		<official-title>To reauthorize and amend the National Marine Sanctuaries
		  Act to establish a National Marine Sanctuary System, to strengthen and clarify
		  management authorities, and for other purposes.</official-title>

		<section id="HA1E9A9C1467A4D9EA0AC574BF2C75F35" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sanctuary Enhancement Act of
			 2008</short-title></quote>.</text>
		</section><section id="H80FE93885C754E64853B664F1B3CE259"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to such section or other provision of the National
			 Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431 et seq.</external-xref>).</text>
		</section><section id="HE5EB9376438F4E8393B67E0069C1627E"><enum>3.</enum><header>Clarification of
			 findings, purposes, and policies</header>
			<subsection id="H6ECA74A80A0E4A818EF21D7BF05CD673"><enum>(a)</enum><header>Findings</header><text>Section
			 301(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431(a)</external-xref>) is amended—</text>
				<paragraph id="H37DDC99773B54F7DB49385004CD338D5"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (5) and (6), respectively, and by
			 inserting after paragraph (2) the following:</text>
					<quoted-block id="HB4C364D08375491EBE0027F26FB61374" style="OLC">
						<paragraph id="H13D06D55536147ADB200E6B24D68B596"><enum>(3)</enum><text display-inline="yes-display-inline">the marine environment consists of numerous
				ecoregions and ecosystems, the boundaries of which are based on geomorphologic
				and oceanographic processes and the distribution of living and nonliving
				resources in the marine environment;</text>
						</paragraph><paragraph id="H7FFE7492D2F9417D8629B58E33EC4F10"><enum>(4)</enum><text>scientific
				research has confirmed the value of protected areas in the ocean, which serve
				to—</text>
							<subparagraph id="HB949872232EB4D3A98546100992C5FD1"><enum>(A)</enum><text>increase the
				number, biomass, density, and diversity of living resources both inside and
				outside the protected areas;</text>
							</subparagraph><subparagraph id="HB154EA6F1C1144ABABEE26A5EBF0505"><enum>(B)</enum><text>maintain ecosystems
				that are resistant and resilient to a variety of environmental threats such as
				global climate change, pollution, coastal development, habitat alteration, and
				overfishing; and</text>
							</subparagraph><subparagraph id="H32A4EFF73B8C4F2FBD69A2DFF5CE6C55"><enum>(C)</enum><text display-inline="yes-display-inline">create spillover and export of eggs,
				larvae, and juvenile and adult fish, shellfish, and plants which can repopulate
				adjacent areas;</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE9E3A236EFC543FA9BAAC6A031AF8431"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (6) (as so redesignated) by
			 striking <quote>managed</quote> and inserting <quote>and manages them, together
			 with marine national monuments,</quote>.</text>
				</paragraph></subsection><subsection id="HB85C5929CAAC49C1BD1714E673C3896"><enum>(b)</enum><header>Purposes and
			 policies</header><text>Section 301(b) (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431(b)</external-xref>) is amended to read as
			 follows:</text>
				<quoted-block id="H5AF5E1A507D14FA7B651B8883598CCCD" style="OLC">
					<subsection id="HA3360D95F1C64AEA98598264A6D401DD"><enum>(b)</enum><header>Purposes and
				policies</header><text>The purposes and policies of this title are—</text>
						<paragraph id="HD9ED359F78D245DC00C771AC6C32A39E"><enum>(1)</enum><text>to identify and
				designate as national marine sanctuaries areas of the marine environment that
				are of special national significance;</text>
						</paragraph><paragraph id="HEB7AAADC1AFC4093A9249EF736008541"><enum>(2)</enum><text>to manage the
				System with the primary purpose being the long-term protection and conservation
				of the living and nonliving resources of the System;</text>
						</paragraph><paragraph id="HFECCB0E8420D45BD95E57FDDC99A3C"><enum>(3)</enum><text display-inline="yes-display-inline">to include within the System areas that
				collectively represent the full range of the Nation’s marine ecoregions,
				ecological communities and unique habitats, and diverse maritime heritage
				resources;</text>
						</paragraph><paragraph id="HC7132C93205A40FAAC203379B3C33320"><enum>(4)</enum><text display-inline="yes-display-inline">to provide authority for comprehensive and
				coordinated protection, conservation, and adaptive management of the System,
				and the activities therein affecting the System, in a manner that supports
				ecosystem-based management and recognizes existing regulatory authorities and
				uncertainties in our scientific understanding of the marine environment;</text>
						</paragraph><paragraph id="H5F2C136ADF074B2485223E0500C5866C"><enum>(5)</enum><text>to maintain the
				natural biological communities in the national marine sanctuaries, and to
				protect, and, where appropriate, restore and recover natural habitats,
				populations, and ecological processes;</text>
						</paragraph><paragraph id="HE05F0071B1894FBCBBA03C8089C55938"><enum>(6)</enum><text>to enhance public
				awareness, understanding, appreciation, and sustainable use of the marine
				environment, and the natural, historical, cultural, and archeological resources
				of the System;</text>
						</paragraph><paragraph id="HCF415F453CBD4FC88098176CCB253C2B"><enum>(7)</enum><text>to support,
				promote, and coordinate scientific research on, and long-term monitoring of,
				the resources of the System;</text>
						</paragraph><paragraph id="HBD28952677044B4C9D944C97967B3558"><enum>(8)</enum><text display-inline="yes-display-inline">to the extent compatible with the primary
				purpose of resource protection, to allow the regulated public and private uses
				of the resources of the System that are not prohibited pursuant to this title
				or other authorities;</text>
						</paragraph><paragraph id="H26F73B37E76A4026AE9FBA92FF9BE431"><enum>(9)</enum><text>to develop and
				implement coordinated plans for the protection and management of areas in the
				System with appropriate Federal agencies, State and local governments, Indian
				tribes, Regional Fishery Management Councils, and international organizations,
				and other public and private stakeholders concerned with the continuing health
				and resilience of the System;</text>
						</paragraph><paragraph id="H2B35D0E1F60740C59B3CCE4083E95941"><enum>(10)</enum><text display-inline="yes-display-inline">to create models of, and incentives for,
				ways to conserve and manage System resources, including the application of
				adaptive or innovative management techniques, such as the utilization of zoning
				or other temporal or spatial strategies, including use of marine reserves;
				and</text>
						</paragraph><paragraph id="H71F579930FA64E43003EC798A2796BF2"><enum>(11)</enum><text>to cooperate with
				global programs encouraging conservation of marine
				resources.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H0F970315FB844050B9AA864FF323BEA5"><enum>4.</enum><header>Components and
			 mission of national marine sanctuary system</header><text display-inline="no-display-inline">Section 301(c) (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431(c)</external-xref>) is
			 amended to read as follows:</text>
			<quoted-block id="HD326621F2FA44937A29139209C47E8FC" style="OLC">
				<subsection id="H3680911D704E4342BD2100481100054C"><enum>(c)</enum><header>Establishment
				and mission of National Marine Sanctuary System</header>
					<paragraph id="H89790AF2A2864C4F9CC5BA2844CEADB5"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the National Marine
				Sanctuary System, which shall be managed by the Secretary through the Office of
				National Marine Sanctuaries and consist of—</text>
						<subparagraph id="H12DFCE121B1F4D659632381DD7D11982"><enum>(A)</enum><text>national marine
				sanctuaries designated by the Secretary in accordance with this title or
				authorized or established by an Act of Congress; and</text>
						</subparagraph><subparagraph id="H67BC9A34C4B4487F87FCC2B20F6B4B9"><enum>(B)</enum><text display-inline="yes-display-inline">marine national monuments.</text>
						</subparagraph></paragraph><paragraph id="H5376889357F8484094C94CF6B7B24E1B"><enum>(2)</enum><header>Mission</header><text>The
				mission of the System is to protect, conserve, preserve, restore, and recover
				the biodiversity, ecological integrity, and cultural legacy of the living and
				nonliving resources within the System for the benefit of present and future
				generations.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H6EA7289AE64648D7855639264D79C42B"><enum>5.</enum><header>Amendments to
			 definitions</header>
			<subsection id="H2249928A9A2B4B7AB3EDD073C876C0E3"><enum>(a)</enum><header>In
			 general</header><text>Section 302 (<external-xref legal-doc="usc" parsable-cite="usc/16/1432">16 U.S.C. 1432</external-xref>) is amended by striking
			 <quote>and</quote> after the semicolon at the end of paragraph (9), by striking
			 the period at the end of paragraph (10) and inserting a semicolon, and by
			 adding at the end the following new paragraphs:</text>
				<quoted-block id="H1E525695352B41E293B7F38919FBEA16" style="OLC">
					<paragraph id="H1A917C0DA1704BA88F9B9564C76ED4D7"><enum>(11)</enum><text><quote>Indian
				tribe</quote> has the same meaning given that term in section 4 of the Indian
				Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>);</text>
					</paragraph><paragraph id="H68B216D5111D4CD39F8E68C07D26A453"><enum>(12)</enum><text><quote>marine
				ecoregion</quote> means a large area of the marine environment that contains a
				geographically distinct assemblage of natural communities that—</text>
						<subparagraph id="H4521B9561AA641819E2EEA76A7E0274F"><enum>(A)</enum><text>share a large
				majority of their species and ecological processes;</text>
						</subparagraph><subparagraph id="HE7FDDA55CC67416D8F3C20008055942F"><enum>(B)</enum><text>share similar
				environmental conditions; and</text>
						</subparagraph><subparagraph id="H9E7993672CC1400790AB63EFA8D1524"><enum>(C)</enum><text>interact
				ecologically in ways that are critical for their long-term persistence;</text>
						</subparagraph></paragraph><paragraph id="HB203228615CD48129693C8E603F7C09"><enum>(13)</enum><text><quote>marine
				national monument</quote> means a national monument or any portion thereof
				established by the President pursuant to the Act of June 8, 1906 (chapter 3060;
				<external-xref legal-doc="usc" parsable-cite="usc/16/431">16 U.S.C. 431</external-xref>), popularly known as the Antiquities Act of 1906, that is—</text>
						<subparagraph id="HAB39B146862B43A688C6F47F36C33C1"><enum>(A)</enum><text display-inline="yes-display-inline">assigned as a management responsibility of
				the Secretary; and</text>
						</subparagraph><subparagraph id="HB3B2D9B62DEA4EEF8614B19F31199935"><enum>(B)</enum><text>managed as a unit
				within the System;</text>
						</subparagraph></paragraph><paragraph id="HC332C90904B3461CACD56AEFCFC286D"><enum>(14)</enum><text><quote>maritime
				heritage resource</quote> means any shipwreck or other site or object that is
				of archaeological, historical, or cultural significance found in, on, or under
				the seabed of the marine environment of the United States; and</text>
					</paragraph><paragraph id="H57605D004EFB4F8FB905B7E4AF7703C"><enum>(15)</enum><text><quote>System
				resource</quote> means any living or nonliving resource of the System that
				contributes to the conservation, recreational, ecological, historical,
				educational, cultural, archeological, scientific, or aesthetic value of the
				System.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAA67AE63D9E94F19B9850386D283F236"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Such section is further amended—</text>
				<paragraph id="H2EA90AFEE9864E2E8B7012F1DA09D4C6"><enum>(1)</enum><text>by striking
			 <quote>sanctuary resource</quote> each place it appears and inserting
			 <quote>System resource</quote>;</text>
				</paragraph><paragraph id="HB8788621F27F40928B95993CBE07E3A0"><enum>(2)</enum><text>by striking
			 <quote>sanctuary resources</quote> each place it appears and inserting
			 <quote>System resources</quote>; and</text>
				</paragraph><paragraph id="HA833B1101EDC46CC808D96D469B0A3D2"><enum>(3)</enum><text>in section
			 302(6)(C) (<external-xref legal-doc="usc" parsable-cite="usc/16/1432">16 U.S.C. 1432</external-xref>) by striking <quote>resources,</quote> and inserting
			 <quote>System resources;</quote>.</text>
				</paragraph></subsection></section><section id="HB285CAE0F42640A6A4E6F64D1D4F0343"><enum>6.</enum><header>Living and
			 nonliving resource classification, identification, and inventory</header><text display-inline="no-display-inline">Section 303 (<external-xref legal-doc="usc" parsable-cite="usc/16/1433">16 U.S.C. 1433</external-xref>) is amended by
			 adding at the end the following new subsections:</text>
			<quoted-block id="H11912FC38E2043FDA4E76B2FBFEEEAA3" style="OLC">
				<subsection id="H52828DE8D2F3475080F7099999C4382"><enum>(c)</enum><header>Living and
				nonliving resource classification, identification, and inventory</header>
					<paragraph id="H7576380950BB49C78C90FF3FCB7700B6"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				prepare an ecological classification of the Nation’s marine environment and an
				identification of maritime heritage resources, and maintain and update such
				classification as a national inventory of marine ecoregions and maritime
				heritage resources under the jurisdiction of the United States.</text>
					</paragraph><paragraph id="H64877D3FEE124D979F1CBF2DA4C72052"><enum>(2)</enum><header>Methodologies
				and guidelines</header><text display-inline="yes-display-inline">Within 12
				months after the date of enactment of this subsection, the Secretary, in
				consultation with other Federal agencies, coastal states, Indian tribes,
				Regional Fishery Management Councils and other regional organizations, and
				other nongovernmental scientific, professional, conservation, archaeological,
				and cultural resource organizations, and other advisors with relevant expertise
				and data as the Secretary considers necessary, shall develop and adopt
				appropriate methodologies and guidelines for the following:</text>
						<subparagraph id="H77432E84A9BE47DB91FFE0EF2B53D1"><enum>(A)</enum><header>Classification of
				ecoregions</header><text display-inline="yes-display-inline">Classification of
				specific marine ecoregions, including ecological subunits, and identification
				of nationally significant marine resources and biological communities therein,
				based upon the best available scientific information.</text>
						</subparagraph><subparagraph id="H52B10807E53F4F79AFFB7EF0C2BAC558"><enum>(B)</enum><header>Maritime
				heritage resource identification</header><text>Identification of nonliving
				submerged archaeological, historical, and cultural resources, in a manner
				that—</text>
							<clause id="H95FB51767BBF4334B586C235CBD49998"><enum>(i)</enum><text>is
				consistent with other relevant Federal and State laws and regulations and
				utilize to the greatest extent practicable existing information; and</text>
							</clause><clause id="H3AA45E1A4B574F0E82E87E05A4CA38E9"><enum>(ii)</enum><text>allows for the
				Secretary to withhold such information if the public release of such
				information could threaten or jeopardize the long-term protection,
				preservation, conservation, or stewardship of any maritime heritage
				resource.</text>
							</clause></subparagraph></paragraph><paragraph id="HD55E413D44CE4620921E268D4ED5298"><enum>(3)</enum><header>Report</header><text>Within
				three years after the date of enactment of this section, the Secretary shall
				submit a report to the Congress that includes—</text>
						<subparagraph id="H4CD7290F99424CCCB4FAAD83CCDF8224"><enum>(A)</enum><text display-inline="yes-display-inline">charts, maps, and other scientific,
				archaeological, historical, hydrographic, geographic, ecological, biological,
				oceanographic, or other information that classify or identify within the
				exclusive economic zone, in accordance with the guidelines and methodologies
				adopted under paragraph (2)—</text>
							<clause id="H52611369491D44D2AD95BB1DACB389F5"><enum>(i)</enum><text>all marine
				ecoregions; and</text>
							</clause><clause id="H15C5C99249764C7EBB75139E445E4471"><enum>(ii)</enum><text>maritime heritage
				resource areas;</text>
							</clause></subparagraph><subparagraph id="H81D285831C71418C9300EA233C00AF9E"><enum>(B)</enum><text>identification of
				areas of the marine environment of the exclusive economic zone that could not
				be classified due to a lack of scientific data necessary to meet the
				methodology and guidelines developed under paragraph (2)(A); and</text>
						</subparagraph><subparagraph id="H00F5544DC4F44D8E87DC91E274E86C48"><enum>(C)</enum><text>other relevant
				information the Secretary considers necessary to identify and describe marine
				ecoregions and marine heritage resource areas of the exclusive economic
				zone.</text>
						</subparagraph></paragraph><paragraph id="H5FB9DD0E3F1049729FE8285B640500E7"><enum>(4)</enum><header>Report
				revisions</header><text>The Secretary shall—</text>
						<subparagraph id="H24C4445E600347B59EB5EFD0EE1CDA3C"><enum>(A)</enum><text>provide for the
				regular review and reassessment of the classification methodologies and
				guidelines and identification of marine ecoregions and maritime heritage
				resource areas; and</text>
						</subparagraph><subparagraph id="HEC88B906286C45A4B2AE71C6A1F9CA0"><enum>(B)</enum><text>based upon new
				scientific information and analysis, submit to Congress revised reports as the
				Secretary determines necessary.</text>
						</subparagraph></paragraph></subsection><subsection id="HCDE98FA2E9D942C9AA7E36F96D681988"><enum>(d)</enum><header>Site selection
				report and list</header>
					<paragraph id="HE67BB73901414ED996E5B97D038BF9CB"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No later than one
				year after the date of submittal of the report required under subsection (c),
				the Secretary, in consultation with other Federal agencies, States, Indian
				tribes, Regional Fishery Management Councils, academic, scientific,
				professional or conservation, organizations, and other stakeholders, shall
				issue a report identifying discrete areas of the marine environment within the
				territorial waters of the United States that the Secretary may consider for
				potential designation as marine sanctuaries. The report shall include—</text>
						<subparagraph id="H8B57F1F8A1194FC2AE0095B500A5985D"><enum>(A)</enum><text display-inline="yes-display-inline">sites representing the spectrum of various
				classifications of marine ecoregions, subunits, biological communities, and
				habitats;</text>
						</subparagraph><subparagraph id="HA37AF2B9CAA04214B46BDCB0D85E50E1"><enum>(B)</enum><text>sites representing
				maritime heritage resource areas;</text>
						</subparagraph><subparagraph id="HFC92E91B0C28428783245753FE090021"><enum>(C)</enum><text>the best available
				scientific, archaeological, historical, and other information regarding the
				status and condition of marine resources that would benefit from designation as
				a national marine sanctuary; and</text>
						</subparagraph><subparagraph id="H5D9E1AB749E7427500CBB9455CB4400"><enum>(D)</enum><text display-inline="yes-display-inline">a site selection list that identifies and
				justifies priority sites for active consideration by the Secretary for
				designation as national marine sanctuaries pursuant to this section and section
				304.</text>
						</subparagraph></paragraph><paragraph id="H0D570912B30041B893B4875E1B826200"><enum>(2)</enum><header>Updates</header><text>The
				Secretary shall update the site selection list under paragraph (1)(D) no later
				than five years after the date of publication of the initial report required
				under this subsection and every five years thereafter.</text>
					</paragraph></subsection><subsection id="H2F365BE719CF4C1C9437A011BB5CA24"><enum>(e)</enum><header>System expansion
				goal</header><text display-inline="yes-display-inline">In order to fulfill the
				purposes of this title, the Secretary shall strive to achieve the goal of
				including in the System by 2030, that number of sites that will incorporate a
				full range of the Nation’s marine ecoregions and rare and unique marine
				habitats, and a full range of maritime heritage resource areas. The Secretary
				shall report to the Congress on progress toward this goal, with such
				explanation as may be necessary and appropriate, no later than January 15 of
				2011 and of every second year
				thereafter.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H4D300300449B44C0A98B07745F98B757"><enum>7.</enum><header>Revisions to
			 designation procedures</header>
			<subsection id="HF584B2EC26AD41EEAFFE824600AF4CA4"><enum>(a)</enum><header>Fishing
			 regulations</header><text>Section 304 (<external-xref legal-doc="usc" parsable-cite="usc/16/1434">16 U.S.C. 1434</external-xref>) is amended in subsection
			 (a) by striking paragraph (5) and inserting the following:</text>
				<quoted-block id="HB83D5B4BC4A64535AC4F056BC89D5455" style="OLC">
					<paragraph id="H20792F1A4B074DFF80D7F9DABCB7CE8C"><enum>(5)</enum><header>Fishing
				regulations</header><text display-inline="yes-display-inline">If the Secretary
				determines that it is necessary to regulate any fishing activities within a
				proposed sanctuary to meet the mission of the System and the purposes under
				this title, the Secretary shall include in the sanctuary designation documents
				under paragraph (2) regulations for such activities, that are—</text>
						<subparagraph id="H1FFBFEF5F9714E6286642ECD4CFBD4B1"><enum>(A)</enum><text>compatible with
				the purposes of the sanctuary;</text>
						</subparagraph><subparagraph id="H3804975D0F034FFBBA11372E5CA87053"><enum>(B)</enum><text>compatible with
				the mission of the System and the purposes of this title; and</text>
						</subparagraph><subparagraph id="HA1BE78DF89554931B0B2986FFA3CD870"><enum>(C)</enum><text>approved or
				prepared by the Secretary in accordance with section
				308(b).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB16AF8E6A8DA461D9F27DF7C7B03CEE7"><enum>(b)</enum><header>Deadlines</header><text>Section
			 304 (<external-xref legal-doc="usc" parsable-cite="usc/16/1434">16 U.S.C. 1434</external-xref>) is amended—</text>
				<paragraph id="HFFD6A86686C8447EB000915C83A8EB0"><enum>(1)</enum><text>in
			 subsection (a)(6), in the second sentence, by striking <quote>forty-five day

					</subparagraph></paragraph></subsection><subsection id="H3E440397AE7D490894ECDC5977634E"><enum>(e)</enum><header>Repeal of
			 limitation on designation of new national marine
			 sanctuaries</header><text>Section 304(f) (<external-xref legal-doc="usc" parsable-cite="usc/16/1434">16 U.S.C. 1434(f)</external-xref>) is
			 repealed.</text>
			</subsection></section><section id="HE6591721299A466CBB1859184664825F"><enum>8.</enum><header>International
			 negotiations</header><text display-inline="no-display-inline">Section 305(b)
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1435">16 U.S.C. 1435(b)</external-xref>) is amended by striking <quote>any national marine sanctuary
			 and to promote the purposes for which the sanctuary is established</quote> and
			 inserting <quote>any unit within the System and to promote the purposes for
			 which the unit is established. In the case of a jointly managed Marine National
			 Monument, the Secretary of State shall also consult with any other Federal or
			 non-Federal government agencies and officials that are co-trustees for such
			 Marine National Monument.</quote>.</text>
		</section><section id="H55D02C830BE647DA95F025B96DE1E95B"><enum>9.</enum><header>Clarifying
			 prohibited activities and strengthening enforcement</header>
			<subsection id="H2726120838264B5E8B009C72C2DBA189"><enum>(a)</enum><header>Prohibited
			 activities</header><text>Section 306 (<external-xref legal-doc="usc" parsable-cite="usc/16/1436">16 U.S.C. 1436</external-xref>) is amended—</text>
				<paragraph id="H4DD681FBFA664D458944E17BC74FE33"><enum>(1)</enum><text>by
			 striking paragraph (1) and inserting the following:</text>
					<quoted-block id="H6E05400F32984D8C92994539D058D38E" style="OLC">

				loss of, or injure any System resource managed under law or regulations for a

			 striking <quote>or</quote> after the semicolon at the end of paragraph (3)(C),
			 by striking the period at the end of paragraph (4) and inserting <quote>:
			 or</quote>, and by adding at the end the following:</text>

				and chumming materials resulting from, and while conducting otherwise lawful,
				fishing activities; or</text>
								</clause><clause id="HBF49E21DA8294C4C9312FA8B754DF13D"><enum>(ii)</enum><text display-inline="yes-display-inline">biodegradable effluents or materials
				incidental to vessel use and maintenance that comply with otherwise applicable
				Federal standards;</text>
								</clause></subparagraph><subparagraph id="H90407BF8B98648C58CC69172BE1795A7"><enum>(B)</enum><text>disturb or remove
				maritime heritage resources;</text>
							</subparagraph><subparagraph id="HE8E5383FCA764B2AA67CE3C924691E10"><enum>(C)</enum><text>explore for,
				lease, develop, produce, or extract mineral resources;</text>
							</subparagraph><subparagraph id="H19BBF368D3944DECA3D8DED259749000"><enum>(D)</enum><text display-inline="yes-display-inline">disturb, construct on, or alter the seabed,
				including—</text>
								<clause id="HB5E3C504B87542489E89B56B40CDDE11"><enum>(i)</enum><text>engaging in bottom
				trawling in a sanctuary designated before January 1, 2009, unless the Secretary
				has determines that such activity can be conducted in a manner that does not
				violate paragraph (1); and</text>
								</clause><clause id="HF5EAD6E20D3D4A72B1B1FFA61F824129"><enum>(ii)</enum><text>engaging in
				bottom trawling in a sanctuary designated on or after that date;</text>
								</clause></subparagraph><subparagraph id="HFF88C82C193246E2A6132633764CF05D"><enum>(E)</enum><text display-inline="yes-display-inline">release toxic or hazardous
				materials;</text>
							</subparagraph><subparagraph id="HBF4052559FFE405FB007A07C3E1E3DCD"><enum>(F)</enum><text>detonate
				explosives; or</text>
							</subparagraph><subparagraph id="HC4BD7786313947D2880017332DA9C782"><enum>(G)</enum><text>intentionally
				introduce or release non-native
				species.</text>
							</subparagraph></paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7370ACD024B741AFB092BCB596CFB16"><enum>(b)</enum><header>Strengthening
			 enforcement</header><text>Section 307 (<external-xref legal-doc="usc" parsable-cite="usc/16/1437">16 U.S.C. 1437</external-xref>) is amended—</text>
				<paragraph id="H36CB6C3798B24133B56F61EB3876AA04"><enum>(1)</enum><text>in subsection

			 regulations</header><text display-inline="no-display-inline">Section 308 (16
			 U.S.C. 1439) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H0538307E29D84C3783B9DDE9D321BFE" style="OLC">
				<section id="H5A31CCE0810E437586C539C121001520"><enum>308.</enum><header>Regulations</header>
					<subsection id="HFD36CB1DA0D542A9AC00183B1534BDCF"><enum>(a)</enum><header>In
				general</header><text>The Secretary may issue such regulations as may be
				necessary to carry out this title. Such regulations may apply to—</text>
						<paragraph id="HCD56DBEAFCA5466C87559401E61007D1"><enum>(1)</enum><text>a national marine
				sanctuary;</text>
						</paragraph><paragraph id="H88A917523EE840A5B32987A7BF00964B"><enum>(2)</enum><text>a marine national
				monument; or</text>
						</paragraph><paragraph id="H0EBDDC5DD12D4F0FBEEFD2121964DF57"><enum>(3)</enum><text>the System.</text>
						</paragraph></subsection><subsection id="H6B5930F2D63D4834BFFCD500F28E80DA"><enum>(b)</enum><header>Fishing
				regulations</header>
						<paragraph id="HAE5F96D5CC4946E9B533BDD496C4D00"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">If the Secretary
				determines that regulations for fishing activities are necessary for the
				designation of a new sanctuary or to manage fishing activities within an
				existing or proposed sanctuary or a marine national monument, if applicable
				under the terms of its designation by the President, to protect System
				resources, the Secretary shall notify and request the appropriate Regional
				Fishery Management Council (in this subsection referred to as the
				<quote>Council</quote>) to prepare such draft regulations for fishing
				activities within the boundaries (or proposed boundaries) of such sanctuary or
				monument.</text>
						</paragraph><paragraph id="H6D63902BF73042E18873B1776EF9F291"><enum>(2)</enum><header>Action by the
				council</header>
							<subparagraph id="HD6CC43310A204F74894767E9ED93831"><enum>(A)</enum><header>Council
				submission</header><text>Within the 180-day period beginning on the date of
				notification by the Secretary, the Council shall submit to the
				Secretary—</text>
								<clause id="HE6A0F4985F5B44F1BF0035D100E80AF"><enum>(i)</enum><text>draft fishing
				regulations for the proposed sanctuary or existing sanctuary or marine national
				monument; or</text>
								</clause><clause id="H75006A6DAF184CF6BDDD089BEE23B1A"><enum>(ii)</enum><text>a
				determination that regulations for fishing activities within the proposed
				sanctuary or existing sanctuary or marine national monument are not
				necessary.</text>
								</clause></subparagraph><subparagraph id="H6C08663D94D74D6D9783C679B74763AA"><enum>(B)</enum><header>Extension of
				deadline</header><text>Upon a written request by the Council, the Secretary may
				grant one extension of time for the submission under subparagraph (A), if the
				Secretary determines that exigent circumstances will prevent the Council from
				completing its work within the period referred to in that subparagraph. The
				extension shall be for a period that does not exceed 90 days.</text>
							</subparagraph><subparagraph id="HB7D25FC49BB14DA3A25C4EFAF9E47E55"><enum>(C)</enum><header>Council
				procedure and standards for preparing draft fishing regulations</header><text display-inline="yes-display-inline">In preparing draft fishing regulations
				under this section, the Council shall comply with the Secretary’s request and
				utilize established administrative procedures to prepare fishery management
				plans that are consistent and compatible with the purposes of a proposed
				national marine sanctuary designation, or the management plans for an existing
				sanctuary or marine national monuments, as applicable, the mission of the
				System, and the purposes and policies of this title.</text>
							</subparagraph></paragraph><paragraph id="H1B53069C9E2845F2A9B6556597C766AB"><enum>(3)</enum><header>Actions by the
				Secretary</header>
							<subparagraph id="H26030C42D40044F000442978D4321272"><enum>(A)</enum><header>Technical
				assistance</header><text>Upon the request of the Council, the Secretary may
				provide technical assistance to the Council to clarify and expedite procedures,
				coordinate reviews with other Federal agencies, and provide scientific and
				technical expertise.</text>
							</subparagraph><subparagraph id="HE41E8E88DA124D9190CE559871B079BB"><enum>(B)</enum><header>Review of
				council submission</header><text>Within 60 days after receiving a response from
				the Council in accordance with paragraph (2), the Secretary shall—</text>
								<clause id="HF2CA1005C9924731AEADDAA5B99F7DF4"><enum>(i)</enum><text>determine if the
				response fulfills—</text>
									<subclause id="HD857518FC8FC40A3B27FA0006100E874"><enum>(I)</enum><text>the management
				objectives of the proposed sanctuary or the existing sanctuary or marine
				national monument;</text>
									</subclause><subclause id="H456B8DDFF3F14BD3B78CB5A3FDF444CD"><enum>(II)</enum><text>the mission of
				the System; and</text>
									</subclause><subclause id="H9F327EDF937549C2821991DAFC1B14F3"><enum>(III)</enum><text>the purposes of
				this title; and</text>
									</subclause></clause><clause id="H3BE571267CCA4765AF213269BF2FBAA2"><enum>(ii)</enum><text>provide in
				writing to the Council an explanation of the factors that contributed to this
				determination.</text>
								</clause></subparagraph><subparagraph id="H4CEDE0635AAC4BBEA8406B0247211800"><enum>(C)</enum><header>Approval by the
				Secretary</header><text>If the Secretary determines that the Council’s response
				is sufficient to meet the criteria under subparagraph (A), the Secretary shall
				accept the Council’s draft fishing regulations and issue them as proposed
				regulations under this title.</text>
							</subparagraph><subparagraph id="HC05CE66C0BBC4DAD861D00DD2D8E9B40"><enum>(D)</enum><header>Disapproval by
				the Secretary</header><text display-inline="yes-display-inline">If the
				Secretary determines that the Council’s response under paragraph (2)
				insufficient to meet the criteria under subparagraph (B)(i), or if the Council
				fails to submit a response in accordance with paragraph (2), the Secretary
				shall prepare any necessary regulations for fishing activities in a proposed
				sanctuary or existing sanctuary or marine national monument under this
				title.</text>
							</subparagraph></paragraph><paragraph id="HF3650E86400B41CF8683EB9E17A6A4B9"><enum>(4)</enum><header>Amendments to
				fishing regulations</header><text>Any amendments to regulations affecting
				fishing activities within the System shall be drafted, approved, and issued in
				the same manner as the original regulations.</text>
						</paragraph><paragraph id="H52C920996FD34F74989D1BD9B4BEA00"><enum>(5)</enum><header>Cooperation and
				consultation with other fishery management entities</header><text>The Secretary
				and the Councils shall cooperate and consult with other appropriate State
				fishery management authorities and Indian tribes with rights or
				responsibilities within a proposed sanctuary or an existing sanctuary or marine
				national monument at the earliest practicable stage when drafting any fishery
				regulations under this subsection.</text>
						</paragraph></subsection><subsection id="HBAFAA751EC374A80B650DCBCFE70A11F"><enum>(c)</enum><header>Access and valid
				rights</header>
						<paragraph id="H30E7933CC40E4C0EA89B344900206409"><enum>(1)</enum><header>Preexisting
				rights</header><text>Nothing in this title shall be construed as terminating or
				granting to the Secretary the right to terminate any valid lease, permit,
				license, or right of subsistence use or access that is in existence on the date
				of designation of any sanctuary.</text>
						</paragraph><paragraph id="H3B6857105E224AC98000DCB38E68EEC8"><enum>(2)</enum><header>Exercise of
				rights</header><text display-inline="yes-display-inline">The exercise of rights
				or authorities within the System under a lease, permit, license, or right is
				subject to regulation by the Secretary consistent with the mission of the
				System and the purposes of this title.</text>
						</paragraph></subsection></section><after-quoted-block>.
				</after-quoted-block></quoted-block>
		</section><section id="HF6D3002777C74B89BF6918B1F99F3650"><enum>11.</enum><header>Research and
			 Monitoring</header>
			<subsection id="HB47E7200C4014FA7AF33F7BA319496B8"><enum>(a)</enum><header>Research and
			 monitoring, generally</header><text>Section 309(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/16/1440">16 U.S.C. 1440(b)(1)</external-xref>) is
			 amended—</text>

				results</header><text>The results of research and monitoring conducted,
				supported, or permitted by the Secretary under this subsection shall be made
				available to the public, unless such information is protected from public
				disclosure under any other provision of law or is withheld pursuant to
				subparagraph (B).</text>
						</subparagraph><subparagraph id="HFBD70E0FA047420C978184BCA5C0DE78"><enum>(B)</enum><header>Authority to
				withhold certain information</header><text>The Secretary may withhold from
				disclosure to the public information described in subparagraph (A), if the
				Secretary—</text>
							<clause id="H019863806F914066B346FBDF08F08B02"><enum>(i)</enum><text>determines that
				such disclosure to the public may result in the destruction, loss of, or injury
				to any System resource; and</text>

			 use permits and interagency cooperation</header>
			<subsection id="HF0B51DCB2A674E209E7F5600D0B33EAA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 310 (16
			 U.S.C. 1441) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H29C426BDE03A4F4580391261F3E35772" style="OLC">
					<section id="H369395D402F04511B083E4A32553CEB3"><enum>310.</enum><header>Permits</header>
						<subsection id="HD5E012556C9A42D58C6BD43B8E763CFE"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may
				allow for the conduct of activities that would otherwise be prohibited by this
				title, other than activities prohibited under subparagraph (B), (C), (E), (F),
				or (G) of section 306(5), or regulations issued under this title through, in
				accordance with such regulations, the issuance of—</text>
							<paragraph id="H0C549EE557F24A5E9F765922DF63FEA"><enum>(1)</enum><text>special use permits
				for the conduct of concession or commercial-oriented activities dependent on
				System resources; or</text>
							</paragraph><paragraph id="H0DB9304828E14433A3BF800C3250000"><enum>(2)</enum><text>general use permits
				for other activities.</text>
							</paragraph></subsection><subsection id="H74DBE8DE8890487E89ABC61CE97FF36D"><enum>(b)</enum><header>Findings
				required</header><text>The Secretary may not issue a permit under this section
				for a proposed activity unless the Secretary finds that—</text>
							<paragraph id="HB092719D856B4B06A1DCCD21C116E2"><enum>(1)</enum><text>the proposed
				activity is compatible with—</text>
								<subparagraph id="HA98447862BC94BFE96B3244DCF94B2A"><enum>(A)</enum><text display-inline="yes-display-inline">the mission of the System and the purposes
				and policies of this title; and</text>
								</subparagraph><subparagraph id="HE4A0482A77984E23BA53E94C00870003"><enum>(B)</enum><text>the purposes for
				which the applicable unit of the System was designated or established;</text>
								</subparagraph></paragraph><paragraph id="H1534ABC1A035494D96DB040071F91000"><enum>(2)</enum><text>there is no
				practicable alternative to conducting the activity within or over the
				applicable unit of the System;</text>
							</paragraph><paragraph id="HB2326743400C43B7BFCF4085464600B"><enum>(3)</enum><text>the proposed
				activity will promote sustainable public use and increase public understanding
				and appreciation of System resources; and</text>
							</paragraph><paragraph id="H8B541738E408490AAF5D992110C678CF"><enum>(4)</enum><text display-inline="yes-display-inline">the proposed activity will cause no
				negligible or irreversible harm to any System resource.</text>
							</paragraph></subsection><subsection id="H635F8CCF4EDF43B99C8D905714EF1900"><enum>(c)</enum><header>Terms and
				conditions</header><text display-inline="yes-display-inline">The Secretary
				shall impose reasonable terms and conditions on activities conducted under a
				permit issued under this section to ensure protection of System resources and
				to fulfill the mission of the System and the purposes and policies under this
				title.</text>
						</subsection><subsection id="H3F874B1D54F84E35A97656B7300E73D"><enum>(d)</enum><header>Special use
				permits</header>
							<paragraph id="H8B09FEC82E7B410BB0AA227905C3C0B6"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A special use permit
				issued under subsection (a)(1)—</text>
								<subparagraph id="HEFE763DBD9E54E0F9DB0598C3E25C3D1"><enum>(A)</enum><text>shall authorize
				the conduct of an activity only if that activity is compatible with the
				purposes for which the sanctuary or marine national monument is designated and
				with protection of sanctuary resources or System resource;</text>
								</subparagraph><subparagraph id="H9D20B58874884BF3AE7CE88BC59F1F03"><enum>(B)</enum><text>shall not
				authorize the conduct of any activity for a period of more than 5 years unless
				renewed by the Secretary;</text>
								</subparagraph><subparagraph id="HF3DF8C8CB2F349BDBE75770047F4D700"><enum>(C)</enum><text>shall require that
				activities carried out under the permit be conducted in a manner that does not
				destroy, cause the loss of, or injure sanctuary resources or System resources;
				and</text>
								</subparagraph><subparagraph id="H99DC56D85E4F405A8087FC22E5953677"><enum>(D)</enum><text>shall require the
				permittee to—</text>
									<clause id="HA3615E4F1B674BFDACAEC0A8C3F81805"><enum>(i)</enum><text>purchase and
				maintain comprehensive general liability insurance, or post an equivalent bond,
				against claims arising out of activities conducted under the permit; and</text>
									</clause><clause id="HAA99476423A7475E004CED71E19E724F"><enum>(ii)</enum><text>agree to hold the
				United States harmless against such claims.</text>
									</clause></subparagraph></paragraph><paragraph id="HDE09D23C8B184DEDBC4F7C19D55B34D2"><enum>(2)</enum><header>Terms and
				conditions</header><text display-inline="yes-display-inline">The Secretary
				shall include in a special use permit under subsection (a)(1) that authorizes
				the conduct of a specific activity such terms and conditions as the Secretary
				determines to be necessary for access to and use of any sanctuary resource or
				System resource under the permit.</text>
							</paragraph><paragraph id="H5D54C8B432B9482F8BB838975104C9F4"><enum>(3)</enum><header>Public notice
				and comment required</header><text display-inline="yes-display-inline">The
				Secretary shall provide appropriate public notice before identifying any
				category of activity subject to a special use permit under subsection (a)(1),
				and shall allow for adequate opportunity for public comment on permit
				applications.</text>
							</paragraph></subsection><subsection id="H19E6855B9C6F43ACA8F4248EFEEBCA2E"><enum>(e)</enum><header>Fees</header>
							<paragraph id="H5B236E86EE324FB9905C12E741C3B74F"><enum>(1)</enum><header>Assessment and
				collection</header><text>The Secretary may assess and collect fees for the
				conduct of any activity under a permit issued under this section.</text>
							</paragraph><paragraph id="H66445E99A4614F0983A4A81500A803BC"><enum>(2)</enum><header>Amount</header><text>The
				amount of a fee under this subsection shall be equal to the sum of—</text>
								<subparagraph id="HF59077D9BEF240F8B69492999810D22B"><enum>(A)</enum><text>costs incurred, or
				expected to be incurred, by the Secretary in issuing the permit;</text>
								</subparagraph><subparagraph id="HBFE3D1EBD915478797264BC2ADCF95E1"><enum>(B)</enum><text>costs incurred, or
				expected to be incurred, by the Secretary as a direct result of the conduct of
				the activity for which the permit is issued, including costs of monitoring the
				conduct of the activity; and</text>
								</subparagraph><subparagraph id="HD235196C54B74DCC93BA8E2523E49400"><enum>(C)</enum><text display-inline="yes-display-inline">an amount that represents the fair market
				value of the use of the System resource concerned, if applicable in the context
				of the permitted use.</text>
								</subparagraph></paragraph><paragraph id="HD3368BDD9F1149D0ADCAACC29688DCE1"><enum>(3)</enum><header>Use of
				fees</header><text>Amounts collected by the Secretary in the form of fees under
				this section shall be used by the Secretary—</text>
								<subparagraph id="H01A2566675E34A7F9D04F34F00F800E9"><enum>(A)</enum><text>for issuing and
				administering permits under this section; and</text>
								</subparagraph><subparagraph id="H7DE08257A6B44D53A9A2BD4E17298911"><enum>(B)</enum><text>for expenses of
				managing the System.</text>
								</subparagraph></paragraph><paragraph id="H8DFE81B953B642C5A609F5B2003FC651"><enum>(4)</enum><header>In-lieu
				contributions; reduction and waiver</header><text>The Secretary may accept
				in-kind contributions in lieu of a fee under paragraph (2)(C), or waive or
				reduce any fee assessed under this subsection for any activity that does not
				derive profit from the access to or use of System resources.</text>
							</paragraph></subsection><subsection id="H38731D0AEEF6454CB374C64060EC1581"><enum>(f)</enum><header>Violations</header><text>Upon
				violation of a term or condition of a permit issued under this section, the
				Secretary may—</text>
							<paragraph id="HED24662848424DB390A8B083960680CA"><enum>(1)</enum><text>suspend or revoke
				the permit without compensation to the permittee and without liability to the
				United States;</text>
							</paragraph><paragraph id="H9D0D60BD5D9E4F2D94A26ECF7D9C100"><enum>(2)</enum><text>assess a civil
				penalty in accordance with section 307; or</text>
							</paragraph><paragraph id="HB35ABF99DD3B43CBB334B98B9D09841F"><enum>(3)</enum><text>both.</text>
							</paragraph></subsection><subsection id="H1797804EF925484F94030739AE4613CC"><enum>(g)</enum><header>Reports</header><text>Each
				person issued a permit under this section shall submit an annual report to the
				Secretary not later than December 31 of each year which describes activities
				conducted under that permit and revenues, if any, derived from such activities
				during the year.</text>
						</subsection><subsection id="H0912EBF001A14DCBB0EEB8CBFAF82273"><enum>(h)</enum><header>Interagency
				cooperation</header>
							<paragraph id="HD0FF8F270EC349919055ABF0010585C"><enum>(1)</enum><header>Review of agency
				actions</header>
								<subparagraph id="H9CBA933F301A41CD94AA3F70ACC010A0"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Federal agency
				actions within or outside of a national marine sanctuary or marine national
				monument, including private or other non-Federal activities authorized by a
				Federal license, lease, or permit, that are likely to destroy, cause the loss
				of, or injure any System resource, are subject to consultation in advance with
				the Secretary in accordance with regulations issued by the Secretary.</text>
								</subparagraph><subparagraph id="H7C31CA6EDB5F4622B2A3EE25F08966B4"><enum>(B)</enum><header>Agency
				statements required</header><text>Subject to any regulations the Secretary may
				establish, the head of each Federal agency proposing an action described in
				subparagraph (A) shall provide to the Secretary a written statement describing
				the action and its potential effects on System resources at the earliest
				practicable time, but in no case later than 120 days before the final approval
				of the action unless such Federal agency and the Secretary agree to a different
				schedule.</text>
								</subparagraph></paragraph><paragraph id="H3AA888626B88419A8EF0D2931F0A7B"><enum>(2)</enum><header>Secretary’s
				recommended alternatives</header><text display-inline="yes-display-inline">If
				the Secretary finds that a Federal agency action is likely to destroy, cause
				the loss of, or injure a System resource, the Secretary shall, within 45 days
				after receiving complete information on the proposed agency action, recommend
				reasonable and prudent alternatives, that can be taken by the Federal agency in
				implementing the agency action and that will protect System resources. Such
				alternatives may include conduct of the action at a different location or
				imposition of additional restrictions as considered necessary by the
				Secretary.</text>
							</paragraph><paragraph id="H5E1B784C4437456ABEC1B1FAACE223F"><enum>(3)</enum><header>Response to
				recommendations</header><text>The head of an agency who receives the
				Secretary’s recommended alternatives under paragraph (2) shall promptly consult
				with the Secretary on the alternatives. If the agency head decides not to
				follow the alternatives, the agency head shall provide the Secretary with a
				written statement explaining the reasons for that decision.</text>
							</paragraph><paragraph id="H710E46F57C584F600066ADB3D8B4E796"><enum>(4)</enum><header>Failure to
				follow alternative</header><text>If the head of a Federal agency takes an
				action other than an alternative recommended by the Secretary and such action
				results in the destruction of, loss of, or injury to a System resource, the
				head of the agency shall promptly prevent and mitigate further damage and
				restore or replace the System resource in a manner approved by the
				Secretary.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H65670E87DFD14C0988CB53595695B5C9"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Commerce shall issue
			 regulations implementing section 310(h) of the National Marine Sanctuaries Act,
			 as amended by this section, by not later than 1 year after the date of the
			 enactment of this Act.</text>
			</subsection></section><section id="HEC44A40F7EAF422AA359CA5CA8D47D6B"><enum>13.</enum><header>Application of
			 authority to marine national monuments and within the system</header>
			<subsection id="H3D3AA874A476461C83B4404D6E00B517"><enum>(a)</enum><header>Cooperative
			 agreements, donations, and acquisitions</header><text>Section 311 (16 U.S.C.
			 1442) is amended—</text>
				<paragraph id="H35D06E84F5E74EEBBDC76200C6860979"><enum>(1)</enum><text>in subsection (c),
			 by striking <quote>designating and administering national marine
			 sanctuaries</quote> and inserting <quote>designating sanctuaries and
			 administering sanctuaries and marine national monuments</quote>; and</text>
				</paragraph><paragraph id="HD1C79105FDE94F3EB108A548F7BA5D59"><enum>(2)</enum><text>in subsection (e),
			 by striking <quote>State or other Federal agency</quote> and inserting
			 <quote>any Federal agency or instrumentality of the United States, any State,
			 local government, Indian tribe, territory or possession of the United States,
			 or any political subdivision thereof, or any foreign government or
			 international organization,</quote>.</text>
				</paragraph></subsection><subsection id="HBF7AC6811230434E9E0006261BC9A6FA"><enum>(b)</enum><header>Destruction or
			 loss of, or injury to, system resources</header><text>Section 312 (16 U.S.C.
			 1443) is amended—</text>
				<paragraph id="H829BA6CC36C54553A5CBE385D4C1E7C"><enum>(1)</enum><text>in
			 the section heading by striking <quote><header-in-text level="section" style="OLC">sanctuary resources</header-in-text></quote> and inserting
