		<official-title>To amend titles II and XVI of the Social Security Act to
		  provide for equitable treatment of disability beneficiaries with waxing and
		  waning medical conditions by establishing, through the implementation of a
		  sliding scale of benefits based on income, a system under which higher incomes
		  result in lower benefits and lower incomes result in higher benefits, and work
		  is incentivized by allowing greater total monthly income when working than
		  could be provided by work or benefits alone.</official-title>

		<section id="H54B9523C65FD4B4885B2A826C6BB45E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Encourage Initiative and Promote
			 Self-Esteem Act of 2008</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H4D7384C3A780472485B780D9006958AF" section-type="subsequent-section"><enum>2.</enum><header>Amendments to title II
			 of the Social Security Act</header>
			<subsection id="H0701DB29D84D490DAC7EE2C8CD4993BC"><enum>(a)</enum><header>In
			 general</header><text>Section 222 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/422">42 U.S.C. 422</external-xref>) is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H9222C7DB9BC2403300E30067D46BD63" other-style="archaic" style="other">
					<subsection id="H651BA34F64A54CA5B3FE8FA001700AD"><enum>(f)</enum><header>Special rules for benefits based on waxing and waning
		  medical condition</header><paragraph commented="no" display-inline="yes-display-inline" id="H0E6B28B28D794E9C868EB162152BEA30"><enum>(1)</enum><text>In the case of any
				qualifying disabled individual—</text>
							<subparagraph id="H47B052855CCD447EA493E849304B34F2" indent="up1"><enum>(A)</enum><text>the termination month for purposes of
				section 223(a)(1) or subsection (d)(1)(G), (e)(1), or (f)(1) of section 202
				shall be, in lieu of the termination month otherwise described therein, the
				third month following the end of the individual's special entitlement
				period,</text>
							</subparagraph><subparagraph id="HE9A405EDAB444FC1A418746BF800B047" indent="up1"><enum>(B)</enum><text>the extent to which benefits of the
				individual under section 223 or subsection (d), (e), or (f) of section 202 are
				payable for any month during the individual’s special entitlement period shall
				be determined without regard to whether the individual engages in substantial
				gainful activity,</text>
							</subparagraph><subparagraph id="HF4AA51B491CF4BA8BE41BDF56041ED57" indent="up1"><enum>(C)</enum><text>the amount of the individual’s monthly
				insurance benefit payable for any month during the special entitlement period
				shall not exceed the maximum benefit payment for the month determined under
				paragraph (4), and</text>
							</subparagraph><subparagraph id="H2BE3D127E7C749A7947D8434A0A26013" indent="up1"><enum>(D)</enum><text>the Commissioner shall not undertake a
				review of such individual’s disability during any month following a month in
				which such individual performs services from which such individual earns the
				greater of $350 or the dollar amount derived for the month for purposes of this
				subparagraph under paragraph (6).</text>
							</subparagraph></paragraph><paragraph id="H1727DBF738144466A360771DBA21B3CB" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the
				term <quote>qualifying disabled individual</quote> means an individual—</text>
							<subparagraph id="H607349A799FA436ABB000264AEEF7A9"><enum>(A)</enum><text>who is entitled to disability
				insurance benefits under section 223, child’s insurance benefits under section
				202(d) based on the individual’s disability, or widow’s or widower’s insurance
				benefits under subsection (e) or (f) of section 202 based on the individual’s
				disability, and</text>
							</subparagraph><subparagraph id="H520305137E13416EA8CF5732EC9753A1"><enum>(B)</enum><text>whose disability is based (in whole or
				in part) on a waxing and waning medical condition.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H3AB5BED5364741659383F9638C3F3C00" indent="up1"><enum>(3)</enum><text>For purposes of paragraph (1), the
				special entitlement period of an individual under this subsection—</text>
							<subparagraph id="H4E8FA26E5DB04885847C70DD094B9C56"><enum>(A)</enum><text>begins with the month in which the
				individual becomes entitled to benefits described in paragraph (2)(A), and</text>
							</subparagraph><subparagraph id="H3B0589EE5E064B6E00E117B04726FC4"><enum>(B)</enum><text display-inline="yes-display-inline">ends with any month during which the
				Commissioner determines that the impairment on the basis of which such benefits
				are provided has ceased, does not exist, or is not disabling.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H69B481EDEFF54796A6F321AFA17B54A1" indent="up1"><enum>(4)</enum><text>The amount of a qualifying disabled
				individual’s benefit described in paragraph (2) which is payable for any month
				under this title commencing with or after such individual’s 7th month of
				entitlement shall not exceed the amount of such benefit otherwise payable under
				this title, reduced (to not less than zero), by <fraction>2/3</fraction> of the
				individual’s excess trial earnings amount for such month.</text>
						</paragraph><paragraph id="HD522FF6AFD4749988FB7F7BDB3B8FA89" indent="up1"><enum>(5)</enum><text>For purposes of this
				paragraph—</text>
							<subparagraph id="H8F764C4DE77F404EA53EBE31F36CDE41"><enum>(A)</enum><text>The term <quote>waxing and waning
				medical condition</quote> means, in connection with an individual, any medical
				condition which, prior to the first month of entitlement of the individual, has
				been certified to the Commissioner by a qualified physician as a condition
				which, in the case of such individual, may reasonably be expected to involve,
				in the absence of recovery, periods for which the individual will be able to
				engage in substantial gainful activity interspersed among periods for which the
				individual will not, by reason of a lack of adequate and reasonably available
				assistive technology, be able to engage in substantial gainful activity.</text>
							</subparagraph><subparagraph id="H91761BD7157A494E870000C3AFC9F6BC"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>excess trial
				earnings</quote> of an individual for any month means the excess (if any)
				of—</text>
								<clause id="HFBC4AEE31A0D4A3CA315380056D48F1F"><enum>(i)</enum><text>the average amount earned by such
				individual from services performed each month during the most recent test
				period commencing with or after the first month of the such individual’s
				special entitlement period, over</text>
								</clause><clause id="HFC5476C64960430BAF1231E207C91D34"><enum>(ii)</enum><text>the trial earnings threshold for
				such month.</text>
								</clause></subparagraph><subparagraph id="H5493639B1CC9405C951DB4DDBAB31CA3"><enum>(C)</enum><text display-inline="yes-display-inline">The term <quote>test period</quote> in
				connection with any month means the period of the first 3 calendar months of
				the period of 6 calendar months immediately preceding such month.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H96AADCA925E345F600B2CC3FD46842C1"><enum>(D)</enum><text display-inline="yes-display-inline">The term <quote>trial earnings
				threshold</quote> for a month means the greater of $670 or the product derived
				for the month for purposes of this subparagraph under paragraph (6).</text>
							</subparagraph></paragraph><paragraph id="HDBE003A8BA904448BB2707976F91F35" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">The product derived under this paragraph
				for any month for purposes of subparagraph (D) of paragraph (1) or subparagraph
				(D) of paragraph (5) is the product derived by multiplying the dollar amount
				specified in such subparagraph by the ratio of—</text>
							<subparagraph id="H45CB7B934F2D4044B89BFAEC43F9C2E"><enum>(A)</enum><text>the national average wage index (as
				defined in section 209(k)(1)) for the first of the 2 preceding calendar years,
				to</text>
							</subparagraph><subparagraph id="H933F078FA7594B25A4EE739BD31BB0CB"><enum>(B)</enum><text>the national average wage index (as so
				defined) for calendar year 2006.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">Any such
				product which is not a multiple of $10 shall be rounded to the next higher
				multiple of $10 where such product is a multiple of $5 but not of $10 and to
				the nearest multiple of $10 in any other case. The Secretary shall determine
				and publish the trial earnings threshold for each month in November of the
				preceding calendar
				year.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H86ACFF6A225B4069A7C09DC7B89DA1C9"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H07FB8C67C7E24197AAFB98BAA1EAD24"><enum>(1)</enum><header>Termination
			 month</header>
					<subparagraph id="HE6A96BDC341B4527BE2F615848E38C4F"><enum>(A)</enum><text>Section 223(a)(1)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423(a)(1)</external-xref>) is amended by inserting, after the first full
			 sentence beginning in the matter following subparagraph (E), the following new
			 sentence: <quote>The termination month of a qualifying disabled individual (as
			 defined in section 222(f)(2)) shall be determined under section
			 222(f)(1)(A).</quote>.</text>
					</subparagraph><subparagraph id="HDA5AAA132FE747078DD4C2C842354272"><enum>(B)</enum><text>Section
			 202(d)(1)(G)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(1)(G)(i)</external-xref>) is amended by striking
			 <quote>activity)</quote> and inserting <quote>activity, and, in the case of a
			 qualifying disabled individual (as defined in section 222(f)(2)), the
			 termination month shall be the month determined under section
			 222(f)(1)(A))</quote>.</text>
					</subparagraph><subparagraph id="H36795612055A43F19B57731864606D97"><enum>(C)</enum><text display-inline="yes-display-inline">Section 202(e)(1) of such Act (42 U.S.C.
			 402(e)(1)) is amended by inserting, after the first full sentence beginning in
			 the matter following subparagraph (F)(ii), the following new sentence:
			 <quote>The termination month of a qualifying disabled individual (as defined in
			 section 222(f)(2)) shall be determined under section
			 222(f)(1)(A).</quote>.</text>
					</subparagraph><subparagraph id="H0F57C794F4714457946F27FE2C2682FC"><enum>(D)</enum><text>Section 202(f)(1)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(f)(1)</external-xref>) is amended by inserting, after the first full
			 sentence beginning in the matter following subparagraph (F)(ii), the following
			 new sentence: <quote>The termination month of a qualifying disabled individual
			 (as defined in section 222(f)(2)) shall be determined under section
			 222(f)(1)(A).</quote>.</text>
					</subparagraph></paragraph><paragraph id="HD02DBD38E4024AFCA6A267287FE82E34"><enum>(2)</enum><header>Conforming
			 amendment to current rules regarding substantial gainful activity by other
			 individuals during extended periods of eligibility</header><text>Section
			 223(e)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423(e)(1)</external-xref>) is amended by striking <quote>No
			 benefit</quote> and inserting <quote>In the case of an individual other than a
			 qualifying disabled individual (as defined in section 222(f)(2)), no
			 benefit</quote>, and by striking <quote>to an individual</quote> and inserting
			 <quote>to such individual</quote>.</text>
				</paragraph></subsection><subsection id="H0EFE6FA07F904315968459AEB064CF9D"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to individuals who are entitled to disability insurance benefits under section
			 223 of the Social Security Act, child’s insurance benefits under section 202(d)
			 of such Act (based on the individual’s disability), or wife’s or husband’s
			 insurance benefits under subsection (b) or (c) of section 202 of such Act
			 (based on the individual’s disability) on or after the date of the enactment of
			 this Act and whose trial work period in connection with such entitlement has
			 not terminated as of such date.</text>
			</subsection></section><section id="HC584CD08E49C45E1BB6E93FEA9CEC92"><enum>3.</enum><header>Amendment to title
			 XVI of the Social Security Act</header>
			<subsection display-inline="no-display-inline" id="HE4BF1D8A3BF14E5484C9BBFE346D902E"><enum>(a)</enum><header>In
			 general</header><text>Section 1611 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382">42 U.S.C. 1382</external-xref>)
			 is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H0FA62E643F28412A9FC33E84CA164E00" other-style="archaic" style="other">
					<subsection id="H3EE3BCE969354C7AB82B6C92E9C137E7"><enum>(j)</enum><header>Special rules for disability benefit based on waxing and
		  waning medical condition</header><paragraph commented="no" display-inline="yes-display-inline" id="H6A2530E495A442ECBF19C07E8400589D"><enum>(1)</enum><text>In the case of any
				qualifying disabled individual—</text>
							<subparagraph id="H7AF252FB7FDB4E2386B9A5B090DEF4F8" indent="up1"><enum>(A)</enum><text>the extent to which a benefit under
				this title by reason of disability is payable with respect to the individual
				during the special entitlement period of the individual shall be determined
				without regard to whether the individual is able to engage in substantial
				gainful activity;</text>
							</subparagraph><subparagraph id="H3912A8353CFA4E1CAB397272E726001C" indent="up1"><enum>(B)</enum><text>the amount of the benefit payable for
				any month during the special entitlement period shall not exceed the maximum
				benefit payable with respect to the individual for the month, as determined
				under paragraph (4); and</text>
							</subparagraph><subparagraph id="HEF8A4B8A68CA48ABA803900300CD0019" indent="up1"><enum>(C)</enum><text>the Commissioner shall not undertake a
				review of the individual’s disability during any month following a month in
				which such individual performs services from which the individual earns the
				greater of $350 or the dollar amount derived for the month for purposes of
				section 222(f)(1)(D) under section 222(f)(6).</text>
							</subparagraph></paragraph><paragraph id="H90DA5B88AF6A4487B1F3EBCB456B453C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), the term
				<quote>qualifying disabled individual</quote> means an individual who is an
				eligible individual for purposes of this title by reason of disability, and
				whose disability is based (in whole or in part) on a waxing and waning medical
				condition.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="HB417520623BC4A1CBCB410067E63E445" indent="up1"><enum>(3)</enum><text>For purposes of paragraph (1), the
				special entitlement period of an individual—</text>
							<subparagraph id="H45283ECE89C14D7CBE548C5DF51454EE"><enum>(A)</enum><text>begins with the month in which the
				individual becomes entitled to benefits under this title by reason of
				disability; and</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H8DC3D52769B04D1BA32C23E59B1E469C"><enum>(B)</enum><text display-inline="yes-display-inline">ends with any month during which the
				Commissioner determines that the impairment on the basis of which such benefits
				are provided has ceased, does not exist, or is not disabling.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE6B16BECFCCA4A3F85197B00672984D6" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The amount of the benefit of a qualifying
				disabled individual which is payable for any month under this title commencing
				with or after the 7th month for which the individual is eligible for benefits
				under this title by reason of such disability shall not exceed the amount of
				the benefit otherwise payable under this title, reduced (to not less than zero)
				by <fraction>2/3</fraction> of the individual’s excess trial earnings amount
				for the month.</text>
						</paragraph><paragraph id="HAB09D1A4A00440B4A5D5C62500BBDA87" indent="up1"><enum>(5)</enum><text>For purposes of this
				subsection:</text>
							<subparagraph id="H802FC0498C6D431188979739C2104BB4"><enum>(A)</enum><text>The term <quote>waxing and waning
				medical condition</quote> means, in connection with an individual, any medical
				condition which, prior to the first month of eligibility of the individual for
				benefits under this title by reason of disability, has been certified to the
				Commissioner by a qualified physician as a condition which, in the case of such
				individual, may reasonably be expected to involve, in the absence of recovery,
				periods for which the individual will be able to engage in substantial gainful
				activity interspersed among periods for which the individual will not, by
				reason of a lack of adequate and reasonably available assistive technology, be
				able to engage in substantial gainful activity.</text>
							</subparagraph><subparagraph id="H444474BF86AC4E3AAE54F88092FD00DA"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>excess trial
				earnings</quote> of an individual for any month has the meaning given the term
				in section 222(f)(5)(B).</text>
							</subparagraph><subparagraph id="HC109B12235AD42468B005D7DE17381B3"><enum>(C)</enum><text display-inline="yes-display-inline">The term <quote>test period</quote> in
				connection with any month has the meaning given the term in section
				222(f)(5)(C).</text>
							</subparagraph><subparagraph id="H7F61A663882B41B2A2AC05B56C5E84D6"><enum>(D)</enum><text display-inline="yes-display-inline">The term <quote>trial earnings
				threshold</quote> for a month has the meaning given the term in section
				222(f)(5)(D).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6996FDFD0E8745DA96AC0473846D3F8F"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to benefits
			 payable for months beginning after the date of the enactment of this
			 Act.</text>
