<official-title>To create an Office of Domestic Product Promotion within the Department of Commerce to promote the sale of United States products.</official-title>

<section id="H524B76687B6E4B9FA901A491C5F503FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Office of Domestic Product Promotion Act</short-title></quote>.</text></section> 
<section id="HFFEFFD8A1D43444C98809D15E2F02782"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="HAF80E1246A09403CADE07D22EE3F8CF0"><enum>(1)</enum><text display-inline="yes-display-inline">In 2007, the United States trade deficit for goods reached $815 billion.</text></paragraph> 
<paragraph id="H7EC302C8387A48D6BB7B03E5C9BFB22E"><enum>(2)</enum><text>In March 2005, manufacturing employment in the United States fell to 14.3 million. This number is lower than it was in 1945, when the population of the United States was more than 50 percent less.</text></paragraph> 
<paragraph id="H61D77845A5DC450B80698B8CA500B84B"><enum>(3)</enum><text>In 2006, United States manufacturing’s share of the Gross Domestic Product was approximately half what it was in 1950.</text></paragraph> 
<paragraph id="H161131C38CED49AC975F04EBF7044EFD"><enum>(4)</enum><text>The earnings of United States manufacturing workers exceed the earnings of workers in the service and other sectors.</text></paragraph> 
<paragraph id="HCA111D7E02D541369CD055595B90FA06"><enum>(5)</enum><text>Each United States manufacturing job creates as many as four related jobs.</text></paragraph> 
<paragraph id="H69929CF05A3C4071B17BB3F9BBF0584E"><enum>(6)</enum><text>The promotion of domestically produced goods is beneficial for United States workers and the United States economy.</text></paragraph></section> 
<section id="H8FA18A9E05FA4F82B2CBC178DEA913AB"><enum>3.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act the term <term>domestic product</term> means a product—</text> 
<paragraph id="HA4344513BCC747D4AAF377CC25C644F1"><enum>(1)</enum><text display-inline="yes-display-inline">that is manufactured or produced in the United States; and</text></paragraph> 
<paragraph id="H66DE67418BF848A1BF20B133CA8F2100"><enum>(2)</enum><text display-inline="yes-display-inline">at least 65 percent of the cost of the articles, materials, or supplies of which are grown, mined, produced, or manufactured in the United States.</text> </paragraph></section> 
<section id="H81EDB42626D44DA3848DF5BB3856E266"><enum>4.</enum><header>Office of Domestic Product Promotion</header> 
<subsection id="HA770D496506E418BAB3C84BA30DFE708"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is hereby established within the Department of Commerce an Office of Domestic Product Promotion (hereinafter referred to in this Act as the <quote>Office</quote>).</text></subsection> 
<subsection id="H5DD9FA7C93E844CCA633C8BAC2A7246D"><enum>(b)</enum><header>Duties</header><text>The Office shall—</text> 
<paragraph id="H7599D06F6E3B423D962FCAB22D95DD38"><enum>(1)</enum><text>work with United States businesses to promote domestic products;</text></paragraph> 
<paragraph id="HE9E85BF89B744E098BC227534EEA4176"><enum>(2)</enum><text display-inline="yes-display-inline">provide information and advice to United States businesses on benefits and incentives available to United States businesses for producing domestic products, including the award of Federal procurement contracts and Federal and State tax benefits;</text> </paragraph> 
<paragraph id="H40635D873B31424592006C88D1FA5E55"><enum>(3)</enum><text display-inline="yes-display-inline">establish a comprehensive database of businesses that use, sell, or would prefer to use or sell, domestic products, and make the information in such database available to the public, including on a website that a user can sort and search by the State, county, city, or congressional district of a business, as well as by product type;</text></paragraph> 
<paragraph id="H55F585A98DE3463495CFD81B51911474"><enum>(4)</enum><text display-inline="yes-display-inline">develop, with input from private businesses, non-profit businesses, labor organizations, academic institutions, and other entities, tools and ideas on how to promote domestic products; and</text></paragraph> 
<paragraph id="HD051FA71883C4B628E64198DC6C94727"><enum>(5)</enum><text>coordinate with State governments to further the Office’s performance of its duties.</text></paragraph></subsection></section> 
<section id="H7D776DADDAA247BC83CAE250210970B6"><enum>5.</enum><header>Composition of the Office</header> 
<subsection id="H2E3456FE7F464951A9058DA44687C03"><enum>(a)</enum><header>National Director</header> 
<paragraph id="H0E000659254C4DD680C2FB629EA32581"><enum>(1)</enum><header>Selection</header><text>The Office shall be headed by a National Director, who shall be appointed by the President, by and with the advice of the Senate.</text></paragraph> 
<paragraph id="H244E60558964440EAAE878AC7DE27614"><enum>(2)</enum><header>Term</header><text>The National Director shall serve a term of 5 years. A National Director whose term has expired may continue to serve until the date on which a successor takes office.</text></paragraph> 
<paragraph id="HAB7420BA619640EAA261D1665E0354AE"><enum>(3)</enum><header>Compensation</header><text>The National Director shall be compensated at the rate provided for level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="HB412B5BAC6F444F9B2B6D5DB64BE2F1"><enum>(b)</enum><header>Staff</header><text display-inline="yes-display-inline">The National Director shall appoint, terminate, and fix the compensation of such employees of the Office as the National Director considers necessary to carry out the functions of the Office, except that no rate of pay fixed under this subsection may exceed the equivalent of the rate provided for level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text></subsection></section> 
<section id="H75352432FA634FDFB04B87075B55AA18"><enum>6.</enum><header>Regional Offices</header> 
<subsection id="H765D0E12E7944D309587FB00377342C7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Office shall have six regional offices, each headed by a regional director, and one regional office shall be located within each of the following six regions:</text> 
<paragraph id="HB2928BDA3850498985E66171AC80D725"><enum>(1)</enum><text>Region 1, consisting of Ohio, Pennsylvania, Michigan, Indiana, Illinois, Kentucky, and West Virginia.</text></paragraph> 
<paragraph id="HF95263C534164ECDB4505D7E00816400"><enum>(2)</enum><text display-inline="yes-display-inline">Region 2, consisting of the District of Columbia, Maine, New Hampshire, Vermont, Massachusetts, Rhode Island, Connecticut, New York, New Jersey, Delaware, and Maryland.</text></paragraph> 
<paragraph id="HBA9B6854DF2942D8A22B2C9822F5237D"><enum>(3)</enum><text display-inline="yes-display-inline">Region 3, consisting of Virginia, North Carolina, South Carolina, Tennessee, Georgia, Florida, Alabama, Mississippi, Louisiana, and Arkansas.</text></paragraph> 
<paragraph id="H598CFB26BF354EE68E29A356D4CCE89"><enum>(4)</enum><text display-inline="yes-display-inline">Region 4, consisting of California, Oregon, Washington, Idaho, Montana, Wyoming, Alaska, and Hawaii.</text></paragraph> 
<paragraph id="H832E5CA47C6441AD82125887834BAA6"><enum>(5)</enum><text display-inline="yes-display-inline">Region 5, consisting of Iowa, Missouri, North Dakota, South Dakota, Nebraska, Kansas, Oklahoma, Minnesota, and Wisconsin.</text></paragraph> 
<paragraph id="HA1A49D360F4441BBA37B9D440041EA05"><enum>(6)</enum><text display-inline="yes-display-inline">Region 6, consisting of Texas, Nevada, New Mexico, Arizona, Utah, and Colorado.</text></paragraph></subsection> 
<subsection id="H361157FA355C4CB5891067247966FBD"><enum>(b)</enum><header>Duties</header><text>The regional offices shall—</text> 
<paragraph id="HB6313DF0FAF24663A27500DC099C211C"><enum>(1)</enum><text>support the Office in performing the Office’s duties; and</text></paragraph> 
<paragraph id="H6DA8CC2D9BCE4AD1A47F7254ABFCEC4C"><enum>(2)</enum><text>concentrate on issues affecting the promotion of domestic products produced in the region in which the regional office is located.</text></paragraph></subsection> 
<subsection id="H5C6D9475F6C946779D2CD287815FEB52"><enum>(c)</enum><header>Regional director and staff</header> 
<paragraph id="H1982AAD1809047E693BE07A53446DCBC"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The National Director shall appoint, terminate, and fix the compensation of each regional director, except that no rate of pay fixed under this paragraph may exceed the equivalent of the rate provided for level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H8BA79F3B10CF42458F5F804021226995"><enum>(2)</enum><header>Qualifications</header><text>Each regional director shall have knowledge of the domestic products produced in the region in which the regional office is located and region-specific issues related to the promotion of the region’s domestic products.</text></paragraph> 
<paragraph id="H553F0418D14543F98290DA115957214C"><enum>(3)</enum><header>Regional office staff</header><text display-inline="yes-display-inline">Each regional director shall, with the approval of the National Director, appoint, terminate, and fix the compensation of such additional employees of the regional office as the regional director considers necessary to carry out the functions of the regional office, except that no rate of pay fixed under this paragraph may exceed the equivalent of the rate provided for level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text> </paragraph></subsection> 
<subsection id="H493F0DFC50AE48CD8C589C7E00425F8E"><enum>(d)</enum><header>Regional Conventions</header><text>Each regional office shall hold an annual convention to help connect United States businesses producing domestic products with consumers who want to work with domestic products, address domestic product production issues, and generate ideas on how to promote domestic products.</text></subsection></section> 
<section id="HB59EFE06FDF94BC1ABE93F97B4EF1F44"><enum>7.</enum><header>Reports to the President and the Congress</header><text display-inline="no-display-inline">The National Director and the Secretary of Commerce shall submit an annual report to the President and the Congress on the operation of the Office, including recommendations on strategies for promoting domestic products.</text></section> 
<section id="H2042FEE434F84663A96B6065CC97765D"><enum>8.</enum><header>Authorization of appropriation</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section>
