<official-title display="yes">To establish a research, development, demonstration, and commercial application program to promote research of appropriate technologies for heavy duty plug-in hybrid vehicles, and for other purposes.</official-title>

<section id="H87D8D1BE01C7427EB43008AA3CC55CE6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Heavy Duty Hybrid Vehicle Research, Development, and Demonstration Act of 2008</short-title></quote>. </text></section> 
<section id="H8174573303E44919AB00D75850BCB41"><enum>2.</enum><header>Advanced heavy duty hybrid vehicle technology research, development, demonstration, and commercial application program</header> 
<subsection id="HA0295C90A50140A3B5B72189E134EF7E"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a competitive research, development, demonstration, and commercial application program (referred to in this Act as the <quote>program</quote>) to provide grants to applicants to carry out projects to advance research and development and to demonstrate technologies for advanced heavy duty hybrid vehicles.</text></subsection> 
<subsection id="H1BAF9CD07EBA4A6EBF97A62187BAA54C"><enum>(b)</enum><header>Applications</header> 
<paragraph id="H1E7721493A4D4D84858B647EB1900029"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall issue requirements for applying for grants under the program.</text></paragraph> 
<paragraph id="H384237539C0B4432898F710081F7C54"><enum>(2)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">The Secretary shall establish selection criteria for awarding grants under the program. In evaluating applications, the Secretary shall—</text> 
<subparagraph id="H4C05460F77EA434FB400416BC88D298D"><enum>(A)</enum><text display-inline="yes-display-inline">consider the ability of applicants to successfully complete both phases described in subsection (c); and</text></subparagraph> 
<subparagraph id="H40C4C4172AD7401EBE7169D980AE5D79"><enum>(B)</enum><text>give priority to applicants who are best able to—</text> 
<clause id="H327A579E55F24DD3B8DC64553B984703"><enum>(i)</enum><text>fill existing research gaps and achieve the greatest advances beyond the state of current technology; and</text></clause> 
<clause id="H0FB03272BEC04E0AAFADFA9199D1892E"><enum>(ii)</enum><text>achieve the greatest reduction in fuel consumption and emissions.</text></clause></subparagraph></paragraph> 
<paragraph id="HE9E88B108DBC47F38765224D89DDEF97"><enum>(3)</enum><header>Partners</header><text>An applicant for a grant under this section may carry out a project in partnership with other entities.</text></paragraph> 
<paragraph id="H248A510364C148EA8905A5B4804D4260"><enum>(4)</enum><header>Schedule</header> 
<subparagraph id="HE42E4405115C42C8818DDC6DDF1D865B"><enum>(A)</enum><header>Application request</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall publish in the Federal Register, and elsewhere as appropriate, a request for applications to undertake projects under the program. Applications shall be due not later than 90 days after the date of such publication. </text></subparagraph> 
<subparagraph id="H3B6B3A7458BA4207BCD5CEA2DE096067"><enum>(B)</enum><header>Application selection</header><text>Not later than 90 days after the date on which applications for grants under the program are due, the Secretary shall select, through a competitive process, all applicants to be awarded a grant under the program.</text></subparagraph></paragraph> 
<paragraph id="HE09146BAFD914AABB3E52D773896C1EC"><enum>(5)</enum><header>Number of grants</header><text>The Secretary shall determine the number of grants to be awarded under the program based on the technical merits of the applications received. The number of grants awarded under the program shall not be less than 3 or more than 7, and at least half of the grants awarded shall be for plug-in hybrid technology.</text></paragraph> 
<paragraph id="H875D3F716AF84D5EB8B5ABD86873D8A7"><enum>(6)</enum><header>Award amounts</header><text>The Secretary shall award not more than $3,000,000 to each recipient per year for each of the 3 years of the project.</text></paragraph></subsection> 
<subsection id="H72D4070AA2474184AAAA6B3E332398F6"><enum>(c)</enum><header>Program requirements; Two phases</header><text display-inline="yes-display-inline">Each grant recipient shall be required to complete two phases:</text> 
<paragraph id="H4F181AF5885140459B961B81F413775D" display-inline="no-display-inline"><enum>(1)</enum><header>Phase one</header> 
<subparagraph id="H58DF56249A5C433385FB45DC24204D6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In phase one, the recipient shall research and demonstrate advanced hybrid technology by producing or retrofitting one or more advanced heavy duty hybrid vehicles.</text></subparagraph> 
<subparagraph id="H09DA20B0938743CCA8C64313AF41CCFB"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the completion of phase one, the recipient shall submit to the Secretary a report containing data and analysis of—</text> 
<clause id="HED386720D455498E8CE428AD65AFB866"><enum>(i)</enum><text display-inline="yes-display-inline">the performance of each vehicle in carrying out the testing procedures developed by the Secretary under subparagraph (E);</text></clause> 
<clause id="H124499BDFEE942EE862E111D3E20BE68"><enum>(ii)</enum><text>the performance during such testing of each vehicle’s components, including the battery, energy management system, charging system, and power controls;</text></clause> 
<clause id="H2FCBFA99AF7C4824942F9900F00603E5"><enum>(iii)</enum><text display-inline="yes-display-inline">the projected cost of each vehicle, including acquisition, operating, and maintenance costs; and</text></clause> 
<clause id="HF2DE08A84C5040B8BC5308B8F271B344"><enum>(iv)</enum><text display-inline="yes-display-inline">the emissions levels of each vehicle, including greenhouse gas levels.</text></clause></subparagraph> 
<subparagraph id="HD4FE0F655BFE40C09CAB7824B00393A5"><enum>(C)</enum><header>Termination</header><text>The Secretary may terminate the grant program with respect to the project of a recipient at the conclusion of phase one if the Secretary determines that the recipient cannot successfully complete the requirements of phase two.</text></subparagraph> 
<subparagraph id="HB970D3CD90894B4398CF94A83C8BEADE"><enum>(D)</enum><header>Timing</header><text>Phase one begins upon receipt of a grant under the program and has a duration of one year.</text></subparagraph> 
<subparagraph id="HF34EAC1B583C4E72831EA92521551112"><enum>(E)</enum><header>Testing procedures</header><text display-inline="yes-display-inline">The Secretary shall develop standard testing procedures to be used by recipients in testing each vehicle. Such procedures shall include testing a vehicle’s performance under typical operating conditions.</text></subparagraph></paragraph> 
<paragraph id="HC19DA0759B0D4B378FABC5B5904BD600"><enum>(2)</enum><header>Phase two</header> 
<subparagraph id="H02C91E7D3DB54D59B5F558435ECF197B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In phase two, the recipient shall demonstrate advanced manufacturing processes and technologies by producing or retrofitting 50 advanced heavy duty hybrid vehicles.</text></subparagraph> 
<subparagraph id="H0EEC518663EE4179A6F02C1576320086"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the completion of phase two, the recipient shall submit to the Secretary a report containing—</text> 
<clause id="H759A611951FA43F89D7767BC6BA77523"><enum>(i)</enum><text display-inline="yes-display-inline">an analysis of the technological challenges encountered by the recipient in the development of the vehicles;</text></clause> 
<clause id="HF82DA7ADB3A542B8BE9090B103D72CC"><enum>(ii)</enum><text display-inline="yes-display-inline">an analysis of the technological challenges involved in mass producing the vehicles; and</text></clause> 
<clause id="H4928033F9EAF4642A5002D8969FD8C7D"><enum>(iii)</enum><text display-inline="yes-display-inline">the manufacturing cost of each vehicle, the estimated sale price of each vehicle, and the cost of a comparable non-hybrid vehicle.</text></clause></subparagraph> 
<subparagraph id="H6F3C6D34620841008180D4996245B5D2"><enum>(C)</enum><header>Timing</header><text>Phase two begins at the conclusion of phase one and has a duration of two years.</text></subparagraph></paragraph></subsection> 
<subsection id="H9203095464B14CE8A48E5025AF862100"><enum>(d)</enum><header>Research on vehicle usage and alternative drive trains</header><text display-inline="yes-display-inline">The Secretary shall conduct research into alternative power train designs for use in advanced heavy duty hybrid vehicles. Such research shall compare the estimated cost, including operating and maintenance costs, emissions reductions, and fuel savings of each design with similar non-hybrid power train designs under the conditions in which these vehicles are typically used, including, for each vehicle type—</text> 
<paragraph id="H8467E4E2AA5B42AAB9EAA470B4873CC" display-inline="no-display-inline"><enum>(1)</enum><text>number of miles driven;</text></paragraph> 
<paragraph id="HBA79E45A532E475A8F49388B09EED24D"><enum>(2)</enum><text>time spent with the engine at idle;</text></paragraph> 
<paragraph id="H2BEDFE93C34E4A319F89BE0005ACAAC7"><enum>(3)</enum><text>horsepower requirements;</text></paragraph> 
<paragraph id="HD79B3B0733FD4948912DD6472C6B7097"><enum>(4)</enum><text>length of time the maximum or near maximum power output of the vehicle is needed; and</text></paragraph> 
<paragraph id="HC7A12193C4B849B0B4BD08FD00B8C98"><enum>(5)</enum><text>any other factors that the Secretary considers appropriate.</text></paragraph></subsection> 
<subsection id="H56A3F3F763C8475FBA2FE718D6B5E026"><enum>(e)</enum><header>Report to the Congress</header><text display-inline="yes-display-inline">Not later than 60 days after the Secretary receives the reports from grant recipients under subsection (c)(2)(B), the Secretary shall submit to the Congress a report containing—</text> 
<paragraph id="H2A170361F3CF468DBEDF32BA009D0428"><enum>(1)</enum><text>an identification of the grant recipients and a description of the projects to be funded;</text></paragraph> 
<paragraph id="H59D146D161C2488A852E49C5559B587B"><enum>(2)</enum><text>an identification of all applicants who submitted applications for the program;</text></paragraph> 
<paragraph id="H6B093A85FD5744EBBFB9EB10006DF431"><enum>(3)</enum><text display-inline="yes-display-inline">all data contained in reports submitted by grant recipients under subsection (c);</text></paragraph> 
<paragraph id="H63A06BBE92AB422498FDA2856348E23C"><enum>(4)</enum><text>a description of the vehicles produced or retrofitted by recipients in phase one and phase two of the project, including an analysis of the fuel efficiency of such vehicles; and</text></paragraph> 
<paragraph id="HEAD16A4D596A4FB7B29D82755B0112B8"><enum>(5)</enum><text>the results of the research carried out under subsections (d) and (h).</text></paragraph></subsection> 
<subsection id="H69901662F95A429DAFBE70FCBE2B732"><enum>(f)</enum><header>Coordination and nonduplication</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Secretary shall coordinate, and not duplicate, activities under this Act with other programs and laboratories of the Department of Energy and other Federal research programs.</text></subsection> 
<subsection id="HA5C2A36B082E47E895C91F3599F21760"><enum>(g)</enum><header>Cost sharing</header><text display-inline="yes-display-inline">Section 988 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352</external-xref>) shall apply to the program established pursuant to this section.</text></subsection> 
<subsection id="HAF4D00E8E2A449B983E574D7A5C3D48"><enum>(h)</enum><header>Electrical grid research pilot program</header><text>The Secretary shall establish a pilot program through the National Laboratories and Technology Centers of the Department of Energy to research and test the effects on the domestic electric power grid of the widespread use of plug-in hybrid vehicles, including plug-in hybrid vehicles that are advanced heavy duty hybrid vehicles.</text></subsection> 
<subsection id="H9333F7DF613C41E2827EBFECBCC30091"><enum>(i)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="HBA5CF21231B14B63A4F12B4B9EC023AC"><enum>(1)</enum><header>Advanced heavy duty hybrid vehicle</header><text display-inline="yes-display-inline">The term <quote>advanced heavy duty hybrid vehicle</quote> means a vehicle with a gross weight between 14,000 pounds and 33,000 pounds that is fueled, in part, by a rechargeable energy storage system.</text></paragraph> 
<paragraph id="H8E55895005264B5B88ACB21522268211"><enum>(2)</enum><header>Greenhouse gas</header><text>The term <quote>greenhouse gas</quote> means—</text> 
<subparagraph id="H6D92733B265E41048FEC50A977CAC33E"><enum>(A)</enum><text display-inline="yes-display-inline">carbon dioxide;</text></subparagraph> 
<subparagraph id="HB4456370DA604B7493741C3867D4A7A8"><enum>(B)</enum><text>methane;</text></subparagraph> 
<subparagraph id="H5546A2694D684B6D98859F00CB333C76"><enum>(C)</enum><text>nitrous oxide;</text></subparagraph> 
<subparagraph id="HA04D4CA21AB64C99B523008CEAA79BC"><enum>(D)</enum><text>hydrofluorocarbons;</text></subparagraph> 
<subparagraph id="H82F58E6FCD63460B90616474AE07C0C2"><enum>(E)</enum><text>perfluorocarbons; or</text></subparagraph> 
<subparagraph id="H7C49F884A23043AEB71D37E2B279E4B"><enum>(F)</enum><text>sulfur hexafluoride.</text></subparagraph></paragraph> 
<paragraph id="H80CDD0F7E8E24922B3E7011658BCB9D"><enum>(3)</enum><header>Plug-in hybrid</header><text display-inline="yes-display-inline">The term <quote>plug-in hybrid</quote> means a vehicle fueled, in part, by electrical power that can be recharged by connecting the vehicle to an electric power source.</text></paragraph> 
<paragraph id="H9D5624570E3D4A908F6DDEEB047EF9B" display-inline="no-display-inline"><enum>(4)</enum><header>Retrofit</header><text>The term <quote>retrofit</quote> means the process of creating an advanced heavy duty hybrid vehicle by converting an existing, fuel-powered vehicle.</text></paragraph> 
<paragraph id="H8DE2D7E28C4C4C0099F1D7866FDD178"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text></paragraph></subsection> 
<subsection id="HCC2FCB4457CE4788AC10A6883E117335"><enum>(j)</enum><header>Authorization of appropriations</header> 
<paragraph id="H543D61442E394A5AA17516C895AE6900"><enum>(1)</enum><text>There are authorized to be appropriated to the Secretary $16,000,000 for each of fiscal years 2009 through 2011 to carry out this section.</text></paragraph> 
<paragraph id="HCD8826C7FC9E4C52BB627E59C7BFB496"><enum>(2)</enum><text>Of the funds authorized under paragraph (1), not more than $1,000,000 per fiscal year may be used for—</text> 
<subparagraph id="H51EB631A9702481D8E91A6DD4E786C82"><enum>(A)</enum><text>carrying out the studies required under subsection (d);</text></subparagraph> 
<subparagraph id="H56983FA05E014F5CAC1EB8E1AC8CE4FD"><enum>(B)</enum><text display-inline="yes-display-inline">carrying out the pilot program required under subsection (h); and</text></subparagraph> 
<subparagraph id="HDBE9139F24AE4506B4D8A5458EAF11D1"><enum>(C)</enum><text>the administration of the program.</text></subparagraph></paragraph></subsection></section> 
<section id="HE2B37CC0091E45BC828B8B00DACBBD40"><enum>3.</enum><header>Expanding research in hybrid technology for large vehicles</header><text display-inline="no-display-inline">Subsection (g)(1) of the United States Energy Storage Competitiveness Act of 2007 (enacted as section 641(g)(1) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17231">42 U.S.C. 17231(g)(1)</external-xref>)) is amended by inserting <quote>vehicles with a gross weight over 16,000 pounds,</quote> before <quote>stationary applications</quote>.</text></section>
