<official-title>To expedite the construction of new refining capacity on brownfield sites in the United States, and for other purposes.</official-title>

<section id="HF60D7132695E4622B4D87B00EC6517D9" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text> 
<paragraph id="H08E009A10F2A44A5A02EAD9C76C828D6"><enum>(1)</enum><text>the term <quote>brownfield site</quote> has the meaning given that term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>);</text></paragraph> 
<paragraph id="HFB16DCB7C1DC45CBAD2E58B0974572D"><enum>(2)</enum><text>the term <quote>designated refinery</quote> means a refinery designated under section 2(a);</text></paragraph> 
<paragraph id="HBC5B0CE47BB24AF2A1755852568C00F4"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Federal refinery authorization</term>—</text> 
<subparagraph id="HB981E528F0374B13B27FCC1CA026AE20" display-inline="no-display-inline"><enum>(A)</enum><text>means any authorization required under Federal law, whether administered by a Federal or State administrative agency or official, with respect to siting, construction, expansion, or operation of a refinery; and</text></subparagraph> 
<subparagraph id="H08B28DD58C384660ADB773D6BCD30520"><enum>(B)</enum><text>includes any permits, special use authorizations, certifications, opinions, or other approvals required under Federal law with respect to siting, construction, expansion, or operation of a refinery;</text></subparagraph></paragraph> 
<paragraph id="HA3DACA44F27B4E8E8BEDA453D8EF39F9"><enum>(4)</enum><text>the term <term>refinery</term> means—</text> 
<subparagraph id="H3259B51667784318A93857EF7F95F23C"><enum>(A)</enum><text>a facility designed and operated to receive, load, unload, store, transport, process, and refine crude oil by any chemical or physical process, including distillation, fluid catalytic cracking, hydrocracking, coking, alkylation, etherification, polymerization, catalytic reforming, isomerization, hydrotreating, blending, and any combination thereof, in order to produce gasoline or other fuel; or</text></subparagraph> 
<subparagraph id="H08A21D4E1EC9402E810090E036B48FE9"><enum>(B)</enum><text>a facility designed and operated to receive, load, unload, store, transport, process, and refine coal by any chemical or physical process, including liquefaction, in order to produce gasoline, diesel, or other liquid fuel as its primary output; </text></subparagraph></paragraph> 
<paragraph id="HDC6EE4DF118144A6B12EA700B4B80003"><enum>(5)</enum><text>the term <term>Secretary</term> means the Secretary of Energy; and</text></paragraph> 
<paragraph id="H5C11DF9FBF954F0F9DB220F3E5CB2E30"><enum>(6)</enum><text>the term <term>State</term> means a State, the District of Columbia, the Commonwealth of Puerto Rico, and any other territory or possession of the United States.</text></paragraph></section> 
<section id="HF19678594FCF4DD3B8003E3E7D2F64C9"><enum>2.</enum><header>State participation and Secretary’s designation</header> 
<subsection id="HAB3B3CC7EF7F4F5DA0A5C37BED5948D"><enum>(a)</enum><header>Designation requirement</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall designate no less than 5 brownfield sites, or portions thereof, subject to subsection (c)(2), that are appropriate and available for the purposes of siting a refinery.</text></subsection> 
<subsection id="HD642DD49C5CE4556982FE96F39B6C46B"><enum>(b)</enum><header>Analysis of refinery sites</header><text>In considering any site for possible designation under subsection (a), the Secretary shall conduct an analysis of—</text> 
<paragraph id="HEDAE751611DC430CA09F1F60A8E6A968"><enum>(1)</enum><text>the availability of crude oil supplies to the site, including supplies from domestic production of shale oil and tar sands and other strategic unconventional fuels;</text></paragraph> 
<paragraph id="H5C09E7330A5449BAAC3955A9326B8824"><enum>(2)</enum><text>the distribution of the Nation’s refined petroleum product demand;</text></paragraph> 
<paragraph id="HA0A8C7AE61FA4AB0B7751FDDB606A0D7"><enum>(3)</enum><text>whether such site is in close proximity to substantial pipeline infrastructure, including both crude oil and refined petroleum product pipelines, and potential infrastructure feasibility;</text></paragraph> 
<paragraph id="H0B93844F5B5D4339A0FFD9B7519B2BA1"><enum>(4)</enum><text>the need to diversify the geographical location of the domestic refining capacity;</text></paragraph> 
<paragraph id="HF51BAE5A10D842B09DE2E11D898FAAD8"><enum>(5)</enum><text>the effect that increased refined petroleum products from a refinery on that site may have on the price and supply of gasoline to consumers; and</text></paragraph> 
<paragraph id="H83E1D20D007A4A3E8F15DEF4E7BC3791"><enum>(6)</enum><text>such other factors as the Secretary considers appropriate.</text></paragraph></subsection> 
<subsection id="H424A77E5D06546679EEEA32D66D089"><enum>(c)</enum><header>Making designated sites available</header> 
<paragraph id="H1DE34699130E49AC80EA6E375E48E6D7"><enum>(1)</enum><header>Secretary’s role</header><text display-inline="yes-display-inline">If a designated site is owned by the Federal Government, the Secretary shall take appropriate actions to make the site available for the construction of a refinery. If the site is not owned by the Federal Government, the Secretary shall facilitate the necessary transfer of interest in the site from a willing seller to enable the construction of a refinery on the site.</text></paragraph> 
<paragraph id="HCFC12DC6958148B2BDB6CE3DF73DEE10"><enum>(2)</enum><header>Governor’s objection</header><text>No site may be used for a refinery under this Act if, not later than 60 days after designation of the site under subsection (a), the Governor of the State in which the site is located transmits to the Secretary an objection to the designation, unless, not later than 60 days after the Secretary receives such objection, the Congress has by law overridden the objection. </text></paragraph></subsection> </section> 
<section id="H860C6437797C4F5EB5F327696917BF3F"><enum>3.</enum><header>Process coordination and rules of procedure</header> 
<subsection id="H6792C21A8D68477C9F82A9CC627D6F3C"><enum>(a)</enum><header>Designation as Lead Agency</header> 
<paragraph id="H888C199FC5AF47CDBC4D7F6957AB8089"><enum>(1)</enum><header>In general</header><text>The Department of Energy shall act as the lead agency for the purposes of coordinating all applicable Federal refinery authorizations and related environmental reviews with respect to a designated refinery.</text></paragraph> 
<paragraph id="H0F6CD1F6F47346F099E9D32DE09E5E34"><enum>(2)</enum><header>Other agencies</header><text>Each Federal and State agency or official required to provide a Federal refinery authorization shall cooperate with the Secretary and comply with the deadlines established by the Secretary.</text></paragraph></subsection> 
<subsection id="HCF2C11D718A64875B506A4C731865CFC"><enum>(b)</enum><header>Schedule</header> 
<paragraph id="HA6608B7982354CD1971F1B04EB2C837E"><enum>(1)</enum><header>Secretary’s authority to set schedule</header><text>The Secretary shall establish a schedule for all Federal refinery authorizations with respect to a designated refinery. In establishing the schedule, the Secretary shall—</text> 
<subparagraph id="H667724D3F97F414EB7A69E029D0000A4"><enum>(A)</enum><text>ensure expeditious completion of all such proceedings; and</text></subparagraph> 
<subparagraph id="H8E93D5B4097249A6A4B0B408259B8534"><enum>(B)</enum><text>accommodate the applicable schedules established by Federal law for such proceedings.</text></subparagraph></paragraph> 
<paragraph id="HDEE04643D8234E3A910084E2CEFE4E1C"><enum>(2)</enum><header>Failure to meet schedule</header><text>If a Federal or State administrative agency or official does not complete a proceeding for an approval that is required for a Federal refinery authorization in accordance with the schedule established by the Secretary under this subsection, the applicant may pursue remedies under subsection (d).</text></paragraph></subsection> 
<subsection id="H6E03C168B1864EA5B31ECBD32C45F97F"><enum>(c)</enum><header>Consolidated Record</header><text>The Secretary shall, with the cooperation of Federal and State administrative agencies and officials, maintain a complete consolidated record of all decisions made or actions taken by the Secretary or by a Federal administrative agency or officer (or State administrative agency or officer acting under delegated Federal authority) with respect to any Federal refinery authorization. Such record shall be the record for judicial review under subsection (d) of decisions made or actions taken by Federal and State administrative agencies and officials, except that, if the Court determines that the record does not contain sufficient information, the Court may remand the proceeding to the Secretary for further development of the consolidated record.</text></subsection> 
<subsection id="H3AEB283780A84E29BE9EFCFF7097DDF6"><enum>(d)</enum><header>Judicial Review</header> 
<paragraph id="H2377799B6E6A458A95178E609B6886CB"><enum>(1)</enum><header>In general</header><text>The United States Court of Appeals for the District of Columbia shall have original and exclusive jurisdiction over any civil action for the review of—</text> 
<subparagraph id="H3719BD447B854D1C953405D12F8507AF"><enum>(A)</enum><text>an order or action, related to a Federal refinery authorization, by a Federal or State administrative agency or official; and</text></subparagraph> 
<subparagraph id="H0612CCD3E3834E999C1F47C2ABFB4500"><enum>(B)</enum><text>an alleged failure to act by a Federal or State administrative agency or official acting pursuant to a Federal refinery authorization.</text></subparagraph><continuation-text continuation-text-level="paragraph">The failure of an agency or official to act on a Federal refinery authorization in accordance with the Secretary’s schedule established pursuant to subsection (b) shall be considered inconsistent with Federal law for the purposes of paragraph (2) of this subsection.</continuation-text></paragraph> 
<paragraph id="H004C005AC5844767AC96B98E17033B91"><enum>(2)</enum><header>Court action</header><text>If the Court finds that an order or action described in paragraph (1)(A) is inconsistent with the Federal law governing such Federal refinery authorization, or that a failure to act as described in paragraph (1)(B) has occurred, and the order, action, or failure to act would prevent the siting, construction, expansion, or operation of the designated refinery, the Court shall remand the proceeding to the agency or official to take appropriate action consistent with the order of the Court. If the Court remands the order, action, or failure to act to the Federal or State administrative agency or official, the Court shall set a reasonable schedule and deadline for the agency or official to act on remand.</text></paragraph> 
<paragraph id="H96EF648B420045D088DE3010A996688"><enum>(3)</enum><header>Secretary’s action</header><text>For any civil action brought under this subsection, the Secretary shall promptly file with the Court the consolidated record compiled by the Secretary pursuant to subsection (c).</text></paragraph> 
<paragraph id="H41BF9E6F2C474A69882192FCC822AE6F"><enum>(4)</enum><header>Expedited review</header><text>The Court shall set any civil action brought under this subsection for expedited consideration.</text></paragraph> 
<paragraph id="HAF55B38D30574ABD82E119E6A4A41B00"><enum>(5)</enum><header>Attorney’s fees</header><text>In any action challenging a Federal refinery authorization that has been granted, reasonable attorney’s fees and other expenses of litigation shall be awarded to the prevailing party. This paragraph shall not apply to any action seeking remedies for denial of a Federal refinery authorization or failure to act on an application for a Federal refinery authorization.</text></paragraph></subsection></section> 
<section id="H3FAEE571190348D49203D8A1A4E37D3D" section-type="subsequent-section"><enum>4.</enum><header>5-Year extension of election to expense certain refineries</header> 
<subsection id="H0E459FDADF854DE8B856D7366DDDAFD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/179C">section 179C(c)</external-xref> of the Internal Revenue Code of 1986 (defining qualified refinery property) is amended—</text> 
<paragraph id="H491BB4887C644937A6244BBFFA615935"><enum>(1)</enum><text>by striking <quote>January 1, 2012</quote> in subparagraph (B) and inserting <quote>January 1, 2017</quote>, and</text></paragraph> 
<paragraph id="H01AE5FAFD94B43FFA7FCD54FA86DF0B3"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>January 1, 2008</quote> each place it appears in subparagraph (F) and inserting <quote>January 1, 2013</quote>.</text></paragraph></subsection> 
<subsection id="H98AD2B57E1294775BF2BF9A9E687E0B9"><enum>(b)</enum><header>Implementation through Secretarial guidance</header> 
<paragraph id="H09F1274CF36042FEA0424000A7281CE0"><enum>(1)</enum><header>Guidance</header><text>Paragraph (1) of section 179C(b) of such Code (relating to general rule for election) is amended by inserting <quote>or other guidance</quote> after <quote>regulations</quote>.</text></paragraph> 
<paragraph id="H97AC3722C7DE41ADB78567D39CCF676"><enum>(2)</enum><header>Reporting</header><text>Subsection (h) of section 179C of such Code (relating to reporting) is amended by striking <quote>shall require</quote> and inserting <quote>may, through guidance, require</quote>.</text></paragraph></subsection> 
<subsection id="HD67B7A7E5DE945AFB217009824486DF2"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this Act shall apply to property placed in service after December 31, 2007.</text></subsection> 
<subsection id="H975147F11A5348A19C164E7110601D3C"><enum>(d)</enum><header>Requirement for issuance of guidance</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of the Treasury shall issue regulations or other guidance to carry out <external-xref legal-doc="usc" parsable-cite="usc/26/179C">section 179C</external-xref> of the Internal Revenue Code of 1986 (as amended by this section).</text></subsection></section>
