			 limitation</header><text display-inline="yes-display-inline">Section 3031 of
			 title 38, United States Code, is amended—</text>
					<paragraph id="H4AF859A9573048358770728D6881CED0"><enum>(1)</enum><text>by striking
			 <quote>10-year period</quote> each place it appears and inserting
			 <quote>15-year period</quote>; and</text>
					</paragraph><paragraph id="H2893E55D542F4092A6E1DBDAE0613D1"><enum>(2)</enum><text>in
			 subsection (a)—</text>
						<subparagraph id="H74FF3371BD024BCCAFAC332EAA039DD8"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>and</quote> after the semicolon;</text>

			 subsection (a) shall apply with respect to an individual who is entitled to
			 educational assistance under chapter 30 of such title on the date that is 90
			 days after the date of the enactment of this Act or who becomes entitled to
			 educational assistance under such chapter after such date.</text>
				</subsection></section><section display-inline="no-display-inline" id="H754077FA90EC42CDA40061488988373D" section-type="subsequent-section"><enum>103.</enum><header>Monthly stipend for
			 recipients of educational assistance allowance</header>
				<subsection id="HAE62625CEA35496A83F6D300FE473103"><enum>(a)</enum><header>Entitlement to
			 monthly stipend</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United
			 States Code, is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HB9CA90E283CF494AAE5B27AC7EBFF14C" style="USC">
						<section id="H4FF77E642A4A4E89B4E641AD2488EE76"><enum>3020A.</enum><header>Educational
				stipend</header>
							<subsection id="H818C4EA67CA64987BBB34000D1E3817F"><enum>(a)</enum><header>Entitlement</header><text display-inline="yes-display-inline">Each individual who is receiving
				educational assistance under this chapter and who is pursuing a program of
				education at an institution of higher learning (as such term is defined in
				section 3452(f) of this title) is entitled to an educational stipend under this
				section.</text>
							</subsection><subsection id="HCE5E077D932248CEB794D0C5988144DF"><enum>(b)</enum><header>Amount of
				stipend</header><text display-inline="yes-display-inline">An educational
				stipend under this section shall be paid to an individual who is entitled to
				such a stipend—</text>
								<paragraph id="H8BAF6DB439CD4FB4A4BAAE339E56859F"><enum>(1)</enum><text>in the case of an
				individual pursuing an approved program of education on at least a half-time
				basis, at the monthly rate of $500; and</text>
								</paragraph><paragraph id="HE15950CD71F644D7AD2068CB27117B36"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an individual pursuing an
				approved program of education on less than a half-time basis, at the monthly
				rate of
				$250.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HDA02E4310F5949B785C6FDD3DB59C7C"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end of the items relating to subchapter II the
			 following new item:</text>

			 period for collection of fee for basic educational assistance</header>
				<subsection id="HF0954DE5513C471C984697FC593DB613"><enum>(a)</enum><header>Basic
			 educational assistance for service on active duty</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3011">Section 3011(b)(1)</external-xref> of title 38, United
			 States Code, is amended—</text>
					<paragraph id="HAC7AE67E8A77477DBE7BB9FBDA6AE96"><enum>(1)</enum><text>by
			 striking <quote>$100</quote> and inserting <quote>$50</quote>; and</text>
					</paragraph><paragraph id="HFD88F157DFED4ED5BDD900F55C1654B0"><enum>(2)</enum><text>by striking
			 <quote>12</quote> and inserting <quote>24</quote>.</text>
					</paragraph></subsection><subsection id="H3B7967938523437F8544BCABB8F328A9"><enum>(b)</enum><header>Basic
			 educational assistance for service in the Selected
			 Reserve</header><text>Section 3012(c)(1) of such title is amended—</text>
					<paragraph id="H4C40818CF3764FAE943DFC1EB54945C4"><enum>(1)</enum><text>by striking
			 <quote>$100</quote> and inserting <quote>$50</quote>; and</text>
					</paragraph><paragraph id="H1B92C586C9204B0B97B31EF1928482B9"><enum>(2)</enum><text>by striking
			 <quote>12</quote> and inserting <quote>24</quote>.</text>
					</paragraph></subsection><subsection id="H2C58237E005B4090948C8268DD33142B"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date that is 90 days after the date of the enactment of this Act.</text>
				</subsection></section><section display-inline="no-display-inline" id="H20E514A0FAA5418700E1ED27F033593E" section-type="subsequent-section"><enum>105.</enum><header>Use of educational
			 assistance for business courses and seminars</header>
				<subsection id="HBA57E9E593EB415D8BEBF897E280080"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Veterans Affairs shall ensure that individuals entitled to educational
			 assistance under laws administered by the Secretary are entitled to use such
			 assistance for business courses and seminars, if such courses or seminars are
			 related to the operation of a business, and for continuing education courses.
			 The Secretary shall treat the courses referred to in the preceding sentence in
			 a similar manner as licensing and certification courses.</text>
				</subsection><subsection id="H3E292A4CFB1C468C840022CD28EB40E5"><enum>(b)</enum><header>Effective
			 date</header><text>Subsection (a) shall take effect on the date that is two
			 years after the date of the enactment of this Act.</text>
				</subsection></section><section display-inline="no-display-inline" id="H20924A23A3DE47359CE59B84FF8CE71E" section-type="subsequent-section"><enum>106.</enum><header>Use of educational
			 assistance for courses taken to prepare for licensing or certification
			 tests</header>
				<subsection id="H7A4575C2629C49B49D74127868A0BEFE"><enum>(a)</enum><header>Basic
			 educational assistance</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3452">Section 3452(b)</external-xref> of title 38, United States
			 Code, is amended by inserting after the fourth sentence the following new
			 sentence: <quote>Such term also includes preparatory courses for licensing or
			 certification tests described in the preceding sentence, as designated by the
			 Secretary.</quote>.</text>
				</subsection><subsection commented="no" id="HE4B3E995AD4549E8BEC169D9929069B5"><enum>(b)</enum><header>Survivors’ and
			 dependents’ educational assistance</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3501">Section 3501(a)(5)</external-xref> of title 38, United
			 States Code, is amended by inserting after the second sentence the following
			 new sentence: <quote>Such term also includes preparatory courses for licensing
			 or certification tests described in the preceding sentence, as designated by
			 the Secretary.</quote>.</text>
				</subsection><subsection id="H671EE6FF9022455AB86D13C9B4E6F576"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by subsections (a) and (b) shall take
			 effect on the date that 2 years after the date of the enactment of this
			 Act.</text>
				</subsection></section><section display-inline="no-display-inline" id="HCC925F651437482CB23B7F943B00181E" section-type="subsequent-section"><enum>107.</enum><header>Use of educational
			 assistance to repay Federal student loans</header>
				<subsection id="H6A6E18A99E5F4458BA8B335C85C77F00"><enum>(a)</enum><header>In
			 general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States
			 Code, as amended by section 103, is further amended by inserting after section
			 3020A the following new section:</text>

				</enum><header>Use of educational assistance benefits for the repayment of
				Federal student loans for certain courses of education</header>
							<subsection id="H211993208D8E472898FB151079A00F8"><enum>(a)</enum><header>Use of
				benefits</header><text>Notwithstanding any other provision of this chapter, and
				subject to subsections (b) through (e), an individual who is serving on active
				duty and who is entitled to educational assistance under this subchapter may
				apply amounts of such educational assistance otherwise available to the
				individual to repay some or all of any Federal student loan balance owed by the
				individual for a course of education pursued by the individual.</text>
							</subsection><subsection id="H029E1706049F4A759F7B9FEA7382191E"><enum>(b)</enum><header>Limitations on
				payments</header><paragraph commented="no" display-inline="yes-display-inline" id="H4CBD50223CC04880B01BAF92E200EE1B"><enum>(1)</enum><text>The amount of an
				individual’s entitlement to educational assistance that the individual may
				apply to the repayment of a student loan balance under subsection (a) may not
				exceed $6,000 in any 12-month period.</text>
								</paragraph><paragraph id="HCDA59AF915634CF4BA11E0ED0833AED" indent="up1"><enum>(2)</enum><text>In no event shall payment of
				educational assistance under this section exceed the amount of the individual’s
				available entitlement under this chapter.</text>
								</paragraph><paragraph id="H5CCC207B9319425D89D10100426EA1E" indent="up1"><enum>(3)</enum><text>An individual entitled to educational
				assistance under this subchapter may not apply such educational assistance to
				any of the following:</text>
									<subparagraph id="H838D158B14C64528ABA939003EA4E980"><enum>(A)</enum><text display-inline="yes-display-inline">A
				loan made to the parents of a dependent student under section 428B of the
				Higher Education Act of 1965.</text>
									</subparagraph><subparagraph id="H39957877000D438FAA05C41BCD00CC11"><enum>(B)</enum><text>A Federal Direct PLUS Loan made to the
				parents of a dependent student.</text>
									</subparagraph><subparagraph id="HED2AF77BB1C0450EB9089702CF01FC7F"><enum>(C)</enum><text>A loan made under section 428C or
				455(g) of such Act, to the extent that such loan was used to repay—</text>
										<clause id="H8889C778BCE544368B9FC5ED09033205"><enum>(i)</enum><text>a loan made to the parent of a
				dependent student under section 428B of such Act;</text>
										</clause><clause id="H21379136CD474A18B4E048007CD4147E"><enum>(ii)</enum><text>a Federal Direct PLUS Loan made to
				the parents of a dependent student.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H25237223C1A4450D825B85315D56132B"><enum>(c)</enum><header>Amount of
				payments</header><text>The Secretary shall make monthly payments under this
				section in such amounts as the individual may elect for the repayment of a
				Federal student loan of such an individual.</text>
							</subsection><subsection id="H0566601CC0CE45E09BDB3E007FAFF8B"><enum>(d)</enum><header>Arrangements to
				make payments</header><text>The Secretary shall enter into such arrangements,
				and shall prescribe such regulations, as may be necessary to carry out this
				section.</text>
							</subsection><subsection id="HF71F98DC1A9549F8AE981D447E06EFD9"><enum>(e)</enum><header>Federal student
				loan defined</header><text>In this section, the term <term>Federal student
				loan</term> means any loan made under title IV of the Higher Education Act of
				1965 (20 U.S.C. 1070 et
				seq.).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H4A8284084FD742B88C1D5F50EFB9FC8E"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections of subchapter II of chapter 30 of
			 such title is amended by inserting after the item relating to section 3020 the
			 following new item:</text>

			 subsection (a) shall apply with respect to educational assistance paid for
			 months beginning after the date that is two years after the date of the
			 enactment of this Act.</text>
				</subsection></section><section display-inline="no-display-inline" id="H34FAE335CEE54DF08EF629F227B4FD97" section-type="subsequent-section"><enum>108.</enum><header>Opportunity to
			 withdraw election not to enroll in educational assistance program</header>
				<subsection id="H2D8582B2B2B94EA28C65C28C89402481"><enum>(a)</enum><header>Basic
			 educational assistance for active duty service</header>
					<paragraph id="H7C823F941BB644FCBDCDC7AD4D00B01E"><enum>(1)</enum><header>Opportunity to
			 withdraw</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/38/3011">section 3011</external-xref> of title 38, United
			 States Code, is amended by adding at the end the following new
			 paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HD773A85EDEE24DDFA049091010A70440" style="USC">
							<paragraph display-inline="no-display-inline" id="HE593B3D924EF457DB79152788817ED95" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">An individual who makes an election not to
				receive educational assistance under paragraph (1) may withdraw that election
				at any time and, after making such withdrawal, shall be entitled to educational
				assistance under this chapter in the same manner as if the individual had never
				made that election, if—</text>
								<subparagraph id="HC8C55A90B3E34F8183002E8937ABD6D5"><enum>(A)</enum><text>at the time the individual makes such
				withdrawal, the individual is serving on active duty as a member of the Armed
				Forces; and</text>
								</subparagraph><subparagraph id="H838F4F3D815340039F1408CC7B8D95A9"><enum>(B)</enum><text display-inline="yes-display-inline">the basic pay of the individual is reduced
				by, or the individual otherwise pays to the Secretary, $1,200 by not later than
				90 days after the date on which the individual is discharged or released from
				active duty in the Armed
				Forces.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H6A924504DC8B43FC8BD23CCC5AC3932"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Paragraph (1) of such subsection is amended in the

			 States Code, is amended by adding at the end the following new

				receive educational assistance under paragraph (1) may withdraw that election

								</subparagraph><subparagraph id="H71F66CE1586B4D53A3FF4D4B91CD3214"><enum>(B)</enum><text>the basic pay of the individual is
				reduced by, or the individual otherwise pays to the Secretary, $1,200 by not
				later than 90 days after the date on which the individual is discharged or
				released from active duty in the Armed
				Forces.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HCEFAFC632DE74CCE998BA01FB7EE9E2"><enum>(2)</enum><header>Conforming

			 benefits not to reduce financial aid</header>
				<subsection id="HE2ED3BE50AAE4F8CA9EEE7DDDA01C8D2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 480(j) of the
			 Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(j)</external-xref>) Act is amended—</text>
					<paragraph id="H4ECBBA45A36B45F591398E0037FC30F7"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>including veterans’ education benefits as defined in
			 subsection (c),</quote> and inserting <quote>including, subject to paragraph
			 (4), veterans’ education benefits as defined in subsection (c),</quote>;
			 and</text>
					</paragraph><paragraph id="HBE90BCD5D7A641E683EF5900EEEA1F59"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>

							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H699AB1CE50ED4DB7A2A3E9FA772035E"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall take effect on the date that is 90 days after the date of
			 the enactment of this Act.</text>
				</subsection></section><section id="H6D92C8D5E81A4D83B962E5025BA6F807" section-type="subsequent-section"><enum>110.</enum><header>Extension of
			 increase in benefit for certain individuals pursuing apprenticeships or on-job
			 training</header>
				<subsection id="HDCA4CF175DF64B5CB8FA3021956C141B"><enum>(a)</enum><header>Members of the
			 Selected Reserve</header><text display-inline="yes-display-inline">Subsection
			 (d) of section 103 of the Veterans Earn and Learn Act of 2004 (Public Law
			 108–454; <external-xref legal-doc="usc" parsable-cite="usc/38/3032">38 U.S.C. 3032</external-xref> note) is amended by striking <quote>January 1,
			 2008</quote> and inserting <quote>January 1, 2014</quote>.</text>
				</subsection><subsection id="H4E3C647D8A3143E0AEF7C55DAAB4EDF6"><enum>(b)</enum><header>Survivors and
			 dependents</header><text display-inline="yes-display-inline">Subsection (c) of
			 such section is amended by striking <quote>January 1, 2008</quote> and
			 inserting <quote>January 1, 2014</quote>.</text>

			 States Code, is amended by striking <quote>may not exceed $13,000,000</quote>
			 and all that follows through the end and inserting <quote>shall be
			 $19,000,000</quote>.</text>
			</section><section id="H9B93F1FDE96A4DCB94F48B934F115300"><enum>112.</enum><header>Provision of
			 basic educational assistance benefits for veterans discharged from active duty
			 with general discharge</header>
				<subsection id="HF40DE0E1EC934D7782AE18D695B95114"><enum>(a)</enum><header>Active duty
			 service</header><text display-inline="yes-display-inline">Section 3011(a)(3)(B)
			 of title 38, United States Code, is amended by inserting <quote>or a general
			 discharge (under honorable conditions)</quote> before the period at the
			 end.</text>
				</subsection><subsection id="HDA20E4174AC04B94B7EA13C4A99E6DEA"><enum>(b)</enum><header>Service in
			 Selected Reserve</header><text display-inline="yes-display-inline">Section
			 3012(a)(3)(A) of such title is amended by inserting <quote>or a general
			 discharge (under honorable conditions)</quote> before the semicolon.</text>
				</subsection><subsection id="H6E615BEA37C84B2BA4FB1E6760F0A952"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsections (a) and (b) shall apply with respect to an individual who is
			 discharged from service in the Armed Forces after the date that is 90 days
			 after the date of the enactment of this Act.</text>

			 amount of reporting fee payable to educational institutions that enroll

			 States Code, is amended by adding at the end the following new
			 subparagraph:</text>
					<quoted-block id="H63A2A8E4BE44464D8F3DE5692E79CB03" style="USC">
						<subparagraph id="H7BAD15C97B004528AD12777D404EF382" indent="up1"><enum>(G)</enum><text>The provision of placement services
				described in section 3104(a)(5) of this title at an educational institution
				carried out under the supervision of a Department
				employee.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HAB529A161CD14212949850AE29C2D2E0"><enum>(b)</enum><header>Work study for
			 students enrolled on half-time basis</header><text>Subsection (b) of such
			 section is amended—</text>
					<paragraph id="H93687314AB9345F8B300E1B9372030CA"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>three-quarters</quote> and inserting
			 <quote>half</quote>; and</text>
					</paragraph><paragraph id="H22489448EAD54F0CAC856330D3B9ACF1"><enum>(2)</enum><text>in the third

				</subsection></section><section commented="no" id="H296D4FDB18514B0A8DC2AE149344F501"><enum>115.</enum><header>5-year pilot
			 program for on-campus work-study positions</header>
				<subsection commented="no" id="H37EF27D051C44D748872CA69A181DF34"><enum>(a)</enum><header>Establishment of
			 pilot program</header><text display-inline="yes-display-inline">Beginning not
			 later than two years after the date of the enactment of this Act, the Secretary
			 of Veterans Affairs shall conduct a five-year pilot project to test the
			 feasibility and advisability of expanding the scope of qualifying work-study
			 activities under subsection (a)(4) of <external-xref legal-doc="usc" parsable-cite="usc/38/3485">section 3485</external-xref> of title 38, United States
			 Code, including work-study positions available on site at educational
			 institutions.</text>
				</subsection><subsection commented="no" id="H8F209662716046FE8C21C00600C751B8"><enum>(b)</enum><header>Type of
			 work-study positions</header><text>The work-study positions referred to in
			 subsection (a) may include positions in academic departments (including
			 positions as tutors or research, teaching, and lab assistants) and in student
			 services (including positions in career centers and financial aid, campus
			 orientation, cashiers, admissions, records, and registration offices).</text>
				</subsection><subsection commented="no" id="HC4A9B1175C0B4498BCFD270085D86FF6"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe regulations
			 to carry out the pilot project under this section, including regulations
			 providing for the supervision of work-study positions referred to in subsection
			 (a) by appropriate personnel.</text>
				</subsection><subsection commented="no" id="H0F0E6D3A89B24821A5E49538D172772"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary $10,000,000 for each of the fiscal years during which the Secretary
			 carries out the pilot project under this section.</text>
				</subsection></section><section id="H6B0DFC9EC40C423FB8321F6401C69E41"><enum>116.</enum><header>Increase in
			 employees for Education Service</header><text display-inline="no-display-inline">The Secretary of Veterans Affairs shall
			 increase the number of full-time employees of the Education Service of the
			 Department of Veterans Affairs by 150 additional such employees.</text>
			</section><section id="H75DAD9B2B84444EB9E476925F1000421"><enum>117.</enum><header>Upgrade of
			 certain information technology</header>
				<subsection id="H028D175D07104762AF66A8FC5B831854"><enum>(a)</enum><header>Action plan
			 required</header><text display-inline="yes-display-inline">The Chief
			 Information Officer of the Department of Veterans Affairs, in coordination with
			 the Director of the Department of Veterans Affairs Education Service, shall
			 submit to the Committees on Veterans’ Affairs of the Senate and House of
			 Representatives and action plan describing how the Chief Information Officer
			 and Director of the Department of Veterans Affairs Education Service intend to
			 upgrade the information technology system of the Department of Veteran Affairs
			 that is used in connection with the administration of educational benefits
			 under laws administered by the Secretary of Veterans Affairs. The Chief
			 Information Officer and Director of the Department of Veterans Affairs
			 Education Service shall update the committees at least annually on any progress
			 made in upgrading such system.</text>
				</subsection><subsection id="H3FB9B0F52D8C4297A76F6DBA41DEC122"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to upgrade
			 the information technology system of the Department of Veteran Affairs that is
			 used in connection with the administration of educational benefits under laws
			 administered by the Secretary of Veterans Affairs—</text>
					<paragraph id="HF35F131C5DAD47A789B3123CBFC9569"><enum>(1)</enum><text>$8,000,000 for
			 fiscal year 2009; and</text>
					</paragraph><paragraph id="H667A43BAFDD34F01BB00A567312938DC"><enum>(2)</enum><text>$3,000,000 for
			 each of fiscal years 2010, 2011, and 2012.</text>
					</paragraph></subsection></section><section id="H7E00CE1D739540838F95C61779D35644"><enum>118.</enum><header>Modification of
			 advance payment of initial educational assistance or subsistence
			 allowance</header>
				<subsection id="H6DECBD4F17AF46DA8CED05C626BF469C"><enum>(a)</enum><header>Modification</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3680">Section 3680(d)(2)</external-xref> of title 38, United
			 States Code, is amended by inserting after the third sentence the following new
			 sentence: <quote>For purposes of the entitlement to educational assistance of
			 the veteran or person receiving an advance payment under this subsection, the
			 advance payment shall be charged against the final month of the entitlement of
			 the person or veteran and, if necessary, the penultimate such month. In no
			 event may any veteran or person receive more than one advance payment under
			 this subsection during any academic year.</quote>.</text>
				</subsection><subsection id="HCED1DE02EBF74DC29327876C934E3EA9"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply with respect to an advance payment of educational
			 assistance made after the date that is 90 days after the date of the enactment
			 of this Act.</text>
				</subsection></section><section id="HE22D59EFDC0C40CF96422D8B2400B59B"><enum>119.</enum><header>Modification of
			 period of eligibility applicable to certain spouses of individuals with
			 service-connected total disabilities permanent in nature</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3512">Section 3512(b)(1)</external-xref> of title 38, United
			 States Code, is amended—</text>
				<paragraph id="H7EAB37B6BC15497DB8B2E91538881501"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>subparagraph (B) or (C)</quote> and inserting
			 <quote>subparagraphs (B), (C), and (D)</quote>; and</text>
				</paragraph><paragraph id="HE3E64A25284B4B45B5DC13361D8802EE"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HDDD7D4E45A2D4828AD1270A3A58BECB6" style="USC">
						<subparagraph id="H3A3C626A326C461CAD622200001CD64B" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), an
				eligible person referred to in that subparagraph who is made eligible under
				section 3501(a)(1)(D)(i) of this title by reason of a service-connected
				disability that was determined to be a total disability permanent in nature not
				later than three years after discharge from service may be afforded educational
				assistance under this chapter during the 20-year period beginning on the date
				the disability was so determined to be a total disability permanent in nature,
				but only if the eligible person remains the spouse of the disabled person
				throughout the
				period.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 operations</header>
				<subsection id="H2B27AAE33D1F43639F55FF6EE24CB551"><enum>(a)</enum><header>Members of the
			 Selected Reserve</header><text display-inline="yes-display-inline">Section
			 16131(b) of title 10, United States Code, is amended—</text>
					<paragraph id="H65A3720A22E04AE8BBD46D8ED5DBC8D7"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>at the following rates</quote> and all that follows through
			 the end;</text>
					</paragraph><paragraph id="H3621D690C0DF43E6A1928BF5AEE3DEE1"><enum>(2)</enum><text>by striking
			 paragraph (2);</text>
					</paragraph><paragraph id="H949B9B8BB76047D48188ECFDA74C69D3"><enum>(3)</enum><text>by inserting after
			 paragraph (1) the following new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="H41681D2632074E5895B147A7BBD5EACF" style="USC">
							<paragraph id="HD42753FF5417471EA07EBD1DA3CC00A9" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The educational assistance allowance
				provided under this subchapter shall be based on the applicable percent under
				paragraph (4) of the applicable rate provided under <external-xref legal-doc="usc" parsable-cite="usc/38/3015">section 3015</external-xref> of title 38
				for a member whose entitlement is based on completion of an obligated period of
				active duty of 3 years.</text>
							</paragraph><paragraph id="H49DBBFBB9E664646A5B5D3003182E9AA" indent="up1"><enum>(3)</enum><text>The educational assistance allowance
				provided under this section for a person who is undertaking a program for which
				a reduced rate is specified in chapter 30 of such title, that rate shall be
				further adjusted by the applicable percent specified in paragraph (4).</text>
							</paragraph><paragraph id="HC4398BC855054AA98C7313F3BD2FD046" indent="up1"><enum>(4)</enum><text>The adjusted educational assistance
				allowance under paragraph (2) or (3), as applicable, shall be 47
				percent.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H0E79CC415E444BC1A453EEACD7BBA7A5"><enum>(b)</enum><header>Reserve
			 component members supporting contingency operations and certain other
			 operations</header><text>Paragraph (4) of <external-xref legal-doc="usc" parsable-cite="usc/10/16162">section 16162(c)</external-xref> of title 10, United
			 States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HDF3B5966020848C7A73DC6E9A239B03B" style="USC">
						<paragraph id="H1E0B39C001474F7FADD28686765474EC" indent="up1"><enum>(4)</enum><text>The adjusted educational assistance
				allowance under paragraph (2) or (3), as applicable, shall be—</text>
							<subparagraph id="H1B889E24F23A47CB82249CE2673CCDF"><enum>(A)</enum><text>50 percent in the case of a member of
				a reserve component who performed active service for 90 cumulative days but
				less than 180 cumulative days;</text>

				percent in the case of a member of a reserve component who performed active

				percent in the case of a member of a reserve component who performed active
				service for 365 cumulative days but less than 545 cumulative days;</text>
							</subparagraph><subparagraph id="H7211CDC947844678A9B0E8562EFAEE00"><enum>(D)</enum><text display-inline="yes-display-inline">70
				percent in the case of a member of a reserve component who performed active
				service for 545 cumulative days but less than 730 cumulative days;</text>

			 general</header><text display-inline="yes-display-inline">Section 8906(b) of
			 title 5, United States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HDDBD345D8FF44966941F83B217A8BDEA" style="USC">
						<subsection id="HD866DEFBF46649B49ED1CF9DBB0658B1"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H8DD1B12E5D854E54B3F8600FCA2AE7B"><enum>(1)</enum><text display-inline="yes-display-inline">Except as otherwise provided in this
				subsection, the maximum annual Government contribution for an employee or
				annuitant enrolled in a health benefits plan under this chapter is, for any
				year beginning after 2009, equal to—</text>
								<subparagraph id="H811732877C4B4FD3BB7B14C3B4555923" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">$3,600 in the case of an employee or
				annuitant enrolled for self alone; and</text>
								</subparagraph><subparagraph id="HDABDEB14692F43C09029084277508596" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">$8,400 in the case of an employee or
				annuitant enrolled for self and family.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H2BCDDB916A9D4794B156A8CA24E61D57" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H6EB508261BFD4CA28CE5DFE0FF9EB83C"><enum>(A)</enum><text>In the case of each year
				beginning after 2010, each of the dollar amounts in paragraph (1) shall be
				increased by an amount equal to—</text>
									<clause commented="no" id="H40082BFCB6FC4FCEB82FA5E2E179478D" indent="up1"><enum>(i)</enum><text>such dollar amount, multiplied
				by</text>
									</clause><clause commented="no" id="HA3A3F653F35444CE9E262B00D47BD6B" indent="up1"><enum>(ii)</enum><text>the cost-of-living adjustment for
				such year.</text>
									</clause></subparagraph><subparagraph commented="no" id="HF52790ECAB364A01A80058F775681686" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A), the
				cost-of-living adjustment for any year is the percentage (if any) by
				which—</text>
									<clause commented="no" id="H06D2D96DED4044B000BE3537DADBEA1B"><enum>(i)</enum><text>the CPI for the preceding year,
				exceeds</text>
									</clause><clause commented="no" id="H58D79E3D95B5419D86BB394E323995F"><enum>(ii)</enum><text>the CPI for 2009.</text>
									</clause></subparagraph><subparagraph commented="no" id="H075DA4CBFCA24C4685D0C57CB4952EDC" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph (B), the
				CPI for any year is the average of the Consumer Price Index for the 12-month
				period ending on June 30 of such year.</text>
								</subparagraph><subparagraph commented="no" id="H7603A939E405475294B3E86D000661CA" indent="up1"><enum>(D)</enum><text>For purposes of subparagraph (C), the
				term <term>Consumer Price Index</term> means the Consumer Price Index (all
				items-United States city average) published monthly by the Bureau of Labor
				Statistics.</text>
								</subparagraph><subparagraph commented="no" id="HF0525A71E08C476F93F43C307FF5588F" indent="up1"><enum>(E)</enum><text>If any increase determined under
				subparagraph (A) is not a multiple of $50, such increase shall be rounded to
				the next lowest multiple of $50.</text>
								</subparagraph></paragraph><paragraph id="H7E2D0B3AD9CC438A80DE1DDA50166C84" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The biweekly Government contribution for an
				employee or annuitant enrolled in a health benefits plan under this chapter
				shall be the amount equal to—</text>
								<subparagraph id="HDC28AF6DDD974437A0B792E36F7BC0B2"><enum>(A)</enum><text>the amount of the biweekly
				subscription charge, multiplied by</text>
								</subparagraph><subparagraph id="HDE72336BB4774188B69BA8BB5D6CB589"><enum>(B)</enum><text>the lesser of—</text>
									<clause id="H67B03BCB37924E3F869BE7EB1C414472"><enum>(i)</enum><text>the percentage determined by
				dividing the dollar amount specified in paragraph (1)(A) or (1)(B) (as
				applicable) by the total annual subscription charge, or</text>
									</clause><clause id="H18C598F031304B8D9062A022702E1424"><enum>(ii)</enum><text>75 percent.</text>
									</clause></subparagraph></paragraph><paragraph id="H4F769716D30C4664B25ECECB82D136F1" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of an employee who is occupying
				a position on a part-time career employment basis (as defined in section
				3401(2)), the biweekly Government contribution shall be equal to the amount
				which bears the same ratio to the amount determined under paragraph (3) as the
				average number of hours in such employee's regularly scheduled workweek bears
				to the average number of hours in the regularly scheduled workweek of an
				employee serving in a comparable position on a full-time career basis (as
				determined under regulations prescribed by the Office).</text>
							</paragraph><paragraph id="H469C62C2FDF6424DB26946A5A575DA31" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">For an employee, the Government
				contribution computed under this subsection with respect to a year begins on
				the first day of the employee's first pay period of each year. For an
				annuitant, the Government contribution begins on the first day of the first
				period of the year for which an annuity payment is
				made.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H72B7D4550C5D4C15BB45017CA8D748B3"><enum>(b)</enum><header>Conforming
			 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8906">Section 8906(a)</external-xref> of title 5, United States Code, is
			 repealed.</text>
				</subsection><subsection id="HEE1BE830B6CA42C3BC25709F65D4D28D"><enum>(c)</enum><header>Savings
			 provisions</header>
					<paragraph id="H923A9531A06C411C00BD46634400E38E"><enum>(1)</enum><header>In
			 general</header><text>For the purposes described in paragraph (2), the
			 provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code, shall be applied as if
			 the amendments made by this section had not been enacted.</text>
					</paragraph><paragraph id="H41DBF96211F5451A95A179E44EAD5C9D"><enum>(2)</enum><header>Purposes
			 described</header><text>Paragraph (1) shall apply for purposes of determining
			 the individual and Government contributions payable—</text>
						<subparagraph id="H61E631F79DD74D1095CD4DAAF4F7F61"><enum>(A)</enum><text>for any period
			 before the first day of the first applicable pay or other period beginning in
			 2010, in the case of any individual; and</text>
						</subparagraph><subparagraph id="H437952E58562494CAC505134D50084B7"><enum>(B)</enum><text>for any period
			 beginning on or after the first day described in subparagraph (A), in the case
			 of any individual who, as of the date of the enactment of this Act—</text>
							<clause id="H208E8FDA35D54171A099F7EEB1597B67"><enum>(i)</enum><text>is
			 enrolled in a health benefits plan under chapter 89 of such title 5 as an
			 annuitant; or</text>
							</clause><clause id="H0A9DEC90859F4CD7959EB907E54DFD61"><enum>(ii)</enum><text>would (but for
			 being enrolled as a family member) be eligible under section 8905(b) of such
			 title for continued enrollment as an annuitant.</text>
							</clause></subparagraph></paragraph></subsection></section><section id="HB732D975767B4066A235F16DF1E5BDCC"><enum>202.</enum><header>Government
			 contributions for annuitants under FEHBP to be determined based on length of
			 Government service</header><text display-inline="no-display-inline">Section
			 8906(b) of title 5, United States Code, as amended by section 201, is further
			 amended—</text>
				<paragraph id="H4ACB05C91112433782E3D0196B62D800"><enum>(1)</enum><text>by redesignating
			 paragraph (5) as paragraph (6); and</text>
				</paragraph><paragraph id="H49A8C1C3070946B7A0523E7ECBD1A327"><enum>(2)</enum><text>by inserting after
			 paragraph (4) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H1A6F37CE4D824BAA92B1764915D40628" style="USC">
						<paragraph id="H26A31CC1344A43B191B739C1B61EAE96" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB2D205E4EB354AA9AC999F3930268212"><enum>(A)</enum><text>In the case of an
				annuitant, the dollar amount specified in paragraph (1)(A) or (1)(B) (as
				applicable) shall be reduced by <fraction>1/6</fraction> of 1 percent for each
				full month that—</text>
								<clause id="H3D0B4A702F9245939C45698174AF55A9" indent="up1"><enum>(i)</enum><text>in the case of an annuitant within the
				meaning of subparagraph (A) or (C) of section 8901(3), the total amount of
				creditable service performed by such annuitant is less than 20 years;
				and</text>
								</clause><clause id="H791C85A33B9143598FD5FA82DC1022EB" indent="up1"><enum>(ii)</enum><text>in the case of an annuitant within
				the meaning of subparagraph (B) or (D) of section 8901(3), the total amount of
				creditable service performed by the deceased employee or former employee (as
				referred to in such subparagraph (B) or (D), as applicable) is less than 20
				years.</text>
								</clause></subparagraph><subparagraph id="HF78FDEE5F2D74EA69500C346D0B91876" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term
				<term>creditable service</term> means any employment creditable under section
				8332 or 8411.</text>
							</subparagraph><subparagraph id="H1C765E39252A4D1DBFD7D217CC1DB391" indent="up1"><enum>(C)</enum><text>Nothing in this paragraph shall apply
				in the case of any individual who becomes an annuitant, within the meaning of
				section 8901(3), before January 1,
				2010.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H1641DABC8FB44B2400DCC7FEB90300FF"><enum>203.</enum><header>Benefits under
			 CSRS and FERS to be computed based on modified definition of <quote>average
			 pay</quote></header>

			 general</header><text display-inline="yes-display-inline">Section 8331(4) of
			 title 5, United States Code, is amended by striking <quote>3</quote> each place

			 date</header><text>The amendments made by subsection (a) shall apply with
			 respect to any annuity which is payable based on a separation from service

			 provision</header><text display-inline="yes-display-inline">For purposes of any
			 annuity which is payable based on a separation from service occurring before
			 October 1, 2008, the provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/8331">section 8331(4)</external-xref> of title 5, United States
			 Code, shall be applied as if the amendments made by subsection (a) had not been
			 enacted.</text>

			 annuity supplement under FERS and related retirement systems</header>
				<subsection id="HB3F5ED6B24024EB5875B1F97AECCE58"><enum>(a)</enum><header>Supplements under
			 FERS</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">Chapter 84</external-xref> of title 5, United States Code, is
			 amended—</text>
					<paragraph id="HF04C5F7BAA9549018393D15BF3F3B10"><enum>(1)</enum><text>by
			 repealing sections 8421 and 8421a; and</text>

			 of Federal law that prohibit the expenditure of appropriated funds to conduct
			 natural gas leasing and preleasing activities for any area of the Outer
			 Continental Shelf shall have no force or effect with respect to such
			 activities.</text>
				</subsection><subsection id="H67DE9FC2357648199138A7E0840289E8"><enum>(b)</enum><header>Revocation
			 withdrawals</header><text>All withdrawals of Federal submerged lands of the
			 Outer Continental Shelf from leasing, including withdrawals by the President
			 under the authority of section 12(a) of the Outer Continental Shelf Lands Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/1341">43 U.S.C. 1341(a)</external-xref>), are hereby revoked and are no longer in effect with
			 respect to the leasing of areas for exploration for, and development and
			 production of, natural gas.</text>
				</subsection><subsection id="H781FE548D3624B7197C546785FF9DB2C"><enum>(c)</enum><header>Prohibitions and
			 withdrawals for oil not affected</header><text>This section does not
			 affect—</text>
					<paragraph id="H17190F4CE9824A78002F612C001EB5B1"><enum>(1)</enum><text display-inline="yes-display-inline">any prohibition on the expenditure of
			 appropriated funds to conduct oil leasing or preleasing activities; and</text>
					</paragraph><paragraph id="HB39B3230DCB34C85A5BAE1932BBDDCFA"><enum>(2)</enum><text>any withdrawal of
			 Federal submerged lands from leasing for exploration for, and development and
			 production of, oil.</text>
					</paragraph></subsection></section><section id="H0F7DAFA6066B48F89E00B000A1AFB375"><enum>303.</enum><header>Outer
			 Continental Shelf natural gas leasing program</header><text display-inline="no-display-inline">The Outer Continental Shelf Lands Act (43
			 U.S.C. 1331 et seq.) is amended by inserting after section 9 the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H33699C44772441200012BEE0EB128977" style="OLC">
					<section id="H6D092BF3E095405290C20001ADEE25B2"><enum>10.</enum><header>Moratoria area
				and State approval requirement with respect to natural gas leasing</header>
						<subsection id="HA9814F170863448F882011B3003D6C7F"><enum>(a)</enum><header>Buffer
				zone</header><text display-inline="yes-display-inline">The Secretary may not
				grant any natural gas lease for any area of the outer Continental Shelf that is
				located within 25 miles of the coastline of a State.</text>
						</subsection><subsection id="H4C58492946C3443ABD714345FF08C8B2"><enum>(b)</enum><header>State approval
				requirement</header>
							<paragraph id="HA48F5F37C45B4E28A5AB05FA70B2E794"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may not
				issue any lease authorizing exploration for, or development of, natural gas in
				any area of the outer Continental Shelf that is located within 50 miles of the
				coastline of a State unless the State has enacted a law approving of the
				issuance of such leases by the Secretary.</text>
							</paragraph><paragraph id="H8EFC8BF7D0F844C60078E03082C47B00"><enum>(2)</enum><header>State approval
				permanent</header><text>Repeal of such a law by a State shall have no effect
				for purposes of paragraph (1).</text>
							</paragraph></subsection><subsection id="H18FE1E46CCEF459AAD1179145F5EDFC0"><enum>(c)</enum><header>State
				disapproval authority</header><text></text>
							<paragraph id="H00B6FEA996F243EE871850B1939CF8B0"><enum>(1)</enum><header>In
				general</header><text>The Secretary may not issue any lease authorizing
				exploration for, or development of, natural gas in any area of the outer
				Continental Shelf that is located more than 50 miles and less than 100 miles
				from the coastline of a State if the State has enacted a law disapproving of
				the issuance of such leases by the Secretary.</text>
							</paragraph><paragraph id="HEF75155520814169823FF17FFF00021C"><enum>(2)</enum><header>Requirements for
				State law</header><text>A law enacted by a State for purposes of paragraph
				(1)—</text>
								<subparagraph id="HD761113542604472B94285A93117B666"><enum>(A)</enum><text>shall have no
				force or effect for purposes of paragraph (1) unless first enacted by the State
				within the one-year period beginning on the date of the enactment of the
				<short-title>National Environment and Energy Development
				Act</short-title>; and</text>
								</subparagraph><subparagraph id="HF21A822B06A8422DA66713191B69CE4"><enum>(B)</enum><text>shall have no force
				or effect for purposes of paragraph (1) after the end of the 2-year period
				beginning on the date it first takes effect, unless the State, in the 2-year
				period preceding the application of the law for purposes of paragraph (1),
				enacted legislation extending the effectiveness of the
				law.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="HF197C9AC87564BEC99A9232825C2FF34" section-type="subsequent-section"><enum>304.</enum><header>Natural gas
			 leasing</header><text display-inline="no-display-inline">Section 8 of the Outer
			 Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref>) is further amended by adding at
			 the end the following subsection:</text>
				<quoted-block id="H92B950ACF238491F93AA2B11288CE243" style="OLC">
					<subsection id="HD037D3DB0C8D444AA122ABE12BF4A7E1"><enum>(r)</enum><header>Natural gas
				leasing</header>
						<paragraph id="H496EC364D1E643420047D97400DEB28"><enum>(1)</enum><header>In
				general</header><text>The Secretary may issue leases under this section that
				authorize development and production of natural gas and associated condensate
				in accordance with regulations promulgated under paragraph (2).</text>
						</paragraph><paragraph id="H408AB28BA7BA44978535B27D25FE9EEA"><enum>(2)</enum><header>Regulations</header><text>Before
				issuing any lease under paragraph (1), the Secretary must promulgate
				regulations that—</text>
							<subparagraph id="H0D8CD8E7D970433EB57B0707151EA083"><enum>(A)</enum><text>define what
				constitutes natural gas, condensate, and oil;</text>
							</subparagraph><subparagraph id="HD9E9AFC60228492982DE3729209DCB90"><enum>(B)</enum><text>establish the
				lessee’s rights and obligations regarding condensate produced in association
				with natural gas;</text>
							</subparagraph><subparagraph id="H6FEF53690B6C4A9CBFA947E007D16BDF"><enum>(C)</enum><text>prescribe
				procedures and requirements that the lessee of a lease issued under this
				subsection must follow if the lessee discovers oil deposits in the course of
				exploration or development; and</text>
							</subparagraph><subparagraph id="H07C9A0389F9C4CD596CDEF6E5179A2E0"><enum>(D)</enum><text>establish such
				other requirements for natural gas leases as the Secretary considers
				appropriate.</text>
							</subparagraph></paragraph><paragraph id="H8A8667CBA6BB49C3AD6D39CE872445A6"><enum>(3)</enum><header>Application of
				other laws</header><text>All provisions of this Act or any other Federal law or
				regulations that apply to oil and natural gas leases for the Outer Continental
				Shelf shall apply to natural gas-only leases authorized under this
				subsection.</text>
						</paragraph><paragraph id="HEC2004F971C343DF9546B4B818A2C186"><enum>(4)</enum><header>Existing
				leases</header><text>At the request of the lessee of an oil and gas lease in
				effect under this section on the date of enactment of this subsection, and
				under the requirements prescribed in regulations promulgated under paragraph
				(2), the Secretary may restrict development under such a lease to natural gas
				and associated condensate.</text>
						</paragraph><paragraph id="HA90F439B419C49A9B065E8D251A65014"><enum>(5)</enum><header>Oil and gas
				leasing programs</header><text>The Secretary may include provisions regarding
				issuance of natural gas leases in the outer Continental shelf leasing program
				that applies for the 5-year period beginning in 2007, notwithstanding any draft
				proposal for such program issued before the date of the enactment of this
				subsection.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H55B45E52B05E47CE9F7B0538BE00BE39"><enum>(6)</enum><header>Prohibitions and
				withdrawals for oil not affected</header><text>This subsection does not
				affect—</text>
							<subparagraph id="H87AD8C1AFA2A4808B4A11D8E72A8CCB7"><enum>(A)</enum><text display-inline="yes-display-inline">any prohibition on the expenditure of
				appropriated funds to conduct oil leasing or preleasing activities; and</text>
							</subparagraph><subparagraph id="H632D9BE0108F43018F1032DEDDFF3DF2"><enum>(B)</enum><text>any withdrawal of
				Federal submerged lands from leasing for exploration for, and development and
				production of,
				oil.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HDB14344D5ADC4288A1E704846C2873E8"><enum>305.</enum><header>Policies
			 regarding buying and building American</header>
				<subsection id="HC05C3D0ACC424EAC8DB36EC93F72811"><enum>(a)</enum><header>Intent of
			 Congress</header><text>It is the intent of the Congress that this title, among
			 other things, result in a healthy and growing American industrial,
			 manufacturing, transportation, and service sector employing the vast talents of
			 America’s workforce to assist in the development of affordable energy from the
			 Outer Continental Shelf. Moreover, the Congress intends to monitor the
			 deployment of personnel and material in the Outer Continental Shelf to
			 encourage the development of American technology and manufacturing to enable
			 United States workers to benefit from this title by good jobs and careers, as
			 well as the establishment of important industrial facilities to support
			 expanded access to American resources.</text>
				</subsection><subsection id="HB89F89F8CDC14B81BF52AE1BA6B27808"><enum>(b)</enum><header>Safeguard for
			 Extraordinary Ability</header><text>Section 30(a) of the Outer Continental
			 Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1356">43 U.S.C. 1356(a)</external-xref>) is amended in the matter preceding
			 paragraph (1) by striking <quote>regulations which</quote> and inserting
			 <quote>regulations that shall be supplemental and complimentary with and under
			 no circumstances a substitution for the provisions of the Constitution and laws
			 of the United States extended to the subsoil and seabed of the outer
			 Continental Shelf pursuant to section 4 of this Act, except insofar as such
			 laws would otherwise apply to individuals who have extraordinary ability in the
			 sciences, arts, education, or business, which has been demonstrated by
			 sustained national or international acclaim, and that</quote>.</text>
				</subsection></section></title><title id="H8ED98171A158479BA95ED38E0878AAA1"><enum>IV</enum><header>Oil
			 and gas leasing program for lands within the Coastal Plain of Alaska</header>
			<section id="HC0128780DF8740869B623267A9F85E28" section-type="section-one"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the
			 <quote><short-title>American Energy Independence and Price
			 Reduction Act</short-title></quote>.</text>
			</section><section id="H693B12002515471D827E2800D7633959"><enum>402.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="HF94F82E7635C41E7B046F9BCE3F8C558"><enum>(1)</enum><header>Coastal
			 Plain</header><text>The term <quote>Coastal Plain</quote> means that area
			 described in appendix I to part 37 of title 50, Code of Federal
			 Regulations.</text>
				</paragraph><paragraph id="H24D7EA4B7663493D9B87F719FCF9863F"><enum>(2)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote>, except as otherwise provided, means the
			 Secretary of the Interior or the Secretary’s designee.</text>
				</paragraph></section><section id="H090DB36C186E47D4A756F1D59BF4FD71"><enum>403.</enum><header>Leasing program
			 for lands within the Coastal Plain</header>
				<subsection id="H74591770EB694EA3A95831B5B1875DE3"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall take such actions as are
			 necessary—</text>
					<paragraph id="H27D2DA8D7DD84216813E4711A8493755"><enum>(1)</enum><text>to establish and
			 implement, in accordance with this title and acting through the Director of the
			 Bureau of Land Management in consultation with the Director of the United
			 States Fish and Wildlife Service, a competitive oil and gas leasing program
			 that will result in an environmentally sound program for the exploration,
			 development, and production of the oil and gas resources of the Coastal Plain;
			 and</text>
					</paragraph><paragraph id="H8A1E4BDB85004D1FBCC5F0D68C70EFAE"><enum>(2)</enum><text>to administer the
			 provisions of this title through regulations, lease terms, conditions,
			 restrictions, prohibitions, stipulations, and other provisions that ensure the
			 oil and gas exploration, development, and production activities on the Coastal
			 Plain will result in no significant adverse effect on fish and wildlife, their
			 habitat, subsistence resources, and the environment, including, in furtherance
			 of this goal, by requiring the application of the best commercially available
			 technology for oil and gas exploration, development, and production to all
			 exploration, development, and production operations under this title in a
			 manner that ensures the receipt of fair market value by the public for the
			 mineral resources to be leased.</text>
					</paragraph></subsection><subsection id="H023E9B3822F64CBAA705584D6167F68"><enum>(b)</enum><header>Repeal</header>
					<paragraph id="H3A382668F34A4CD3BEE378F1766E0500"><enum>(1)</enum><header>Repeal</header><text>Section
			 1003 of the Alaska National Interest Lands Conservation Act of 1980 (16 U.S.C.
			 3143) is repealed.</text>
					</paragraph><paragraph id="HC2858CF17FFE4A6DA5BD75C005DB7223"><enum>(2)</enum><header>Conforming
			 amendment</header><text>The table of contents in section 1 of such Act is
			 amended by striking the item relating to section 1003.</text>
					</paragraph></subsection><subsection id="H515F2469FE2649589C17DF72D6D5CC8B"><enum>(c)</enum><header>Compliance with
			 requirements under certain other laws</header>
					<paragraph id="HC0159AC07BEB4D4BADF19248308F65E4"><enum>(1)</enum><header>Compatibility</header><text>For
			 purposes of the National Wildlife Refuge System Administration Act of 1966 (16
			 U.S.C. 668dd et seq.), the oil and gas leasing program and activities
			 authorized by this section in the Coastal Plain are deemed to be compatible
			 with the purposes for which the Arctic National Wildlife Refuge was
			 established, and no further findings or decisions are required to implement
			 this determination.</text>
					</paragraph><paragraph id="HF9FAFF0299794933ACEC2D10E9925639"><enum>(2)</enum><header>Adequacy of the
			 Department of the Interior’s legislative environmental impact
			 statement</header><text>The <quote>Final Legislative Environmental Impact
			 Statement</quote> (April 1987) on the Coastal Plain prepared pursuant to
			 section 1002 of the Alaska National Interest Lands Conservation Act of 1980 (16
			 U.S.C. 3142) and section 102(2)(C) of the National Environmental Policy Act of
			 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) is deemed to satisfy the requirements under the
			 National Environmental Policy Act of 1969 that apply with respect to prelease
			 activities, including actions authorized to be taken by the Secretary to
			 develop and promulgate the regulations for the establishment of a leasing
			 program authorized by this title before the conduct of the first lease
			 sale.</text>
					</paragraph><paragraph id="HE8F7A7381F384D3295FE96986F59244F"><enum>(3)</enum><header>Compliance with
			 NEPA for other actions</header><text>Before conducting the first lease sale
			 under this title, the Secretary shall prepare an environmental impact statement
			 under the National Environmental Policy Act of 1969 with respect to the actions
			 authorized by this title that are not referred to in paragraph (2).
			 Notwithstanding any other law, the Secretary is not required to identify
			 nonleasing alternative courses of action or to analyze the environmental
			 effects of such courses of action. The Secretary shall only identify a
			 preferred action for such leasing and a single leasing alternative, and analyze
			 the environmental effects and potential mitigation measures for those two
			 alternatives. The identification of the preferred action and related analysis
			 for the first lease sale under this title shall be completed within 18 months
			 after the date of enactment of this Act. The Secretary shall only consider
			 public comments that specifically address the Secretary’s preferred action and
			 that are filed within 20 days after publication of an environmental analysis.
			 Notwithstanding any other law, compliance with this paragraph is deemed to
			 satisfy all requirements for the analysis and consideration of the
			 environmental effects of proposed leasing under this title.</text>
					</paragraph></subsection><subsection id="H97DCB803510D44D3B7F7FB80C89415CB"><enum>(d)</enum><header>Relationship to
			 State and local authority</header><text>Nothing in this title shall be
			 considered to expand or limit State and local regulatory authority.</text>
				</subsection><subsection id="HF2A035B4326C48179B4194899796A1F5"><enum>(e)</enum><header>Special
			 areas</header>
					<paragraph id="HFFF90A473E0E42B2AEDAF29154684607"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, after consultation with the State of
			 Alaska, the city of Kaktovik, and the North Slope Borough, may designate up to
			 a total of 45,000 acres of the Coastal Plain as a Special Area if the Secretary
			 determines that the Special Area is of such unique character and interest so as
			 to require special management and regulatory protection. The Secretary shall
			 designate as such a Special Area the Sadlerochit Spring area, comprising
			 approximately 4,000 acres.</text>
					</paragraph><paragraph id="H57708A4D866240089452EC2424A9752D"><enum>(2)</enum><header>Management</header><text>Each
			 such Special Area shall be managed so as to protect and preserve the area’s
			 unique and diverse character including its fish, wildlife, and subsistence
			 resource values.</text>
					</paragraph><paragraph id="H221079B0619646F09CB9C51DEA8F239D"><enum>(3)</enum><header>Exclusion from
			 leasing or surface occupancy</header><text>The Secretary may exclude any
			 Special Area from leasing. If the Secretary leases a Special Area, or any part
			 thereof, for purposes of oil and gas exploration, development, production, and
			 related activities, there shall be no surface occupancy of the lands comprising
			 the Special Area.</text>
					</paragraph><paragraph id="H630AE1BD16354021A110D9AB28339CE9"><enum>(4)</enum><header>Directional
			 drilling</header><text>Notwithstanding the other provisions of this subsection,
			 the Secretary may lease all or a portion of a Special Area under terms that
			 permit the use of horizontal drilling technology from sites on leases located
			 outside the Special Area.</text>
					</paragraph></subsection><subsection id="HE2A541F2B3FD438886892986469E1FA6"><enum>(f)</enum><header>Limitation on
			 closed areas</header><text>The Secretary’s sole authority to close lands within
			 the Coastal Plain to oil and gas leasing and to exploration, development, and
			 production is that set forth in this title.</text>
				</subsection><subsection id="H7CD86787720B4596A364F63658F1261F"><enum>(g)</enum><header>Regulations</header>
					<paragraph id="HD08F9BAE91C24AC5AA0670B205CC24DB"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall prescribe such regulations as may be
			 necessary to carry out this title, including rules and regulations relating to
			 protection of the fish and wildlife, their habitat, subsistence resources, and
			 environment of the Coastal Plain, by no later than 15 months after the date of
			 enactment of this Act.</text>
					</paragraph><paragraph id="HA2381F5967804ADA9BE7F3533E68DEAF"><enum>(2)</enum><header>Revision of
			 regulations</header><text>The Secretary shall periodically review and, if
			 appropriate, revise the rules and regulations issued under subsection (a) to
			 reflect any significant biological, environmental, or engineering data that
			 come to the Secretary’s attention.</text>
					</paragraph></subsection></section><section id="H12CBF29263464214B5AC004EA4C74960"><enum>404.</enum><header>Lease
			 sales</header>
				<subsection id="H3FEC97CEA7484429B9C779BA84F43BCE"><enum>(a)</enum><header>In
			 general</header><text>Lands may be leased pursuant to this title to any person
			 qualified to obtain a lease for deposits of oil and gas under the Mineral
			 Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>).</text>
				</subsection><subsection id="H7D80778BD2E2447DAF9FBDE0544682D"><enum>(b)</enum><header>Procedures</header><text>The
			 Secretary shall, by regulation, establish procedures for—</text>
					<paragraph id="HD6B69F19140C4E1E97056D0031003C50"><enum>(1)</enum><text>receipt and
			 consideration of sealed nominations for any area in the Coastal Plain for
			 inclusion in, or exclusion (as provided in subsection (c)) from, a lease
			 sale;</text>
					</paragraph><paragraph id="H1B1D03EED23B4CBF9CCE0007EE43D139"><enum>(2)</enum><text>the holding of
			 lease sales after such nomination process; and</text>
					</paragraph><paragraph id="H7276CBBC10F8441E8F4FED9B8E2500B1"><enum>(3)</enum><text>public notice of
			 and comment on designation of areas to be included in, or excluded from, a
			 lease sale.</text>
					</paragraph></subsection><subsection id="H7737390CB44D40A485D4F5E300CFD835"><enum>(c)</enum><header>Lease sale
			 bids</header><text>Bidding for leases under this title shall be by sealed
			 competitive cash bonus bids.</text>
				</subsection><subsection id="H7D8AE2EE56934A60BF22ECF175048EA"><enum>(d)</enum><header>Acreage minimum
			 in first sale</header><text>In the first lease sale under this title, the
			 Secretary shall offer for lease those tracts the Secretary considers to have
			 the greatest potential for the discovery of hydrocarbons, taking into
			 consideration nominations received pursuant to subsection (b)(1), but in no
			 case less than 200,000 acres.</text>
				</subsection><subsection id="H82ECD3CA01F14794006E46163056F8F1"><enum>(e)</enum><header>Timing of lease
			 sales</header><text>The Secretary shall—</text>
					<paragraph id="H484ED1858B5E45EF95C2E5B018A4A1F"><enum>(1)</enum><text>conduct the first
			 lease sale under this title within 22 months after the date of the enactment of
			 this Act;</text>
					</paragraph><paragraph id="H5C4930F7704B46129D57AD3C608DAB93"><enum>(2)</enum><text display-inline="yes-display-inline">evaluate the bids in such sale and issue
			 leases resulting from such sale, within 90 days after the date of the
			 completion of such sale; and</text>
					</paragraph><paragraph id="HE4775A5EB3E5406FB81796858F0000D0"><enum>(3)</enum><text>conduct additional
			 sales so long as sufficient interest in development exists to warrant, in the
			 Secretary’s judgment, the conduct of such sales.</text>
					</paragraph></subsection></section><section id="HEBE5BDC9475D47F4B9973C89B6870065"><enum>405.</enum><header>Grant of leases
			 by the Secretary</header>
				<subsection id="HBEC01B10952B40858D73A1289F761D74"><enum>(a)</enum><header>In
			 general</header><text>The Secretary may grant to the highest responsible
			 qualified bidder in a lease sale conducted pursuant to section 404 any lands to
			 be leased on the Coastal Plain upon payment by the lessee of such bonus as may
			 be accepted by the Secretary.</text>
				</subsection><subsection id="H33836B3BE4D74DB7B2A970082ADCD71"><enum>(b)</enum><header>Subsequent
			 transfers</header><text>No lease issued under this title may be sold,
			 exchanged, assigned, sublet, or otherwise transferred except with the approval
			 of the Secretary. Prior to any such approval the Secretary shall consult with,
			 and give due consideration to the views of, the Attorney General.</text>
				</subsection></section><section id="H6F46A758DC4F4701A2AB00A29483D1C"><enum>406.</enum><header>Lease terms and
			 conditions</header>
				<subsection id="HFF30DD882ABB486C91B486B500163E67"><enum>(a)</enum><header>In
			 general</header><text>An oil or gas lease issued pursuant to this title
			 shall—</text>
					<paragraph id="H9C232FCAF0E14C0BBF7E422D65EB0095"><enum>(1)</enum><text>provide for the
			 payment of a royalty of not less than 12½ percent in amount or value of the
			 production removed or sold from the lease, as determined by the Secretary under
			 the regulations applicable to other Federal oil and gas leases;</text>
					</paragraph><paragraph id="H80FA25DE0A2E440291B5344CB6296F17"><enum>(2)</enum><text>provide that the
			 Secretary may close, on a seasonal basis, portions of the Coastal Plain to
			 exploratory drilling activities as necessary to protect caribou calving areas
			 and other species of fish and wildlife;</text>
					</paragraph><paragraph id="H65F6703B48BA420EB556A2AD1101A099"><enum>(3)</enum><text>require that the
			 lessee of lands within the Coastal Plain shall be fully responsible and liable
			 for the reclamation of lands within the Coastal Plain and any other Federal
			 lands that are adversely affected in connection with exploration, development,
			 production, or transportation activities conducted under the lease and within
			 the Coastal Plain by the lessee or by any of the subcontractors or agents of
			 the lessee;</text>
					</paragraph><paragraph id="HE5F05E23EFA942FA9FF8399F30C22B8B"><enum>(4)</enum><text>provide that the
			 lessee may not delegate or convey, by contract or otherwise, the reclamation
			 responsibility and liability to another person without the express written
			 approval of the Secretary;</text>
					</paragraph><paragraph id="H1415A8B2CAE94307A9FE35795CB37CD6"><enum>(5)</enum><text>provide that the
			 standard of reclamation for lands required to be reclaimed under this title
			 shall be, as nearly as practicable, a condition capable of supporting the uses
			 which the lands were capable of supporting prior to any exploration,
			 development, or production activities, or upon application by the lessee, to a
			 higher or better use as approved by the Secretary;</text>
					</paragraph><paragraph id="HCA8C757450DF450FB51DBD7303E22E46"><enum>(6)</enum><text>contain terms and
			 conditions relating to protection of fish and wildlife, their habitat,
			 subsistence resources, and the environment as required pursuant to section
			 403(a)(2);</text>
					</paragraph><paragraph id="HB918A48D47084492AAEF3922A874E2FB"><enum>(7)</enum><text>provide that the
			 lessee, its agents, and its contractors use best efforts to provide a fair
			 share, as determined by the level of obligation previously agreed to in the
			 1974 agreement implementing section 29 of the Federal Agreement and Grant of
			 Right of Way for the Operation of the Trans-Alaska Pipeline, of employment and
			 contracting for Alaska Natives and Alaska Native Corporations from throughout
			 the State;</text>
					</paragraph><paragraph id="H4B73001B1D0E48018553D95CCCD59D6E"><enum>(8)</enum><text>prohibit the
			 export of oil produced under the lease; and</text>
					</paragraph><paragraph id="HEEC1374AB6424EB8B981101D22EBAE3B"><enum>(9)</enum><text>contain such other
			 provisions as the Secretary determines necessary to ensure compliance with the
			 provisions of this title and the regulations issued under this title.</text>
					</paragraph></subsection><subsection id="HF1B3522B01EB4BAEA7A4E53C6BE27F03"><enum>(b)</enum><header>Project labor
			 agreements</header><text>The Secretary, as a term and condition of each lease
			 under this title and in recognizing the Government’s proprietary interest in
			 labor stability and in the ability of construction labor and management to meet
			 the particular needs and conditions of projects to be developed under the
			 leases issued pursuant to this title and the special concerns of the parties to
			 such leases, shall require that the lessee and its agents and contractors
			 negotiate to obtain a project labor agreement for the employment of laborers
			 and mechanics on production, maintenance, and construction under the
			 lease.</text>
				</subsection></section><section id="HAAEF941C609C4A76AB875BD17E061163"><enum>407.</enum><header>Coastal plain
			 environmental protection</header>
				<subsection id="H06B809F9D69F4AF799A9B6D125A82DE9"><enum>(a)</enum><header>No significant
			 adverse effect standard To govern authorized Coastal Plain
			 activities</header><text>The Secretary shall, consistent with the requirements
			 of section 403, administer the provisions of this title through regulations,
			 lease terms, conditions, restrictions, prohibitions, stipulations, and other
			 provisions that—</text>
					<paragraph id="H410C8B22927F4430AA537E8E4BF53800"><enum>(1)</enum><text>ensure the oil and
			 gas exploration, development, and production activities on the Coastal Plain
			 will result in no significant adverse effect on fish and wildlife, their
			 habitat, and the environment;</text>
					</paragraph><paragraph id="H3FED4383A86D4801845E0000DDC1D847"><enum>(2)</enum><text>require the
			 application of the best commercially available technology for oil and gas
			 exploration, development, and production on all new exploration, development,
			 and production operations; and</text>
					</paragraph><paragraph id="HF56CD1F2454440E300E06739FE63D000"><enum>(3)</enum><text>ensure that the
			 maximum amount of surface acreage covered by production and support facilities,
			 including airstrips and any areas covered by gravel berms or piers for support
			 of pipelines, does not exceed 2,000 acres on the Coastal Plain.</text>
					</paragraph></subsection><subsection id="H8AEA20E00EA449EDA418F5522591E78E"><enum>(b)</enum><header>Site-specific
			 assessment and mitigation</header><text>The Secretary shall also require, with
			 respect to any proposed drilling and related activities, that—</text>
					<paragraph id="HAE8A4A37FB7E40DCA9166ED078B3E11E"><enum>(1)</enum><text>a
			 site-specific analysis be made of the probable effects, if any, that the
			 drilling or related activities will have on fish and wildlife, their habitat,
			 subsistence resources, and the environment;</text>
					</paragraph><paragraph id="HBC476C9B6F9747079D8D46CAF7EED475"><enum>(2)</enum><text>a
			 plan be implemented to avoid, minimize, and mitigate (in that order and to the
			 extent practicable) any significant adverse effect identified under paragraph
			 (1); and</text>
					</paragraph><paragraph id="HEAA195AC2789477B9248EA6CBEBD024"><enum>(3)</enum><text>the development of
			 the plan shall occur after consultation with the agency or agencies having
			 jurisdiction over matters mitigated by the plan.</text>
					</paragraph></subsection><subsection id="HF85DD060E23F4AE5A6F5A11B3E3CE359"><enum>(c)</enum><header>Regulations To
			 protect coastal plain fish and wildlife resources, subsistence users, and the
			 environment</header><text>Before implementing the leasing program authorized by
			 this title, the Secretary shall prepare and promulgate regulations, lease
			 terms, conditions, restrictions, prohibitions, stipulations, and other measures
			 designed to ensure that the activities undertaken on the Coastal Plain under
			 this title are conducted in a manner consistent with the purposes and
			 environmental requirements of this title.</text>
				</subsection><subsection id="H4F7FBEABB81940E882AB10FA0217ADE7"><enum>(d)</enum><header>Compliance with
			 Federal and State environmental laws and other requirements</header><text>The
			 proposed regulations, lease terms, conditions, restrictions, prohibitions, and
			 stipulations for the leasing program under this title shall require compliance
			 with all applicable provisions of Federal and State environmental law, and
			 shall also require the following:</text>
					<paragraph id="H8D6E1536B7E74C8E84C400A284FFA330"><enum>(1)</enum><text>Standards at least
			 as effective as the safety and environmental mitigation measures set forth in
			 items 1 through 29 at pages 167 through 169 of the <quote>Final Legislative
			 Environmental Impact Statement</quote> (April 1987) on the Coastal
			 Plain.</text>
					</paragraph><paragraph id="HDBB6EE1B2C5540B28DE6B6CA49B78CA7"><enum>(2)</enum><text>Seasonal
			 limitations on exploration, development, and related activities, where
			 necessary, to avoid significant adverse effects during periods of concentrated
			 fish and wildlife breeding, denning, nesting, spawning, and migration.</text>
					</paragraph><paragraph id="H98B00A0A2FC54D45A66DF2119CC9A719"><enum>(3)</enum><text>That exploration
			 activities, except for surface geological studies, be limited to the period
			 between approximately November 1 and May 1 each year and that exploration
			 activities shall be supported, if necessary, by ice roads, winter trails with
			 adequate snow cover, ice pads, ice airstrips, and air transport methods, except
			 that such exploration activities may occur at other times if the Secretary
			 finds that such exploration will have no significant adverse effect on the fish
			 and wildlife, their habitat, and the environment of the Coastal Plain.</text>
					</paragraph><paragraph id="H68925F3975CF4DA100425587BC98662E"><enum>(4)</enum><text>Design safety and
			 construction standards for all pipelines and any access and service roads,
			 that—</text>
						<subparagraph id="H507CEA34C7CF43ECB7637CF8328E273B"><enum>(A)</enum><text>minimize, to the
			 maximum extent possible, adverse effects upon the passage of migratory species
			 such as caribou; and</text>
						</subparagraph><subparagraph id="H813ED52287894839B1117CADED38004F"><enum>(B)</enum><text>minimize adverse
			 effects upon the flow of surface water by requiring the use of culverts,
			 bridges, and other structural devices.</text>
						</subparagraph></paragraph><paragraph id="H5C042E3FAD51470BA8C385166700A705"><enum>(5)</enum><text>Prohibitions on
			 general public access and use on all pipeline access and service roads.</text>
					</paragraph><paragraph id="HF4E800E23FFC4119A500F0D577CFB48F"><enum>(6)</enum><text>Stringent
			 reclamation and rehabilitation requirements, consistent with the standards set
			 forth in this title, requiring the removal from the Coastal Plain of all oil
			 and gas development and production facilities, structures, and equipment upon
			 completion of oil and gas production operations, except that the Secretary may
			 exempt from the requirements of this paragraph those facilities, structures, or
			 equipment that the Secretary determines would assist in the management of the
			 Arctic National Wildlife Refuge and that are donated to the United States for
			 that purpose.</text>
					</paragraph><paragraph id="H8898987EF92646F08293726D144B135B"><enum>(7)</enum><text>Appropriate
			 prohibitions or restrictions on access by all modes of transportation.</text>
					</paragraph><paragraph id="H5407B84D073E4DDEAE6D5F004EFD25EA"><enum>(8)</enum><text>Appropriate
			 prohibitions or restrictions on sand and gravel extraction.</text>
					</paragraph><paragraph id="HD5E8E7A4878E4EA9BECC5DD60C7C23B"><enum>(9)</enum><text>Consolidation of
			 facility siting.</text>
					</paragraph><paragraph id="H49DA4DD7FF9B4163B68781005CD4BAC"><enum>(10)</enum><text>Appropriate
			 prohibitions or restrictions on use of explosives.</text>
					</paragraph><paragraph id="HA26607E5CACD4C78B05F1411ECB200D3"><enum>(11)</enum><text>Avoidance, to the
			 extent practicable, of springs, streams, and river system; the protection of
			 natural surface drainage patterns, wetlands, and riparian habitats; and the
			 regulation of methods or techniques for developing or transporting adequate
			 supplies of water for exploratory drilling.</text>
					</paragraph><paragraph id="H533E87C8119C49CC97A752A6D2AAAD8B"><enum>(12)</enum><text>Avoidance or
			 minimization of air traffic-related disturbance to fish and wildlife.</text>
					</paragraph><paragraph id="HCE44EFAC27814CAB92821C16649DA92C"><enum>(13)</enum><text>Treatment and
			 disposal of hazardous and toxic wastes, solid wastes, reserve pit fluids,
			 drilling muds and cuttings, and domestic wastewater, including an annual waste
			 management report, a hazardous materials tracking system, and a prohibition on
			 chlorinated solvents, in accordance with applicable Federal and State
			 environmental law.</text>
					</paragraph><paragraph id="HB7EC41BCD2EE49669311A2EB109C7C0"><enum>(14)</enum><text>Fuel storage and
			 oil spill contingency planning.</text>
					</paragraph><paragraph id="HA4E97A6700A04B089768B61E8E00D666"><enum>(15)</enum><text>Research,
			 monitoring, and reporting requirements.</text>
					</paragraph><paragraph id="H88E8631930C54C728332D3CACD23AA"><enum>(16)</enum><text>Field crew
			 environmental briefings.</text>
					</paragraph><paragraph id="H23FEDF965332441187F165D5F53994D"><enum>(17)</enum><text>Avoidance of
			 significant adverse effects upon subsistence hunting, fishing, and trapping by
			 subsistence users.</text>
					</paragraph><paragraph id="HC608D47E03BA48B696E86890B1439F00"><enum>(18)</enum><text>Compliance with
			 applicable air and water quality standards.</text>
					</paragraph><paragraph id="H005220433D6B4264A905D440FD328018"><enum>(19)</enum><text>Appropriate
			 seasonal and safety zone designations around well sites, within which
			 subsistence hunting and trapping shall be limited.</text>
					</paragraph><paragraph id="H3B06D4B84251493B828022E171A00504"><enum>(20)</enum><text>Reasonable
			 stipulations for protection of cultural and archeological resources.</text>
					</paragraph><paragraph id="HE2B0EAE7F4B845A5A59898396C2B3E1C"><enum>(21)</enum><text>All other
			 protective environmental stipulations, restrictions, terms, and conditions
			 deemed necessary by the Secretary.</text>
					</paragraph></subsection><subsection id="HDEB46029138F4CC7A54CA65E1254CAF5"><enum>(e)</enum><header>Considerations</header><text>In
			 preparing and promulgating regulations, lease terms, conditions, restrictions,
			 prohibitions, and stipulations under this section, the Secretary shall consider
			 the following:</text>
					<paragraph id="HDD7FE751A96C4BB8A175101BEC6533EB"><enum>(1)</enum><text>The stipulations
			 and conditions that govern the National Petroleum Reserve-Alaska leasing
			 program, as set forth in the 1999 Northeast National Petroleum Reserve-Alaska
			 Final Integrated Activity Plan/Environmental Impact Statement.</text>
					</paragraph><paragraph id="H1C9C039B4E87481BA0FCB4D2B3943B96"><enum>(2)</enum><text>The environmental
			 protection standards that governed the initial Coastal Plain seismic
			 exploration program under parts 37.31 to 37.33 of title 50, Code of Federal
			 Regulations.</text>
					</paragraph><paragraph id="H4AD11CCD584144B587E3706D51EC7924"><enum>(3)</enum><text>The land use
			 stipulations for exploratory drilling on the KIC–ASRC private lands that are
			 set forth in Appendix 2 of the August 9, 1983, agreement between Arctic Slope
			 Regional Corporation and the United States.</text>
					</paragraph></subsection><subsection id="HF0E963DDFA544185AD28C7CEA44B62A6"><enum>(f)</enum><header>Facility
			 consolidation planning</header>
					<paragraph id="H8C68627E1C744C94861DA57856E7789"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall, after providing for public notice
			 and comment, prepare and update periodically a plan to govern, guide, and
			 direct the siting and construction of facilities for the exploration,
			 development, production, and transportation of Coastal Plain oil and gas
			 resources.</text>
					</paragraph><paragraph id="HA1851D65A7B6420191F7723800BF928C"><enum>(2)</enum><header>Objectives</header><text>The
			 plan shall have the following objectives:</text>
						<subparagraph id="H50A9CD905EA6423E98C8E2C587C28875"><enum>(A)</enum><text>Avoiding
			 unnecessary duplication of facilities and activities.</text>
						</subparagraph><subparagraph id="H84FB3869D01346E6BF43BBC50949FF96"><enum>(B)</enum><text>Encouraging
			 consolidation of common facilities and activities.</text>
						</subparagraph><subparagraph id="HAF105DF35D8A426FAAE4EDB8AA13F0BF"><enum>(C)</enum><text>Locating or
			 confining facilities and activities to areas that will minimize impact on fish
			 and wildlife, their habitat, and the environment.</text>
						</subparagraph><subparagraph id="H7FC6B2E54F024992AB52A85400035F3D"><enum>(D)</enum><text>Utilizing existing
			 facilities wherever practicable.</text>
						</subparagraph><subparagraph id="HB56BE90DFDE24FD5AB8926003BD66455"><enum>(E)</enum><text>Enhancing
			 compatibility between wildlife values and development activities.</text>
						</subparagraph></paragraph></subsection><subsection id="H2BB33D3B8FAA46C293B9007D5D01113B"><enum>(g)</enum><header>Access to public
			 lands</header><text>The Secretary shall—</text>
					<paragraph id="H2BA49C30C46A42EEA759BFEB47BCCF9B"><enum>(1)</enum><text>manage public
			 lands in the Coastal Plain subject to subsections (a) and (b) of section 811 of
			 the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3121">16 U.S.C. 3121</external-xref>);
			 and</text>
					</paragraph><paragraph id="H3CCA856C3255409193298F1913003F1B"><enum>(2)</enum><text>ensure that local
			 residents shall have reasonable access to public lands in the Coastal Plain for
			 traditional uses.</text>
					</paragraph></subsection></section><section id="H0A035E95B4AA4162B29FCEA2A323F700"><enum>408.</enum><header>Expedited
			 judicial review</header>
				<subsection id="H5702CC976E1A45F898CA3491076300A1"><enum>(a)</enum><header>Filing of
			 complaint</header>
					<paragraph id="H831D3B31061549E2AEF9DE1FB8D30094"><enum>(1)</enum><header>Deadline</header><text>Subject
			 to paragraph (2), any complaint seeking judicial review of any provision of
			 this title or any action of the Secretary under this title shall be
			 filed—</text>
						<subparagraph id="H92A94E887AD947B8B5C6CC62DAFC42CB"><enum>(A)</enum><text>except as provided
			 in subparagraph (B), within the 90-day period beginning on the date of the
			 action being challenged; or</text>
						</subparagraph><subparagraph id="H3B16F44AC42E4144AAF700C6B0EB33B7"><enum>(B)</enum><text>in the case of a
			 complaint based solely on grounds arising after such period, within 90 days
			 after the complainant knew or reasonably should have known of the grounds for
			 the complaint.</text>
						</subparagraph></paragraph><paragraph id="H6160B47661A14374866C87B3341F2148"><enum>(2)</enum><header>Venue</header><text>Any
			 complaint seeking judicial review of any provision of this title or any action
			 of the Secretary under this title may be filed only in the United States Court
			 of Appeals for the District of Columbia.</text>
					</paragraph><paragraph id="H187FDD25BE46429E84AE03A1C3F8001E"><enum>(3)</enum><header>Limitation on
			 scope of certain review</header><text>Judicial review of a Secretarial decision
			 to conduct a lease sale under this title, including the environmental analysis
			 thereof, shall be limited to whether the Secretary has complied with the terms
			 of this title and shall be based upon the administrative record of that
			 decision. The Secretary’s identification of a preferred course of action to
			 enable leasing to proceed and the Secretary’s analysis of environmental effects
			 under this title shall be presumed to be correct unless shown otherwise by
			 clear and convincing evidence to the contrary.</text>
					</paragraph></subsection><subsection id="H88E969A09CD346FE804B1F2C2949D8B8"><enum>(b)</enum><header>Limitation on
			 other review</header><text>Actions of the Secretary with respect to which
			 review could have been obtained under this section shall not be subject to
			 judicial review in any civil or criminal proceeding for enforcement.</text>
				</subsection></section><section id="HCD5720689DB04008A29C2878EE9EF83"><enum>409.</enum><header>Federal and
			 State distribution of revenues</header>
				<subsection id="H8D24740D58294DB291A59400BF7E5C9D"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, of the amount
			 of adjusted bonus, rental, and royalty revenues from Federal oil and gas
			 leasing and operations authorized under this title—</text>
					<paragraph id="H66746E0916F6469886F72B00698F7341"><enum>(1)</enum><text>50 percent shall
			 be paid to the State of Alaska; and</text>
					</paragraph><paragraph id="HB91E0B180B20444897ECD35BF1CCFF6"><enum>(2)</enum><text display-inline="yes-display-inline">except as provided in section 412(d), the
			 balance shall be transferred to the ANWR Alternative Energy Trust Fund
			 established by this title.</text>
					</paragraph></subsection><subsection id="H5405977D9C134946BB7912829CCA2C47"><enum>(b)</enum><header>Payments to
			 Alaska</header><text>Payments to the State of Alaska under this section shall
			 be made semiannually.</text>
				</subsection></section><section id="H87B9718B0B7341369F23CCE9B18CA57C"><enum>410.</enum><header>Rights-of-way
			 across the Coastal Plain</header>
				<subsection id="HE0053888B09C4EFFA04EDE18483DA799"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall issue rights-of-way and easements
			 across the Coastal Plain for the transportation of oil and gas—</text>
					<paragraph id="H5F88DA8D75684499B86FA0DB463BC9A0"><enum>(1)</enum><text>except as provided
			 in paragraph (2), under section 28 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/185">30 U.S.C. 185</external-xref>),
			 without regard to title XI of the Alaska National Interest Lands Conservation
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/30/3161">30 U.S.C. 3161 et seq.</external-xref>); and</text>
					</paragraph><paragraph id="H2AC5351E13FF42A7ACA6656E2DF11B77"><enum>(2)</enum><text>under title XI of
			 the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/30/3161">30 U.S.C. 3161 et seq.</external-xref>),
			 for access authorized by sections 1110 and 1111 of that Act (16 U.S.C. 3170 and
			 3171).</text>
					</paragraph></subsection><subsection id="HA7638923B50040C9BD9D02EA7FA7CDC"><enum>(b)</enum><header>Terms and
			 conditions</header><text>The Secretary shall include in any right-of-way or
			 easement issued under subsection (a) such terms and conditions as may be
			 necessary to ensure that transportation of oil and gas does not result in a
			 significant adverse effect on the fish and wildlife, subsistence resources,
			 their habitat, and the environment of the Coastal Plain, including requirements
			 that facilities be sited or designed so as to avoid unnecessary duplication of
			 roads and pipelines.</text>
				</subsection><subsection id="H03839AB559D84D9C9DE5E42CB53560E2"><enum>(c)</enum><header>Regulations</header><text>The
			 Secretary shall include in regulations under section 403(g) provisions granting
			 rights-of-way and easements described in subsection (a) of this section.</text>
				</subsection></section><section id="HBEA0C2E99D9648C98EE76F7402ED0042"><enum>411.</enum><header>Conveyance</header><text display-inline="no-display-inline">In order to maximize Federal revenues by
			 removing clouds on title to lands and clarifying land ownership patterns within
			 the Coastal Plain, the Secretary, notwithstanding the provisions of section
			 1302(h)(2) of the Alaska National Interest Lands Conservation Act (16 U.S.C.
			 3192(h)(2)), shall convey—</text>
				<paragraph id="HEFF5C30C1CBB43ADB0320748E2FA3DB"><enum>(1)</enum><text>to
			 the Kaktovik Inupiat Corporation the surface estate of the lands described in
			 paragraph 1 of Public Land Order 6959, to the extent necessary to fulfill the
			 Corporation’s entitlement under sections 12 and 14 of the Alaska Native Claims
			 Settlement Act (43 U.S.C. 1611 and 1613) in accordance with the terms and
			 conditions of the Agreement between the Department of the Interior, the United
			 States Fish and Wildlife Service, the Bureau of Land Management, and the
			 Kaktovik Inupiat Corporation effective January 22, 1993; and</text>
				</paragraph><paragraph id="HEF84619E331A44EFAAC7311E52EE4700"><enum>(2)</enum><text>to the Arctic
			 Slope Regional Corporation the remaining subsurface estate to which it is
			 entitled pursuant to the August 9, 1983, agreement between the Arctic Slope
			 Regional Corporation and the United States of America.</text>
				</paragraph></section><section id="HB551DD5B6ACA4CEAA47B572B46D300D6"><enum>412.</enum><header>Local
			 government impact aid and community service assistance</header>
				<subsection id="H0737D07C7D9D44E4BFCA33F56B09F6D5"><enum>(a)</enum><header>Financial
			 assistance authorized</header>
					<paragraph id="H5F4B99937932472D92FDC28336861681"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may use amounts available from the Coastal
			 Plain Local Government Impact Aid Assistance Fund established by subsection (d)
			 to provide timely financial assistance to entities that are eligible under
			 paragraph (2) and that are directly impacted by the exploration for or
			 production of oil and gas on the Coastal Plain under this title.</text>
					</paragraph><paragraph id="HD8A075E307634FA1B8FDF54B6E31EE5E"><enum>(2)</enum><header>Eligible
			 entities</header><text>The North Slope Borough, the City of Kaktovik, and any
			 other borough, municipal subdivision, village, or other community in the State
			 of Alaska that is directly impacted by exploration for, or the production of,
			 oil or gas on the Coastal Plain under this title, as determined by the
			 Secretary, shall be eligible for financial assistance under this
			 section.</text>
					</paragraph></subsection><subsection id="H71B4D33287F9433FA727CFE367441BF3"><enum>(b)</enum><header>Use of
			 assistance</header><text>Financial assistance under this section may be used
			 only for—</text>
					<paragraph id="H321CAD0BCB9745FA00B164C06E27671F"><enum>(1)</enum><text>planning for
			 mitigation of the potential effects of oil and gas exploration and development
			 on environmental, social, cultural, recreational, and subsistence
			 values;</text>
					</paragraph><paragraph id="HDDDC4FD5E90A4E3284130077C013D252"><enum>(2)</enum><text>implementing
			 mitigation plans and maintaining mitigation projects;</text>
					</paragraph><paragraph id="H72E6ABB54EDE436286B92939F82153AA"><enum>(3)</enum><text>developing,
			 carrying out, and maintaining projects and programs that provide new or
			 expanded public facilities and services to address needs and problems
			 associated with such effects, including fire-fighting, police, water, waste
			 treatment, medivac, and medical services; and</text>
					</paragraph><paragraph id="H56D075F94D98405F88881E93EDB69E02"><enum>(4)</enum><text>establishment of a
			 coordination office, by the North Slope Borough, in the City of Kaktovik, which
			 shall—</text>
						<subparagraph id="H2A5B3BAEDBDD4AEB8F46F4FE235F36D4"><enum>(A)</enum><text>coordinate with
			 and advise developers on local conditions, impact, and history of the areas
			 utilized for development; and</text>
						</subparagraph><subparagraph id="HCB4E4F8B4C98404A9907E3A5FDCF9D3D"><enum>(B)</enum><text>provide to the
			 Committee on Resources of the House of Representatives and the Committee on
			 Energy and Natural Resources of the Senate an annual report on the status of
			 coordination between developers and the communities affected by
			 development.</text>
						</subparagraph></paragraph></subsection><subsection id="HD15CBC2F47BD4B608EF7E912404969C6"><enum>(c)</enum><header>Application</header>
					<paragraph id="HCE2441AD89BF4EF88512A56C07A7D9D3"><enum>(1)</enum><header>In
			 general</header><text>Any community that is eligible for assistance under this
			 section may submit an application for such assistance to the Secretary, in such
			 form and under such procedures as the Secretary may prescribe by
			 regulation.</text>
					</paragraph><paragraph id="H1169A2DCA65F49C7924E4647ABBC225F"><enum>(2)</enum><header>North Slope
			 Borough communities</header><text>A community located in the North Slope
			 Borough may apply for assistance under this section either directly to the
			 Secretary or through the North Slope Borough.</text>
					</paragraph><paragraph id="H8EB5F0C9CD3A4A13A8D4A0357B7B78C6"><enum>(3)</enum><header>Application
			 assistance</header><text>The Secretary shall work closely with and assist the
			 North Slope Borough and other communities eligible for assistance under this
			 section in developing and submitting applications for assistance under this
			 section.</text>
					</paragraph></subsection><subsection id="H649B31E308824DBE898953E14F160152"><enum>(d)</enum><header>Establishment of
			 fund</header>
					<paragraph id="H1348E3FAEDDF4A04BDA5CA84CF18828"><enum>(1)</enum><header>In
			 general</header><text>There is established in the Treasury the Coastal Plain
			 Local Government Impact Aid Assistance Fund.</text>
					</paragraph><paragraph id="H450C01A23322473B944ECE4FFBA0EFF1"><enum>(2)</enum><header>Use</header><text>Amounts
			 in the fund may be used only for providing financial assistance under this
			 section.</text>
					</paragraph><paragraph id="H43C5D4E44BA5468D97FD8F2D2CD9D2"><enum>(3)</enum><header>Deposits</header><text>Subject
			 to paragraph (4), there shall be deposited into the fund amounts received by
			 the United States as revenues derived from rents, bonuses, and royalties from
			 Federal leases and lease sales authorized under this title.</text>
					</paragraph><paragraph id="H94C172B7C62442A7AE92DA4E8FD9D1F"><enum>(4)</enum><header>Limitation on
			 deposits</header><text>The total amount in the fund may not exceed
			 $11,000,000.</text>
					</paragraph><paragraph id="H3AD443E61F25423695145DA82EA3E7B3"><enum>(5)</enum><header>Investment of
			 balances</header><text>The Secretary of the Treasury shall invest amounts in
			 the fund in interest bearing government securities.</text>
					</paragraph></subsection><subsection id="HDC4E144D91FE47FEA3AA54F8B0098B8"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text>To provide financial assistance under this section
			 there is authorized to be appropriated to the Secretary from the Coastal Plain
			 Local Government Impact Aid Assistance Fund $5,000,000 for each fiscal
			 year.</text>
				</subsection></section><section id="H27E02466AE1446F5A7AE3F20800030C"><enum>413.</enum><header>ANWR Alternative
			 Energy Trust Fund</header><text display-inline="yes-display-inline"></text>
				<subsection id="HB4CD794AF01143A2BE2D94F1979BEE79"><enum>(a)</enum><header>Establishment of
			 trust fund</header><text>There is established in the Treasury of the United
			 States a trust fund to be known as the <quote>ANWR Alternative Energy Trust
			 Fund</quote>, consisting of such amounts as may be transferred to the ANWR
			 Alternative Energy Trust Fund as provided in section 409.</text>
				</subsection><subsection id="HD19CD16BE742426C9B3288FA82A60027"><enum>(b)</enum><header>Expenditures
			 from ANWR Alternative Energy Trust Fund</header><text></text>
					<paragraph id="H8394F2B02B194EDC94A98D46CDBCB59"><enum>(1)</enum><header>In
			 general</header><text>Amounts in the ANWR Alternative Energy Trust Fund shall
			 be available without further appropriation to carry out specified provisions of
			 the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; in this section referred to
			 as <quote>EPAct2005</quote>) and the Energy Independence and Security Act of
			 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>; in this section referred to as
			 <quote>EISAct2007</quote>), as follows:</text>
