<official-title display="yes">To amend parts B and E of title IV of the Social Security Act to assist children in foster care in developing or maintaining connections to family, community, support, health care, and school, and for other purposes.</official-title>

<section id="H4779662E28524DC897EB03B63D94AD27" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fostering Connections to Success Act</short-title></quote>.</text></section> 
<section id="HE0CBDAF5A4BA41C58EA674A99BB56F73"><enum>2.</enum><header>Kinship guardianship assistance payments for children</header> 
<subsection id="H9B2F99546F5A413C974DEA76C0F75704"><enum>(a)</enum><header>State plan option</header><text>Section 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>) is amended—</text> 
<paragraph id="H04C4D3D9F37245998CC13B01A11158E9"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (26);</text></paragraph> 
<paragraph id="H6AB4E9E55CD841BB8EF79970D150C871"><enum>(2)</enum><text>by striking the period at the end of paragraph (27) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H608A149F601D40DCBAD5E59C26677B71"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H562A00096BC44CE0A9CE3180B08EB81" style="OLC"> 
<paragraph id="HE2E610843A394BF1A200D56770C7E364"><enum>(28)</enum><text>at the option of the State, provides for the State to enter into kinship guardianship assistance agreements to provide kinship guardianship assistance payments on behalf of children to grandparents and other relatives who have assumed legal guardianship of the children for whom they have cared as foster parents and for whom they have committed to care on a permanent basis, as provided in section 473(d).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H69B38CB4338D475CB635E005EAECD44"><enum>(b)</enum><header>In general</header><text>Section 473 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H34855C6EBDDF47FA8200185D7BCD2B53"><enum>(d)</enum><header>Kinship guardianship assistance payments for children</header> 
<paragraph id="H5A932A7F53794A748BC1CA9D09596CEF"><enum>(1)</enum><header>Kinship guardianship assistance agreement</header> 
<subparagraph id="H36B7D07639304EA2BFEE32F0B9B8BB"><enum>(A)</enum><header>In general</header><text>In order to receive payments under section 474(a)(6), a State shall—</text> 
<clause id="H357BFAF3630844138F39CFC6A51E08D2"><enum>(i)</enum><text>negotiate and enter into a written, binding kinship guardianship assistance agreement with the prospective relative guardian of a child who meets the requirements of this paragraph;</text></clause> 
<clause id="H011632565BD04085AB00F66EEE0501A"><enum>(ii)</enum><text>provide the prospective relative guardian with a copy of the agreement; and</text></clause> 
<clause id="H34114C6EC43844030046D4C5F602A90"><enum>(iii)</enum><text>certify that any child on whose behalf kinship guardianship assistance payments are made under the agreement shall be provided medical assistance under title XIX in accordance with section 1902(a)(10)(A)(i)(I).</text></clause></subparagraph> 
<subparagraph id="H9B7DB27ADA144F29894878366D2E7BF4"><enum>(B)</enum><header>Minimum requirements</header><text>The agreement shall specify, at a minimum—</text> 
<clause id="H9F6C949AD970435EABE431A6B6A173FC"><enum>(i)</enum><text>the amount of, and manner in which, each kinship guardianship assistance payment will be provided under the agreement;</text></clause> 
<clause id="H1A68CED9E620459E860425EC15CFC007"><enum>(ii)</enum><text>the additional services and assistance that the child and relative guardian will be eligible for under the agreement;</text></clause> 
<clause id="HED8EA7C736D549A19ED702EE4FCDAC84"><enum>(iii)</enum><text>the procedure by which the relative guardian may apply for additional services as needed; and</text></clause> 
<clause id="H176A416B68B941A3A8C833924700854F"><enum>(iv)</enum><text>subject to subparagraph (D), that the State will pay the total cost of nonrecurring expenses associated with obtaining legal guardianship of the child, to the extent the total cost does not exceed $2,000.</text></clause></subparagraph> 
<subparagraph id="H67AAD50D4E9045C8AFBAAADB9505E6CE"><enum>(C)</enum><header>Interstate applicability</header><text>The agreement shall provide that the agreement shall remain in effect without regard to the State residency of the kinship guardian.</text></subparagraph> 
<subparagraph id="H3DB02F47BCB845EAB4C755B29601B205"><enum>(D)</enum><header>No effect on federal reimbursement</header><text>Nothing in subparagraph (B)(iv) shall be construed as affecting the ability of the State to obtain reimbursement from the Federal Government for costs described in that subparagraph.</text></subparagraph></paragraph> 
<paragraph id="H7EF397FAFA734349A3426E1480AC022B"><enum>(2)</enum><header>Kinship guardianship assistance payment</header> 
<subparagraph id="HA472AECC0E3149658C6F88A350ED0000"><enum>(A)</enum><header>In general</header><text>The kinship guardianship assistance payment shall be equal to the amount of the foster care maintenance payment for which the child would have been eligible if the child had remained in a foster family home, or, at State option, the amount of the adoption assistance payment for which the child would have been eligible if the child had been adopted, and may be readjusted periodically based on changes in the circumstances of the relative guardians involved and the needs of the child. Notwithstanding the preceding sentence, the amount of the kinship guardianship assistance payment may not exceed the foster care maintenance payment which would have been paid during the period involved if the child had been in a foster family home.</text></subparagraph> 
<subparagraph id="H0BF637959E0E4CA590B302918EC40651"><enum>(B)</enum><header>Limitation</header><text>A State may not make a kinship guardianship assistance payment to a relative guardian for any child who has attained 18 years of age, or such greater age as the State may elect under section 475(8)(B)(iii).</text></subparagraph></paragraph> 
<paragraph id="HF4D306A7214D47B3AEBAE828D9C2BB2"><enum>(3)</enum><header>Child’s eligibility for a kinship guardianship assistance payment</header> 
<subparagraph id="H06E2D229CDCA4925857E3500A1265888"><enum>(A)</enum><header>In general</header><text>A child is eligible for a kinship guardianship assistance payment under this subsection if the State agency determines the following:</text> 
<clause id="H22D5A54D5BBA47D0B4C005CE611E38D"><enum>(i)</enum><text>The child has been—</text> 
<subclause id="H3FD9F6D67AA0488E99F12DC5333E6092"><enum>(I)</enum><text>removed from his or her home pursuant to a voluntary placement agreement or as a result of a judicial determination to the effect that continuation in the home would be contrary to the welfare of the child;</text></subclause> 
<subclause id="H067B74A764E14048999FE3E6F28987B8"><enum>(II)</enum><text>under the care of the State agency for the 12-month period ending on the date of the agency determination;</text></subclause> 
<subclause id="HA6BBD3B62215418A976D6BAD7FB0031F"><enum>(III)</enum><text>eligible for foster care maintenance payments under section 472 while in the home of the prospective relative guardian; and</text></subclause> 
<subclause id="H2DFF8C6515DF422288913C6D2E0059F9"><enum>(IV)</enum><text>residing for at least 6 months with the prospective relative guardian.</text></subclause></clause> 
<clause id="HB21E7BCE049949978F77125EB0A981D4"><enum>(ii)</enum><text>Being returned home or adopted are not appropriate permanency options for the child.</text></clause> 
<clause id="H094247780C33416DBF16B416BD2152AD"><enum>(iii)</enum><text>The child demonstrates a strong attachment to the prospective relative guardian and the relative guardian has a strong commitment to caring permanently for the child.</text></clause> 
<clause id="H1A85F7E1720943E3BC19EE96CCF4D8CB"><enum>(iv)</enum><text>With respect to a child who has attained 14 years of age, the child has been consulted regarding the kinship guardianship arrangement.</text></clause></subparagraph> 
<subparagraph id="H13EF3F648D624999965B48A9DDA5F5A9"><enum>(B)</enum><header>Treatment of siblings</header><text>With respect to a child described in subparagraph (A) whose sibling or siblings are not so described—</text> 
<clause id="HD1412AC6196142F0AF3D5FF067A30023"><enum>(i)</enum><text>the child and any sibling of the child may be placed in the same kinship guardianship arrangement if the State agency and the relative agree on the appropriateness of the arrangement for the siblings; and</text></clause> 
<clause id="HE0D61278A9204C9B909299A71DD78956"><enum>(ii)</enum><text>kinship guardianship assistance payments may be paid for the child and each sibling so placed.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H316525CA00BB483E93C6F9D3BB525B34"><enum>(c)</enum><header>Conforming amendments</header> 
<paragraph id="HC1B3DC8CE4BC4C3A9DC7AABFD7BCE078"><enum>(1)</enum><header>Eligibility for adoption assistance payments</header><text>Section 473(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)(2)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HEE93AE9917C845BC92BC09ABA1B17AD" style="OLC"> 
<subparagraph id="H0FAD3676A784497784DF27C2405D4177" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">In determining the eligibility for adoption assistance payments of a child in a legal guardianship arrangement described in section 471(a)(28), the placement of the child with the relative guardian involved shall be considered never to have been made.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H070514C1F7914F1B89026E3FC9BD8363"><enum>(2)</enum><header>State plan requirement</header> 
<subparagraph id="H20E4DEDC28924993B0BB1EFF9486EAC"><enum>(A)</enum><header>In general</header><text>Section 471(a)(20) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(20)</external-xref>) is amended—</text> 
<clause id="HAC83DF5295D3422FBD8258D5F746FAF5"><enum>(i)</enum><text>by adding <quote>and</quote> at the end of subparagraph (C); and</text></clause> 
<clause id="HFA6260785A034BEBB5D90011A2FA9275"><enum>(ii)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HC811D8FB25104084A77B8C42DC9602F9" style="OLC"> 
<subparagraph id="H16C7CED9E332410AAB3248E0F3CAA6E2"><enum>(D)</enum><text display-inline="yes-display-inline">provides procedures for criminal records checks, including fingerprint-based checks of national crime information databases (as defined in <external-xref legal-doc="usc" parsable-cite="usc/28/534">section 534(e)(3)(A)</external-xref> of title 28, United States Code), on any relative guardian, and for checks described in subparagraph (C) of this paragraph on any relative guardian and any other adult living in the home of any relative guardian, before the relative guardian may be finally approved for placement of a child regardless of whether kinship guardianship assistance payments are to be made on behalf of the child under the State plan under this part;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H5A073CFFEC0F4C9F86A820F1F7558EDB"><enum>(B)</enum><header>Redesignation of new provision after amendment made by prior law takes effect</header> 
<clause id="HE0806893A8D1417D968FF2B8685800D2"><enum>(i)</enum><header>In general</header><text>Section 471(a)(20) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(20)</external-xref>) is amended—</text> 
<subclause id="H7CC6768AF4954D54B915A45CB5878F14"><enum>(I)</enum><text>in subparagraph (D), by striking <quote>(C)</quote> and inserting <quote>(B)</quote>; and</text></subclause> 
<subclause id="HD7302E9615AF406E9E70ED14E483E35"><enum>(II)</enum><text>by redesignating subparagraph (D) as subparagraph (C).</text></subclause></clause> 
<clause id="H065E79141F054F49971EBD2B3014799C"><enum>(ii)</enum><header>Effective date</header><text>The amendments made by clause (i) shall take effect immediately after the amendments made by section 152 of <external-xref legal-doc="public-law" parsable-cite="pl/109/248">Public Law 109–248</external-xref> take effect.</text></clause></subparagraph></paragraph> 
<paragraph id="HA8C89DE2BD3B4C0E91832CF842B98419"><enum>(3)</enum><header>Payments to states</header><text>Section 474(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)</external-xref>) is amended—</text> 
<subparagraph id="HAF3B3953A1FB46B7B553A6B4EC9F9D66"><enum>(A)</enum><text>by striking the period at the end and inserting <quote>; plus</quote>; and</text></subparagraph> 
<subparagraph id="HB8B1788E25784F8880C0624CFB72ECD3"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HDADEE52E480F4AC39BFBA2D6E1C0DB7B" style="OLC"> 
<paragraph id="HF81657CA66DB43B693A0F23B06EFF55"><enum>(6)</enum><text>an amount equal to the percentage by which the expenditures referred to in paragraph (2) of this subsection are reimbursed of the total amount expended during such quarter as kinship guardianship assistance payments under section 473(d) pursuant to kinship guardianship assistance agreements.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H0A85F041529C49ADA2EA141FE974518D"><enum>(4)</enum><header>Definitions</header><text>Section 475(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(1)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="HEE338EE5E33F4565B4AAF2AE73CD56AC" style="OLC"> 
<subparagraph id="H894B571591284CCEBB7E593CD7EB6302"><enum>(F)</enum><text>In the case of a child with respect to whom the permanency plan is placement with a relative and receipt of kinship guardianship assistance payments under section 473(d), a description of—</text> 
<clause id="H9470BA41E78D4856870096DAB337AFAE"><enum>(i)</enum><text>the steps that the agency has taken to determine that it is not appropriate for the child to be returned home or adopted;</text></clause> 
<clause id="HE5255DDCCCE241C8A21E2281784711A8"><enum>(ii)</enum><text>the reasons for any separation of siblings during placement;</text></clause> 
<clause id="H9DF3E8EA7B4F4858A863FE1ECFE7765B"><enum>(iii)</enum><text>the reasons why a permanent placement with a fit and willing relative through a kinship guardianship assistance arrangement is in the child’s best interests;</text></clause> 
<clause id="H62A66B0A175248859E00A6C8F7C3B3F5"><enum>(iv)</enum><text>the ways in which the child meets the eligibility requirements for a kinship guardianship assistance payment;</text></clause> 
<clause id="H5E855D0ADE5E4021B3F19031B4A0EA7C"><enum>(v)</enum><text>the efforts the agency has made to discuss adoption by the child’s relative foster parent as a more permanent alternative to legal guardianship and, in the case of a relative foster parent who has chosen not to pursue adoption, documentation of the reasons therefor; and</text></clause> 
<clause id="H689D01C805FE4A2191D0A11944B6CB12"><enum>(vi)</enum><text>the efforts made by the State agency to discuss with the child’s parent or parents the kinship guardianship assistance arrangement, or the reasons why the efforts were not made.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEB66ADD614D94F428DDEBE7B8D0446AF"><enum>(d)</enum><header>Continued services under waiver</header><text>Section 474 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="HCC05B6EFCF114FCE8F915027534E28B8" style="OLC"> 
<subsection id="H05C1630A72AF4857A37237F7E604676"><enum>(g)</enum><text display-inline="yes-display-inline">For purposes of this part, after the termination of a demonstration project relating to guardianship conducted by a State under section 1130, the expenditures of the State for the provision, to children who, as of September 30, 2008, were receiving assistance or services under the project, of the same assistance and services under the same terms and conditions that applied during the conduct of the project, are deemed to be expenditures under the State plan approved under this part.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HB93D4300ACCA4AA90077E9F5E12AA7C"><enum>3.</enum><header>Family connection grants</header><text display-inline="no-display-inline">Part B of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/620">42 U.S.C. 620–629i</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HD7E82790900448C9A415EEFF96D702BD" style="OLC"> 
<subpart id="HF2DEDFDC621847B8B235529C938528E4"><enum>3</enum><header>Family Connection Grants</header> 
<section id="H7D2AE6B2CDE24A3390CEE6668F17D75D"><enum>441.</enum><header>Family connection grants</header> 
<subsection id="HBE45DF4C42D5450A87C007C64148ECFC"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services may make matching grants to State, local, or tribal child welfare agencies, and private nonprofit organizations that have experience in working with foster children or children in kinship care arrangements, for the purpose of helping children who are in, or at risk of entering, foster care reconnect with family members through the implementation of—</text> 
<paragraph id="H4844ED8267254E4B92EA49921BA00B"><enum>(1)</enum><text>kinship navigator programs designed to assist kinship caregivers in navigating their way through programs and services, and to help the caregivers learn about and obtain assistance to meet the needs of the children they are raising and their own needs;</text></paragraph> 
<paragraph id="HBC6E129A5FFB4AFA8165E4DD9F529725"><enum>(2)</enum><text>intensive family-finding efforts that utilize search technology to find biological family members for children in the child welfare system, and once identified, work to reestablish relationships and explore ways to find a permanent family placement for the children; or</text></paragraph> 
<paragraph id="H6F06E31E70204C32A3CC00E48A4BF17"><enum>(3)</enum><text>family group decision-making meetings for children in the child welfare system that engage and empower families to make decisions and develop plans that nurture children and protect them from enduring further abuse and neglect.</text></paragraph></subsection> 
<subsection id="H2DC8C7309FE14DCFB6E6517BBB547106"><enum>(b)</enum><header>Applications</header><text>An entity desiring to receive a matching grant under this section shall submit to the Secretary an application, at such time, in such manner, and containing such information as the Secretary may require, including—</text> 
<paragraph id="H154AE7AA4AC1495D849933245C3400F4"><enum>(1)</enum><text>a description of how the grant will be used to implement 1 or more of the activities described in subsection (a);</text></paragraph> 
<paragraph id="HBBC94E19C25A48769C8200B75E4B0600"><enum>(2)</enum><text>a description of the types of children and families to be served, including how the children and families will be identified and recruited, and an initial projection of the number of children and families to be served;</text></paragraph> 
<paragraph id="H5EB05AEEA60D4DF797681FDABF0031E2"><enum>(3)</enum><text>if the entity is a private organization—</text> 
<subparagraph id="H31423D4E30974148932ECE754FA940B0"><enum>(A)</enum><text>documentation of support from the relevant local or State child welfare agency; or</text></subparagraph> 
<subparagraph id="H07C73BF9E0D74113A317FBD4D34C651B"><enum>(B)</enum><text>a description of how the organization plans to coordinate its services and activities with those offered by the relevant local or State child welfare agency; and</text></subparagraph></paragraph> 
<paragraph id="H28BBF39CBD2142C78478831226974C96"><enum>(4)</enum><text>an assurance that the entity will cooperate fully with any evaluation provided for by the Secretary under this section.</text></paragraph></subsection> 
<subsection id="HD46D072E5DA0406A009298704CB51981"><enum>(c)</enum><header>Limitations</header> 
<paragraph id="H1DD1575222E54664804B5B00C8635942"><enum>(1)</enum><header>Grant duration</header><text>The Secretary may award a grant under this section for a period of not less than 1 year and not more than 3 years.</text></paragraph> 
<paragraph id="HA1AACE2AB1B34C0BA516DB1FBE3C8032"><enum>(2)</enum><header>Number of new grantees per year</header><text>The Secretary may not award a grant under this section to more than 20 new grantees each fiscal year.</text></paragraph></subsection> 
<subsection id="H071E158A13164671AE855137C7E3DD98"><enum>(d)</enum><header>Federal contribution</header><text>The amount of a grant payment to be made to a grantee under this section during each year in the grant period shall be the following percentage of the total expenditures proposed to be made by the grantee in the application approved by the Secretary under this section:</text> 
<paragraph id="H0D83937C10924F448056917F70B7E6BB"><enum>(1)</enum><text>75 percent, if the payment is for the 1st or 2nd year of the grant period.</text></paragraph> 
<paragraph id="H3CBD6F6629ED4E6AA0C3A9BEA12426FF"><enum>(2)</enum><text>50 percent, if the payment is for the 3rd year of the grant period.</text></paragraph></subsection> 
<subsection id="H20FC7D79153949E88F8D24D50221E27"><enum>(e)</enum><header>Form of grantee contribution</header><text>A grantee under this section may provide not more than 50 percent of the amount which the grantee is required to expend to carry out the activities for which a grant is awarded under this section in kind, fairly evaluated, including plant, equipment, or services.</text></subsection> 
<subsection id="HEB6B70DE5E114C60A543BE7E2D5B73B2"><enum>(f)</enum><header>Use of grant</header><text>A grantee under this section shall use the grant in accordance with the approved application for the grant.</text></subsection> 
<subsection id="H67D94CC1032A4C378B008C76D2C5EDE"><enum>(g)</enum><header>Reservations of funds</header> 
<paragraph id="H22712C31D9A0498688EA1CF55746B5C7"><enum>(1)</enum><header>Evaluation</header><text>The Secretary shall reserve 3 percent of the funds made available under subsection (h) for each fiscal year for the conduct of a rigorous evaluation of the activities funded with grants under this section.</text></paragraph> 
<paragraph id="HC1651E923C804D3A897DAB30B1FC8ED"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary may reserve 2 percent of the funds made available under subsection (h) for each fiscal year to provide technical assistance to recipients of grants under this section.</text></paragraph></subsection> 
<subsection id="H2627B94174234B0AB950F602F100B38F"><enum>(h)</enum><header>Limitations on authorization of Appropriations</header><text>To carry out this section, there are authorized to be appropriated to the Secretary not more than $50,000,000 for each of fiscal years 2009 through 2013.</text></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HA78C588000BA42C389D941CCFF82BD06"><enum>4.</enum><header>Notification to relatives of foster care placements</header><text display-inline="no-display-inline">Section 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>), as amended by section 2(a) of this Act, is amended—</text> 
<paragraph id="HA9121E0365A14535BD893736ADE4CDE0"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (27);</text></paragraph> 
<paragraph id="H4487347A984145E3BA3D6018AD78D0BA"><enum>(2)</enum><text>by striking the period at the end of paragraph (28) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H0CB9FCD5397D42D89390D9D7FF2892DF"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H2CEBA2B69A9E43699199BF636EEF9C43" style="OLC"> 
<paragraph id="H5190505DA7894F8789DCBBA0BE1B6EEB"><enum>(29)</enum><text>provides that, not later than 30 days after the date the State places a child in foster care, the State agency shall attempt to locate and notify any noncustodial parents, siblings, grandparents, aunts, or uncles of the child who are adults, of the removal of the child from the custody of the child’s parent or parents and explain the options the relative has to participate in the care and placement of the child, subject to exceptions due to family or domestic violence which shall be provided for under State law.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HBA7E78CBE0964EB1B786EC5026A389CB"><enum>5.</enum><header>State option for children in foster care, and certain children in an adoptive or guardianship placement, after attaining age 18</header> 
<subsection id="HADAC3AAAD88A4BBBB0EA5B1D92B2292"><enum>(a)</enum><header>Definition of child</header><text>Section 475 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H2996B5EF36A1467D86F458ACCB4D0084" style="OLC"> 
<paragraph id="H609B1FDB300E44F485C55708A02414F"><enum>(8)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H860D410B3CE140ACB620B085A52641DB"><enum>(A)</enum><text>Subject to subparagraph (B), the term <term>child</term> means an individual who has not attained 18 years of age.</text></subparagraph> 
<subparagraph id="H869011E95A9348FC87C8C4F5716B7185" indent="up1"><enum>(B)</enum><text>At the option of a State, the term shall include an individual—</text> 
<clause id="HDE3D445B454948679F2796DF244398FF"><enum>(i)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="HB145486D9CF34EA294EB73CAE234761D"><enum>(I)</enum><text>who is in foster care under the responsibility of the State;</text></subclause> 
<subclause id="HA4FAFD6D3CA6422EBFE2E33FB1D8590" indent="up1"><enum>(II)</enum><text>with respect to whom an adoption assistance agreement is in effect under section 473 if the child had attained 16 years of age before the agreement became effective; or</text></subclause> 
<subclause id="H5D58A5790B934FA7B123442585CB8666" indent="up1"><enum>(III)</enum><text>with respect to whom a kinship guardianship assistance agreement is in effect under section 473(d) if the child had attained 16 years of age before the agreement became effective;</text></subclause></clause> 
<clause id="H5FF458E8650F484294618D20B76F05BD"><enum>(ii)</enum><text>who has attained 18 years of age;</text></clause> 
<clause id="HA231AB509E534CEAAA6811BD01C713F8"><enum>(iii)</enum><text>who has not attained 19, 20, or 21 years of age, as the State may elect; and</text></clause> 
<clause id="H0DA6C166B670420D80E47C76F00409E"><enum>(iv)</enum><text>who is—</text> 
<subclause id="H7A161CC27F3A4259A542827504D675EE"><enum>(I)</enum><text>completing secondary education or a program leading to an equivalent credential;</text></subclause> 
<subclause id="H66D7B81F9E3A4690BE4BF86300B3DD"><enum>(II)</enum><text>enrolled in an institution which provides post-secondary or vocational education;</text></subclause> 
<subclause id="H435D3AEE91FB4C67BFC688F689E5BB"><enum>(III)</enum><text>participating in a program or activity designed to promote, or remove barriers to, employment; or</text></subclause> 
<subclause id="H2C9D272EC4E640218074836C1F56DE9D"><enum>(IV)</enum><text>employed for at least 80 hours per month.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H30C1C0D866A04FF6B411B83847615659"><enum>(b)</enum><header>Conforming amendment to definition of child-care institution</header><text>Section 472(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/672">42 U.S.C. 672(c)(2)</external-xref>) is amended by inserting <quote>, except, in the case of a child who has attained 18 years of age, the term shall include a supervised setting in which the individual is living independently, in accordance with such conditions as the Secretary shall establish in regulations</quote> before the period.</text></subsection> 
<subsection id="HFF556773C6A4464FBCC4A6E888C1D52E"><enum>(c)</enum><header>Conforming amendments to age limits applicable to children eligible for adoption assistance or kinship guardianship assistance</header><text>Section 473(a)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)(4)</external-xref>) is amended to read as follows:</text>

<paragraph id="HEA1E114A61BC4C38AB57C8206B001EA0" indent="up1"><enum>(4)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H44159086B28B4CF8006C8D0962F54F7D"><enum>(A)</enum><text>Notwithstanding any other provision of this section, a payment may not be made pursuant to this section to parents or relative guardians with respect to a child—</text> 
<clause id="H21C11FC1422849A7A87552EC5578BD63" indent="up1"><enum>(i)</enum><text>who has attained—</text> 
<subclause id="H8873275347974384AE4EE69D43D33401"><enum>(I)</enum><text>18 years of age, or such greater age as the State may elect under section 475(8)(B)(iii); or</text></subclause> 
<subclause id="HDBCCF138D7A3430E92CF11446CBFC79B"><enum>(II)</enum><text>21 years of age, if the State determines that the child has a mental or physical handicap which warrants the continuation of assistance;</text></subclause></clause> 
<clause id="H8F2B344EBA3948BAB3790045C9B6E71E" indent="up1"><enum>(ii)</enum><text>who has not attained 18 years of age, if the State determines that the parents or relative guardians, as the case may be, are no longer legally responsible for the support of the child; or</text></clause> 
<clause id="H18B49C0F0FEB44E5B0DCFAE72E6FF45F" indent="up1"><enum>(iii)</enum><text>if the State determines that the child is no longer receiving any support from the parents or relative guardians, as the case may be.</text></clause></subparagraph> 
<subparagraph id="HD5ED971CB47C4E7F84FEA38B5D26B23" indent="up1"><enum>(B)</enum><text>Parents or relative guardians who have been receiving adoption assistance payments or kinship guardianship assistance payments under this section shall keep the State or local agency administering the program under this section informed of circumstances which would, pursuant to this subsection, make them ineligible for the payments, or eligible for the payments in a different amount.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0ABA996C36D3438EAB373933E4C600AE"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2010.</text></subsection></section> 
<section id="H23B3693398C64F01BC8F1825E9B44020"><enum>6.</enum><header>Short-term training for child welfare agencies, prospective relative guardians, and court personnel</header> 
<subsection id="HA0FE839C5082460E9CA2176D4386C701"><enum>(a)</enum><header>In general</header><text>Section 474(a)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)(3)(B)</external-xref>) is amended—</text> 
<paragraph id="HD28783475DEC4A6A89A2165507B2FE63"><enum>(1)</enum><text>by inserting <quote>or relative guardians</quote> after <quote>adoptive parents</quote>;</text></paragraph> 
<paragraph id="HC8237578D79F442DBA92A27E35F694B9"><enum>(2)</enum><text>by striking <quote>and the members</quote> and inserting <quote>, the members</quote>; </text></paragraph> 
<paragraph id="H0AA87E93097A44AAA74E708F5C72C73D"><enum>(3)</enum><text>by inserting <quote>, or State-licensed or State-approved child welfare agencies providing services,</quote> after <quote>providing care</quote>;</text></paragraph> 
<paragraph id="HD7E2A173E2334747855C0054C2669644"><enum>(4)</enum><text>by inserting <quote>, and members of the staff of abuse and neglect courts, agency attorneys, attorneys representing children or parents, guardians ad litem, or other court-appointed special advocates representing children in proceedings of such courts</quote> after <quote>part,</quote>;</text></paragraph> 
<paragraph id="HE9D19390A5424E1F88F2B41076179E6E"><enum>(5)</enum><text>by inserting <quote>guardians,</quote> before <quote>staff members,</quote>; and</text></paragraph> 
<paragraph id="H92A99EBCFF3F4489A71EC6159D31CDE5"><enum>(6)</enum><text>by striking <quote>and institutions</quote> and inserting <quote>institutions, attorneys, and advocates</quote>.</text></paragraph></subsection> 
<subsection id="H94A362DAF7004FDBA02492FD56964588"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2008.</text></subsection> 
<subsection id="H4951347806D347E68708E5CE615D27A2"><enum>(c)</enum><header>Phase-in</header><text display-inline="yes-display-inline">With respect to an expenditure described in section 474(a)(3)(B) of the Social Security Act by reason of an amendment made by subsection (a) of this section, in lieu of the percentage set forth in such section 474(a)(3)(B), the percentage that shall apply is—</text> 
<paragraph id="H8CA4BF33DEC3427E880029D78313B9DA"><enum>(1)</enum><text>55 percent, if the expenditure is made in fiscal year 2009;</text></paragraph> 
<paragraph id="H920AE2F57FF541A3BF23BB2BAEB100EC"><enum>(2)</enum><text>60 percent, if the expenditure is made in fiscal year 2010;</text></paragraph> 
<paragraph id="HCDBC18B206F34000993D7CF68281B2EC"><enum>(3)</enum><text display-inline="yes-display-inline">65 percent, if the expenditure is made in fiscal year 2011; or</text></paragraph> 
<paragraph id="HF6B5712251374FB988C8BF3D967F7788"><enum>(4)</enum><text display-inline="yes-display-inline">70 percent, if the expenditure is made in fiscal year 2012.</text></paragraph></subsection></section> 
<section id="HDA8B0AC8360447EA8E807E2525229DE"><enum>7.</enum><header>Equitable access for foster care and adoption services for Indian children in tribal areas</header> 
<subsection id="HCC6BD66CCE8B4C8BA3DD11DE6C5EE19E"><enum>(a)</enum><header>Authority for indian tribes To receive direct federal title iv–E funds</header><text>Section 472(a)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/672">42 U.S.C. 672(a)(2)(B)</external-xref>) is amended—</text> 
<paragraph id="HF361C798993A4D409D1500F6FDE116E"><enum>(1)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H93FF22AA580543B896DD8FD7F5867BF"><enum>(2)</enum><text>in clause (ii), by striking <quote>and</quote> at the end and inserting <quote>or</quote>; and</text></paragraph>

<subsection id="H1FB0329CE78B4482BB54694314F13800"><enum>(b)</enum><header>Programs operated by indian tribal organizations</header><text>Part E of title IV of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670 et seq.</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H834C15FBB35C442F87CED3BB85E0034"><enum>(c)</enum><header>Modification of plan and other requirements</header> 
<paragraph display-inline="no-display-inline" id="H4D3991809706476EB543EE9DFB3D8724"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an Indian tribe, a tribal organization, or a tribal consortium submitting a plan for approval under section 471, the plan—</text> 
<subparagraph id="H6ED202AE5DF040F7917F444176E403C4"><enum>(A)</enum><text>shall—</text> 
<clause id="HDD66CB1820234C48B1EDF3E2294F6431"><enum>(i)</enum><text>in lieu of the requirements of section 471(a)(3), identify the service area or areas and population to be served by the Indian tribe, tribal organization, or tribal consortium; and</text></clause> 
<clause id="H63B7C4CD3A4F4A038D046658A53300FA"><enum>(ii)</enum><text>in lieu of the requirements of section 471(a)(10), provide for the establishment and application of standards for foster family homes and child care institutions pursuant to tribal standards and in a manner that ensures the safety of, and accountability for, children placed in foster care; and</text></clause></subparagraph> 
<subparagraph id="HC576BFD916424ED9A9AD798751EB45EF"><enum>(B)</enum><text>may, at the option of the Indian tribe, tribal organization, or tribal consortium, in lieu of the requirements of section 471(a)(20), provide procedures for conducting background checks in accordance with the requirements of section 408 of the Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3207">25 U.S.C. 3207</external-xref>) and regulations issued thereunder, and for conducting checks of child abuse and neglect registries maintained by the Federal Government, by a State, and by an Indian tribe, tribal organization, or tribal consortium in a manner that ensures the safety of, and accountability for, children placed in foster care or who are being placed for adoption.</text></subparagraph></paragraph> 
<paragraph id="HA09C10B5BBA54F3985E77DC0DCDB00D4"><enum>(2)</enum><header>Determination of Federal share; sources of non-Federal share</header> 
<subparagraph id="H69564BF0422A4F8BA04BE1BB31B797C1"><enum>(A)</enum><header>Per capita income</header> 
<clause id="HBF7E81CF570E4F93A86781EDFE40AF4E"><enum>(i)</enum><header>In general</header><text>For purposes of determining the Federal medical assistance percentage applicable to an Indian tribe, a tribal organization, or a tribal consortium under paragraphs (1) and (2) of section 474(a) (and for purposes of payments made under an arrangement described in section 472(a)(2)(B)(iii)(III)), the calculation of the per capita income of the Indian tribe, tribal organization, or tribal consortium shall be based upon the service population of the Indian tribe, tribal organization, or tribal consortium as defined in the plan of the Indian tribe, tribal organization, or tribal consortium, in accordance with paragraph (1)(A), except that in no case shall an Indian tribe, a tribal organization, or a tribal consortium receive less than the Federal medical assistance percentage for any State in which the tribe is located.</text></clause> 
<clause id="H38BBD1C33DF948A9B607A59D73B2A958"><enum>(ii)</enum><header>Consideration of other information</header><text>Before making a calculation under clause (i), the Secretary shall consider any information submitted by an Indian tribe, a tribal organization, or a tribal consortium that the Indian tribe, tribal organization, or tribal consortium considers relevant to making the calculation of the per capita income of the Indian tribe, tribal organization, or tribal consortium.</text></clause></subparagraph> 
<subparagraph id="H01E4FED59EEB439DAFD0DBE0A39DE0E9"><enum>(B)</enum><header>Administrative, training, and data collection expenditures</header><text>The Secretary shall, by regulation, determine the proportions to be paid to Indian tribes, tribal organizations, and tribal consortiums pursuant to section 474(a)(3) for purposes of this section (and for purposes of payments made under an arrangement described in section 472(a)(2)(B)(iii)(III)), except that in no case shall an Indian tribe, a tribal organization, or a tribal consortium receive a lesser proportion than the corresponding amount specified for a State in that section.</text></subparagraph> 
<subparagraph id="HBFCC69371CE04D8E99193E4FDF47F1C5"><enum>(C)</enum><header>Sources of non-Federal share</header><text>An Indian tribe, tribal organization, or tribal consortium may use Federal, State, tribal, or private funds, which may be in kind, fairly evaluated, including plant, equipment, administration, and services, to match payments for which the tribe, organization, or consortium is eligible under section 474.</text></subparagraph></paragraph> 
<paragraph id="H33F702809CD5434386B02EE582A3EB06"><enum>(3)</enum><header>Modification of other requirements</header><text>On the request of an Indian tribe, tribal organization, or a tribal consortium, the Secretary may modify any requirement under this part if, after consulting with the Indian tribe, tribal organization, or tribal consortium, the Secretary determines that modification of the requirement would advance the best interests and the safety of children served by the Indian tribe, tribal organization, or tribal consortium.</text></paragraph> 
<paragraph id="H14D8704F86194368B5F943A914D15241"><enum>(4)</enum><header>Consortium</header><text>The participating Indian tribes or tribal organizations of a tribal consortium may develop and submit a single plan under section 471 that meets the requirements of this section.</text></paragraph></subsection> 
<subsection id="HED53741EF63C4C9691DC1DAC0050D84C"><enum>(d)</enum><header>Cooperative agreements</header> 
<paragraph id="H23350A96443844279319B5F62EAB42EC"><enum>(1)</enum><header>In general</header><text>An Indian tribe, a tribal organization, or a tribal consortium and a State may enter into a cooperative agreement for the administration or payment of funds under this part.</text></paragraph> 
<paragraph id="HB134C9038B8D482996F6C4DD8CBA3C"><enum>(2)</enum><header>Application and enforcement of incorporated provisions of this section</header><text>If an Indian tribe, a tribal organization, or a tribal consortium and a State enter into a cooperative agreement that incorporates any of the provisions of this section, those provisions shall be valid and enforceable.</text></paragraph> 
<paragraph id="HA109D5662DFF4EC09E349721E208ECF"><enum>(3)</enum><header>Prior agreements in effect</header><text>Any cooperative agreement described in paragraph (1) that is in effect as of the date of enactment of this section, shall remain in full force and effect subject to the right of either party to the agreement to revoke or modify the agreement pursuant to the terms of the agreement.</text></paragraph></subsection> 
<subsection id="HFDCFBA167BD94ED4B472AD7E66A3FA"><enum>(e)</enum><header>John H. Chafee foster care independence program</header><text>Except as provided in section 477(j), subsection (b) of this section shall not apply with respect to the John H. Chafee Foster Care Independence Program established under section 477 (or with respect to payments made under section 474(a)(4) or grants made under section 474(e)).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H896DE8A5FB8F4F9587C55450ACD0CFA5"><enum>(c)</enum><header>Application of Federal matching rate that would apply to Indian tribes, tribal organizations, or tribal consortia to expenditures under State agreements or an agreement with the Secretary</header> 
<paragraph id="H8BBE745CE7184268934217E9CB40A0EB"><enum>(1)</enum><header>Foster care maintenance and adoption assistance payments</header><text>Paragraphs (1) and (2) of section 474(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)</external-xref>) are each amended by inserting <quote>(or, with respect to such payments made during such quarter under an agreement entered into by the State and an Indian tribe, tribal organization, or tribal consortium, or under an arrangement described in section 472(a)(2)(B)(iii)(III), an amount equal to the Federal medical assistance percentage that would apply under subsection (c)(2)(A) of section 479B (in this paragraph referred to as the <quote>tribal FMAP</quote>) if such Indian tribe, tribal organization, or tribal consortium made such payments under a program operated under that section, unless the tribal FMAP is less than the Federal medical assistance percentage that applies to the State)</quote> before the semicolon.</text></paragraph> 
<paragraph id="H8AB6C915FBED4612AFADA0C43322386F"><enum>(2)</enum><header>Administrative expenditures</header><text>Section 474(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)(3)</external-xref>) is amended—</text> 
<subparagraph id="HE117CE8B9BF348C49669B7C644EE6BC2"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>section 472(i)</quote> and inserting <quote>subparagraph (E) and section 472(i)</quote>;</text></subparagraph> 
<subparagraph id="HB4D1517B97474E36B651C3C50006BC7D"><enum>(B)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H5D15C395CC5947019132A6CA492C6C"><enum>(C)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></subparagraph>

<subsection id="H26CD3E5EACD94613A8AA31001F49B674"><enum>(d)</enum><header>Hold harmless for indian families receiving foster care maintenance payments or adoption assistance</header><text>Nothing in the amendments made by this Act shall be construed as authorization to terminate funding to any Indian or Indian family currently receiving foster care maintenance payments or adoption assistance on behalf of a child and for which the State receives Federal matching payments under paragraph (1) or (2) of section 474(a) of the Social Security Act, regardless of whether a cooperative agreement between the State and an Indian tribe, tribal organization, or tribal consortium is in effect pursuant to subsection (d) of section 479B(d) of such Act, or an Indian tribe, tribal organization, or tribal consortium elects to operate a foster care and adoption assistance program directly under such section 479B.</text></subsection> 
<subsection id="H2F95BFAD7E91400082B8FC7582582158"><enum>(e)</enum><header>Nonapplication of certain eligibility requirements for indian children</header><text>Section 472(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/672">42 U.S.C. 672(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H032259A3767C4E51BE92131200E18ECA" style="OLC"> 
<paragraph id="H3DAD6A7286954D8989D652FB13ED2055"><enum>(5)</enum><header>Nonapplication of certain requirements for indian children</header><text>In the case of an Indian tribe, tribal organization, or tribal consortium that assumes responsibility for administering the program under this part through a cooperative agreement with the State under section 479B(d), or that elects to operate a foster care and adoption assistance program directly under section 479B, the following rules shall apply:</text> 
<subparagraph id="H957289FE6EEA4263B69CCB67BC7C3213"><enum>(A)</enum><header>Use of affidavits, etc</header><text>The requirement in paragraph (1) shall not be interpreted so as to prohibit the use of affidavits or nunc pro tunc orders as verification documents in support of the reasonable efforts and contrary to the welfare of the child judicial determinations required under such paragraph.</text></subparagraph> 
<subparagraph id="H11A46E24E0124FEC9D2C8391E42A0EB"><enum>(B)</enum><header>Residency requirement imposed under afdc state plan</header><text>Notwithstanding paragraph (3)(A), any residency requirement imposed under the State plan referred to in such paragraph shall not apply with respect to a child for whom an Indian tribe, tribal organization, or tribal consortium assumes responsibility.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H55D6B41743BC420196BC76A0440139FA"><enum>(f)</enum><header>Authority To receive portion of State allotment as part of an agreement To operate the John H. Chafee Foster Care Independence Program</header> 
<paragraph id="H17947257361B47F9AF7D3452FEB3C87E"><enum>(1)</enum><header>In general</header><text>Section 477 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H7999469377294DACA8CCD6D3A2CB7BFD"><enum>(j)</enum><header>Authority for an Indian tribe, tribal organization, or tribal consortium To receive an allotment</header> 
<paragraph id="HC6E1138C80CB4D0A87CD99C22DB10097"><enum>(1)</enum><header>In general</header><text>An Indian tribe, tribal organization, or tribal consortium with a plan approved under section 479B, which is receiving funding to provide foster care under this part pursuant to a cooperative agreement with a State, or that provides child welfare services and protections in accordance with an arrangement submitted to the Secretary under section 472(a)(2)(B)(iii)(III), may apply for an allotment out of any funds authorized by paragraph (1) or (2) (or both) of subsection (h) of this section.</text></paragraph> 
<paragraph id="HEA5FE773801844D7B01040F7F0CC81A1"><enum>(2)</enum><header>Application</header><text>An Indian tribe, tribal organization, or tribal consortium desiring an allotment under paragraph (1) shall submit an application to the Secretary to directly receive such allotment that includes a plan that satisfies such requirements of paragraphs (2) and (3) of subsection (b) as the Secretary determines are appropriate.</text></paragraph> 
<paragraph id="HD325C777AF6F478F812853535FAB0012"><enum>(3)</enum><header>Payments</header><text>The Secretary shall pay an Indian tribe, tribal organization, or tribal consortium with an application and plan approved under this subsection from the allotment determined for the tribe, organization, or consortium under paragraph (4) of this subsection in the same manner as is provided in section 474(a)(4) (and, where requested, and if funds are appropriated, section 474(e)) with respect to a State, or in such other manner as is determined appropriate by the Secretary, except that in no case shall an Indian tribe, a tribal organization, or a tribal consortium receive a lesser proportion of such funds than a State is authorized to receive under those sections.</text></paragraph> 
<paragraph id="H11BE027C0E144F02A45CBAAE424BE7B1"><enum>(4)</enum><header>Allotment</header><text>From the amounts allotted to a State under subsection (c) of this section for a fiscal year, the Secretary shall allot to each Indian tribe, tribal organization, or tribal consortium with an application and plan approved under this subsection for that fiscal year an amount equal to the tribal foster care ratio determined under paragraph (5) of this subsection for the tribe, organization, or consortium multiplied by the allotment amount of the State within which the tribe, organization, or consortium is located. The allotment determined under this paragraph is deemed to be a part of the allotment determined under section 477(c) for the State in which the Indian tribal organization or tribal consortium is located.</text></paragraph> 
<paragraph id="H76CA18AFAE3B4C9586788700E9D1AD59"><enum>(5)</enum><header>Tribal foster care ratio</header><text>For purposes of paragraph (4), the tribal foster care ratio means, with respect to an Indian tribe, tribal organization, or tribal consortium, the ratio of—</text> 
<subparagraph id="H52EF289F96D5490EB81FEE29CA49A9F9"><enum>(A)</enum><text>the number of children in foster care under the responsibility of the Indian tribe, tribal organization, or tribal consortium (either directly or under supervision of the State), in the most recent fiscal year for which the information is available; to</text></subparagraph> 
<subparagraph id="H2B9BB84F7EF34A4E83FDA1C9DD49D700"><enum>(B)</enum><text>the sum of—</text> 
<clause id="H1FD4D1B21F8546D5B657CFEF893E887D"><enum>(i)</enum><text>the total number of children in foster care under the responsibility of the State within which the Indian tribe, tribal organization, or tribal consortium is located; and</text></clause> 
<clause id="H7BA0D769BE5946EB8DE051B300696236"><enum>(ii)</enum><text>the total number of children in foster care under the responsibility of all Indian tribes, tribal organizations, or tribal consortia (either directly or under supervision of the State).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2ED004D018BE415D81DA91B301DDB9CE"><enum>(2)</enum><header>Authority to receive portion of state allotment as part of a cooperative agreement entered into with respect to the chafee program</header><text>Section 477(b)(3)(G) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(b)(3)(G)</external-xref>) is amended—</text> 
<subparagraph id="H78EE0347EE144D5E91B7C0B62D782E70"><enum>(A)</enum><text>by striking <quote>and that</quote> and inserting <quote>that</quote>; and</text></subparagraph> 
<subparagraph id="H2B5B4C20079547240098BF1D5BB27938"><enum>(B)</enum><text>by striking the period and inserting <quote>; and that each Indian tribe, tribal organization, or tribal consortium in the State that does not receive an allotment under subsection (j)(4) for a fiscal year may enter into a cooperative agreement or contract with the State to administer, supervise, or oversee the programs to be carried out under the plan with respect to the Indian children who are eligible for such programs and who are under the authority of the Indian tribe and to receive from the State an appropriate portion of the State allotment under subsection (c) for the cost of such administration, supervision, or oversight.</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HF0297FF501A34684A600A1FA1BCAA69E"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in the amendments made by this Act shall be construed as affecting the responsibility of a State—</text> 
<paragraph id="H274C3B23C92B4DF8B0BC8FC08E00F722"><enum>(1)</enum><text>as part of the plan approved under section 471 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671</external-xref>), to provide foster care maintenance payments and adoption assistance for Indian children who are eligible for such payments or assistance and who are not otherwise being served by an Indian tribe, tribal organization, or tribal consortium pursuant to a foster care and adoption assistance program operated under section 479B of such Act; or</text></paragraph> 
<paragraph id="HBE1550EDF1144B9EA2E1CDF8A4D13C2"><enum>(2)</enum><text>as part of the plan approved under section 477 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) to administer, supervise, or oversee programs carried out under that plan on behalf of Indian children who are eligible for such programs if such children are not otherwise being served by an Indian tribe, tribal organization, or tribal consortium pursuant to an approved plan under section 477(j) or a cooperative agreement or contract entered into under section 477(b)(3)(G) of such Act.</text></paragraph></subsection> 
<subsection id="HAACAB22E04494177A73FED50A3FD82DC"><enum>(h)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this section, the Secretary, in consultation with Indian tribes, tribal organizations, tribal consortia, and affected States, shall promulgate regulations to carry out the amendments made by this section.</text></subsection> 
<subsection id="HC36A24F1DF0F483CB3A41649C500F18C"><enum>(i)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2010.</text></subsection></section> 
<section id="H9A7CAD5BDA564F5F917149FC8DEC00C9"><enum>8.</enum><header>Health oversight and coordination plan</header><text display-inline="no-display-inline">Section 422(b)(15) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/622">42 U.S.C. 622(b)(15)</external-xref>) is amended to read as follows:</text> 
<quoted-block id="HE026A3789A3E427586B621166E8062C3" style="OLC"> 
<paragraph id="H4EC2883579374BBDB78600F8E3801DC7"><enum>(15)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H5E7B41F5AB6A4EF9AEF1FF9E1613FE52"><enum>(A)</enum><text>provides that the State will develop, in coordination and collaboration with the State agency referred to in paragraph (1) and the State agency responsible for administering the State plan approved under title XIX, and in consultation with pediatricians, other experts in health care, and experts in and recipients of child welfare services, a plan for the ongoing oversight and coordination of health care services for any child in a foster care placement, which shall ensure a coordinated strategy to identify and respond to the health care needs of children in foster care placements, including mental health and dental health needs, and shall include an outline of—</text> 
<clause id="H1131BD3C30F04F2C8F3BB45D14638649" indent="up1"><enum>(i)</enum><text>a schedule for initial and follow-up health screenings that meet reasonable standards of medical practice;</text></clause> 
<clause id="H8768155B5CA04EECAF0923EC00C3CF99" indent="up1"><enum>(ii)</enum><text>how health needs identified through screenings will be monitored and treated;</text></clause> 
<clause id="H8934B4F87CD94405B082174F3C87994F" indent="up1"><enum>(iii)</enum><text>how medical information for children in care will be updated and appropriately shared, which may include the development and implementation of an electronic health record;</text></clause> 
<clause id="HE7750EC9747F47E49EF6532726C97AA" indent="up1"><enum>(iv)</enum><text>steps to ensure continuity of health care services, which may include the establishment of a medical home for every child in care;</text></clause> 
<clause id="HF901A0B399BD499E9DBCEB5BFD4D7FA" indent="up1"><enum>(v)</enum><text>the oversight of prescription medicines; and</text></clause> 
<clause id="H82A4C65C781847A7AD08FDF1A59CBFF" indent="up1"><enum>(vi)</enum><text>how the State actively consults with and involves physicians or other appropriate medical professionals in assessing the health and well-being of children in foster care and in determining appropriate medical treatment for the children; and</text></clause></subparagraph> 
<subparagraph id="HB9359D28B6F84D1183F400D154E467FB" indent="up1"><enum>(B)</enum><text>subparagraph (A) shall not be construed to reduce or limit the responsibility of the State agency responsible for administering the State plan approved under title XIX to administer and provide care and services for children with respect to whom services are provided under the State plan developed pursuant to this subpart;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4B0C116FBA1C467F8115B4F2BC57B897"><enum>9.</enum><header>Educational stability</header> 
<subsection id="H31551224B92642558973F4D7ACCAAF92"><enum>(a)</enum><header>In general</header><text>Section 475 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>), as amended by section 2(c)(4) of this Act, is amended—</text> 
<paragraph id="H246A5AF7C7EC452CB098BE5500272EC1"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HA0E8F6F887AB42FCAD3C446F442BEF1B"><enum>(A)</enum><text>in subparagraph (C), by striking clause (iv) and redesignating clauses (v) through (viii) as clauses (iv) through (vii), respectively; and</text></subparagraph> 
<subparagraph id="H7F3AF8D296E54741841134D96DD8E38C"><enum>(B)</enum><text>by adding at the end the following:</text>

<subparagraph id="H0D42A285A826455D8BE8E3FBEC7601"><enum>(G)</enum><text>A plan for ensuring the educational stability of the child while in foster care, including—</text> 
<clause id="HA3F91EFA920B40019B0904BEE1BAECD9"><enum>(i)</enum><text>assurances that the placement of the child in foster care takes into account the appropriateness of the current educational setting and the proximity to the school in which the child is enrolled at the time of placement; and</text></clause> 
<clause id="H96002320BA6B447D8773DA5977EBCCE9"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="HEC29644525E24650AC14E4FBA27D177D"><enum>(I)</enum><text>an assurance that the State agency has coordinated with appropriate local educational agencies (as defined under section 9101 of the Elementary and Secondary Education Act of 1965) to ensure that the child remains in the school in which the child is enrolled at the time of placement; or</text></subclause> 
<subclause id="HC29753A3F0DE42F495F90100B9561239" indent="up1"><enum>(II)</enum><text>if remaining in such school is not in the best interests of the child, assurances by the State agency and the local educational agencies to provide immediate and appropriate enrollment in a new school, with all of the educational records of the child provided to the school.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HE97498C50C624DE1005E70E8DDD75451"><enum>(2)</enum><text>in the 1st sentence of paragraph (4)(A)—</text> 
<subparagraph id="HA5AFEF1A7D9646B48BDCB791CBB0B352"><enum>(A)</enum><text>by striking <quote>and reasonable</quote> and inserting <quote>reasonable</quote>; and</text></subparagraph> 
<subparagraph id="H1525C93DA87448B2B31125758BA799EB"><enum>(B)</enum><text>by inserting <quote>, and reasonable travel for the child to remain in the school in which the child is enrolled at the time of placement</quote> before the period.</text></subparagraph></paragraph></subsection> 
<subsection id="H42DBCC92B07D423C89AB0249869000D8"><enum>(b)</enum><header>Educational attendance requirement</header><text>Section 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>), as amended by sections 2(a) and 4 of this Act, is amended—</text> 
<paragraph id="HAF9D17FEA77F49E58442C5EA4AD2800"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (28);</text></paragraph> 
<paragraph id="H5B553344B0494AFCB751B597461184DD"><enum>(2)</enum><text>by striking the period at the end of paragraph (29) and inserting <quote>; and</quote>; and</text></paragraph>

<paragraph id="H6FF22AE684EE462A9817D4521BC29800"><enum>(30)</enum><text>provides assurances that each child who has attained the minimum age for compulsory school attendance under State law and with respect to whom there is eligibility for a payment under the State plan is a full-time elementary or secondary school student or has completed secondary school, and for purposes of this paragraph, the term <term>elementary or secondary school student</term> means, with respect to a child, that the child is—</text> 
<subparagraph id="HC8D4FFAD53504DBB91175EC2BBD60024"><enum>(A)</enum><text>enrolled (or in the process of enrolling) in an institution which provides elementary or secondary education, as determined under the law of the State or other jurisdiction in which the institution is located;</text></subparagraph> 
<subparagraph id="HDA07635ECC5947E0BF0039F268003791"><enum>(B)</enum><text>instructed in elementary or secondary education at home in accordance with a home school law of the State or other jurisdiction in which the home is located;</text></subparagraph> 
<subparagraph id="HF5AFCC9381FD49EEAEEBC3CB8189BDD6"><enum>(C)</enum><text>in an independent study elementary or secondary education program in accordance with the law of the State or other jurisdiction in which the program is located, which is administered by the local school or school district; or</text></subparagraph> 
<subparagraph id="H8CA6755E7A3046D386E85370A975CF11"><enum>(D)</enum><text>incapable of attending school on a full-time basis due to the medical condition of the child, which incapability is supported by regularly updated information included in the case plan of the child.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HEBB4A24A233743F1840199A4464DE83"><enum>10.</enum><header>Sibling placement</header><text display-inline="no-display-inline">Section 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>), as amended by sections 2(a), 4, and 9(b) of this Act, is amended—</text> 
<paragraph id="HB2BF035B911E4A86A35965F45202FA86"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (29);</text></paragraph> 
<paragraph id="H64167A19FDAC45298CDBEA0322767C5"><enum>(2)</enum><text>by striking the period at the end of paragraph (30) and inserting <quote>; and</quote>; and</text></paragraph>

<paragraph id="H1F62581716154FE88E635E5C564191F4"><enum>(31)</enum><text>provides that reasonable efforts shall be made to place siblings removed from their home in the same foster care, kinship guardianship, or adoptive placement unless the State documents that such a joint placement would be contrary to the safety or well-being of any of the siblings.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H1C50ABB5FDA4456BA5102EADEB99D434"><enum>11.</enum><header>Adoption incentives program</header> 
<subsection id="H06AAC3283AAB4E77A14B00A3F6E89DC3"><enum>(a)</enum><header>5-year extension</header><text>Section 473A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b</external-xref>) is amended—</text> 
<paragraph id="H2C967E2FFFC444C7AB002909C808F574"><enum>(1)</enum><text>in subsection (b)(4), by striking <quote>in the case of fiscal years 2001 through 2007,</quote>;</text></paragraph> 
<paragraph id="H5426D80F5EBA481088B08DE7BB06FEB6"><enum>(2)</enum><text>in subsection (b)(5), by striking <quote>1998 through 2007</quote> and inserting <quote>2008 through 2012</quote>;</text></paragraph> 
<paragraph id="H3DA3328A63EB43D79986402839E99387"><enum>(3)</enum><text>in subsection (c)(2), by striking <quote>each of fiscal years 2002 through 2007</quote> and inserting <quote>a fiscal year</quote>; and</text></paragraph> 
<paragraph id="HE3FAB1E2D6C3428191E7E805EA88618"><enum>(4)</enum><text>in each of subsections (h)(1)(D), and (h)(2), by striking <quote>2008</quote> and inserting <quote>2013</quote>.</text></paragraph></subsection> 
<subsection id="H3975AB39B2EF4BC0AB84E9EA3CE05676"><enum>(b)</enum><header>Updating of fiscal year used in determining base numbers of adoptions</header><text>Section 473A(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(g)</external-xref>) is amended—</text> 
<paragraph id="HEE4DE9597ECE45CCB98E2CB2DC1FDD68"><enum>(1)</enum><text>in paragraph (3), by striking <quote>means</quote> and all that follows and inserting <quote>means, with respect to any fiscal year, the number of foster child adoptions in the State in fiscal year 2007.</quote>;</text></paragraph>

<section id="H7409150297FB464DAA4BDBCF6F337D0"><enum>13.</enum><header>Modification of foster care matching rate for the District of Columbia to conform with medicaid matching rate</header><text display-inline="no-display-inline">Section 474(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)</external-xref>) is amended in each of paragraphs (1) and (2) by striking <quote>(as defined in section 1905(b) of this Act)</quote> and inserting <quote>(which shall be as defined in section 1905(b), in the case of a State other than the District of Columbia, or 70 percent, in the case of the District of Columbia)</quote>.</text></section> 
<section id="H719820CB4A2A499481032B176FCB2B25" section-type="subsequent-section"><enum>14.</enum><header>Collection of unemployment compensation debts resulting from fraud</header> 
<subsection id="H42F955CF9D14427D9B651E7B46DE14C5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6402 of the Internal Revenue Code (relating to authority to make credits or refunds) is amended by redesignating subsections (f) through (k) as subsections (g) through (l), respectively, and by inserting after subsection (e) the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H6C8098C4BB8F4102A18C04DAA3AC58FE" style="OLC"> 
<subsection id="H443E8894BD2E4BBDABF48B9FDEA92D09"><enum>(f)</enum><header>Collection of unemployment compensation debts resulting from fraud</header> 
<paragraph id="H0A19730F7566452FAB5BF6203E8E53E9"><enum>(1)</enum><header>In general</header><text>Upon receiving notice from any State that a named person owes a covered unemployment compensation debt to such State, the Secretary shall, under such conditions as may be prescribed by the Secretary—</text> 
<subparagraph id="H69BA0DEC80FB4AFB90797E15C24F832C"><enum>(A)</enum><text>reduce the amount of any overpayment payable to such person by the amount of such covered unemployment compensation debt;</text></subparagraph> 
<subparagraph id="HB684C4CB81AA446DB6E9B5C95BF03F27"><enum>(B)</enum><text>pay the amount by which such overpayment is reduced under subparagraph (A) to such State and notify such State of such person’s name, taxpayer identification number, address, and the amount collected; and</text></subparagraph> 
<subparagraph id="HDC18A54DFA7241DC891C8DDAFBCF0051"><enum>(C)</enum><text>notify the person making such overpayment that the overpayment has been reduced by an amount necessary to satisfy a covered unemployment compensation debt.</text></subparagraph><continuation-text continuation-text-level="paragraph">If an offset is made pursuant to a joint return, the notice under subparagraph (B) shall include the names, taxpayer identification numbers, and addresses of each person filing such return and the notice under subparagraph (C) shall include information related to the rights of a spouse of a person subject to such an offset.</continuation-text></paragraph> 
<paragraph id="H97670D6338954A6DABF4831E3006F2E6"><enum>(2)</enum><header>Priorities for offset</header><text>Any overpayment by a person shall be reduced pursuant to this subsection—</text> 
<subparagraph id="HDCA50566FA4549F59D18B6D8CD8946C3"><enum>(A)</enum><text>after such overpayment is reduced pursuant to—</text> 
<clause id="HB73F1751E5194777A5B456FE7E203BB"><enum>(i)</enum><text>subsection (a) with respect to any liability for any internal revenue tax on the part of the person who made the overpayment;</text></clause> 
<clause id="HA03DC6F3ED7741928373CF04F3999E59"><enum>(ii)</enum><text>subsection (c) with respect to past-due support; and</text></clause> 
<clause id="HDEBDF4F267664FAF9D518B19DA06B589"><enum>(iii)</enum><text>subsection (d) with respect to any past-due, legally enforceable debt owed to a Federal agency; and</text></clause></subparagraph> 
<subparagraph id="HDE45D6DF18BE44DB0030AC1C7F1F14AB"><enum>(B)</enum><text>before such overpayment is credited to the future liability for any Federal internal revenue tax of such person pursuant to subsection (b).</text></subparagraph><continuation-text continuation-text-level="paragraph">If the Secretary receives notice from a State or States of more than one debt subject to paragraph (1) or subsection (e) that is owed by a person to such State or States, any overpayment by such person shall be applied against such debts in the order in which such debts accrued.</continuation-text></paragraph> 
<paragraph id="H851906C5B8264EE9BA00EB3F9B00358"><enum>(3)</enum><header>Notice; consideration of evidence</header><text>No State may take action under this subsection until such State—</text> 
<subparagraph id="H133B806B1A374BDB8299278ED9FA0032"><enum>(A)</enum><text>notifies the person owing the covered unemployment compensation debt that the State proposes to take action pursuant to this section;</text></subparagraph> 
<subparagraph id="HE2D1DAB8A41145C6BA7E80641EAC8485"><enum>(B)</enum><text>provides such person at least 60 days to present evidence that all or part of such liability is not legally enforceable or due to fraud;</text></subparagraph> 
<subparagraph id="H8FD6513437FD4DE4BCD092A1E647964E"><enum>(C)</enum><text>considers any evidence presented by such person and determines that an amount of such debt is legally enforceable and due to fraud; and</text></subparagraph> 
<subparagraph id="HF5EBEBF3CC314FD88C61BE006C0052B3"><enum>(D)</enum><text>satisfies such other conditions as the Secretary may prescribe to ensure that the determination made under subparagraph (C) is valid and that the State has made reasonable efforts to obtain payment of such covered unemployment compensation debt.</text></subparagraph></paragraph> 
<paragraph id="HFF518E97E98343D280F19C23D5317FB3"><enum>(4)</enum><header>Covered unemployment compensation debt</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>covered unemployment compensation debt</term> means—</text> 
<subparagraph id="H2D439F3D38E84AF5B5A405AD57D81046"><enum>(A)</enum><text display-inline="yes-display-inline">a past-due debt for erroneous payment of unemployment compensation due to fraud which has become final under the law of a State certified by the Secretary of Labor pursuant to section 3304 and which remains uncollected;</text></subparagraph> 
<subparagraph id="H6441D30D68F047D2A6C9931E3941E8B8"><enum>(B)</enum><text display-inline="yes-display-inline">contributions due to the unemployment fund of a State for which the State has determined the person to be liable due to fraud; and</text></subparagraph> 
<subparagraph id="H3D4EE3BF3F5248CAABC07748F63D7F5"><enum>(C)</enum><text>any penalties and interest assessed on such debt.</text></subparagraph></paragraph> 
<paragraph id="HE8597ABA10EE4966A5BEE74BDAB85DB"><enum>(5)</enum><header>Regulations</header> 
<subparagraph id="H67DD3B10E86E4F9A87925CE27253F7D7"><enum>(A)</enum><header>In general</header><text>The Secretary may issue regulations prescribing the time and manner in which States must submit notices of covered unemployment compensation debt and the necessary information that must be contained in or accompany such notices. The regulations may specify the minimum amount of debt to which the reduction procedure established by paragraph (1) may be applied.</text></subparagraph> 
<subparagraph id="H0CF00B6747664FAF9499AF6DBD3927AA"><enum>(B)</enum><header>Fee payable to Secretary</header><text>The regulations may require States to pay a fee to the Secretary, which may be deducted from amounts collected, to reimburse the Secretary for the cost of applying such procedure. Any fee paid to the Secretary pursuant to the preceding sentence shall be used to reimburse appropriations which bore all or part of the cost of applying such procedure.</text></subparagraph> 
<subparagraph id="H544A43950662440F81CD23396B172419"><enum>(C)</enum><header>Submission of notices through Secretary of Labor</header><text>The regulations may include a requirement that States submit notices of covered unemployment compensation debt to the Secretary via the Secretary of Labor in accordance with procedures established by the Secretary of Labor. Such procedures may require States to pay a fee to the Secretary of Labor to reimburse the Secretary of Labor for the costs of applying this subsection. Any such fee shall be established in consultation with the Secretary of the Treasury. Any fee paid to the Secretary of Labor may be deducted from amounts collected and shall be used to reimburse the appropriation account which bore all or part of the cost of applying this subsection.</text></subparagraph></paragraph> 
<paragraph id="HC7A5EF69A1D34E63B6005F4B99FCCCE"><enum>(6)</enum><header>Erroneous payment to state</header><text>Any State receiving notice from the Secretary that an erroneous payment has been made to such State under paragraph (1) shall pay promptly to the Secretary, in accordance with such regulations as the Secretary may prescribe, an amount equal to the amount of such erroneous payment (without regard to whether any other amounts payable to such State under such paragraph have been paid to such State).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC27053FE8030423EBED4DA986DAD00FB"><enum>(b)</enum><header>Disclosure of certain information to States requesting refund offsets for legally enforceable state unemployment compensation debt resulting from fraud</header> 
<paragraph id="H236E13A2F00C46D087D28D91C6F3D5A0"><enum>(1)</enum><header>General rule</header><text>Paragraph (3) of section 6103(a) of such Code is amended by inserting <quote>(10),</quote> after <quote>(6),</quote>.</text></paragraph> 
<paragraph id="H8890772FA7FA41E88F737700F0998CF9"><enum>(2)</enum><header>Disclosure to Department of Labor and its agent</header><text>Paragraph (10) of section 6103(l) of such Code is amended—</text> 
<subparagraph id="H723ABD8DF85D4E9D822C4D9118DD8946"><enum>(A)</enum><text>by striking <quote>(c), (d), or (e)</quote> each place it appears in the heading and text and inserting <quote>(c), (d), (e), or (f)</quote>,</text></subparagraph>

<clause id="H826F9030C99F481B8E22A8AD005BDD12"><enum>(ii)</enum><text>the penalties and interest described in section 6402(f)(4)(B) may be transferred to the appropriate State fund into which the State would have deposited such amounts had the person owing the debt paid such amounts directly to the State;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<paragraph id="HFC2F1A80FE8E4C0AA3C8A6879899C200"><enum>(1)</enum><text>Subsection (a) of section 6402 of such Code is amended by striking <quote>(c), (d), and (e),</quote> and inserting <quote>(c), (d), (e), and (f)</quote>.</text></paragraph> 
<paragraph id="HB8D9C76D6FC9475AB3ED6B74926D1956"><enum>(2)</enum><text>Paragraph (2) of section 6402(d) of such Code is amended by striking <quote>and before such overpayment is reduced pursuant to subsection (e)</quote> and inserting <quote>and before such overpayment is reduced pursuant to subsections (e) and (f)</quote>.</text></paragraph>

<section id="H446A70D2CA4C446CA7BB95B00037C8D8"><enum>15.</enum><header>Investment of operating cash</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/323">Section 323</external-xref> of title 31, United States Code, is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H5D81BF618D124A2EB67C976645D73627" style="USC"> 
<section id="H692AD9B677494B33BDA8D89974235C94"><enum>323.</enum><header>Investment of operating cash</header> 
<subsection id="H13A4AF514A2545A690401DF5E3E5A5CB"><enum>(a)</enum><text>To manage United States cash, the Secretary of the Treasury may invest any part of the operating cash of the Treasury for not more than 90 days. The Secretary may invest the operating cash of the Treasury in—</text> 
<paragraph id="H1EA494D62E444E87B46514DE1E2CC59"><enum>(1)</enum><text>obligations of depositories maintaining Treasury tax and loan accounts secured by pledged collateral acceptable to the Secretary;</text></paragraph> 
<paragraph id="H194F75840526486DB22484C0A53E8BCD"><enum>(2)</enum><text>obligations of the United States Government; and</text></paragraph> 
<paragraph id="HB71E5DADB5C54C35ABEB6C946434E676"><enum>(3)</enum><text>repurchase agreements with parties acceptable to the Secretary.</text></paragraph></subsection> 
<subsection id="H3A15AEDA2DC14CF8A5CED004FF87C9"><enum>(b)</enum><text>Subsection (a) of this section does not require the Secretary to invest a cash balance held in a particular account.</text></subsection> 
<subsection id="HC6DC9FCE031F4E73B57D739100505DD6"><enum>(c)</enum><text>The Secretary shall consider the prevailing market in prescribing rates of interest for investments under subsection (a)(1) of this section.</text></subsection> 
<subsection id="H7403787AFD324FBFBD285FD9D4C75000"><enum>(d)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HDE633D52D5624D50B5463E5446D27EC7"><enum>(1)</enum><text>The Secretary of the Treasury shall submit each fiscal year to the appropriate committees a report detailing the investment of operating cash under subsection (a) for the preceding fiscal year. The report shall describe the Secretary's consideration of risks associated with investments and the actions taken to manage such risks.</text></paragraph> 
<paragraph id="H1A1FB3324EF84918BD222541B6E21C69" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the term <term>appropriate committees</term> means the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC5983DA5444642D092A9551733777330"><enum>16.</enum><header>Effective date</header> 
<subsection id="H3A77270D36C64956AEC23C21D75CC0EF"><enum>(a)</enum><header>In general</header><text>Except as otherwise provided in this Act, each amendment made by this Act to part B or E of title IV of the Social Security Act shall take effect on the date of the enactment of this Act, and shall apply to payments under the part amended for quarters beginning on or after the effective date of the amendment.</text></subsection> 
<subsection id="H3A4FD55ABA424EB0A8891B7BC9C1342D"><enum>(b)</enum><header>Delay permitted if State legislation required</header><text>In the case of a State plan approved under part B or E of title IV of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by this Act, the State plan shall not be regarded as failing to comply with the requirements of such part solely on the basis of the failure of the plan to meet such additional requirements before the 1st day of the 1st calendar quarter beginning after the close of the 1st regular session of the State legislature that ends after the 1-year period beginning with the date of the enactment of this Act. For purposes of the preceding sentence, in the case of a State that has a 2-year legislative session, each year of the session is deemed to be a separate regular session of the State legislature.</text></subsection></section> 
<section id="H5709149E7C9D432FB7E3DD31F0DFADC2"><enum>17.</enum><header>No Federal funding to unlawfully present individuals</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to alter prohibitions on Federal payments to individuals who are unlawfully present in the United States.</text></section>
