<official-title>To amend title 5, United States Code, to provide additional leave for Federal employees to serve as poll workers, and to direct the Election Assistance Commission to make grants to States for poll worker recruitment and training.</official-title>

<section id="HE311F66B58114CED923CAEB074E84918" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employees Deserve to Volunteer on the Elections Act of 2008</short-title></quote> or the <quote><short-title>FEDVOTE Act of 2008</short-title></quote>. </text></section> 
<section id="HFF23D1AD1D814F5E88AFD1008300DAC7" section-type="subsequent-section"><enum>2.</enum><header>Leave to serve as a poll worker</header> 
<subsection id="HA37C2CDD4E5945CC93B8E5ACF912968C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H437C8C4032EF42469CD9C0645239DBE4" display-inline="no-display-inline"> 
<section id="HF88F609B4A1D45B591508FF55E7F6B5"><enum>6329.</enum><header>Absence in connection with serving as a poll worker</header> 
<subsection id="H7125C96BD1ED4AFAA231EC056871F4D7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An employee in or under an Executive agency is entitled to leave, without loss of or reduction in pay, leave to which otherwise entitled, credit for time or service, or performance or efficiency rating, not to exceed 6 days in a leave year, in order—</text> 
<paragraph id="HFDF7F5D6D1F947E5BCF4C1D7B95CF20"><enum>(1)</enum><text>to provide election administration assistance to a State or unit of local government at a polling place on the date of any election for public office; or</text></paragraph> 
<paragraph id="H64A686481B4E4E3589F8FBC9D061F7C1"><enum>(2)</enum><text>to receive any training without which such employee would be ineligible to provide such assistance. </text></paragraph></subsection> 
<subsection id="H382DB26F1DC84171A3C271FD7469FDBD"><enum>(b)</enum><header>Regulations</header><text>The Director of the Office of Personnel Management may prescribe regulations for the administration of this section, including regulations setting forth the terms and conditions of the election administration assistance an employee may provide for purposes of subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5BF05F932A15485B8284C80753DC0848"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/6328">section 6328</external-xref> the following:</text>

<section id="HAE82ABBF260343AFA544862E94A5E000"><enum>3.</enum><header>Grants to States for Poll Worker Recruitment and Training</header> 
<subsection id="H8D041BA09E8B498484B97762D831F7D4"><enum>(a)</enum><header>Grants by Election Assistance Commission</header> 
<paragraph id="HF643C1A4232F4BFEA48C005827006761"><enum>(1)</enum><header>In general</header><text>The Election Assistance Commission (hereafter referred to as the <quote>Commission</quote>) shall make a grant to each eligible State for recruiting and training individuals to serve as nonpartisan poll workers on dates of elections for public office.</text></paragraph> 
<paragraph id="HBF050C19873C4096B2DEA3668CB45D5F"><enum>(2)</enum><header>Use of Commission materials</header><text display-inline="yes-display-inline">In carrying out activities with a grant provided under this section, the recipient of the grant shall use the manual prepared by the Commission on successful practices for poll worker recruiting, training and retention as an interactive training tool, and shall develop training programs with the participation and input of experts in adult learning.</text></paragraph></subsection> 
<subsection id="H852A4FAF1B6A4DEA8711BE703DEBD8F2"><enum>(b)</enum><header>Requirements for Eligibility</header> 
<paragraph id="HEBE091C9DC604877A03E72798CFAC28"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">Each State that desires to receive a payment under this section shall submit an application for the payment to the Commission at such time and in such manner and containing such information as the Commission shall require.</text></paragraph> 
<paragraph id="HBD8832714C024EB7868910A2DD026800"><enum>(2)</enum><header>Contents of Application</header><text display-inline="yes-display-inline">Each application submitted under paragraph (1) shall—</text> 
<subparagraph id="H20CD1ACF3E7E4E7FBC9168B02EDD5CA8"><enum>(A)</enum><text>describe the activities for which assistance under this section is sought;</text></subparagraph> 
<subparagraph id="H13CBB6FF27334A73BF009BAF442F9B2F"><enum>(B)</enum><text>provide assurances that the funds provided under this section will be used to supplement and not supplant other funds used to carry out the activities;</text></subparagraph> 
<subparagraph id="H0E5ABCB944084290989F24A45AD5699"><enum>(C)</enum><text>provide assurances that the State will furnish the Commission with information on the number of individuals who served as nonpartisan poll workers after recruitment and training with the funds provided under this section; and</text></subparagraph> 
<subparagraph id="HE6524C7D42684C26AFA3FB3E631B34C5"><enum>(D)</enum><text>provide such additional information and certifications as the Commission determines to be essential to ensure compliance with the requirements of this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H4E466C8AC5024E5F89D389C8A11EDCA"><enum>(c)</enum><header>Amount of Grant</header> 
<paragraph id="H5A29725297234BC7922B5CA1086DE8B0"><enum>(1)</enum><header>In general</header><text>The amount of a grant made to a State under this section shall be equal to the product of—</text> 
<subparagraph id="H92C713DD073748308C206B98E8772889"><enum>(A)</enum><text>the aggregate amount made available for grants to States under this section; and</text></subparagraph> 
<subparagraph id="H0E1A21AC8CA842C6BD3E09D1004030EC"><enum>(B)</enum><text>the voting age population percentage for the State.</text></subparagraph></paragraph> 
<paragraph id="HFCF75468B4CB422B8531C6BA3006C25"><enum>(2)</enum><header>Voting age population percentage defined</header><text>In paragraph (1), the <quote>voting age population percentage</quote> for a State is the quotient of—</text> 
<subparagraph id="H626942B6E3C24FD28CEB6308C9D78397"><enum>(A)</enum><text>the voting age population of the State (as determined on the basis of the most recent information available from the Bureau of the Census); and</text></subparagraph> 
<subparagraph id="H8EDB8D2C6AB4419A83C1920B32336B1"><enum>(B)</enum><text display-inline="yes-display-inline">the total voting age population of all States (as determined on the basis of the most recent information available from the Bureau of the Census).</text></subparagraph></paragraph></subsection> 
<subsection id="H0BA429AF33D149ABA143BC9BDB0012D0"><enum>(d)</enum><header>Reports to Congress</header> 
<paragraph id="HA39EEA9616A5491D8E3043F1DB3B3608"><enum>(1)</enum><header>Reports by recipients of grants</header><text display-inline="yes-display-inline">Not later than 6 months after the date on which the final grant is made under this section, each recipient of a grant shall submit a report to the Commission on the activities conducted with the funds provided by the grant.</text></paragraph> 
<paragraph id="HFF9810AFE0F64D39A9A4FE600C6A825"><enum>(2)</enum><header>Reports by Commission</header><text>Not later than 1 year after the date on which the final grant is made under this section, the Commission shall submit a report to Congress on the grants made under this section and the activities carried out by recipients with the grants, and shall include in the report such recommendations as the Commission considers appropriate.</text></paragraph></subsection> 
<subsection id="HE0D516D01C2448780035FA5900A859D9"><enum>(e)</enum><header>State Defined</header><text>In this Act, the term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, and the United States Virgin Islands.</text></subsection> 
<subsection id="HBEA6BC96BF20450196DA72E3F4EBC342"><enum>(f)</enum><header>Authorization of Appropriations</header> 
<paragraph id="HEFE00801108647BBB4F8C3AD7192219F"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to carry out this section $75,000,000. Any amount appropriated pursuant to the authority of this subsection shall remain available without fiscal year limitation until expended.</text></paragraph> 
<paragraph id="H3C952C300D094A0A876FB007D6AA000"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amount appropriated for any fiscal year pursuant to the authority of this subsection, not more than 3 percent shall be available for administrative expenses of the Commission.</text></paragraph></subsection></section> 
<section id="H845EF6214DAE4602B9AABE01425E901C"><enum>4.</enum><header>Exemption of Election Assistance Commission From Paperwork Reduction Act</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/3502">Section 3502(1)</external-xref> of title 44, United States Code, is amended—</text> 
<paragraph id="H44E204D45EA549A09DACE6FE8473B4B"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of subparagraph (C);</text></paragraph> 
<paragraph id="H0FAF1410113449589C3C08BAA6EB90B7"><enum>(2)</enum><text>by striking the semicolon at the end of subparagraph (D) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HF6FB43070CCB418EBA4BEB5053A8BA05"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>
