<official-title>To rescind certain earmark projects under SAFETEA–LU for the purpose of eliminating the shortfall in the Highway Trust Fund, and for other purposes.</official-title>

<section id="H0BC596D7361D424CB2AFC54FBA8344E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Resist Offsetting with Additional Debt Act</short-title></quote> or the <quote>ROAD Act</quote>.</text></section> 
<section id="H4D6127018B3A41C39CEB5E7E833E9571" section-type="subsequent-section"><enum>2.</enum><header>Rescissions</header> 
<subsection id="HC08031C4375C4654AF29865F4E318FA0"><enum>(a)</enum><header>SAFETEA–LU Rescissions</header><text display-inline="yes-display-inline">Subject to subsection (b), the unobligated balances of funds made available for the following provisions of SAFETEA–LU (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>), or made available by amendments made by the following provisions of SAFETEA–LU, are hereby rescinded:</text>

<paragraph id="H65CCA44D05F34F12AEF0E1A9CBECDC62"><enum>(3)</enum><text>Section 1302 (national corridor infrastructure improvement program).</text></paragraph>

<subsection id="HF8BA0D5D908C4738AB276C1CD3D170DA"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (a) applies to the unobligated balances that are—</text> 
<paragraph id="H923C92D221874B028B16917B9D00BEEC"><enum>(1)</enum><text>available on the date of enactment of this Act; and</text></paragraph> 
<paragraph id="H5213BD857D6049C5BFC5B93AE99348"><enum>(2)</enum><text>the result of a congressional earmark.</text></paragraph></subsection> 
<subsection id="H48DCAE0DC2F94968003C57D49EC96E62"><enum>(c)</enum><header>Limitation on Recalculation of Equity Bonus Program</header> 
<paragraph id="HEC74FD38385044E18CB6D633CEA5F21D"><enum>(1)</enum><header>No recalculation</header><text>Notwithstanding any other provision of law, the amounts determined, and the amounts allocated, under <external-xref legal-doc="usc" parsable-cite="usc/23/105">section 105</external-xref> of title 23, United States Code, for a fiscal year shall not be recalculated to take into account a rescission made by this section.</text></paragraph> 
<paragraph id="HB96902AF29DE44DDAD58B91EE7A9DA43"><enum>(2)</enum><header>Obligation limitation</header><text>Any unobligated balances of obligation limitation made available for the projects rescinded by section 2 of this Act in the Consolidated Appropriations Act, 2005, the Transportation, Treasury, Housing and Urban Development, the District of Columbia, and other Independent Agencies Appropriations Act, 2006, the Department of Defense Appropriations Act, 2007, the Consolidated Appropriations Act, 2008, and any other appropriations acts, are hereby rescinded.</text></paragraph></subsection> 
<subsection id="H445C94E0229C44F8B7633C7522559459"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">The term <quote>congressional earmark</quote> has the meaning given such term in clause 9(d) of Rule XXI of the Rules of the House of Representatives, as in effect on the date of enactment of this Act.</text></subsection></section> 
<section id="HBB77F99A76624B38A088E9C84800BC5D"><enum>3.</enum><header>No transfer of funds</header><text display-inline="no-display-inline">Except as provided by <external-xref legal-doc="usc" parsable-cite="usc/26/9503">section 9503(b)</external-xref> of the Internal Revenue Code of 1986, amounts in the General Fund of the Treasury shall not be made available for the purpose of alleviating a deficit in the Highway Trust Fund. </text></section> 
<section id="H973878E865AA44C899C0246EB4F42444"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that State departments of transportation should consider implementing those projects described in <external-xref legal-doc="usc" parsable-cite="usc/23/144">section 144(g)(1)(A)</external-xref> of title 23, United States Code, and in the tables contained in sections 1301, 1302, 1702, 1934, and 3044 of the SAFETEA–LU (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>) if such projects involve improving transportation safety.</text></section>
