			 Act of 2008</short-title></quote>.</text>

			 enrollments</header>
			<subsection id="H83C2B030786240EB9E72ED4B5F65069F"><enum>(a)</enum><header>Automatic
			 enrollment of new participants</header>
				<paragraph id="H0B96CB3DD2F842EFA3DD4F51DBF526BE"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8432">Section 8432(b)</external-xref> of title 5, United States Code, is
			 amended by striking paragraphs (2) through (4) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HC0BBA104074544409B9D59582BD1E92D" style="USC">
						<paragraph id="HEEBC317BD9104FF8B1664B00B43FE816" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H09C9B93FA5C140088212E04D323B47AD"><enum>(A)</enum><text>The Board shall by
				regulation provide for new participants to be automatically enrolled to make
				contributions under subsection (a) at the default percentage of basic
				pay.</text>
							</subparagraph><subparagraph id="HFB1E7A3604DD4FE1AED8D00056C2D56" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, the
				default percentage shall be equal to 3 percent or such other percentage, not
				less than 2 percent nor more than 5 percent, as the Board may by regulation
				prescribe.</text>
							</subparagraph><subparagraph id="H2EF30A93B8B44789BAA795CB06FEB815" indent="up1"><enum>(C)</enum><text>The regulations shall include
				provisions under which any individual who would otherwise be automatically
				enrolled in accordance with subparagraph (A) may—</text>
								<clause id="H99E3E369534D4EA2A9D3A25B9983B908"><enum>(i)</enum><text>modify the percentage or amount to be
				contributed pursuant to automatic enrollment, effective from the start of such
				enrollment; or</text>
								</clause><clause id="H8EBFE07B256B42009FC379008004826E"><enum>(ii)</enum><text>decline automatic enrollment
				altogether.</text>
								</clause></subparagraph><subparagraph id="H690A7040D24C4437BD7F4DAB1F9C3336" indent="up1"><enum>(D)</enum><text>For purposes of this paragraph, the
				term <term>new participant</term> means any individual participating in the
				Thrift Savings Plan pursuant to an appointment or election which occurs after
				any regulations under subparagraph (A) first take effect.</text>
							</subparagraph><subparagraph commented="no" id="HA13A256C834A454EAFBED154DCB58124" indent="up1"><enum>(E)</enum><text>Sections 8351(a)(1), 8440a(a)(1),
				8440b(a)(1), 8440c(a)(1), 8440d(a)(1), and 8440e(a)(1) shall be applied in a
				manner consistent with the purposes of this
				paragraph.</text>
							</subparagraph></paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0BD7D0FBE0584003B0B4EF5790F7BE34"><enum>(2)</enum><header>Technical
			 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8432">Section 8432(b)(1)</external-xref> of title 5, United States Code, is
			 amended by striking the parenthetical matter in subparagraph (B).</text>
				</paragraph></subsection><subsection id="HB6E4B611FF4B4FA2AF4CA3E724902C20"><enum>(b)</enum><header>Default
			 investments</header><text display-inline="yes-display-inline">Section
			 8438(c)(2) of title 5, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HBDE1BF3C8B6A42A2B39B586CE275EF51" style="USC">
					<paragraph id="HB36A4A64607B4F9AAB55DB02FFEEBDB" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If an election has not been made with
				respect to any sums in the Thrift Savings Fund which are available for
				investment, the Executive Director shall invest such sums in—</text>
						<subparagraph id="H087AAC671B314D04BA6079428F88D6C9"><enum>(A)</enum><text>the Government Securities Investment
				Fund; or</text>
						</subparagraph><subparagraph id="HBB5F1CBE236141969F756D8FB100D782"><enum>(B)</enum><text display-inline="yes-display-inline">such alternative fund or funds (in lieu of
				the fund under subparagraph (A)) as the Board may designate in regulations.</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">The
				designation of an alternative fund by regulations under subparagraph (B) may be
				made only if, in the judgment of the Board, such designation would be in the
				best interests of participants. Any decision under the preceding sentence shall
				be made after consultation with the Employee Thrift Advisory Council
				(established under section
				8473).</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HC289527F09AD4637A88F8326C048318C" section-type="subsequent-section"><enum>3.</enum><header>Qualified Roth
			 contribution program</header>
			<subsection id="H92EB4F99FCA44A45B7291095F99917D8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter III of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, is amended by inserting after
			 section 8432c the following:</text>
				<quoted-block display-inline="no-display-inline" id="H683A44A560904C50AF7DC18D47B629DA" style="USC">
					<section id="H66081A939C0B4A0884FB2514EBCA1D00"><enum>8432d.</enum><header>Qualified
				Roth contribution program</header>
						<subsection id="H143CD97B0A2441D6B49B00F170B03EA0"><enum>(a)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="HF8E5E4465E314A30BCB496842D3D728B"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>qualified Roth contribution
				program</term> means a program described in paragraph (1) of section 402A(b) of
				the Internal Revenue Code of 1986 which meets the requirements of paragraph (2)
				of such section; and</text>
							</paragraph><paragraph id="H2D87CDCB28514E1ABA767DB514B37B92"><enum>(2)</enum><text display-inline="yes-display-inline">the terms <term>designated Roth
				contribution</term> and <term>elective deferral</term> have the meanings given
				such terms in <external-xref legal-doc="usc" parsable-cite="usc/26/402A">section 402A</external-xref> of the Internal Revenue Code of 1986.</text>
							</paragraph></subsection><subsection id="H3E6FF25FA69141A78F2702A092067C60"><enum>(b)</enum><header>Authority To
				establish</header><text>The Board shall by regulation provide for the inclusion
				in the Thrift Savings Plan of a qualified Roth contribution program, under such
				terms and conditions as the Board may prescribe.</text>
						</subsection><subsection id="H6D9981152998466B9FF8F05064947F5E"><enum>(c)</enum><header>Required
				provisions</header><text>The regulations under subsection (b) shall
				include—</text>
							<paragraph id="H5F372D04C9F346348D98BAE7C89E002E"><enum>(1)</enum><text>provisions under
				which an election to make designated Roth contributions may be made—</text>
								<subparagraph id="HEA73447B74D44CFC9871D537AC621E3B"><enum>(A)</enum><text>by any individual
				who is eligible to make contributions under section 8351, 8432(a), 8440a,
				8440b, 8440c, 8440d, or 8440e; and</text>
								</subparagraph><subparagraph id="H9F1679DB25314CE0B3BDADCB00165CDF"><enum>(B)</enum><text>by any individual,
				not described in subparagraph (A), who is otherwise eligible to make elective
				deferrals under the Thrift Savings Plan;</text>
								</subparagraph></paragraph><paragraph id="HB51E11A9E437433F9BDB00BCF2CCFDCA"><enum>(2)</enum><text display-inline="yes-display-inline">any provisions which may, as a result of
				the enactment of this section, be necessary in order to clarify the meaning of
				any reference to an <quote>account</quote> made in section 8432(f), 8433,
				8434(d), 8435, 8437, or any other provision of law; and</text>
							</paragraph><paragraph id="H364716437A9840F5BE7184A587EB90"><enum>(3)</enum><text display-inline="yes-display-inline">any other provisions which may be necessary
				to carry out this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8B6B1B9A9DCD4F46B54E036C2E6335A9"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States
			 Code, is amended by inserting after the item relating to section 8432c the
			 following:</text>
				<toc regeneration="no-regeneration">
					<toc-entry level="section"><quote>8432d. Qualified Roth contribution
				program.</quote>.</toc-entry>
				</toc>
			</subsection></section><section commented="no" id="H76046CD9F1A64DADB3E1F361EC0095B9"><enum>4.</enum><header>Authority to
			 establish self-directed investment options</header>
			<subsection commented="no" id="H2411E9838C184DB2B4D19BBE88891E1B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8438(b)(1) of
			 title 5, United States Code, is amended—</text>
				<paragraph commented="no" id="H18EAE3E97BF141C6A9FC18B3342C166B"><enum>(1)</enum><text>in subparagraph
			 (D), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" id="HBFA08DF916BE41549233AB28169F5101"><enum>(2)</enum><text>in subparagraph
			 (E), by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph commented="no" id="HEDBF0B0397E34D1AB84848D6A9658DEA"><enum>(3)</enum><text>by adding after
			 subparagraph (E) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HDEC9B1994B744E0CAAC2B2A2CC5BAC69" style="USC">
						<subparagraph commented="no" id="HD1B0BD20EB98402CAFCEAA84BBEC4"><enum>(F)</enum><text display-inline="yes-display-inline">self-directed investment options, if the
				Board authorizes such options under paragraph
				(5).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H0F0BF5EB548941F5BD2C688237D51189"><enum>(b)</enum><header>Requirements</header><text>Section
			 8438(b) of title 5, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HF775CE67B9234074A3883C00CEFFBF9C" style="USC">
					<paragraph commented="no" id="HCF19B62B3766440BB3B93F74FE971121" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7F27BC68013A4A0FBE027B6B23B62C16"><enum>(A)</enum><text display-inline="yes-display-inline">The Board may authorize the addition of
				self-directed investment options under the Thrift Savings Plan if the Board
				determines that the addition of such options would be in the best interests of
				participants.</text>
						</subparagraph><subparagraph id="H9AB3BF08924C44CF8BFDA62D0FB77B9" indent="up1"><enum>(B)</enum><text>The self-directed investment options
				shall be limited to—</text>
							<clause id="H7F52AD6E9E1F4D809316D8691714F00"><enum>(i)</enum><text>low-cost, passively-managed index
				funds that offer diversification benefits; and</text>
							</clause><clause id="HCCEA51C6B89B49AC9508FFB4CBBF7E59"><enum>(ii)</enum><text>other investment options, if the
				Board determines the options to be appropriate retirement investment vehicles
				for participants.</text>
							</clause></subparagraph><subparagraph id="H6AEF1513347B403D96AA8979D2FFF645" indent="up1"><enum>(C)</enum><text>The Board shall ensure that any
				administrative expenses related to self-directed investment options are borne
				solely by the participants who use such options.</text>
						</subparagraph><subparagraph id="H5EDF5CD2FD7F4FEE9ED07B33F54D320" indent="up1"><enum>(D)</enum><text>The Board may establish such other
				terms and conditions for self-directed investment options as the Board
				considers appropriate to protect the interests of participants, including
				requirements relating to risk disclosure.</text>
						</subparagraph><subparagraph id="H71B1FE77CCC64A48AB97A7D39095D27" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">The Board shall consult with the Employee
				Thrift Advisory Council (established under section 8473) before establishing
				any self-directed investment
				option.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H0A103F7AAF664682BC99B5E645007EC0"><enum>5.</enum><header>Reporting
			 requirements</header>
			<subsection id="HF1F62D8579DC4C099411C38004F6027"><enum>(a)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">The Board shall, not
			 later than March 31 of each year, submit to Congress an annual report on the
			 operations of the Thrift Savings Plan. Such report shall include, for the prior
			 calendar year, information on the number of participants as of the last day of
			 such prior calendar year, the median balance in participants’ accounts as of
			 such last day, demographic information on participants, the percentage
			 allocation of amounts among investment funds or options, the status of the
			 development and implementation of self-directed investment options, and such
			 other information as the Board considers appropriate. A copy of each annual
			 report under this subsection shall be made available to the public through an
			 Internet website.</text>
			</subsection><subsection id="H1D68F15D80664D258367D441B26EA612"><enum>(b)</enum><header>Reporting of
			 fees and other information</header>
				<paragraph id="HAA71B5D9F4764E7CB7D539C830100A3"><enum>(1)</enum><header>In
			 general</header><text>The Board shall include in the periodic statements
			 provided to participants under section 8439(c) the amount of the investment
			 management fees, administrative expenses, and any other fees or expenses paid
			 with respect to each investment fund and option under the Thrift Savings Plan.
			 Any such statement shall also provide—</text>
					<subparagraph id="H6148A1E32ED2433190E6B7BE497E041"><enum>(A)</enum><text>information on the
			 employee’s estimated income replacement rate, as determined by the Executive
			 Director based on the employee’s most recent account balance and rates of
			 contributions; and</text>
					</subparagraph><subparagraph id="HC5D75628CB0745E0B0C1266AE543700"><enum>(B)</enum><text>a statement
			 notifying participants as to how they may access the annual report described in
			 subsection (a) as well as any other information concerning the Thrift Savings
			 Plan that might be useful.</text>
					</subparagraph></paragraph><paragraph id="H21D35AD5917B49A5A750E71D0188009C"><enum>(2)</enum><header>Use of
			 estimates</header><text>For purposes of providing the information required
			 under this subsection, the Executive Director may provide a reasonable and
			 representative estimate of any fees or expenses described in paragraph (1) and
			 shall indicate any such estimate as being such an estimate. Any such estimate
			 shall be based on the previous year’s experience.</text>
				</paragraph></subsection><subsection commented="no" id="H11D172EDB56C4E1E953CA9A7A226A827"><enum>(c)</enum><header>Definitions</header><text>For
			 purposes of this section—</text>
				<paragraph commented="no" id="HEF0E14D6332041CC8028DF861B16CB53"><enum>(1)</enum><text>the term
			 <term>Board</term> has the meaning given such term by 8401(5) of title 5,
			 United States Code;</text>
				</paragraph><paragraph commented="no" id="H836406A1DF5F4C86B2E433000800C844"><enum>(2)</enum><text>the term
			 <term>participant</term> has the meaning given such term by section 8471(3) of
			 title 5, United States Code; and</text>
				</paragraph><paragraph commented="no" id="HE63B76B045744339A3005220AE00F507"><enum>(3)</enum><text>the term
			 <term>account</term> means an account established under section 8439 of title
			 5, United States Code.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="HCDD3BB334D484C448488A77FF3A8359" section-type="subsequent-section"><enum>6.</enum><header>Acknowledgement of
			 risk</header>
			<subsection id="H89C9E9F224E04002A74199C605D31523"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8439(d) of
			 title 5, United States Code, is amended—</text>
				<paragraph id="H87B920DCE54044D6A769F01607ADF276"><enum>(1)</enum><text>by striking the
			 matter after <quote>who elects to invest in</quote> and before <quote>shall
			 sign an acknowledgement</quote> and inserting <quote>any investment fund or
			 option under this chapter, other than the Government Securities Investment
			 Fund,</quote>; and</text>
				</paragraph><paragraph id="HFF681E0E014445DE88AFA30099C7281E"><enum>(2)</enum><text>by striking
			 <quote>either such Fund</quote> and inserting <quote>any such fund or
			 option</quote>.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HA2C36E4F2E5243A9962F6E6F66D03873"><enum>(b)</enum><header>Coordination
			 with provisions relating to investments in the absence of an
			 election</header><text>Subsection (d) of <external-xref legal-doc="usc" parsable-cite="usc/5/8439">section 8439</external-xref> of title 5, United States
			 Code (as amended by subsection (a)) is further amended—</text>
				<paragraph id="H959114DDCE214CE5B83FFB7952532F"><enum>(1)</enum><text>by
			 redesignating subsection (d) as subsection (d)(1); and</text>
				</paragraph><paragraph id="H9F6CE87F91DE400995AF79A040F97743"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8F0CB25A30E843FB8D7EC9E5EEE841D" style="USC">
						<paragraph commented="no" id="H282F29222CBF4893BB5984E7C01F0400" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HFCB4179BE79E4F7CA5A319A9F93B174D"><enum>(A)</enum><text>In the case of an
				investment made under section 8438(c)(2) in any fund or option to which
				paragraph (1) would otherwise apply, the participant involved shall, for
				purposes of this subsection, be deemed—</text>
								<clause commented="no" id="H7417C41624E24B9B9D8708A26D7FF737" indent="up1"><enum>(i)</enum><text>to have elected to invest in such fund
				or option; and</text>
								</clause><clause commented="no" id="HE3C0DEFD2CE64E85BC7C47932C73BEC" indent="up1"><enum>(ii)</enum><text>to have executed the acknowledgement
				required under paragraph (1).</text>
								</clause></subparagraph><subparagraph id="H11CF774FF7094EBFA7BB4245B97F5060" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H4FDE3277689D4F94A6EBCF34A45968B7"><enum>(i)</enum><text>The Executive Director
				shall prescribe regulations under which written notice shall be provided to a
				participant whenever an investment is made under section 8438(c)(2)(B) on
				behalf of such particpant in the absence of an affirmative election described
				in section 8438(c)(1).</text>
								</clause><clause id="HFB7C8FDD7F0049998708394794346388" indent="up1"><enum>(ii)</enum><text>The regulations shall ensure that
				any such notice shall be provided to the participant within 7 calendar days
				after the effective date of the default election.</text>
								</clause></subparagraph><subparagraph id="H00443807F9424ED88FF5A3EF135D52E2" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<term>participant</term> has the meaning given such term by section
				8471(3).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H2FF59601DDEE456FAB10283698B57707"><enum>(c)</enum><header>Coordination
			 with provisions relating to fiduciary responsibilities, liabilities, and
			 penalties</header><text>Section 8477(e)(1)(C) is amended—</text>
				<paragraph id="H0C2504C49AF14FFA88FA1F1B00E12B1F"><enum>(1)</enum><text>by redesignating
			 subparagraph (C) as subparagraph (C)(i); and</text>
				</paragraph><paragraph id="H8BB4B2C7F65E4203947BB422C017A7AF"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB36FA4FFA3E14C4F9700ED2213C00CB" style="USC">
						<clause id="H03AE6CB0A9EF4C3DA7D95822D3F13190" indent="up3"><enum>(ii)</enum><text display-inline="yes-display-inline">A fiduciary shall not be liable under
				subparagraph (A), and no civil action may be brought against a
