<official-title>To amend title II of the Social Security Act to provide that disability determinations under such title on the basis of hearings by the Commissioner of Social Security are made on a timely basis and to require the Commissioner to establish a program for monitoring each year the number of disability determinations which are in reconsideration.</official-title>

<section id="H7E39F13891DD44C1822DE37D9900CFDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Timely Due Process for the Disabled Act of 2008</short-title></quote>.</text></section> 
<section id="HCA72819F356A4A79A1001672EFE5C528"><enum>2.</enum><header>Establishment of time frames to ensure timely disability determinations</header> 
<subsection id="HCD058C7677E24613A429AFC3D543CDD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 221(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/421">42 U.S.C. 421(d)</external-xref>) is amended—</text> 
<paragraph id="HD7892639A01B414FBE8053769E9D592E"><enum>(1)</enum><text>by inserting <quote>(1)</quote> after <quote>(d)</quote>; and </text></paragraph> 
<paragraph id="HFCE96616530144DF928648718956D973"><enum>(2)</enum><text>by adding at the end the following new paragraph: </text> 
<quoted-block style="traditional" id="H018B82D8F8C144F8A99DF9DFC796F22" display-inline="no-display-inline"> 
<paragraph id="HE308866DB5B54859865F6C59BF7F91B6" indent="up1"><enum>(2) </enum><text display-inline="yes-display-inline">The Commissioner of Social Security shall ensure that—</text> 
<subparagraph id="HE0E15A7874784C68B55044EBA234DAC6"><enum>(A)</enum><text>the scheduling of the date for the hearing described in paragraph (1) occurs before the end of the period of 5 business days after the date of the request for the hearing;</text></subparagraph> 
<subparagraph id="H0096B80E8ABB44D58869833F9378E004"><enum>(B)</enum><text>the date scheduled for the hearing is during the period of 15 business days after the period of 60 business days after the date of the request; and</text></subparagraph> 
<subparagraph id="H5FC135568E9842DA800052EAC229C2E"><enum>(C)</enum><text>any disability determination on the basis of the hearing is issued before the end of the period of 15 business days after the date on which the hearing is concluded.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H747C18A641854FADB907A755AAF91B23"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="HEC27482F4EC74347BD108488E6DDEBFE"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall apply with respect to hearings under section 221(d) of the Social Security Act commenced on or after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HABBCA8779D0D4CB40042F0DB9CBE55ED"><enum>(2)</enum><header>Hearings requested prior to date of enactment</header><text display-inline="yes-display-inline">In the case of any hearing described in paragraph (1) which was requested prior to the date of the enactment of this Act—</text> 
<subparagraph id="H62774DB2FE784298B505FF01490743BF"><enum>(A)</enum><text>the requirements of subparagraph (A) of section 221(d)(2) of such Act (as added by subsection (a)) shall apply as if the date of the request for the hearing is the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph id="HBCBFCB468BCB4F1EB7EBFDC1D5F7D4FA"><enum>(B)</enum><text>the requirements of subparagraph (B) of such section 221(d)(2) shall be treated as met if the date scheduled for the hearing is during the period of 15 business days following the later of the last day of the period of 60 business days referred to in such subparagraph or the date of the enactment of this Act.</text></subparagraph> </paragraph></subsection></section> 
<section id="H5C7BB52541A14B9F9978DD71FC45CC00"><enum>3.</enum><header>Monitoring of disability determinations in reconsideration</header> <text display-inline="no-display-inline">Section 221 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/421">42 U.S.C. 421</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="traditional" id="H58B3B3ED0DF64F66BF2645BD36DC78B1" display-inline="no-display-inline"> 
<subsection id="HB4B964F9BA5B41F198BAD2448E25B38F"><enum>(n)</enum><text display-inline="yes-display-inline">The Commissioner of Social Security shall establish and maintain a program under which—</text> 
<paragraph id="H4EC4A73DD762458287F15262B222F255"><enum>(1)</enum><text>there is established a target number for disability determinations under this section which are in reconsideration at the end of each year, and</text></paragraph> 
<paragraph id="HCF7C85F0B896414BA8FBF3CC80B6A64D"><enum>(2)</enum><text>progress toward attaining that target is regularly monitored and assessed during the year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
