		  Directory of New Hires in enforcing sex offender registration

		<section id="H03B51F3965224F32A84BC2BC09806184" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Tracking Registered And Convicted
			 Known (TRACK) Sex Offenders Act</short-title></quote>.</text>
		</section><section id="H111368907D914DF58CD922A6BABFBE41" section-type="subsequent-section"><enum>2.</enum><header>Use of information in
			 the National Directory of New Hires in enforcing sex offender registration
			 laws</header><text display-inline="no-display-inline">Section 453(j) of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(j)</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H83EFE850BAF74BC3B066ADB682A45B4F" style="OLC">
				<paragraph id="HBCE46DCB898846E99EBA6D013D3B7BAF"><enum>(11)</enum><header>Information
				comparisons and disclosure to assist in enforcing sex offender registration
				laws</header>
					<subparagraph id="HA405E8C99D13414488D2B7BC1BD2EF4"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">If, for purposes of
				enforcing a Federal or State law requiring the registration of sex offenders,
				the Federal Bureau of Investigations (FBI) transmits to the Secretary the names
				and social security account numbers of individuals, the Secretary shall
				disclose to the FBI information on the individuals and their employers
				maintained in the National Directory of New Hires, subject to this paragraph,
				and the FBI is authorized to disclose this information to state or local law
				enforcement agencies for the same purposes.</text>
					</subparagraph><subparagraph id="H33752E03457143A4A51ED62DDB480A"><enum>(B)</enum><header>Condition on
				disclosure by the secretary</header><text display-inline="yes-display-inline">The Secretary shall make a disclosure under
				subparagraph (A) only to the extent that the Secretary determines that the
				disclosure would not interfere with the effective operation of the program
				under this part.</text>
					</subparagraph><subparagraph id="HDDFC3F6705274EBA93665C2BB8F520D4"><enum>(C)</enum><header>Use and
				disclosure of information by the Federal Bureau of Investigations</header>
						<clause id="H80BACB692EE24361BFEF645CE5EDBBCF"><enum>(i)</enum><header>In
				general</header><text>The FBI may not use or disclose information provided
				under this paragraph except for the purposes described in subparagraph
				(A).</text>
						</clause><clause id="H439786535CA3469ABBC1BB9E238FA00"><enum>(ii)</enum><header>Information
				security</header><text>The FBI shall have in effect data security and control
				policies that the Secretary finds adequate to ensure the security of
				information obtained under this paragraph and to ensure that access to the
				information is restricted to authorized persons for purposes of authorized uses
				and disclosures.</text>
						</clause><clause id="HCD53F66A730E45298FF0F4933877BCC"><enum>(iii)</enum><header>Penalty for
				misuse of information</header><text>An officer or employee of the FBI who fails
				to comply with this subparagraph shall be subject to the sanctions under
				subsection (l)(2).</text>
						</clause></subparagraph><subparagraph id="HA623AB652C1E478AA373E36F91076CD0"><enum>(D)</enum><header>Procedural
				requirements</header><text>The FBI shall adhere to uniform procedures
				established by the Secretary governing information requests and data matching
				under this paragraph.</text>
					</subparagraph><subparagraph id="H44C1BEFCC2BE489696BAC5F6EC129D60"><enum>(E)</enum><header>Reimbursement of
				costs</header><text>The FBI shall reimburse the Secretary, in accordance with
				subsection (k)(3), for the costs incurred by the Secretary in furnishing the
				information requested under this
				paragraph.</text>
