		<section id="H9760A155535C4DBCB12CF4D80097C6C4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Great Lakes Legacy Reauthorization Act
			 of 2008</short-title></quote>.</text>
		</section><section id="H5716B5847D0F4C2AAD8461FE00FDBED"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 118(a)(3) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268(a)(3)</external-xref>) is amended—</text>
			<paragraph id="HFEF758A45BF64B42A8EE597CBC20D78F"><enum>(1)</enum><text>in subparagraph (I) by
			 striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="H2ACCF32CB83D4B6ABE2F311CBAA3FAAF"><enum>(2)</enum><text>in subparagraph (J) by
			 striking the period and inserting a semicolon; and</text>
			</paragraph><paragraph id="H856E688478934336841055AD5ECFCBAB"><enum>(3)</enum><text>by adding at the end the
			 following:</text>
				<quoted-block changed="added" committee-id="HPW00" id="H8D3B1B58E0164A6597C1C4B8EF716CE" reported-display-style="italic" style="OLC">
					<subparagraph commented="no" id="H9CE5AE78507D43E0A846AF1CCA217F78"><enum>(K)</enum><text display-inline="yes-display-inline"><quote>site characterization</quote> means
				a process for monitoring and evaluating the nature and extent of sediment
				contamination in accordance with the Environmental Protection Agency’s guidance
				for the assessment of contaminated sediment in an area of concern located
				wholly or partially within the United States; and</text>
					</subparagraph><subparagraph commented="no" id="HCF029A8CFAD7475CBC323E4BC3B6383F"><enum>(L)</enum><text><quote>potentially
				responsible party</quote> means an individual or entity that may be liable
				under any Federal or State authority that is being used or may be used to
				facilitate the cleanup and protection of the Great
				Lakes.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H96814F5A03D948BFA09689CD6BC98EAF"><enum>3.</enum><header>Remediation of sediment
			 contamination in areas of concern</header>
			<subsection id="HBD1024B3F1EA4AEBAE71A665E1F07492"><enum>(a)</enum><header>Eligible
			 projects</header><text display-inline="yes-display-inline">Section
			 118(c)(12)(B)(ii) of the Federal Water Pollution Control Act (33 U.S.C.
			 1268(c)(12)(B)(ii)) is amended by striking <quote>sediment</quote> and
			 inserting <quote>sediment, including activities to restore aquatic habitat that
			 are carried out in conjunction with a project for the remediation of
			 contaminated sediment</quote>.</text>
			</subsection><subsection id="HA8B63E7B93EB4C1B81B2C928E70693D2"><enum>(b)</enum><header>Limitations</header><text>Section
			 118(c)(12)(D) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268(c)(12)(D)</external-xref>) is amended—</text>
				<paragraph commented="no" id="H817CEF1475D24643BA00AB69EF681646"><enum>(1)</enum><text>in the subparagraph
			 heading by striking <quote><header-in-text level="subparagraph" style="OLC">Limitation</header-in-text></quote> and inserting
			 <quote><header-in-text level="subparagraph" style="OLC">Limitations</header-in-text></quote>;</text>
				</paragraph><paragraph id="HEB7B869309A5430FA8698E171833826E"><enum>(2)</enum><text>in clause (i) by striking
			 <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="H06310CC9AE99451B0000FADB952C8E47"><enum>(3)</enum><text>in clause (ii) by
			 striking the period and inserting a semicolon; and</text>
				</paragraph><paragraph id="HAAD05DDDF7F840999468F0AEA2F729BA"><enum>(4)</enum><text>by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="HPW00" id="H320116F6150C409FB3CFCB32B6E22DAE" reported-display-style="italic" style="OLC">
						<clause id="H59CD23B0CCE443D6B79B4B34E7E7BD5B"><enum>(iii)</enum><text>unless each non-Federal
				sponsor for the project has entered into a written project agreement with the
				Administrator under which the party agrees to carry out its responsibilities
				and requirements for the project; or</text>
						</clause><clause id="H51D73D76556146519BDDA1D2724F023"><enum>(iv)</enum><text>unless the Administrator
				provides assurance that the Agency has conducted a reasonable inquiry to
				identify potentially responsible parties connected with the
				site.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7844ED62D411430DBE0066E61438F71E"><enum>(c)</enum><header>In-kind
			 contributions</header><text>Section 118(c)(12)(E)(ii) of such Act (33 U.S.C.
			 1268(c)(12)(E)(ii)) is amended to read as follows:</text>

					<clause id="H044BFA72CB7243BDA767D8D404F0F293"><enum>(ii)</enum><header>In-kind
				contributions</header>
						<subclause id="H303E827BA34649B091A5A6072FA991FC"><enum>(I)</enum><header>In
				general</header><text>The non-Federal share of the cost of a project carried
				out under this paragraph may include the value of an in-kind contribution
				provided by a non-Federal sponsor.</text>
						</subclause><subclause id="H201288C01AF04FFB8D2FE6039B1177E7"><enum>(II)</enum><header>Credit</header><text>A
				project agreement described in subparagraph (D)(iii) may provide, with respect
				to a project, that the Administrator shall credit toward the non-Federal share
				of the cost of the project the value of an in-kind contribution made by the
				non-Federal sponsor, if the Administrator determines that the material or
				service provided as the in-kind contribution is integral to the project.</text>
						</subclause><subclause id="HCFDE9C3BC41A4516909CA99D87FE3475"><enum>(III)</enum><header>Work performed before
				project agreement</header><text>In any case in which a non-Federal sponsor is
				to receive credit under subclause (II) for the cost of work carried out by the
				non-Federal sponsor and such work has not been carried out by the non-Federal
				sponsor as of the date of enactment of this subclause, the Administrator and
				the non-Federal sponsor shall enter into an agreement under which the
				non-Federal sponsor shall carry out such work, and only work carried out
				following the execution of the agreement shall be eligible for credit.</text>
						</subclause><subclause id="H1138F7627BC448DA807CAC92726750FD"><enum>(IV)</enum><header>Limitation</header><text>Credit
				authorized under this clause for a project carried out under this
				paragraph—</text>
							<item id="HDB957B3CA89248BA000088AB2979755B"><enum>(aa)</enum><text>shall not exceed the
				non-Federal share of the cost of the project; and</text>
							</item><item id="H5B241FECB1E241C38CE84EA3FF5D7131"><enum>(bb)</enum><text>shall not exceed the
				actual and reasonable costs of the materials and services provided by the
				non-Federal sponsor, as determined by the Administrator.</text>
							</item></subclause><subclause id="H54771ABACC994BF39C3FB706A466BCA"><enum>(V)</enum><header>Inclusion of certain
				contributions</header><text>In this subparagraph, the term <quote>in-kind
				contribution</quote> may include the costs of planning (including data
				collection), design, construction, and materials that are provided by the
				non-Federal sponsor for implementation of a project under this
				paragraph.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8A7A2002FA224E088EB640318C7D8F9D"><enum>(d)</enum><header>Non-Federal
			 share</header><text display-inline="yes-display-inline">Section 118(c)(12)(E)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268(c)(12)(E)</external-xref>) is amended—</text>
				<paragraph id="H91285E21C3A2493A8F6669DE75C4AA92"><enum>(1)</enum><text>by redesignating clauses
			 (iii) and (iv) as clauses (iv) and (v), respectively;</text>
				</paragraph><paragraph id="HBC1748CA76AF458489DCFE2B18785A6"><enum>(2)</enum><text>by inserting after clause
			 (ii) the following:</text>
					<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H7DED9FA4A4A846D500DE8EAB2C52531" reported-display-style="italic" style="OLC">
						<clause id="HA2A794AF2BAE4E318CDE00A94DA4112F"><enum>(iii)</enum><header>Treatment of credit
				between projects</header><text display-inline="yes-display-inline">Any credit
				provided under this subparagraph towards the non-Federal share of the cost of a
				project carried out under this paragraph may be applied towards the non-Federal
				share of the cost of any other project carried out under this paragraph by the
				same non-Federal sponsor for a site within the same area of
				concern.</text>
						</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H06E97D5681E14120AAED2B53BA281C40"><enum>(3)</enum><text display-inline="yes-display-inline">in clause (iv) (as redesignated by
			 paragraph (1) of this subsection) by striking <quote>service</quote> each place
			 it appears and inserting <quote>contribution</quote>.</text>
				</paragraph></subsection><subsection id="HD5E0CFC7C95A40BABA53F8A5232337D8"><enum>(e)</enum><header>Site
			 characterization</header><text display-inline="yes-display-inline">Section
			 118(c)(12)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268(c)(12)(F)</external-xref>) is amended to read as
			 follows:</text>
				<quoted-block changed="added" committee-id="HPW00" id="H8B64E2B237484174A0B2DC3E2727D081" reported-display-style="italic" style="OLC">
					<subparagraph id="H8DD8F1DA0CF54B83AD00C1358881AA87"><enum>(F)</enum><header>Site
				characterization</header>
						<clause id="H69CA5E51FC0B497BAC5BCC705F58B487"><enum>(i)</enum><header>In
				general</header><text>The Administrator, in consultation with any affected
				State or unit of local government, shall carry out at Federal expense the site
				characterization of a project under this paragraph for the remediation of
				contaminated sediment.</text>
						</clause><clause id="HD7AD11B42699495E8BB189171C70CB00"><enum>(ii)</enum><header>Limitation</header><text>For
				purposes of clause (i), the Administrator may carry out one site assessment per
				discrete site within a project at Federal
				expense.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAB903DBCBB8E41588B3659BD10CFCBAE"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>Section 118(c)(12)(H) of such Act (33 U.S.C.
			 1268(c)(12)(H)) is amended—</text>
				<paragraph id="H1FFA4BDE114545C793FDB9BC34E0EA98"><enum>(1)</enum><text>by striking clause (i)
			 and inserting the following:</text>
					<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H170B9794CE164D5BB8578103AAD74E86" reported-display-style="italic" style="OLC">
						<clause id="H66335F87C16748078E3E456BA8E6F206"><enum>(i)</enum><header>In

				amounts authorized under this section, there is authorized to be appropriated
				to carry out this paragraph—</text>
							<subclause id="HAC2FB114389742E0BCAF33E7545797A"><enum>(I)</enum><text>$50,000,000 for each of
				fiscal years 2004 through 2008; and</text>
							</subclause><subclause id="H0255D69C64A449209999BBF862B2D7A"><enum>(II)</enum><text>$150,000,000 for each of
				fiscal years 2009 through 2013.</text>
							</subclause></clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC6543DFA30A143C7BDFF005129B11936"><enum>(2)</enum><text>by adding at the end the
			 following:</text>

				</paragraph></subsection><subsection id="H946B3594D56D4DDBAA4F96CC4890498F"><enum>(g)</enum><header>Public Information
			 Program</header><text>Section 118(c)(13)(B) of such Act (33 U.S.C.
			 1268(c)(13)(B)) is amended by striking <quote>2008</quote> and inserting
			 <quote>2013</quote>.</text>
			</subsection></section><section id="H7F8705BE5F5947FFB5D4993FE1B687DE"><enum>4.</enum><header>Research and development
			 program</header><text display-inline="no-display-inline">Section 106(b)(1) of
			 the Great Lakes Legacy Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/33/1271a">33 U.S.C. 1271a(b)(1)</external-xref>) is amended to read
			 as follows:</text>
