<official-title>To amend the Energy Policy and Conservation Act to modify the conditions for the release of products from the Northeast Home Heating Oil Reserve Account, and for other purposes.</official-title>

<section id="H8CC0FEFAC6804D60A7AAFB34145C184" section-type="section-one"><enum>1.</enum><header>Release of products from Northeast Home Heating Oil Reserve Account</header><text display-inline="no-display-inline">Section 183 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6250b">42 U.S.C. 6250b</external-xref>) is amended by striking subsection (a) and inserting the following:</text>

<subsection id="H0871A95D26C642A7B54DDDA1E478C819"><enum>(a)</enum><header>Findings</header> 
<paragraph id="H5BCCF045CA884CE800A5A36C40FD7BAC"><enum>(1)</enum><header>Optional releases</header> 
<subparagraph id="H1056658CCEE64AFFBD8EE669D5614C74"><enum>(A)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary may sell products from the Reserve only on a finding by the President that—</text> 
<clause id="H5DC6E439395049318D388C8B9FB6A400"><enum>(i)</enum><text>there is a severe energy supply interruption; or</text></clause> 
<clause id="H4E3524F0BA56454AA5F300ACD3EAD88D"><enum>(ii)</enum><text>the price of home heating oil threatens the health and safety of residents of the Northeast.</text></clause></subparagraph> 
<subparagraph id="HBD76CD7D95864A4599446201F63E1E33"><enum>(B)</enum><header>Requirement</header><text>The President may make a finding under subparagraph (A) only if the President determines that—</text> 
<clause id="H70546136B9A94E0C947D12B5164D6864"><enum>(i)</enum><text>a dislocation in the heating oil market has resulted from an interruption described in subparagraph (A)(i);</text></clause> 
<clause id="H4EB1567CEF734F2F9BECF9CE2ADD623"><enum>(ii)</enum><text>the price of home heating oil has increased by such an extent that the Northeast is experiencing, or will experience, an emergency situation that threatens the safety and health of residents of the Northeast; or</text></clause> 
<clause id="HEDAB542DFE6F40FD91C6E860A12840A"><enum>(iii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H5008428DC95F4E25935E7954291C64D"><enum>(I)</enum><text>a circumstance (other than a circumstance described in clause (i) or (ii)) exists that constitutes a regional supply shortage of significant scope and duration; and</text></subclause> 
<subclause id="H9411EC83900D4B9D86554579B6460485" indent="up1"><enum>(II)</enum><text>action taken under this section would assist directly and significantly in reducing the adverse impact of the shortage.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H30CB3DDE49EB4A55A8D7F9000CBC9BC"><enum>(2)</enum><header>Mandatory releases</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H894B0368C89C411C889023E08974FBDB"><enum>(A)</enum><header>In general</header><text>For each fiscal year, the Secretary shall sell—</text> 
<clause commented="no" display-inline="no-display-inline" id="H8287B6F5F5BA42D9A5DE78912EF49E6F"><enum>(i)</enum><text>20 percent of the quantity of products in the Reserve as of November 1 of that fiscal year, on a finding by the President that the average retail price of No. 2 heating oil in the Northeast (as reported in the retail price data of the Energy Information Administration for the Northeast) is equal to or more than $4.00 per gallon on November 1 of that fiscal year;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H6647AACA83844E8FA800793828AE576D"><enum>(ii)</enum><text>20 percent of the quantity of products in the Reserve as of November 1 of that fiscal year, on a finding by the President that the average retail price of No. 2 heating oil in the Northeast (as so reported) is equal to or more than $4.00 per gallon on December 1 of that fiscal year;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H7DF2ADEA3AEA4550A48407D1FFDB00DE"><enum>(iii)</enum><text>20 percent of the quantity of products in the Reserve as of November 1 of that fiscal year, on a finding by the President that the average retail price of No. 2 heating oil in the Northeast (as so reported) is equal to or more than $4.00 per gallon on January 1 of that fiscal year;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H99A5416E39E54B15802FA868F405715"><enum>(iv)</enum><text>20 percent of the quantity of products in the Reserve as of November 1 of that fiscal year, on a finding by the President that the average retail price of No. 2 heating oil in the Northeast (as so reported) is equal to or more than $4.00 per gallon on February 1 of that fiscal year; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H2FF2517CB9C24859A1E0628300AAC7C7"><enum>(v)</enum><text>20 percent of the quantity of products in the Reserve as of November 1 of that fiscal year, on a finding by the President that the average retail price of No. 2 heating oil in the Northeast (as so reported) is equal to or more than $4.00 per gallon on March 1 of that fiscal year.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H45B3620B43FA46C38BEF16E9BA174446"><enum>(B)</enum><header>Use of revenue</header><text>The Secretary shall use any revenue derived from the sale of products in the Reserve under subparagraph (A) as follows:</text> 
<clause id="HB6BBF0762A8A4F37812D08B6AB3B0001"><enum>(i)</enum><text>50 percent shall be used to provide assistance to low-income consumers of heating oil under the Weatherization Assistance Program for Low-Income Persons established under part A of title IV of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6861">42 U.S.C. 6861 et seq.</external-xref>).</text></clause> 
<clause id="H0885F06132C94277922B0763F800F9B"><enum>(ii)</enum><text display-inline="yes-display-inline">50 percent shall be used to provide assistance under section 2604(e) of the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8623">42 U.S.C. 8623(e)</external-xref>).</text></clause></subparagraph></paragraph>
<paragraph id="HA28D8D5B0EEB48E69885D2B0C5039531"><enum>(3)</enum><header>Maintaining level</header><text>Notwithstanding paragraphs (1) and (2), the Secretary shall ensure that, as of November 1 of each year, the Reserve contains a sufficient level of petroleum distillate to enable carrying out this part.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
