<official-title>To create a civil action to provide judicial remedies to carry out certain treaty obligations of the United States under the Vienna Convention on Consular Relations and the Optional Protocol to the Vienna Convention on Consular Relations.</official-title>

<section id="H3F36725238DC4ACEB2002C225CEFEBBB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Avena Case Implementation Act of 2008</short-title></quote>.</text></section> 
<section id="H8C8030F3872F451D9D684181C9B730DB"><enum>2.</enum><header>Judicial remedy</header> 
<subsection id="HA14F89E260674FBD8D61BA006663F670"><enum>(a)</enum><header>Civil action</header><text display-inline="yes-display-inline">Any person whose rights are infringed by a violation by any nonforeign governmental authority of article 36 of the Vienna Convention on Consular Relations may in a civil action obtain appropriate relief.</text></subsection> 
<subsection id="HA9AA8A004B834062007E8FE11666FDCC"><enum>(b)</enum><header>Nature of relief</header><text display-inline="yes-display-inline">Appropriate relief for the purposes of this section means—</text> 
<paragraph id="H2788B257509D4D1996376B65A2753037"><enum>(1)</enum><text>any declaratory or equitable relief necessary to secure the rights; and</text></paragraph> 
<paragraph id="H3FD033D563BE4D4EA37D77049F215DA3"><enum>(2)</enum><text>in any case where the plaintiff is convicted of a criminal offense where the violation occurs during and in relation to the investigation or prosecution of that offense, any relief required to remedy the harm done by the violation, including the vitiation of the conviction or sentence where appropriate.</text></paragraph></subsection> 
<subsection id="HDDEEE4ABA5794EDB8E65C66F759DDDCC"><enum>(c)</enum><header>Application</header><text>This Act applies with respect to violations occurring before, on, or after the date of the enactment of this Act. </text> </subsection></section>
