		<section id="H3FA08AA8130F4CBA91117D60AE39E48D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Commodity Futures Restoration Act</quote>.</text>
		</section><section id="H4289845EF12047D89E69D652CF71A762"><enum>2.</enum><header>Jurisdiction of
			 the Commodity Futures Trading Commission extended to derivatives involving
			 energy commodities</header>
			<subsection id="H2B4BE226CAC04A90A890216604ED774C"><enum>(a)</enum><header>Removal of
			 energy commodities from definition of exempt commodity</header><text>Section
			 1a(14) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a(14)</external-xref>) is amended by inserting
			 <quote>, an energy commodity,</quote> after <quote>excluded
			 commodity</quote>.</text>
			</subsection><subsection id="HD67826920FD248C69800DF5402163548"><enum>(b)</enum><header>Energy commodity
			 defined</header><text>Section 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>) is
			 amended—</text>
				<paragraph id="HCBB823AF51564B758D51F66937EC512B"><enum>(1)</enum><text>by redesignating
			 paragraphs (13) through (34) as paragraphs (14) through (35), respectively;
			 and</text>
				</paragraph><paragraph id="H9C11E6712FAD4E739B22935D8F5B8C64"><enum>(2)</enum><text>by inserting after
			 paragraph (12) the following:</text>
					<quoted-block id="H133E93E1717D4D01918CBDBD88782A8" style="OLC">
						<paragraph id="H00159B3EEEE349B3B97749E4A6796364"><enum>(13)</enum><header>Energy
				commodity</header><text>The term <term>energy commodity</term> means—</text>
							<subparagraph id="H3B3B781AFE0E4AA3A333517781335EF4"><enum>(A)</enum><text>coal;</text>
							</subparagraph><subparagraph id="H64F88081C74A493993A77BB83B1D8420"><enum>(B)</enum><text>crude oil,
				gasoline, diesel fuel, heating oil, and propane;</text>
							</subparagraph><subparagraph id="HA991DF63C59D48C3A45D63279335AB0"><enum>(C)</enum><text>electricity;</text>
							</subparagraph><subparagraph id="H78E59C25716F4EC58810DCD9667201A1"><enum>(D)</enum><text>natural gas;
				and</text>
							</subparagraph><subparagraph id="H5B944BC628B44230B97F594D7FB25711"><enum>(E)</enum><text display-inline="yes-display-inline">any other commodity (other than an excluded
				commodity, a metal, or an agricultural commodity) that is used as a source of
				energy, as the Commission deems
				appropriate.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H7BE04897D379425B864B44CD23F12EB3"><enum>3.</enum><header>Narrowing of the
			 foreign board of trade exception to the requirement that certain futures
			 transactions be conducted on or through a designated contract market or
			 derivatives transaction execution facility</header><text display-inline="no-display-inline">Section 4 of the Commodity Exchange Act (7
			 U.S.C. 6) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HD8A420094E4A45739CE4A82FA26BF04F" style="OLC">
				<subsection id="HB5BD465F8A6747C9BDB6DAD555FFDDE4"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HFF10C52C82EC4336A7D2983100F85F49"><enum>(1)</enum><text>For purposes of this
				Act, a board of trade, exchange, or market shall not be considered to be
				foreign or located outside the United States if—</text>
						<subparagraph id="H71FA8ACC2FFF4E729D00F9A4D02DD682" indent="up1"><enum>(A)</enum><text>the board of trade, exchange, or
				market has an affiliate located in the United States;</text>
						</subparagraph><subparagraph id="H2C7490F860864EC998C96E478CFE1B40" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a
				contract of sale of a commodity other than an exempt commodity for future
				delivery in the United States is executed or traded on or through the board of
				trade, exchange, or market; or</text>
						</subparagraph><subparagraph id="HBF8387431F614CC492D3BA7C887AAD" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">a
				significant price discovery contract is executed or traded on or through the
				board of trade, exchange, or market.</text>
						</subparagraph></paragraph><paragraph id="HA752ABD5E55745E3BDC5714236138DB1" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For the purposes of paragraph (1)(A), an
				entity is deemed to be an affiliate of a board of trade, exchange or market
				if—</text>
						<subparagraph id="H5679BDAC80294026BB009B26FF93EA3E"><enum>(A)</enum><text>the entity owns 50 percent or more of
				the board of trade, exchange, or market;</text>
						</subparagraph><subparagraph id="HCB6488BF12DA44F39D21EAC5A9C4189"><enum>(B)</enum><text>the board, exchange, or market owns 50
				percent or more of the entity; or</text>
						</subparagraph><subparagraph id="HB3DAFEEF9BC44270BC3EE1BCF9FC5EC"><enum>(C)</enum><text display-inline="yes-display-inline">a
				third person owns 50 percent or more of the entity and 50 percent or more of
				the board of trade, exchange, or
				market.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H262CA7C3DF0546D78540A7DBFA4BCE89"><enum>4.</enum><header>Jurisdiction of
			 the Commodity Futures Trading Commission extended to swaps involving an energy
			 commodity</header>
			<subsection id="HB203E915D3CC4649B1B3FBC275243FCE"><enum>(a)</enum><header>Elimination of
			 exemption for excluded swap transactions involving an energy
			 commodity</header><text display-inline="yes-display-inline">Section 2(g) of the
			 Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2">7 U.S.C. 2(g)</external-xref>) is amended by inserting <quote>or an
			 energy commodity</quote> after <quote>agricultural commodity</quote>.</text>
			</subsection><subsection id="HE427F3D053C242FCAD54A3B674432634"><enum>(b)</enum><header>Swaps involving
			 an energy commodity To be taken into account in determining compliance with
			 position and transaction limits, without regard to exemption for bona fide
			 hedging transactions</header><text>Section 4a(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/6a">7 U.S.C. 6a(c)</external-xref>)
			 is amended by adding at the end the following: <quote>The preceding provisions
			 of this subsection shall not apply to swaps that involve an energy
			 commodity.</quote>.</text>
			</subsection></section><section id="HE784ADDE122640B9BCDE7FDDDF143E3D"><enum>5.</enum><header>Progress
			 report</header>
			<subsection id="H0D92816C4F74459D8962C1D5784D72DC"><enum>(a)</enum><header>Report on limits
			 fixed with respect to energy commodities</header><text display-inline="yes-display-inline">Within 90 day after the effective date of
			 this Act, the Commodity Futures Trading Commission shall submit to the
			 Committee on Agriculture of the House of Representatives and the Committee on
			 Agriculture, Nutrition, and Forestry of the Senate a report on—</text>
				<paragraph id="H6BEA190056E4453A958871E4845FB1D7"><enum>(1)</enum><text>the progress of
			 the Commission in implementing the amendments made by the preceding provisions
			 of this Act, including an explanation of—</text>
					<subparagraph id="H4E9ADD3B3B8F44BCB52B561366FF8D64"><enum>(A)</enum><text>any exemptions
			 provided by the Commission from the requirements resulting from any such
			 amendment; and</text>
					</subparagraph><subparagraph id="H499D4D781EC14CC4AD081145228EB283"><enum>(B)</enum><text>if the Commission
			 has not established position limits with respect to contracts of sale of an
			 energy commodity for future delivery, why the Commission has not done so;
			 and</text>
					</subparagraph></paragraph><paragraph id="HC1460E343325429F9D7CFEDFA29443A2"><enum>(2)</enum><text>any margin
			 requirements applicable to transactions in the contracts.</text>
				</paragraph></subsection><subsection id="HE32FA88311834C129138C9E96D63C622"><enum>(b)</enum><header>Definitions</header><text>The
			 terms used in subsection (a) shall have the meanings given the terms in the
			 Commodity Exchange Act.</text>
			</subsection></section><section id="HDC58B5453630439989B33EE301490037"><enum>6.</enum><header>Federal Energy
			 Regulatory Commission oversight</header><text display-inline="no-display-inline">Nothing in this Act shall affect the
			 authority of the Federal Energy Regulatory Commission under the Natural Gas Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/717">15 U.S.C. 717 et seq.</external-xref>) or any other law to obtain information or otherwise
			 carry out the responsibilities of the Federal Energy Regulatory
			 Commission.</text>
		</section><section id="H0708BE16CAE2452989FB5BC8D0C29B44"><enum>7.</enum><header>Federal Trade
			 Commission authority over market manipulation</header><text display-inline="no-display-inline">Nothing in this Act shall be construed as
			 interfering with the prohibition contained in subtitle B of title VIII of the
			 Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17301">42 U.S.C. 17301 et seq.</external-xref>) or the
			 authority of the Federal Trade Commission to enforce such subtitle.</text>
		</section><section id="HD2CA9CB86DE74EB18DF1844FD113C27"><enum>8.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall take effect 6 months after the date of the
			 enactment of this Act.</text>
