		<official-title>To amend title 35, United States Code, and the Trademark
		  Act of 1946 to provide that the Secretary of Commerce, in consultation with the
		  Director of the United States Patent and Trademark Office, shall appoint
		  administrative patent judges and administrative trademark judges, and for other
		  purposes.</official-title>

		<section id="H6803D3CED5B94F0EB5A1BBF859978F5F" section-type="section-one"><enum>1.</enum><header>Appointment of administrative
			 patent judges and administrative trademark judges</header>
			<subsection id="H8B9574A4F0DB4E79B1C01B6779B0E1EF"><enum>(a)</enum><header>Administrative
			 patent judges</header><text display-inline="yes-display-inline">Section 6 of
			 title 35, United States Code, is amended—</text>
				<paragraph id="H68AEAD6342B245E8A7E3B03F63362BC6"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="HBEC7ABEB6CC2424FBBF0CBC251549D91"><enum>(A)</enum><text>in the second
			 sentence, by striking <quote>Deputy Commissioner</quote> and inserting
			 <quote>Deputy Director</quote>; and</text>
					</subparagraph><subparagraph id="H4057183D7AC54CD4A7D1A19897E7ABBF"><enum>(B)</enum><text>in the last
			 sentence, by striking <quote>Director</quote> and inserting <quote>Secretary of
			 Commerce, in consultation with the Director</quote>; and</text>
					</subparagraph><subparagraph id="H96FF09A4843D4321B0878F9600FC548E"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

							<subsection id="H3EEEB81D1E314DC8B82EA74100A5A0DE"><enum>(c)</enum><header>Authority of the
				Secretary</header><text>The Secretary of Commerce may, in his or her
				discretion, deem the appointment of an administrative patent judge who, before
				the date of the enactment of this subsection, held office pursuant to an
				appointment by the Director to take effect on the date on which the Director
				initially appointed the administrative patent judge.</text>
							</subsection><subsection display-inline="no-display-inline" id="H7BAD00E03C1C475AA8B4A10837FFE7B8"><enum>(d)</enum><header>Defense to
				challenge of appointment</header><text>It shall be a defense to a challenge to
				the appointment of an administrative patent judge on the basis of the judge’s
				having been originally appointed by the Director that the administrative patent
				judge so appointed was acting as a de facto
				officer.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HD0673E1050F9476ABB131955A595AE63"><enum>(b)</enum><header>Administrative
			 trademark judges</header><text>Section 17 of the Act entitled <quote>An Act to
			 provide for the registration and protection of trademarks used in commerce, to
			 carry out the provisions of certain international conventions, and for other
			 purposes</quote>, approved July 5, 1946 (commonly referred to as the
			 <quote>Trademark Act of 1946</quote>; <external-xref legal-doc="usc" parsable-cite="usc/15/1067">15 U.S.C. 1067</external-xref>), is amended—</text>
				<paragraph id="H038BD47C0B054D499DC0F3E4C04B595"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
					<subparagraph id="HF46CAC06A1034AF9AD881345200767BD"><enum>(A)</enum><text>by inserting
			 <quote>Deputy Director of the United States Patent and Trademark
			 Office,</quote> after <quote>Director,</quote>; and</text>
					</subparagraph><subparagraph id="H2F126BDDC4F94362AD060727D8E7BAE3"><enum>(B)</enum><text>by striking
			 <quote>appointed by the Director</quote> and inserting <quote>appointed by the
			 Secretary of Commerce, in consultation with the Director</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H522A570C7B894D98BDAC60DF10FB8B66"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

						<subsection id="H0D3BDEEB161349B2BF3CCECDBFCDDEF6"><enum>(c)</enum><header>Authority of the
				Secretary</header><text>The Secretary of Commerce may, in his or her
				discretion, deem the appointment of an administrative trademark judge who,
				before the date of the enactment of this subsection, held office pursuant to an
				appointment by the Director to take effect on the date on which the Director
				initially appointed the administrative trademark judge.</text>
						</subsection><subsection id="H5A5D228C4F974E3CB455BC659663F6D5"><enum>(d)</enum><header>Defense to
				challenge of appointment</header><text display-inline="yes-display-inline">It
