by
			 striking <quote>, or (vi)</quote> and inserting <quote>, (vi)</quote>;
			 and</text>
						</clause><clause id="HB29477FD15EF4EB0B465111C3EAAB7D3"><enum>(ii)</enum><text>by
			 inserting before the period at the end the following: <quote>, or (vii) by
			 reason of a sole survivorship discharge (as that term is defined in section
			 1174(i) of title 10)</quote>; and</text>
						</clause></subparagraph><subparagraph id="H26CD34AA270B4089A3939DDCF8819C1C"><enum>(B)</enum><text>in subparagraph
			 (B)—</text>
						<clause id="HCE533F5620A542FB93AB06A42B9C9C00"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (i), by inserting after
			 <quote>service-connected disability,</quote> the following: <quote>by reason of
			 a sole survivorship discharge (as that term is defined in section 1174(i) of
			 title 10),</quote>; and</text>
						</clause><clause id="H8B203F8481EB4CFB993511DF98E4EF50"><enum>(ii)</enum><text>in
			 clause (ii)—</text>
							<subclause id="HCD7F5F3A428347B281D35E9D54823636"><enum>(I)</enum><text>by striking

							</subclause><subclause id="HBB594D19C0E84F678D00D0AE394DCF6"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting before the period at the end
			 the following: <quote>, or (VII) by reason of a sole survivorship discharge (as
			 that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/10/1174">section 1174(i)</external-xref> of title 10)</quote>.</text>
							</subclause></clause></subparagraph></paragraph></subsection></section><section id="H4ED968B6EBFD4C6FBDBED32D14B433C9"><enum>7.</enum><header>Unemployment
			 compensation for members of the Armed Forces who receive sole survivorship
			 discharge</header><text display-inline="no-display-inline">Section
			 8521(a)(1)(B)(ii)(III) of title 5, United States Code, is amended by striking
			 <quote>hardship,</quote> and inserting <quote>hardship (including pursuant to a
			 sole survivorship discharge, as that term is defined in section 1174(i) of
			 title 10),</quote>.</text>
		</section><section id="H6653E5805C7F4CF7B441807BCA517623"><enum>8.</enum><header>Preference-eligible
			 status for members of the Armed Forces who receive sole survivorship
			 discharge</header><text display-inline="no-display-inline">Section 2108(3) of
			 title 5, United States Code, is amended—</text>
			<paragraph id="HEEE496F42339424A930085A9F3C75EDD"><enum>(1)</enum><text>in subparagraph
			 (F), by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="H16A3541E9B6B47069C106E6F2DDC175C"><enum>(2)</enum><text>in subparagraph
			 (G), by inserting <quote>and</quote> at the end; and</text>
			</paragraph><paragraph id="HB9F36149CE6348659BB7A82541C48BB"><enum>(3)</enum><text>by
			 inserting after subparagraph (G) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H21B15EA7E5B04101AAB1D18B628B914E" style="USC">
					<subparagraph id="HCB84C69C26A342D8B607053F9E2BDCDA"><enum>(H)</enum><text display-inline="yes-display-inline">a veteran who was discharged or released
				from a period of active duty by reason of a sole survivorship discharge (as
				that term is defined in section 1174(i) of title
				10);</text>

			</paragraph></section><section display-inline="no-display-inline" id="HBABE5DD79065441AA945B684E6B2AC7C" section-type="subsequent-section"><enum>9.</enum><header>Repeal of dollar
			 limitation on contributions to funeral trusts</header>
			<subsection id="H1E7CEA1215454FE4A853CA96C510C4D0"><enum>(a)</enum><header>In
			 general</header><text>Subsection (c) of section 685 of the Internal Revenue
			 Code of 1986 (relating to treatment of funeral trusts) is repealed.</text>
			</subsection><subsection id="HF00D2B27BA974E26B44BFAA8023EF369"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Subsections (d), (e), and (f) of such section are
			 redesignated as subsections (c), (d), and (e), respectively.</text>
			</subsection><subsection id="H26301C9BCF6F4BBE88E185B315E83400"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
			</subsection></section><section id="H7874B74C6B084A7BBC2B1D05001281CF"><enum>10.</enum><header>Effective
			 dates</header>
			<subsection id="H65C3B62E5A24403F888104D24DD20074"><enum>(a)</enum><header>Retroactive
			 effective date</header><text display-inline="yes-display-inline">Except as
			 provided in subsection (b) and section 9, this Act and the amendments made by
			 this Act shall apply with respect to any sole survivorship discharge granted
			 after September 11, 2001.</text>
			</subsection><subsection id="HE22FA8ABE4F54C939361BA1205825C92"><enum>(b)</enum><header>Date of
			 enactment effective date for certain amendments</header><text display-inline="yes-display-inline">The amendments made by sections 4, 7, and 8
			 shall apply with respect to any sole survivorship discharge granted after the
			 date of the enactment of this Act.</text>
			</subsection><subsection id="HA6D232D46D30401FBF00139DD5869415"><enum>(c)</enum><header>Sole
			 survivorship discharge defined</header><text display-inline="yes-display-inline">In this section, the term <term>sole
			 survivorship discharge</term> means the separation of a member from the Armed
			 Forces, at the request of the member, pursuant to the Department of Defense
			 policy permitting the early separation of a member who is the only surviving
			 child in a family in which—</text>
				<paragraph id="H8418E054C4C64C37836CBE5FEEF42C60"><enum>(1)</enum><text>the father or
			 mother or one or more siblings—</text>
					<subparagraph id="HCF197F00E4F546D5B1B8FA93E03E47A8"><enum>(A)</enum><text>served in the
			 Armed Forces; and</text>
					</subparagraph><subparagraph id="HF157DE5B8A584BB787E1007D9353D01B"><enum>(B)</enum><text display-inline="yes-display-inline">was killed, died as a result of wounds,
			 accident, or disease, is in a captured or missing in action status, or is
			 permanently 100 percent disabled or hospitalized on a continuing basis (and is
			 not employed gainfully because of the disability or hospitalization);
			 and</text>
					</subparagraph></paragraph><paragraph id="HE9D730F478014640A1305F565D178B7E"><enum>(2)</enum><text display-inline="yes-display-inline">the death, status, or disability did not
			 result from the intentional misconduct or willful neglect of the parent or
			 sibling and was not incurred during a period of unauthorized absence.</text>
				</paragraph></subsection></section></legis-body>
