<legis-type>AN ACT</legis-type> 
<official-title display="yes">To require the Secretary of the Treasury to mint coins in commemoration of veterans who became disabled for life while serving in the Armed Forces of the United States.</official-title> 
</form>

<section display-inline="no-display-inline" id="H4ADB924689D54ED1A9883EEA5C7FDD90" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Veterans Disabled for Life Commemorative Coin Act</short-title></quote>.</text></section> 
<section id="H004836AD768C4F8EA5CD8DE84B43C7F8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="H3C9410CE89E9460EAF5780D7B947C456"><enum>(1)</enum><text>The Armed Forces of the United States have answered the call and served with distinction around the world—from hitting the beaches in World War II in the Pacific and Europe, to the cold and difficult terrain in Korea, the steamy jungles of Vietnam, and the desert sands of the Middle East.</text></paragraph> 
<paragraph id="HDF2A1E023ED8447E84AC1C7FC48DE9B7"><enum>(2)</enum><text>All Americans should commemorate those who come home having survived the ordeal of war, and solemnly honor those who made the ultimate sacrifice in giving their lives for their country.</text></paragraph> 
<paragraph id="HDCED8F4CEA3F41088D5667D57863D885"><enum>(3)</enum><text>All Americans should honor the millions of living disabled veterans who carry the scars of war every day, and who have made enormous personal sacrifices defending the principles of our democracy.</text></paragraph> 
<paragraph id="H6004ADF0B435423A84F224D4E227243E"><enum>(4)</enum><text>In 2000, Congress authorized the construction of the American Veterans Disabled for Life Memorial.</text></paragraph> 
<paragraph id="H45C2A1843B2F44488DA3CA8F77F5B53B"><enum>(5)</enum><text>The United States should pay tribute to the Nation’s living disabled veterans by minting and issuing a commemorative silver dollar coin.</text></paragraph> 
<paragraph id="H5447E71A39974B249E1BD83165925105"><enum>(6)</enum><text>The surcharge proceeds from the sale of a commemorative coin would raise valuable funding for the construction of the American Veterans Disabled for Life Memorial.</text></paragraph></section> 
<section id="H739ED8B49814454ABB6E92B368928BD"><enum>3.</enum><header>Coin specifications</header> 
<subsection id="H237F46E1C395425E934FB76F3FCE1FC2"><enum>(a)</enum><header>$1 Silver Coins</header><text>The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue not more than 350,000 $1 coins in commemoration of disabled American veterans, each of which shall—</text> 
<paragraph id="H27EA372C2A314D369715017551E88F76"><enum>(1)</enum><text>weigh 26.73 grams;</text></paragraph> 
<paragraph id="H129E717961C442B98742DF0565F2ECF7"><enum>(2)</enum><text>have a diameter of 1.500 inches; and</text></paragraph> 
<paragraph id="H8EE3D083798A4AAE0044E9278541AA80"><enum>(3)</enum><text>contain 90 percent silver and 10 percent copper.</text></paragraph></subsection> 
<subsection id="H25F1FECFF7E4401DAF386E8029180057"><enum>(b)</enum><header>Legal Tender</header><text>The coins minted under this Act shall be legal tender, as provided in <external-xref legal-doc="usc" parsable-cite="usc/31/5103">section 5103</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="HBBD1B041A68C48068ED0D420B054E8BD"><enum>(c)</enum><header>Numismatic Items</header><text>For purposes of sections <external-xref legal-doc="usc" parsable-cite="usc/31/5134">5134</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/5136">5136</external-xref> of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section> 
<section id="HB7BBF7A09E864B6E95446CCF25AFABD7"><enum>4.</enum><header>Design of coins</header> 
<subsection id="H11D8180E011D4DDD83E5634900E2289C"><enum>(a)</enum><header>Design Requirements</header> 
<paragraph id="HFD20231B4CB240B0941B546E8F5EE4A1"><enum>(1)</enum><header>Design</header><text>The design of the coins minted under this Act shall be emblematic of the service of our disabled veterans who, having survived the ordeal of war, made enormous personal sacrifices defending the principles of our democracy.</text></paragraph> 
<paragraph id="H1A75C49C0F954FD29D9E83B5981BD9D2"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act, there shall be—</text> 
<subparagraph id="H3D8B0944F19F4C8CA5E8677D4C8DEB4D"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph> 
<subparagraph id="H6DAFDAEEA3AD4431B9569ED0DAD3FA00"><enum>(B)</enum><text>an inscription of the year <quote>2010</quote>; and</text></subparagraph> 
<subparagraph id="H1DA9F1880A674BBF9312BAD7D5483393"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H0ECB4CAA6FA44035A667E5FEB437FDF"><enum>(b)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text> 
<paragraph id="H70EAAA5E667D441BBB007C2F79315DA0"><enum>(1)</enum><text>selected by the Secretary, after consultation with the Disabled Veterans’ LIFE Memorial Foundation and the Commission of Fine Arts; and</text></paragraph> 
<paragraph id="H9D7068F4BBE64807991515965BCB3E35"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> 
<section id="HA80366F519054E8000F8FC1EE6B1D8E"><enum>5.</enum><header>Issuance of coins</header> 
<subsection id="HC72EB4526C3A475500D93E9699B06BEE"><enum>(a)</enum><header>Quality of Coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection> 
<subsection id="H6B7BA36537FF4259B7CB1BBF3549BB32"><enum>(b)</enum><header>Mint Facility</header> 
<paragraph id="H083822E01015417A9751378FEACADCA8"><enum>(1)</enum><header>In general</header><text>Only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</text></paragraph> 
<paragraph id="H18F5C8A973FF45D185E460016EFAFD85"><enum>(2)</enum><header>Use of the united states mint at west point, new york</header><text>It is the sense of the Congress that the coins minted under this Act should be struck at the United States Mint at West Point, New York, to the greatest extent possible.</text></paragraph></subsection> 
<subsection id="H701E73C3ECAC4E7D844070CF949E73BA"><enum>(c)</enum><header>Period for Issuance</header><text>The Secretary may issue coins under this Act only during the calendar year beginning on January 1, 2010.</text></subsection></section> 
<section id="H2ECB2FD115E84943A1F832FC1CA8C600"><enum>6.</enum><header>Sale of coins</header> 
<subsection id="H366949B4BB2E4AA29561C9307C255122"><enum>(a)</enum><header>Sale Price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text> 
<paragraph id="H8174D709C6DE4E9EAB1643D967CAE32"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> 
<paragraph id="H9BC76C6DCF2444EFB5E916DA8DD63496"><enum>(2)</enum><text>the surcharge provided in section 7 with respect to such coins; and</text></paragraph> 
<paragraph id="H84C4F88398094B6CA8887C44ADC80040"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> 
<subsection id="HB3921ACD2AA448C1BB74F681ADCA3E98"><enum>(b)</enum><header>Bulk Sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection> 
<subsection id="HF23335E9B8CE4A7799CA278B25BAF93D"><enum>(c)</enum><header>Prepaid Orders</header> 
<paragraph id="H18E1FE1C04F34B94AA2FEA5045910073"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph> 
<paragraph id="HE66C73CBFFD744BA88DD9C99A775AB23"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section> 
<section id="HB8573E35501C4F6F87F014E431A12CF7"><enum>7.</enum><header>Surcharges</header> 
<subsection id="HEB3224C010A844C892005E2B00FDEE4B"><enum>(a)</enum><header>In General</header><text>All sales of coins issued under this Act shall include a surcharge of $10 per coin.</text></subsection> 
<subsection id="H6B4D6AA94DEE43F19885FA7D862EF33D"><enum>(b)</enum><header>Distribution</header><text>Subject to <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)</external-xref> of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be paid to the Disabled Veterans’ LIFE Memorial Foundation for the purpose of establishing an endowment to support the construction of American Veterans’ Disabled for Life Memorial in Washington, D.C.</text></subsection> 
<subsection id="HFFECB10DE9434E989975241934CC1FA3"><enum>(c)</enum><header>Audits</header><text>The Comptroller General of the United States shall have the right to examine such books, records, documents, and other data of the Disabled Veterans’ LIFE Memorial Foundation as may be related to the expenditures of amounts paid under subsection (b).</text></subsection>
<subsection id="H59A57D1633DF4A67AAB409CA9CC2D338"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(m)(1)</external-xref> of title 31, United States Code (as in effect on the date of the enactment of this Act). The Secretary of the Treasury may issue guidance to carry out this subsection.</text></subsection></section>
