		<official-title>To amend title XVIII of the Social Security Act to extend
		  and revise incentive payments for physician scarcity areas under part B of the
		  Medicare Program.</official-title>

		<section id="H72AA5C8DAF9B48768113E3C74F6DF66C" section-type="section-one"><enum>1.</enum><header>Extension and revision of
			 Medicare incentive payments for physician scarcity areas</header>
			<subsection id="H345DE19BE4294807BA5830F2F91098CC"><enum>(a)</enum><header>5-year
			 extension</header><text display-inline="yes-display-inline">Paragraph (1) of
			 section 1833(u) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(u)</external-xref>) is amended by
			 striking <quote>2008</quote> and inserting <quote>2012</quote>.</text>
			</subsection><subsection id="HCBB5C4835A0947EA817B26A6C6820672"><enum>(b)</enum><header>Change in
			 eligibility criteria</header><text display-inline="yes-display-inline">Such
			 section is further amended—</text>
				<paragraph id="H93D9EB8144284E0E8F7D8F0093AC002E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(A)—</text>
					<subparagraph id="H3BB4AF06088A47FCB56E9038B065D200"><enum>(A)</enum><text>by inserting
			 <quote>or paragraph (8), as the case may be</quote> after <quote>paragraph
			 (4)</quote>; and</text>
					</subparagraph><subparagraph id="HCF34A5DD7E204AFBB2B630B48FC7CF2C"><enum>(B)</enum><text>by inserting
			 <quote>(or 2.5 percent in the cases specified in paragraph (8))</quote> after
			 <quote>5 percent</quote>;</text>
					</subparagraph></paragraph><paragraph id="H0CD6E5EC5E434AFBB186571851665002"><enum>(2)</enum><text>in each of clauses
			 (i) and (ii) of paragraph (2)(C), by inserting <quote>and paragraph (8)</quote>
			 after <quote>in this paragraph</quote>;</text>
				</paragraph><paragraph id="H566AEC6BAA424542803B785379F54126"><enum>(3)</enum><text>in paragraph (3),
			 by striking <quote>The Secretary</quote> and inserting <quote>For years before
			 2009, the Secretary</quote>;</text>
				</paragraph><paragraph id="H7AA847E193BE40B1924E2978258C1CEC"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (4)(A), by striking <quote>The
			 Secretary</quote> and inserting <quote>For years before 2009, the
			 Secretary</quote>; and</text>
				</paragraph><paragraph id="HFAFBF3D502774D23AC43DB10052CEDCC"><enum>(5)</enum><text>by adding at the end the following new paragraph:</text>

						<paragraph id="HE944815B8A5B4072B2A29F005C1E2B65"><enum>(8)</enum><header>New rules for
				scarcity areas</header>
							<subparagraph id="H999A3F874F894496915FEF01FEE2D10"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				subparagraph (B)(ii), in applying paragraph (1) in the case of physicians’
				services furnished on or after July 1, 2008—</text>
								<clause id="H3197E3FD7D724DFAAC135D46CE675BFD"><enum>(i)</enum><text>the term
				<term>primary care scarcity county</term> means a county (or equivalent area)
				which the Secretary identifies as having a primary care ratio (as determined
				under paragraph (2)(C)(i)) of less than 1 to 150;</text>
								</clause><clause id="H18EA5D2A45634CA58173A3383344F53E"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>specialist care scarcity
				county</term> means a county (or equivalent area) which the Secretary
				identifies as having a specialist care ratio (as determined under paragraph
				(2)(C)(ii)) of less than 1 to 150;</text>
								</clause><clause id="H287A676115E04275B953DE1D63E25F61"><enum>(iii)</enum><text display-inline="yes-display-inline">for physicians’ services furnished by a
				primary care physician in a primary care scarcity county (as defined in clause
				(i)) which the Secretary identifies under such clause as having a primary care
				ratio of more than 1 to 300, <quote>2.5 percent</quote> shall be substituted
				for <quote>5 percent</quote> in paragraph (1); and</text>
								</clause><clause id="H45FFF50DDE894B8B9D995EA41517FBD"><enum>(iv)</enum><text display-inline="yes-display-inline">for physicians’ services furnished by a
				physician, who is not a primary care physician, in a specialist care scarcity
				county (as defined in clause (ii)) which the Secretary identifies under such
				clause as having a specialist care ratio of more than 1 to 300, <quote>2.5
				percent</quote> shall be substituted for <quote>5 percent</quote> in paragraph
				(1).</text>
								</clause><continuation-text continuation-text-level="subparagraph">The
				provisions of subparagraphs (B) through (D) of paragraph (4) shall apply to
				identification of counties under this subparagraph in the same manner as they
				apply to the identification of counties under subparagraph (A) of paragraph
				(4).</continuation-text></subparagraph><subparagraph id="HE8FCDB01C95644BDAE8EEE1D6344D3FD"><enum>(B)</enum><header>Review of
				ratios</header>
								<clause id="HD3F378007D5847CF98427D50A2E4A721"><enum>(i)</enum><header>Study</header><text>The
				Secretary, in consultation with the Medicare Payment Advisory Commission and
				the Comptroller General of the United States, shall conduct a study to better
				determine whether the primary and specialist care ratios applied under
				subparagraph (A) are appropriate to provide the proper incentive payments for
				physician scarcity areas.</text>
								</clause><clause id="H0BBFD0E3B4F44418A5C1E13C6F80713C"><enum>(ii)</enum><header>Authority to
				apply different ratios</header><text display-inline="yes-display-inline">In the
				case of physicians’ services furnished on or after such date (no earlier than
				January 1, 2012) as the Secretary may specify, if the Secretary determines
				based on the study conducted under clause (i) that other ratios should be
				substituted for the 1-to-300 and 1-to-150 ratios specified in subparagraph (A),
				the Secretary may substitute such other ratios in applying such
				subparagraph.</text>
