		</action>
		<legis-type>A BILL</legis-type>
		<official-title>To achieve greater national energy independence by
		  terminating longstanding moratoriums on the domestic production of offshore oil
		  and natural gas and to authorize States to petition for authorization to
		  conduct offshore oil and natural gas exploration and extraction in the coastal
		  zone of their State.</official-title>
	</form>
	<legis-body id="H7DB7D70F286B453B8E00BE5286C1351E" style="OLC">
		<section id="H477A18EFBB764F09844E00EE2CFE00A6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Developing Resources Immediately and
			 Long-Term through Leases on Our Nation’s Offshore Waters Act of
			 2008</short-title></quote> or the <quote><short-title>DRILL NOW Act of 2008</short-title></quote>.</text>
		</section><section id="H203DC1FB5D974C9AACF7C43C940885A9"><enum>2.</enum><header>Termination of
			 laws prohibiting the spending of appropriated funds for Outer Continental Shelf
			 leasing activities</header><text display-inline="no-display-inline">All
			 provisions of existing Federal law prohibiting the spending of appropriated
			 funds to conduct oil and natural gas leasing and preleasing activities for any
			 area of the Outer Continental Shelf shall have no force or effect.</text>
		</section><section id="HF0E772BD429445B1B6EF00063F582FF4"><enum>3.</enum><header>Revocation of
			 existing Presidential withdrawals</header><text display-inline="no-display-inline">All withdrawals of Federal submerged lands
			 of the Outer Continental Shelf from leasing, including withdrawals by the
			 President under the authority of section 12(a) of the Outer Continental Shelf
			 Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1341">43 U.S.C. 1341(a)</external-xref>), are hereby revoked and are no longer in effect
			 with respect to the leasing of areas for exploration for, and development and
			 production of, oil, and natural gas.</text>
		</section><section id="H03C50A3C60254BA7003B64E802F2D1E9"><enum>4.</enum><header>Revocation of
			 existing Presidential authority</header><text display-inline="no-display-inline">All authorities given to the President with
			 respect to the leasing of Federal submerged lands of the Outer Continental
			 Shelf, given under section 12(a) of the Outer Continental Shelf Lands Act (43
			 U.S.C. 1341(a)), are hereby revoked, except in the interest of national
			 security.</text>
		</section><section id="HFA9C20672FA14376819E180283FB0451"><enum>5.</enum><header>Availability of
			 certain areas for leasing</header><text display-inline="no-display-inline">Section 8 of the Outer Continental Shelf
			 Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref>) is amended by adding at the end the
			 following:</text>

				<subsection id="HCEEBD334931944A0A7E2A8FB7919C0EC"><enum>(q)</enum><header>Availability of
				certain areas for leasing</header>
					<paragraph id="H00D95D80BEF840E988BE3FDF8CEADB01"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
						<subparagraph id="H9644CF65110040BDB504005CD6AD52C5"><enum>(A)</enum><header>Governor</header><text>The
				term <quote>Governor</quote> means the Governor of a State.</text>
						</subparagraph><subparagraph id="HEC1FA9CD09E54CD48CEC9278292BF65"><enum>(B)</enum><header>Qualified
				revenues</header><text>The term <quote>qualified revenues</quote> means all
				rentals, royalties, bonus bids, and other sums due and payable to the United
				States from leases entered into on or after the date of enactment of this Act
				for natural gas exploration and extraction activities authorized by the
				Secretary under this subsection.</text>
						</subparagraph></paragraph><paragraph id="H91E2D3230A7E4A2BA3C600B7D61FEBFC"><enum>(2)</enum><header>Petition</header>
						<subparagraph id="H663C10F1427E4F6BA2E28D784170000"><enum>(A)</enum><header>In
				general</header><text>The Governor may submit to the Secretary a petition
				requesting that the Secretary issue leases authorizing the conduct of oil and
				natural gas exploration and extraction activities in any area that is at least
				50 miles beyond the coastal zone of the State.</text>
						</subparagraph><subparagraph id="HB3BA724167734881A8D14CED4B0996C9"><enum>(B)</enum><header>Contents</header><text>In
				any petition under subparagraph (A), the Governor shall include a detailed plan
				of the proposed exploration and extraction activities, as applicable.</text>
						</subparagraph></paragraph><paragraph id="H91A9608114554BC68F26F0C4E1DDBD1"><enum>(3)</enum><header>Action by
				secretary</header>
						<subparagraph id="H019FD506F120446B8399666C6CC5D54C"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (D), as soon as practicable after
				the date of receipt of a petition under paragraph (2), the Secretary shall
				approve or deny the petition.</text>
						</subparagraph><subparagraph id="H5D29C7C240DD4AED9594F8D2FB3064F"><enum>(B)</enum><header>Requirements for
				exploration and extraction</header><text>The Secretary shall not approve a
				petition submitted under paragraph (2)(A) unless the State enacts legislation
				supporting exploration and extraction of oil and natural gas in the coastal
				zone of the State.</text>
						</subparagraph><subparagraph id="H79DE311EB4434722BCA4A1F4934C994B"><enum>(C)</enum><header>Consistency with
				legislation</header><text>The plan provided in the petition under paragraph
				(2)(B) shall be consistent with the legislation described in subparagraph (B)
				as applicable.</text>
						</subparagraph><subparagraph id="H440610DDC2FE44C982C60842002FE600"><enum>(D)</enum><header>Conflicts with
				military operations and national security</header><text>The Secretary shall not
				approve a petition for a drilling activity under this paragraph if the drilling
				activity would conflict with any military operation or national security, as
				determined by the President.</text>
						</subparagraph></paragraph><paragraph id="H7C451CFA56C64966BBDFA100CD1BBE26"><enum>(4)</enum><header>Disposition of
				revenues</header><text>Notwithstanding section 9, for each applicable fiscal
				year, the Secretary of the Treasury shall deposit—</text>
						<subparagraph id="HF14DFDDD2A4D4DE7A3DFF5CC636365FE"><enum>(A)</enum><text>25 percent of
				qualified revenues in a Clean and Alternative Energy Fund in the Treasury,
				which shall be established by the Secretary;</text>
						</subparagraph><subparagraph id="HFF5EE2A9313B4E24A83F34B19696D02C"><enum>(B)</enum><text>25 percent of
				qualified revenues in the general fund of the Treasury;</text>
						</subparagraph><subparagraph id="H3C9FD257B5324AD8848CF79948F3CFD6"><enum>(C)</enum><text>37.5 percent of
				qualified revenues in a special account in the Treasury from which the
				Secretary shall disburse to the State; and</text>
						</subparagraph><subparagraph id="H2ACAB2714564495892AB1BAFE19DD4F3"><enum>(D)</enum><text>6.25 percent to
				provide financial assistance to States in accordance with section 6 of the Land
				and Water Conservation Fund Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-8">16 U.S.C. 460l–8</external-xref>), which shall be
				considered income to the Land and Water Conservation Fund for purposes of
				section 2 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-5">16 U.S.C. 460l–5</external-xref>); and</text>
						</subparagraph><subparagraph id="HC660DE0A5AF64C7FB712C42100E398F3"><enum>(E)</enum><text>6.25 percent to a
				reserve fund to be used to mitigate for any environmental damage that occurs as
				a result of extraction activities authorized under this subsection, regardless
				of whether the damage is—</text>
							<clause id="H4695C9F85C7D42D9AD47BB5C8D3B46AF"><enum>(i)</enum><text>reasonably
				foreseeable; or</text>
							</clause><clause id="HEBE6448E0B174162A9B2F415CE1878A1"><enum>(ii)</enum><text>caused by
				negligence, natural disasters, or other acts.</text>
							</clause></subparagraph></paragraph><paragraph id="HE09FB4CF87254630BD642E4271BF4000"><enum>(5)</enum><header>Existing
				leases</header><text>Any funds that would be received by the United States as
				royalties under any Federal oil and gas lease of an area on the outer
				Continental Shelf within 50 miles of the coastal zone of the State of Texas,
				Louisiana, Mississippi, or Alabama that is in effect on the date of enactment
				of the DRILL NOW Act of 2008 shall be paid to that State if the State enacts a
				statute that establishes a plan for expenditure of those
				funds.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
