		<official-title>To prohibit the manufacture, marketing, sale, or shipment
		  in interstate commerce of products designed to assist in defrauding a drug
		  test.</official-title>

		<section id="HD4EF8D0A91B84B79A1D449B2F17B0362" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Drug Testing Integrity Act of
			 2008</short-title></quote>.</text>
		</section><section id="H5AF72CF50B1146AA9F52B9009474522C"><enum>2.</enum><header>Ban of products
			 designed to defraud drug tests</header>
			<subsection id="H3198FE444CB84BCABF88D0D8F9113200"><enum>(a)</enum><header>Conduct
			 prohibited</header><text display-inline="yes-display-inline">It shall be
			 unlawful to knowingly manufacture, market, sell, ship, or otherwise provide to
			 another individual any product with the intent to assist such other individual
			 to use such product to defraud a drug test.</text>
			</subsection><subsection id="H633B4E7D7EDE4F19B25D39690053F2C"><enum>(b)</enum><header>Definition</header><text>As
			 used in this Act, the term <term>defraud a drug test</term> means—</text>
				<paragraph id="H809F7D82411D4A39B05D097D9900406B"><enum>(1)</enum><text>submit a substance
			 that purports to be from an individual other than its actual source, or
			 purports to have been excreted or collected other than when it was actually
			 excreted or collected; or</text>
				</paragraph><paragraph id="HF0F1396D9A154EC793D2B5BD459B33C7"><enum>(2)</enum><text>engage in any
			 other conduct with the intent to produce a false or misleading outcome of a
			 test for the presence of a controlled substance.</text>
				</paragraph></subsection></section><section id="H42D05AC65EAA4567AFEB62F40023ACA"><enum>3.</enum><header>Enforcement by the
			 Federal Trade Commission</header>
			<subsection id="H9132D2F17F994B8B94DA5696E84B22D6"><enum>(a)</enum><header>Unfair and
			 deceptive act or practice</header><text display-inline="yes-display-inline">A
			 violation of section 2 shall be treated as a violation of a rule defining an
			 unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the
			 Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text>
			</subsection><subsection id="H8070DE7D8D824B618BB8495995CD6162"><enum>(b)</enum><header>Enforcement
			 authority</header><text>The Federal Trade Commission shall enforce this Act in
			 the same manner, by the same means, and with the same jurisdiction as though
			 all applicable terms and provisions of the Federal Trade Commission Act were
			 incorporated into and made a part of this Act.</text>
