<paragraph id="H93B6D8022FB7447B80247048009811BD"><enum>(1)</enum><text>The United States and other members of the World Trade Organization made clear when they established the World Trade Organization that the text of the WTO agreements, and not interpretations of those agreements by the Appellate Body or any other international tribunal, establishes the rights and obligations of WTO members. The WTO members determined that <quote>in their findings and recommendations, the panel and Appellate Body cannot add to or diminish the rights and obligations</quote> in the text of an agreement. Instead, a dispute settlement panel is to make an <quote>objective assessment of the matter before it, including an objective assessment of the facts of the case and the applicability of and conformity with the relevant covered agreements</quote>.
