<section id="H4A044DA7E66740BAA799DEC683F75776" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vietnam Education Foundation Amendments Act of 2008</short-title></quote>.</text></section>
<section id="H4B8531F3AD2C4488913EB0E8CAF2827D"><enum>2.</enum><header>Transfer of the Foundation to the Department of State</header>
<subsection id="H0E2A300B5DA14AA1BACB52ABD6DF9579"><enum>(a)</enum><header>In general</header><text>Section 204 of the Vietnam Education Foundation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/2452">22 U.S.C. 2452</external-xref> note) is amended to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="HDE8DBA63D5DA4C08AA1E90791C534C56" style="OLC">
<section id="HE50573AFFD764AABA5946EDF42E06685"><enum>204.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established, within the Bureau of Educational and Cultural Affairs of the Department of State, the Vietnam Education Foundation (referred to in this title as the <quote>Foundation</quote>).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H04895F2DAC604708A500DCF5FBE96443"><enum>(b)</enum><header>Replacement of Board of Directors with Advisory Committee</header><text>Section 205 of such Act is amended to read as follows:</text>

<section id="H0A47141A255D4890AB2DFC081F6D8F37"><enum>205.</enum><header>Vietnam Education Foundation Advisory Committee</header>
<subsection id="HCF6B2498D91441A598603600D4971546"><enum>(a)</enum><header>Establishment</header>
<paragraph id="HC326E44C40F647380023C1EE76DD6600"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is established a Vietnam Education Foundation Advisory Committee (referred to in this section as the <quote>Advisory Committee</quote>), which shall provide advice to the Secretary and the Assistant Secretary for Educational and Cultural Affairs regarding the Foundation’s activities.</text></paragraph>
<paragraph id="H239069991E574ACB9776E19BFB8F7FA2"><enum>(2)</enum><header>Membership</header><text>The Advisory Committee shall be composed of 7 members, of whom—</text>
<subparagraph id="H14BA82356A5B4D6F91D22EA41EFEA48F"><enum>(A)</enum><text>3 shall be appointed by the Secretary;</text></subparagraph>
<subparagraph id="H7D55DC20A0F14383A08C4400E288DC00"><enum>(B)</enum><text>1 shall be appointed by the majority leader of the Senate;</text></subparagraph>
<subparagraph id="H70A37830D5674CD28F4D32F783071558"><enum>(C)</enum><text>1 shall be appointed by the minority leader of the Senate;</text></subparagraph>
<subparagraph id="HE19FBDD6CA154FE0A9ADAB85A3D39178"><enum>(D)</enum><text>1 shall be appointed by the Speaker of the House of Representatives; and</text></subparagraph>
<subparagraph id="HB5F087EFBE2C485B919D6327D9645ECD"><enum>(E)</enum><text>1 shall be appointed by the minority leader of the House of Representatives.</text></subparagraph></paragraph>
<paragraph id="HBA25B5968BB741E59C691DA3F28C59E6"><enum>(3)</enum><header>Appointment of incumbent members of board of directors</header><text>Members appointed to the Advisory Committee under paragraph (2) may include individuals who were members of the Board of Directors of the Foundation on the date immediately preceding the date of the enactment of the <short-title>Vietnam Education Foundation Amendments Act of 2008</short-title>.</text></paragraph></subsection>
<subsection id="H9EA8D5CDEB514B988DFB8C875F638371"><enum>(b)</enum><header>Supervision</header><text display-inline="yes-display-inline">The Foundation shall be subject to the supervision and direction of the Secretary, working through the Assistant Secretary for Educational and Cultural Affairs, and in consultation with the Advisory Committee established under subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HC70337B54B5C4399A5A7BE183200E92F"><enum>(c)</enum><header>Fellowship Program</header><text>Section 206(a) of such Act is amended—</text>
<paragraph id="H135063AE692D4080B8E7D8574683C79D"><enum>(1)</enum><text>in paragraph (1)(A), by striking <quote>to study at institutions of higher education in the United States at graduate and post-graduate levels</quote> and inserting <quote>for post-secondary studies at institutions of higher education in the United States</quote>;</text></paragraph>
<paragraph id="HAE54C612310C4226BAAA3B007EEB47C2"><enum>(2)</enum><text>in paragraph (2)—</text>
<subparagraph id="H4156E379ED4047AE9111A00024B0D6DA"><enum>(A)</enum><text>by striking <quote>may include funding to improve</quote> and inserting the following:</text>
<quoted-block display-inline="yes-display-inline" id="H55E9C16636064604B76D9E73006D7050" style="OLC"><text>may include funding to—</text>
<subparagraph id="HDAD11A8A031242AD9908B674A095D384"><enum>(A)</enum><text>improve</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HEA26667C89A7419BAA9357C89DF3A7CE"><enum>(B)</enum><text>by striking the period at the end and inserting the following:</text>
<quoted-block display-inline="yes-display-inline" id="H6662D6AADD814D8495222E9F4975A355" style="OLC"><text>; and</text>
<subparagraph id="HFFA71A59212041E596368B7E61C3A8E0"><enum>(B)</enum><text>prepare the fellowship recipient for post-secondary education in any field described in paragraph (1)(A).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H8167604C486B44E79551460925C7FF79"><enum>(3)</enum><text>by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="HAE768ECED8544B3A005E61925611623F" style="OLC">
<paragraph id="H67C06B958F1E4193B097D633B1BB759D"><enum>(3)</enum><header>Priority for basic sciences</header><text>In awarding fellowships under this subsection, the Foundation shall give priority to individuals described in paragraph (1)(A) who are studying the basic sciences.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H4EB4B1016C0B462100DF12C4D3E41CE"><enum>(d)</enum><header>Conforming amendments</header><text>Such Act is amended—</text>
<paragraph id="H1C38CA4DFE2249E28D00E4F5C19624FD"><enum>(1)</enum><text>in section 203—</text>
<subparagraph id="HAD97699D52974F9BA9C227425C84C2BB"><enum>(A)</enum><text>by striking paragraph (1);</text></subparagraph>
<subparagraph id="HB12B3F172EEE427AB2306BC3BC6FAE02"><enum>(B)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (1) and (2), respectively; and</text></subparagraph>
<subparagraph id="H8BEE28187A874D8DAF003EBC29228320"><enum>(C)</enum><text>by inserting after paragraph (2), as redesignated, the following:</text>

<paragraph id="H0C3524DB453B405F94354E00168DB81B"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of State.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HDB762E687AF54DC8BC91C2E2B967533"><enum>(2)</enum><text>in section 206(e), by striking <quote>of the Board</quote> and inserting <quote>promulgated by the Secretary</quote>;</text></paragraph>
<paragraph id="H43A589AF8A964248902938E3D5BD5291"><enum>(3)</enum><text>in section 208—</text>
<subparagraph id="HA6489EF91CE44D439E9C3BE1378BDC12"><enum>(A)</enum><text>in subsection (a)—</text>
<clause id="H9A8E396FF0604E52963C2CA89EA556AC"><enum>(i)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Board</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Secretary</header-in-text></quote>; and</text></clause>

<paragraph id="H30CD6A2DD8B24D87830206C65389A8C3"><enum>(4)</enum><text>in section 209(b), by striking <quote>Board</quote> and inserting <quote>Secretary</quote>.</text></paragraph></subsection>
<subsection id="H5273E26B1B43485D91A300B36800157D"><enum>(e)</enum><header>Mutual Educational and Cultural Exchange Act of 1961</header><text>Section 112(a) of the Mutual Educational and Cultural Exchange Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2460">22 U.S.C. 2460(a)</external-xref>) is amended—</text>
<paragraph id="H4708B6D838A946F0AD00DB4DCD4F794C"><enum>(1)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></paragraph>
<paragraph id="H977EE6DFF2F84A3FAFFF5FB3B059804D"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph>
<paragraph id="H0A7968FA158345F992ED6D87E0C23218"><enum>(3)</enum><text>by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="HE87C7468602247E30023BE4D677CC647" style="OLC">
<paragraph id="HB3895CE4409F4004ABD96862A7E7CA37"><enum>(10)</enum><text>programs administered by the Vietnam Education Foundation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H8BBE22E954EE42C4AB9F1D9E30073D1E"><enum>(f)</enum><header>Transfer of functions</header><text>All functions and assets of the Vietnam Education Foundation are transferred to the Bureau of Educational and Cultural Affairs of the Department of State. The Assistant Secretary for Educational and Cultural Affairs may hire personnel who were employed by the Vietnam Education Foundation on the date before the date of the enactment of this Act, and such other personnel as may be necessary to support the Foundation, in accordance with part III of title 5, United States Code.</text></subsection></section>
<section id="H4F85056F3BC245FC80261B2CCB00415D"><enum>3.</enum><header>American Research College in Vietnam</header>
<subsection id="H5326FE2495FA4D49BBD2AADCCD34CC6D"><enum>(a)</enum><header>Grants authorized</header><text>The Secretary of State, acting through the Assistant Secretary for Educational and Cultural Affairs, is authorized to award 1 or more grants to institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)), which shall be used to participate in a partnership with the Government of the Socialist Republic of Vietnam to establish an American Research College in Vietnam. The purpose of the American Research College shall be to provide a high quality general education to Vietnamese undergraduate students.</text></subsection>
<subsection id="HA1826B87BAAA4EADB6005234267FC185"><enum>(b)</enum><header>Application</header>
<paragraph id="HAECC2C1283F84E94A108FE787B7739AA"><enum>(1)</enum><header>In general</header><text>Each institution of higher education desiring the grant under this section shall submit an application to the Secretary of State at such time, in such manner, and accompanied by such information as the Secretary may reasonably require.</text></paragraph>
<paragraph id="H1B0397DDBC2345EF83B8095C38182CEC"><enum>(2)</enum><header>Competitive basis</header><text>Each grant authorized under subsection (a) shall be awarded on a competitive basis.</text></paragraph></subsection>
<subsection id="H179CAD6D860441EC86CFFD2546F9C621"><enum>(c)</enum><header>Source of grant funds</header><text>The Secretary of State may use funds made available to the Vietnam Education Foundation under section 207(c) of the Vietnam Education Foundation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/2452">22 U.S.C. 2452</external-xref> note) for the grant awarded under this section.</text></subsection>
<subsection id="HA6559AFEEA5746088962B8B0535180D5"><enum>(d)</enum><header>Limitation</header><text>The Secretary of State shall encourage the Government of the Socialist Republic of Vietnam to make an appropriate financial or in-kind contribution to establish and maintain the college established with grant funds awarded under this section.</text></subsection></section>
<section id="H5C0DC9495BD344BD9E63BEDEA165981"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date that is 90 days after the date of the enactment of this Act.</text></section>
