<official-title display="yes">To amend title 38, United States Code, to prohibit the Secretary of Veterans Affairs from collecting certain copayments from veterans who are catastrophically disabled, and for other purposes.</official-title>

<section id="H6179E4D2C9824C6C92DECB647FF1E78" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans’ Health Care Policy Enhancement Act of 2008</short-title></quote>.</text></section>
<section id="HE1D4D692D3FC464B878988CAED24CE60"><enum>2.</enum><header>Prohibition on collection of certain copayments from veterans who are catastrophically disabled</header>
<subsection id="H6339FF423DD64FD096DC66B16DCD98C0"><enum>(a)</enum><header>Prohibition on collection of copayments and other fees for hospital or nursing home care</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1710">Section 1710</external-xref> of title 38, United States Code, is amended—</text>
<paragraph id="HFDB84D8EA1334CBF927268186435798F"><enum>(1)</enum><text>by redesignating subsection (h) as subsection (i); and</text></paragraph>
<paragraph id="H57BC04E02EFB41079E577E6E87A9514"><enum>(2)</enum><text>by inserting after subsection (g) the following new subsection (h):</text>

<subsection id="H305178F02530474490D200B39359F1AF"><enum>(h)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, a veteran who is catastrophically disabled shall not be required to make any payment otherwise required under subsection (f) or (g) for the receipt of hospital care or nursing home care under this section.</text></subsection>

<subsection id="H57FAD35145A44C1694F218A64C504D5D"><enum>(b)</enum><header>Effective date</header><text>Subsection (h) of <external-xref legal-doc="usc" parsable-cite="usc/38/1710">section 1710</external-xref> of title 38, United States Code, as added by subsection (a), shall apply with respect to hospital care or nursing home care provided after the date of the enactment of this Act.</text></subsection></section>
<section id="HBA51EEE0C2054B8AB13786BA94E1B3D"><enum>3.</enum><header>Expansion of authority of secretary of veterans affairs to provide counseling for family members of veterans receiving nonservice-connected treatment</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1782">Section 1782(b)</external-xref> of title 38, United States Code, is amended by striking <quote>if—</quote> and all that follows and inserting a period.</text></section>
<section id="H20AF7E39372142969800003901DB285D" section-type="subsequent-section"><enum>4.</enum><header>Comprehensive policy on pain management</header>
<subsection id="HFC3DC4E3DD194EA2AD4FDDBCA316E72F"><enum>(a)</enum><header>Comprehensive policy required</header><text display-inline="yes-display-inline">Not later than October 1, 2008, the Secretary of Veterans Affairs shall develop and implement a comprehensive policy on the management of pain experienced by veterans enrolled for health care services provided by the Department of Veterans Affairs.</text></subsection>
<subsection id="H3D9E453EB44A4D06ADE5A2A8D900F950"><enum>(b)</enum><header>Scope of policy</header><text>The policy required by subsection (a) shall cover each of the following:</text>
<paragraph id="H7E8A6489D2B8421F955F7BCE84F9656B"><enum>(1)</enum><text>The systemwide management of acute and chronic pain experienced by veterans.</text></paragraph>
<paragraph id="H911C8CA8D6164E3EB7DB19C6DE1645BE"><enum>(2)</enum><text display-inline="yes-display-inline">The standard of care for pain management to be used throughout the Department.</text></paragraph>
<paragraph id="H2601652351EC4FE0AD1B612E1504BE23"><enum>(3)</enum><text display-inline="yes-display-inline">The consistent application of pain assessments to be used throughout the Department.</text></paragraph>
<paragraph id="H5AE7B7580CDB4278863EC3D725A65090"><enum>(4)</enum><text>The assurance of prompt and appropriate pain care treatment and management by the Department, systemwide, when medically necessary.</text></paragraph>
<paragraph id="H233D8286DF2D4DC1A8E262CA60131755"><enum>(5)</enum><text>The Department’s program of research related to acute and chronic pain suffered by veterans, including pain attributable to central and peripheral nervous system damage characteristic of injuries incurred in modern warfare.</text></paragraph>
<paragraph id="HED21327F05984726B65B09994F62E0BE"><enum>(6)</enum><text>The Department’s program of pain care education and training for health care personnel of the Department.</text></paragraph>
<paragraph id="H77CCF9E40BF742FEA1B854D99092B87E"><enum>(7)</enum><text display-inline="yes-display-inline">The Department’s program of patient education for veterans suffering from acute or chronic pain and their families.</text></paragraph></subsection>
<subsection id="HFBEF10F0017E4B45AFA7FFAC46DC354E"><enum>(c)</enum><header>Updates</header><text display-inline="yes-display-inline">The Secretary shall revise the policy developed under subsection (a) on a periodic basis in accordance with experience and evolving best practice guidelines.</text></subsection>
<subsection id="H299BF5804E2343CB84745CA6283976AB"><enum>(d)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall develop the policy developed under subsection (a), and revise such policy under subsection (c), in consultation with veterans service organizations and organizations with expertise in the assessment, diagnosis, treatment, and management of pain.</text></subsection>
<subsection id="H780770D5200C42EEB7B1A1B100028D6"><enum>(e)</enum><header>Annual report</header>
<paragraph id="HD73D2DB9CF934F0D80F0091E058E6DFC"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the completion and initial implementation of the policy under subsection (a) and on October 1 of every fiscal year thereafter through fiscal year 2018, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the implementation of the policy developed under subsection (a).</text></paragraph>
<paragraph id="H7FA26DB0E1CE4C40A1DE7E974657236C"><enum>(2)</enum><header>Contents</header><text>The report required by paragraph (1) shall include the following:</text>
<subparagraph id="H22000B786CF4479597DF6367E67B13FA"><enum>(A)</enum><text>A description of the policy developed and implemented under subsection (a) and any revisions to such policy under subsection (c).</text></subparagraph>
<subparagraph id="HAECFF8C34F5449209919EF3C6FB07946"><enum>(B)</enum><text>A description of the performance measures used to determine the effectiveness of such policy in improving pain care for veterans systemwide.</text></subparagraph>
<subparagraph id="HCE732FE6E8A149489C34311C04380380"><enum>(C)</enum><text>An assessment of the adequacy of the Department’s pain management services based on a survey of patients managed in Department clinics.</text></subparagraph>
<subparagraph id="H3B2BD7F14E1944669CBB661817B25254"><enum>(D)</enum><text>An assessment of the Department’s research programs relevant to the treatment of the types of acute and chronic pain suffered by veterans.</text></subparagraph>
<subparagraph id="HC3E468521E304A998C35BA0524D157AE"><enum>(E)</enum><text>An assessment of the training provided to Department health care personnel with respect to the diagnosis, treatment, and management of acute and chronic pain.</text></subparagraph>
<subparagraph id="HF7FE1E4748A74FD58C2C7200569984AD"><enum>(F)</enum><text>An assessment of the Department’s pain care-related patient education programs.</text></subparagraph></paragraph></subsection>
<subsection id="HCB69C4734E9D4A36A42BC4C5EC46000"><enum>(f)</enum><header>Veterans service organization defined</header><text>In this section, the term <term>veterans service organization</term> means any organization recognized by the Secretary for the representation of veterans under <external-xref legal-doc="usc" parsable-cite="usc/38/5902">section 5902</external-xref> of title 38, United States Code.</text></subsection></section>
<section id="H97FA863194EA40198672258860D2B8CB" section-type="subsequent-section"><enum>5.</enum><header>Establishment of consolidated patient accounting centers</header>
<subsection display-inline="no-display-inline" id="H400B11A6252B42F6AD8E48EA6C89543C"><enum>(a)</enum><header>Establishment of Centers</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">Chapter 17</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1729A">section 1729A</external-xref> the following:</text>

<section id="H02CC3FE302E5464A8C8784A924C7CA93"><enum>1729B.</enum><header>Consolidated patient accounting centers</header>
<subsection id="H68C8BA7A1F30402DAEFD707F4EB5E600"><enum>(a)</enum><header>In general</header><text>Not later than 5 years after the date of enactment of this section, the Secretary of Veterans Affairs shall establish not more than seven consolidated patient accounting centers for conducting industry-modeled regionalized billing and collection activities of the Department.</text></subsection>
<subsection id="H21BCE57B01DD46919B8C323800894300"><enum>(b)</enum><header>Functions</header><text>The centers shall carry out the following functions:</text>
<paragraph id="H12748BADFA9847DCBDC9FC04E9B05777"><enum>(1)</enum><text>Reengineer and integrate all business processes of the revenue cycle of the Department.</text></paragraph>
<paragraph id="H36F1288C1C11491AA43C4E58E5DBF7D4"><enum>(2)</enum><text>Standardize and coordinate all activities of the Department related to the revenue cycle for all health care services furnished to veterans for nonservice-connected medical conditions.</text></paragraph>
<paragraph id="H7285E53B0EA449AA95D16CAAC646A508"><enum>(3)</enum><text>Apply commercial industry standards for measures of access, timeliness, and performance metrics with respect to revenue enhancement of the Department.</text></paragraph>
<paragraph id="H7F211B73705D45AB8200EBB3BE278F31"><enum>(4)</enum><text>Apply other requirements with respect to such revenue cycle improvement as the Secretary may specify.</text></paragraph></subsection></section>

<subsection id="H58A6F09A1BC04223923FEC00A39D78A9"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1729A the following:</text>

<section id="HA209551E3A3B40AA95982630433E67D8"><enum>6.</enum><header>Simplifying and updating national standards to encourage testing of the human immunodeficiency virus</header><text display-inline="no-display-inline">Section 124 of the Veterans’ Benefits and Services Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/38/7333">38 U.S.C. 7333</external-xref> note; 102 Stat. 505) and the item relating to such section in the table of contents of such Act (102 Stat. 487) are repealed.</text></section>
