<official-title display="yes">To amend the District of Columbia School Reform Act of 1995 to permit the District of Columbia government to exercise authority over the Public Charter School Board in the same manner as the District government may exercise authority over other entities of the District government.</official-title>

<section id="H34FF2F79777C46E5952EFC8907292B06" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Charter Schools Home Rule Act of 2008</short-title></quote>.</text> </section>
<section id="H1BD6669E55ED472100DA3D81D96C4362"><enum>2.</enum><header>Authority of District of Columbia Government to Regulate Public Charter School Board</header><text display-inline="no-display-inline">Section 2214 of the District of Columbia School Reform Act of 1995 (sec. 38–1802.14, D.C. Official Code) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H3C47B1E0FBF74FB3AC99E206701DF0A2" style="OLC"> 
<subsection id="H6F1CA123B2794AF799E559207190CEC"><enum>(j)</enum><header>Determination of Membership of Board in Accordance With District Law</header> 
<paragraph id="HD65A9E883F3B477DAD63BF2BBB9D33D7"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (a), the membership of the Board and the process by which members of the Board are appointed shall be determined in accordance with such laws as may be enacted by the District of Columbia.</text> </paragraph>
<paragraph id="H0A6D6B91654C443A9F26C4DFD73D1305"><enum>(2)</enum><header>Transition</header><text>Subsection (a) shall remain in effect until a law enacted by the District of Columbia takes effect to establish the membership of the Board and the process by which members of the Board are appointed.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="HDA52EBF1FCC24AB1803D5CA981F1E532"><enum>3.</enum><header>Repeal of Other Requirements Relating to Receipt of Reports by Federal Government</header> 
<subsection id="H94CBBBDD28CA4EBB8C29F76CC227C383"><enum>(a)</enum><header>Receipt of Annual Report of Chartering Authorities</header><text display-inline="yes-display-inline">Section 2211(d) of the District of Columbia School Reform Act of 1995 (sec. 38–1802.11(d), D.C. Official Code) is amended in the matter preceding paragraph (1) by striking <quote>the Secretary of Education, the appropriate congressional committees,</quote>.</text> </subsection>
<subsection id="H0236DA61EC6F47C7A8D17329237339C3"><enum>(b)</enum><header>Receipt of Annual Report on Number of Students</header><text>Section 2402(c) of such Act (sec. 38–1804.02(c), D.C. Official Code), as amended by section 102(b) of the Public School Enrollment Integrity Clarification and Board of Education Honoraria Amendment Act of 2004 (D.C. Law 15–348), is amended by striking <quote>the Authority (during a control year), the Council, the Comptroller General of the United States, and the appropriate congressional committees</quote> and inserting <quote>the Authority (during a control year) and the Council</quote>.</text> </subsection>
<subsection id="H582DA7A059F6499197008C699FD7EFFA"><enum>(c)</enum><header>Access to Fiscal and Staffing Data</header><text>Section 2752(b) of such Act (sec. 38–1807.52(b), D.C. Official Code) is amended by striking <quote>the Authority, and appropriate congressional committees</quote> and inserting <quote>and the Authority</quote>.</text> </subsection></section>
