<section id="HBA3F96DDC6924D61912BA8E5B0E8D183" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lead-Safe Housing for Kids Act of 2008</short-title></quote> .</text></section> 
<section id="H219C0D4BDBF6458C8311AAB5240BD57"><enum>2.</enum><header>Amendments to Residential Lead-Based Paint Hazard Reduction Act of 1992</header> 
<subsection id="H32D969F5EFE44B8590CA8CA9CD2B124B"><enum>(a)</enum><header>Amendments</header><text>Section 1017 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/4852c">42 U.S.C. 4852c</external-xref>) is amended—</text> 
<paragraph id="H398DF81459F5496F96A1F15D8796D7E0"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Not later than</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—Not later than</quote>; and</text></paragraph> 
<paragraph id="H5DFBE7C5CC7F410B91316278BB7935B7"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H813A860AD74D479A97F5D06519ABB490"><enum>(b)</enum><header>Environmental intervention blood lead level</header> 
<paragraph id="H64C8009FDCD745D4A0876CC216F8348"><enum>(1)</enum><header>In general</header><text>For purposes of this title and any regulations issued under this title, an environmental intervention blood lead level shall be defined as the lower of—</text> 
<subparagraph id="H8321CB44E65B45DE8EF8A0514BE1DCA4"><enum>(A)</enum><text>10 ug/dL (micrograms of lead per deciliter); or</text></subparagraph> 
<subparagraph id="H4D40912BE7F748DC8C14CC009DDEE5B2"><enum>(B)</enum><text>the elevated blood lead level of concern for a child under six years of age that has been recommended by the Centers for Disease Control and Prevention.</text></subparagraph></paragraph> 
<paragraph id="H9F40469E3A704A61A87281C7F3833C51"><enum>(2)</enum><header>Relation to other authorities</header><text>This Act may not be construed as affecting the authority of the Environmental Protection Agency under section 403 of the Toxic Substances Control Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEB4FE10C182B425B89557DD84416E97"><enum>(b)</enum><header>Regulations</header><text>Not later than the expiration of the 90-day period beginning on the date of the enactment of this Act, the Secretary of Housing and Urban Development shall amend the regulations of such Department to comply with the amendments made by subsection (a).</text></subsection></section> 
<section id="H55E86053FF2C42748902C98C725B51CA"><enum>3.</enum><header>Report to Congress on previous lead hazard inspection programs</header><text display-inline="no-display-inline">Not later than the expiration of the 90-day period beginning on the date of the enactment of this Act, the Secretary of Housing and Urban Development shall submit a report to the Congress on the status of the program of the Department of Housing and Urban Development known as the Big Buy program and any other voluntary programs the Secretary has implemented, or has planned to implement, through which the Secretary has conducted, or planned to conduct, lead evaluations of housing covered by section 35.715 of the Secretary’s regulations (24 C.F.R. 35.715; Lead Safe Housing Rule for pre-1978 assisted housing). Such report shall include the following information:</text> 
<paragraph id="H11549F60C63145A89762D6D474BA7D4D"><enum>(1)</enum><text>A description of the purpose of such programs implemented or planned to be implemented.</text></paragraph> 
<paragraph id="HF3D6CC8CB46D48E58D522C51A651AE40"><enum>(2)</enum><text>A statement of the amounts allocated for each of such programs.</text></paragraph> 
<paragraph id="H5584BEE57A5C47ECB7A4CDB3DA8F10F5"><enum>(3)</enum><text>Identification of the sources of the funding for each of such programs.</text></paragraph> 
<paragraph id="H5906C10F50A64EE589DDE3002C519C"><enum>(4)</enum><text>A statement of the amount expended to each of such programs, as of the date of the submission of the report.</text></paragraph> 
<paragraph id="HCA7628F25DEE4E28A35EADD2B90000D4"><enum>(5)</enum><text>A statement of the number of properties and the number of dwelling units intended to be covered by each of such programs.</text></paragraph> 
<paragraph id="H9C8CCBA3ED9C4F4693C5F9FD031E006E"><enum>(6)</enum><text>A statement of the number of properties and the number of dwelling units actually assisted by each of such programs.</text></paragraph> 
<paragraph id="HB95573B37A8740C6BDA25962F284A5BD"><enum>(7)</enum><text>A description of the status of each of such programs, as of the date of the submission of the report.</text></paragraph> 
<paragraph id="H6A09DEA8FE4A43FDAA00CA871BAC658"><enum>(8)</enum><text>An explanation as to why each of such programs have not been completed.</text></paragraph> 
<paragraph id="H0D996417FB1D49938F6810FDF0A71781"><enum>(9)</enum><text display-inline="yes-display-inline">A description of any enforcement actions taken against owners of such housing who were to have been held harmless with respect to any noncompliance with section 1018 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/4852d">42 U.S.C. 4852d</external-xref>), or with any rules implementing such section, during implementation of such programs.</text></paragraph> 
<paragraph id="H4545800A2E57416ABBA9A928D6D32A"><enum>(10)</enum><text>A timeline for completion of the remaining properties and units covered by each of such programs.</text></paragraph></section> 
<section commented="no" id="H51A393EDA3BD4DA08D6F7FCEBAC65405"><enum>4.</enum><header>Authorization of appropriations</header> 
<subsection id="HCC4814F52DDE4D6D8CAF99CC4496B02B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this Act and the amendments made by this Act such sums as may be appropriated for fiscal year 2009.</text></subsection> 
<subsection id="H3224801687A647B4ABF5FB71474D429E"><enum>(b)</enum><header>Costs of compliance</header><text display-inline="yes-display-inline">This Act and the amendments made by this Act shall not create any obligation or requirement on the part of any owner of housing, public housing agency, or other party (other than the Secretary of Housing and Urban Development) to comply with any new obligations established by or pursuant to this Act or such amendments, except to the extent that the Secretary of Housing and Urban Development makes amounts available to such owner, agency, or party for the costs of such compliance.</text></subsection></section>
