<official-title display="yes">To amend the Public Health Service Act to authorize increased Federal funding for the Organ Procurement and Transplantation Network. </official-title>

<section id="H8A3F0482E820456EBC74523BF0AC7C20" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stephanie Tubbs Jones Organ Transplant Authorization Act of 2008</short-title></quote>.</text></section>
<section commented="no" display-inline="no-display-inline" id="H76C704A7BE3D4732B2BF25E8A9079246" section-type="subsequent-section"><enum>2.</enum><header>Increased funding for the Organ Procurement and Transplantation Network</header><text display-inline="no-display-inline">Section 372(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274">42 U.S.C. 274(a)</external-xref>) is amended by striking <quote>$2,000,000</quote> and inserting <quote>$7,000,000</quote>.</text></section>
<section id="H3E36139D886741339ED03668730060C7"><enum>3.</enum><header>Report</header>
<subsection id="H9824DEBC26244B88B218088F00AC548D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall request that the Executive Director of the Organ Procurement and Transplantation Network submit to Congress, not later than 1 year after the date of enactment of this Act, a report that shall include—</text>
<paragraph id="HCB0D141A8DB44EDB9F4E9735ACDD62DA"><enum>(1)</enum><text display-inline="yes-display-inline">the identity of transplant programs that have become inactive or have closed since the heart allocation policy change of 2006;</text></paragraph>
<paragraph id="H84705B613E6143F296A72B7BBEBB5218"><enum>(2)</enum><text display-inline="yes-display-inline">the distance to the next closest operational heart transplant center from such inactivated or closed programs and an evaluation of whether or not access to care has been reduced to the population previously serviced by such inactive or closed program;</text></paragraph>
<paragraph id="H34E86182D71148B59749DFE9081E849F"><enum>(3)</enum><text display-inline="yes-display-inline">the number of patients with rural zip codes that received transplants after the heart allocation policy change of 2006 as compared with the number of such patients that received such transplants prior to such heart allocation policy change;</text></paragraph>
<paragraph id="H4C54D11BBE944678AAF07487CA67ADC1"><enum>(4)</enum><text display-inline="yes-display-inline">a comparison of the number of transplants performed, the mortality rate for individuals on the transplant waiting lists, and the post-transplant survival rate nationally and by region prior to and after the heart allocation policy change of 2006; and</text></paragraph>
<paragraph id="H302D3A4D0EAE4CF895A96D81CC537196"><enum>(5)</enum><text display-inline="yes-display-inline">specifically with respect to allosensitized patients, a comparison of the number of heart transplants performed, the mortality rate for individuals on the heart transplant waiting lists, and the post heart transplant survival rate nationally and by region prior to and after the heart allocation policy change of 2006.</text></paragraph></subsection>
<subsection id="H88D1ABDD727D4AD3A15D88D2DB00565C"><enum>(b)</enum><header>Limitation on funding</header><text>The increase provided for in the amendment made by section 2 shall not apply with respect to contracts entered into under section 372(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274">42 U.S.C. 274(a)</external-xref>) after the date that is 1 year after the date of enactment of this Act if the Executive Director of the Organ Procurement and Transplantation Network fails to submit the report under subsection (a).</text></subsection></section>
