<section id="H604A10AAFFAC4A9AB4C4240020A9C088"><enum>101.</enum><header>Additional procedures regarding certain persons outside the United States</header> 
<subsection id="HABC23CB7174A432D9C92D82643EE8F76"><enum>(a)</enum><header>In general</header><text>The Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) is amended—</text> 
<paragraph id="HEA8FABDC2D914927BC9C5C63AE876397"><enum>(1)</enum><text>by striking title VII; and</text> </paragraph> 
<paragraph id="H47D4F4E82CCE4577AD94DBA13BB5C5D4"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="HACBE647A3E224EF0B5D846E8A0B0EDDF"><enum>(a)</enum><header>In general</header><text>The terms <term>agent of a foreign power</term>, <term>Attorney General</term>, <term>contents</term>, <term>electronic surveillance</term>, <term>foreign intelligence information</term>, <term>foreign power</term>, <term>person</term>, <term>United States</term>, and <term>United States person</term> have the meanings given such terms in section 101, except as specifically provided in this title.</text> </subsection> 
<subsection id="H7F589FE56CE2450D8E0003C93F713D37"><enum>(b)</enum><header>Additional definitions</header> 
<paragraph id="H782A9957EFCB4962A32B4969B9F66758"><enum>(1)</enum><header>Congressional intelligence committees</header><text>The term <term>congressional intelligence committees</term> means—</text> 
<subparagraph id="H0D422CDDE297415796DFA90573006EFD"><enum>(A)</enum><text>the Select Committee on Intelligence of the Senate; and</text> </subparagraph> 
<subparagraph id="HB0DD64977C1A4BF98C7F61D9F8D56B6B"><enum>(B)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives.</text> </subparagraph></paragraph> 
<paragraph id="H3EFB6D9A1CF34B909447D6617640A0CE"><enum>(2)</enum><header>Foreign Intelligence Surveillance Court; Court</header><text>The terms <term>Foreign Intelligence Surveillance Court</term> and <term>Court</term> mean the court established under section 103(a).</text> </paragraph> 
<paragraph id="H960DE99034F24B9B97ABD24E75EE5F9E"><enum>(3)</enum><header>Foreign Intelligence Surveillance Court of Review; Court of Review</header><text>The terms <term>Foreign Intelligence Surveillance Court of Review</term> and <term>Court of Review</term> mean the court established under section 103(b).</text> </paragraph> 
<paragraph id="HAE43C834758E40F5BA2643A42CBDDBA0"><enum>(4)</enum><header>Electronic communication service provider</header><text>The term <term>electronic communication service provider</term> means—</text> 
<subparagraph id="H7C2FCD2925B64D4480813703D588978C"><enum>(A)</enum><text>a telecommunications carrier, as that term is defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>);</text> </subparagraph> 
<subparagraph id="HBACA7E9C9823475491FF56B92EB81494"><enum>(B)</enum><text>a provider of electronic communication service, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510</external-xref> of title 18, United States Code;</text> </subparagraph> 
<subparagraph id="HB148E2C3A0154BCCAF3C839B04433059"><enum>(C)</enum><text>a provider of a remote computing service, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2711">section 2711</external-xref> of title 18, United States Code;</text> </subparagraph> 
<subparagraph id="H81262E007DAB430E9900CE79DC935029"><enum>(D)</enum><text>any other communication service provider who has access to wire or electronic communications either as such communications are transmitted or as such communications are stored; or</text> </subparagraph> 
<subparagraph id="H268ADE3B0A7E4B81BD43655D00ECC00"><enum>(E)</enum><text>an officer, employee, or agent of an entity described in subparagraph (A), (B), (C), or (D).</text> </subparagraph></paragraph> 
<paragraph id="H51A83B81945048649E9675D2EDF07E1"><enum>(5)</enum><header>Intelligence community</header><text>The term <term>intelligence community</term> has the meaning given the term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>).</text> </paragraph></subsection></section> 
<section id="H21B6612059C84590934FA6C52C246EB5"><enum>702.</enum><header>Procedures for targeting certain persons outside the United States other than United States persons</header> 
<subsection id="HE62AE9EE88834AD9B305D808D9D9F7E"><enum>(a)</enum><header>Authorization</header><text>Notwithstanding any other provision of law, upon the issuance of an order in accordance with subsection (i)(3) or a determination under subsection (c)(2), the Attorney General and the Director of National Intelligence may authorize jointly, for a period of up to 1 year from the effective date of the authorization, the targeting of persons reasonably believed to be located outside the United States to acquire foreign intelligence information.</text> </subsection> 
<subsection id="H0AE7C84A8D60427EBF6F1B35899C6860"><enum>(b)</enum><header>Limitations</header><text>An acquisition authorized under subsection (a)—</text> 
<paragraph id="H6D755A07E77D453D9421261DFBCCECB"><enum>(1)</enum><text>may not intentionally target any person known at the time of acquisition to be located in the United States;</text> </paragraph> 
<paragraph id="H732D3E7079A046BABDA63B9B15693402"><enum>(2)</enum><text>may not intentionally target a person reasonably believed to be located outside the United States if the purpose of such acquisition is to target a particular, known person reasonably believed to be in the United States;</text> </paragraph> 
<paragraph id="HC4BB4A8D67A54739A536E0D66FDDBF12"><enum>(3)</enum><text>may not intentionally target a United States person reasonably believed to be located outside the United States;</text> </paragraph> 
<paragraph id="H8D07DBC34A2A4079AD9CD82F40FF457C"><enum>(4)</enum><text>may not intentionally acquire any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States; and</text> </paragraph> 
<paragraph id="HF2EDD1C998554CDAADA352AB00D5CD71"><enum>(5)</enum><text>shall be conducted in a manner consistent with the fourth amendment to the Constitution of the United States.</text> </paragraph></subsection> 
<subsection id="HE3E2B892602C4AE3AA9926B62E6EDFE8"><enum>(c)</enum><header>Conduct of acquisition</header> 
<paragraph id="HFD668059A84748FA00A27690FCD9C440"><enum>(1)</enum><header>In general</header><text>An acquisition authorized under subsection (a) shall be conducted only in accordance with—</text> 
<subparagraph id="H0AD7944A12044FCE8D7E00F4D200A5FC"><enum>(A)</enum><text>the targeting and minimization procedures adopted in accordance with subsections (d) and (e); and</text> </subparagraph> 
<subparagraph id="HEB67F9A67D764F1EB0FD57009004B3CB"><enum>(B)</enum><text>upon submission of a certification in accordance with subsection (g), such certification.</text> </subparagraph></paragraph> 
<paragraph display-inline="no-display-inline" id="HA547CAA5B434423AA08DBEFE96A8E182"><enum>(2)</enum><header>Determination</header><text display-inline="yes-display-inline">A determination under this paragraph and for purposes of subsection (a) is a determination by the Attorney General and the Director of National Intelligence that exigent circumstances exist because, without immediate implementation of an authorization under subsection (a), intelligence important to the national security of the United States may be lost or not timely acquired and time does not permit the issuance of an order pursuant to subsection (i)(3) prior to the implementation of such authorization.</text> </paragraph> 
<paragraph id="HC7A76FA76AD14365BDC3301C5CEEEAFD"><enum>(3)</enum><header>Timing of determination</header><text display-inline="yes-display-inline">The Attorney General and the Director of National Intelligence may make the determination under paragraph (2)—</text> 
<subparagraph id="H3AE5D21EDDBF4730ABCEB134BDF29785"><enum>(A)</enum><text>before the submission of a certification in accordance with subsection (g); or</text> </subparagraph> 
<subparagraph id="H3938B6EAE16D451AB2B2C399DEF6057D"><enum>(B)</enum><text>by amending a certification pursuant to subsection (i)(1)(C) at any time during which judicial review under subsection (i) of such certification is pending.</text> </subparagraph></paragraph> 
<paragraph id="H5306EE41ABB5436DBA17E94058502CB"><enum>(4)</enum><header>Construction</header><text>Nothing in title I shall be construed to require an application for a court order under such title for an acquisition that is targeted in accordance with this section at a person reasonably believed to be located outside the United States.</text> </paragraph></subsection> 
<subsection id="H7474E393696345759BCB8B27FE22CDFB"><enum>(d)</enum><header>Targeting procedures</header> 
<paragraph id="H0F8AAFC357A142FD95022C2BC3B70992"><enum>(1)</enum><header>Requirement to adopt</header><text>The Attorney General, in consultation with the Director of National Intelligence, shall adopt targeting procedures that are reasonably designed to—</text> 
<subparagraph id="H2937ED82DCEE48099BF5E79065D0E029"><enum>(A)</enum><text>ensure that any acquisition authorized under subsection (a) is limited to targeting persons reasonably believed to be located outside the United States; and</text> </subparagraph> 
<subparagraph id="H810EDC9421994846A0807E9C7052AC55"><enum>(B)</enum><text>prevent the intentional acquisition of any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States.</text> </subparagraph></paragraph> 
<paragraph id="HC5F7465A7D9542B89554072E68E21E87"><enum>(2)</enum><header>Judicial review</header><text>The procedures adopted in accordance with paragraph (1) shall be subject to judicial review pursuant to subsection (i).</text> </paragraph></subsection> 
<subsection id="H59611F01CA2E47CC8D1F5C0047D91413"><enum>(e)</enum><header>Minimization procedures</header> 
<paragraph id="H4AA043E30FF44A2C8817252693CD13FE"><enum>(1)</enum><header>Requirement to adopt</header><text>The Attorney General, in consultation with the Director of National Intelligence, shall adopt minimization procedures that meet the definition of minimization procedures under section 101(h) or 301(4), as appropriate, for acquisitions authorized under subsection (a).</text> </paragraph> 
<paragraph id="H4BFBF02E4AD34149B7B355A961E13B8E"><enum>(2)</enum><header>Judicial review</header><text>The minimization procedures adopted in accordance with paragraph (1) shall be subject to judicial review pursuant to subsection (i).</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H36C40FD5EC4249A6A7AFA6BD0020FA17"><enum>(f)</enum><header>Guidelines for compliance with limitations</header> 
<paragraph commented="no" id="H0885514DDADB4624B4139B03294B1945"><enum>(1)</enum><header>Requirement to adopt</header><text>The Attorney General, in consultation with the Director of National Intelligence, shall adopt guidelines to ensure—</text> 
<subparagraph commented="no" id="H21A88B65864D458E0009F150848B46A9"><enum>(A)</enum><text>compliance with the limitations in subsection (b); and</text> </subparagraph> 
<subparagraph commented="no" id="H3FA36DFB9AB34B9E9D45708E1B4568DE"><enum>(B)</enum><text>that an application for a court order is filed as required by this Act.</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H1B32908E017F484B8006E12F36841E05"><enum>(2)</enum><header>Submission of guidelines</header><text>The Attorney General shall provide the guidelines adopted in accordance with paragraph (1) to—</text> 
<subparagraph commented="no" id="H380E5116080B4863A75E7FF05DDAB570"><enum>(A)</enum><text>the congressional intelligence committees;</text> </subparagraph> 
<subparagraph commented="no" id="H8041B725F5C4463FA889A900A279EBE9"><enum>(B)</enum><text>the Committees on the Judiciary of the Senate and the House of Representatives; and</text> </subparagraph> 
<subparagraph commented="no" id="HB0A255E549994C92B3EAA47C5E4002B"><enum>(C)</enum><text>the Foreign Intelligence Surveillance Court.</text> </subparagraph></paragraph></subsection> 
<subsection id="H891E90806AE84D93A2F524B13333C2FF"><enum>(g)</enum><header>Certification</header> 
<paragraph id="H012CD04B9F6049E68603FFC2F4ECA27"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H206F9D528C7C4141BBF06270A7E2B128"><enum>(A)</enum><header>Requirement</header><text>Subject to subparagraph (B), prior to the implementation of an authorization under subsection (a), the Attorney General and the Director of National Intelligence shall provide to the Foreign Intelligence Surveillance Court a written certification and any supporting affidavit, under oath and under seal, in accordance with this subsection.</text> </subparagraph> 
<subparagraph id="H78103F4E9C41466880A6BF7409D407EC"><enum>(B)</enum><header>Exception</header><text>If the Attorney General and the Director of National Intelligence make a determination under subsection (c)(2) and time does not permit the submission of a certification under this subsection prior to the implementation of an authorization under subsection (a), the Attorney General and the Director of National Intelligence shall submit to the Court a certification for such authorization as soon as practicable but in no event later than 7 days after such determination is made.</text> </subparagraph></paragraph> 
<paragraph id="HD2B408C165E5496CB100F0B99B89E0EB"><enum>(2)</enum><header>Requirements</header><text>A certification made under this subsection shall—</text> 
<subparagraph id="H61A7E16592F1405184C10829A051B69"><enum>(A)</enum><text>attest that—</text> 
<clause id="H102E642EB20249B7B2522CFD2501D7B8"><enum>(i)</enum><text>there are procedures in place that have been approved, have been submitted for approval, or will be submitted with the certification for approval by the Foreign Intelligence Surveillance Court that are reasonably designed to—</text> 
<subclause id="H78EB4988E1EC421FA9B3136D00721933"><enum>(I)</enum><text display-inline="yes-display-inline">ensure that an acquisition authorized under subsection (a) is limited to targeting persons reasonably believed to be located outside the United States; and</text> </subclause> 
<subclause id="H8C4A03E20EDD4DC5A4B896EFBF2A0CD"><enum>(II)</enum><text>prevent the intentional acquisition of any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States;</text> </subclause></clause> 
<clause id="H1B26778909A942FFB25EF79FE5D67398"><enum>(ii)</enum><text>the minimization procedures to be used with respect to such acquisition—</text> 
<subclause id="H3BE5A9CAB6C7466F8B273D2F1B632772"><enum>(I)</enum><text>meet the definition of minimization procedures under section 101(h) or 301(4), as appropriate; and</text> </subclause> 
<subclause id="H6CCAE08ABAC647D9921B5550B6375066"><enum>(II)</enum><text>have been approved, have been submitted for approval, or will be submitted with the certification for approval by the Foreign Intelligence Surveillance Court;</text> </subclause></clause> 
<clause id="H08F26B27246944C4B697CCDBB277C290"><enum>(iii)</enum><text>guidelines have been adopted in accordance with subsection (f) to ensure compliance with the limitations in subsection (b) and to ensure that an application for a court order is filed as required by this Act;</text> </clause> 
<clause id="HE7AE37209A604E1FBD3DA85F963112B"><enum>(iv)</enum><text>the procedures and guidelines referred to in clauses (i), (ii), and (iii) are consistent with the requirements of the fourth amendment to the Constitution of the United States;</text> </clause> 
<clause id="H818A96915E284566AB36D18E3FDBE3F"><enum>(v)</enum><text>a significant purpose of the acquisition is to obtain foreign intelligence information;</text> </clause> 
<clause id="H693D7F8618F34B638D0020114200D83"><enum>(vi)</enum><text>the acquisition involves obtaining foreign intelligence information from or with the assistance of an electronic communication service provider; and</text> </clause> 
<clause id="HEE0BD397245B45BB972DB553F04673CD"><enum>(vii)</enum><text display-inline="yes-display-inline">the acquisition complies with the limitations in subsection (b);</text> </clause></subparagraph> 
<subparagraph id="HE83C6FC262FD4996A940B428F6BBFA64"><enum>(B)</enum><text>include the procedures adopted in accordance with subsections (d) and (e);</text> </subparagraph> 
<subparagraph id="HEAA02EAAD09A427C8E4095355E988094"><enum>(C)</enum><text>be supported, as appropriate, by the affidavit of any appropriate official in the area of national security who is—</text> 
<clause id="H682FEBD0D8C74BBD90AFE5F408D21515"><enum>(i)</enum><text>appointed by the President, by and with the advice and consent of the Senate; or</text> </clause> 
<clause id="H8A83FE1675DE4FFCB437845737E54339"><enum>(ii)</enum><text>the head of an element of the intelligence community;</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA2FC27B1443B4B708EE68573C6D2B05E"><enum>(D)</enum><text>include—</text> 
<clause commented="no" id="HF6EAE8A125754B398396D73E00F86D46"><enum>(i)</enum><text>an effective date for the authorization that is at least 30 days after the submission of the written certification to the court; or</text> </clause> 
<clause commented="no" id="H93760F1111A84982AEADCB82519701CB"><enum>(ii)</enum><text>if the acquisition has begun or the effective date is less than 30 days after the submission of the written certification to the court, the date the acquisition began or the effective date for the acquisition; and</text> </clause></subparagraph> 
<subparagraph id="HFE48385ED4FB4AADBC075624A7BBBBEC"><enum>(E)</enum><text>if the Attorney General and the Director of National Intelligence make a determination under subsection (c)(2), include a statement that such determination has been made.</text> </subparagraph></paragraph> 
<paragraph id="HCEBD91B629D74C599436584E7800B6F0"><enum>(3)</enum><header>Change in effective date</header><text>The Attorney General and the Director of National Intelligence may advance or delay the effective date referred to in paragraph (2)(D) by submitting an amended certification in accordance with subsection (i)(1)(C) to the Foreign Intelligence Surveillance Court for review pursuant to subsection (i).</text> </paragraph> 
<paragraph id="H87A460EFC3CA4C3F8EE24EED3DDB35FE"><enum>(4)</enum><header>Limitation</header><text>A certification made under this subsection is not required to identify the specific facilities, places, premises, or property at which an acquisition authorized under subsection (a) will be directed or conducted.</text> </paragraph> 
<paragraph id="H792DC6A15B9A4F93952C811972715E8D"><enum>(5)</enum><header>Maintenance of certification</header><text>The Attorney General or a designee of the Attorney General shall maintain a copy of a certification made under this subsection.</text> </paragraph> 
<paragraph id="H0F716FC6D09A4021B7EBB279A2AD7698"><enum>(6)</enum><header>Review</header><text>A certification submitted in accordance with this subsection shall be subject to judicial review pursuant to subsection (i).</text> </paragraph></subsection> 
<subsection id="HA697998D4FCF4556BD9F1FE6AD65C3BC"><enum>(h)</enum><header>Directives and judicial review of directives</header> 
<paragraph id="H21D5F86F8C7F47BAAEA400189E681BD0"><enum>(1)</enum><header>Authority</header><text>With respect to an acquisition authorized under subsection (a), the Attorney General and the Director of National Intelligence may direct, in writing, an electronic communication service provider to—</text> 
<subparagraph id="H28ACFFE75E8644D4A6AD1DD2C622E965"><enum>(A)</enum><text>immediately provide the Government with all information, facilities, or assistance necessary to accomplish the acquisition in a manner that will protect the secrecy of the acquisition and produce a minimum of interference with the services that such electronic communication service provider is providing to the target of the acquisition; and</text> </subparagraph> 
<subparagraph id="HCB71317B59B94215B7EE287216482687"><enum>(B)</enum><text>maintain under security procedures approved by the Attorney General and the Director of National Intelligence any records concerning the acquisition or the aid furnished that such electronic communication service provider wishes to maintain.</text> </subparagraph></paragraph> 
<paragraph id="H5AEC7ED4F7A24F5CB95F33EA60450000"><enum>(2)</enum><header>Compensation</header><text display-inline="yes-display-inline">The Government shall compensate, at the prevailing rate, an electronic communication service provider for providing information, facilities, or assistance in accordance with a directive issued pursuant to paragraph (1).</text> </paragraph> 
<paragraph id="H9C3B2DCE0DE9415F8F00FD63ED251F0"><enum>(3)</enum><header>Release from liability</header><text>No cause of action shall lie in any court against any electronic communication service provider for providing any information, facilities, or assistance in accordance with a directive issued pursuant to paragraph (1).</text> </paragraph> 
<paragraph id="H081C1023A2B1414EA5EDCEFC41187394"><enum>(4)</enum><header>Challenging of directives</header> 
<subparagraph id="H9F27D5D06D414502B2DDF877CF80185F"><enum>(A)</enum><header>Authority to challenge</header><text>An electronic communication service provider receiving a directive issued pursuant to paragraph (1) may file a petition to modify or set aside such directive with the Foreign Intelligence Surveillance Court, which shall have jurisdiction to review such petition.</text> </subparagraph> 
<subparagraph id="HE3842226BDD348D0B190A8578B3E8EDB"><enum>(B)</enum><header>Assignment</header><text>The presiding judge of the Court shall assign a petition filed under subparagraph (A) to 1 of the judges serving in the pool established under section 103(e)(1) not later than 24 hours after the filing of such petition.</text> </subparagraph> 
<subparagraph id="H8421CD47430C4C2FA9B65755FF1B7593"><enum>(C)</enum><header>Standards for review</header><text>A judge considering a petition filed under subparagraph (A) may grant such petition only if the judge finds that the directive does not meet the requirements of this section, or is otherwise unlawful.</text> </subparagraph> 
<subparagraph id="H9F6A38350DBB4BF186BE527889C50085"><enum>(D)</enum><header>Procedures for initial review</header><text>A judge shall conduct an initial review of a petition filed under subparagraph (A) not later than 5 days after being assigned such petition. If the judge determines that such petition does not consist of claims, defenses, or other legal contentions that are warranted by existing law or by a nonfrivolous argument for extending, modifying, or reversing existing law or for establishing new law, the judge shall immediately deny such petition and affirm the directive or any part of the directive that is the subject of such petition and order the recipient to comply with the directive or any part of it. Upon making a determination under this subparagraph or promptly thereafter, the judge shall provide a written statement for the record of the reasons for such determination.</text> </subparagraph> 
<subparagraph id="HBEADE2C415FB430EAEB33C6CDB2D00DC"><enum>(E)</enum><header>Procedures for plenary review</header><text>If a judge determines that a petition filed under subparagraph (A) requires plenary review, the judge shall affirm, modify, or set aside the directive that is the subject of such petition not later than 30 days after being assigned such petition. If the judge does not set aside the directive, the judge shall immediately affirm or affirm with modifications the directive, and order the recipient to comply with the directive in its entirety or as modified. The judge shall provide a written statement for the record of the reasons for a determination under this subparagraph.</text> </subparagraph> 
<subparagraph id="H5CD1B7F7898241A2AE00F5B5C7300023"><enum>(F)</enum><header>Continued effect</header><text>Any directive not explicitly modified or set aside under this paragraph shall remain in full effect.</text> </subparagraph> 
<subparagraph id="H96536C7891DC4B22BD8880602637D58D"><enum>(G)</enum><header>Contempt of court</header><text>Failure to obey an order issued under this paragraph may be punished by the Court as contempt of court.</text> </subparagraph></paragraph> 
<paragraph id="HA6039C8AA1014799966ED1E65E113D15"><enum>(5)</enum><header>Enforcement of directives</header> 
<subparagraph id="H72D5B8DC1D9E4428991000599FABC8AF"><enum>(A)</enum><header>Order to compel</header><text>If an electronic communication service provider fails to comply with a directive issued pursuant to paragraph (1), the Attorney General may file a petition for an order to compel the electronic communication service provider to comply with the directive with the Foreign Intelligence Surveillance Court, which shall have jurisdiction to review such petition.</text> </subparagraph> 
<subparagraph id="HF2E0405C1A3442C5B4B40805AFAF7D76"><enum>(B)</enum><header>Assignment</header><text>The presiding judge of the Court shall assign a petition filed under subparagraph (A) to 1 of the judges serving in the pool established under section 103(e)(1) not later than 24 hours after the filing of such petition.</text> </subparagraph> 
<subparagraph id="H373F8819CDB44300BD27BD179CA0B502"><enum>(C)</enum><header>Procedures for review</header><text display-inline="yes-display-inline">A judge considering a petition filed under subparagraph (A) shall, not later than 30 days after being assigned such petition, issue an order requiring the electronic communication service provider to comply with the directive or any part of it, as issued or as modified, if the judge finds that the directive meets the requirements of this section and is otherwise lawful. The judge shall provide a written statement for the record of the reasons for a determination under this paragraph.</text> </subparagraph> 
<subparagraph id="H7E66670E7BC74A2E987719DC7A2055"><enum>(D)</enum><header>Contempt of court</header><text>Failure to obey an order issued under this paragraph may be punished by the Court as contempt of court.</text> </subparagraph> 
<subparagraph id="H67AA1DFDC6B84EB8A78B4E7D293F00D7"><enum>(E)</enum><header>Process</header><text>Any process under this paragraph may be served in any judicial district in which the electronic communication service provider may be found.</text> </subparagraph></paragraph> 
<paragraph id="H41AF91E600BE4E7496EADDFAA76E9939"><enum>(6)</enum><header>Appeal</header> 
<subparagraph id="H4B869C1F33254DDEA3A0BE0023169E17"><enum>(A)</enum><header>Appeal to the court of review</header><text>The Government or an electronic communication service provider receiving a directive issued pursuant to paragraph (1) may file a petition with the Foreign Intelligence Surveillance Court of Review for review of a decision issued pursuant to paragraph (4) or (5). The Court of Review shall have jurisdiction to consider such petition and shall provide a written statement for the record of the reasons for a decision under this subparagraph.</text> </subparagraph> 
<subparagraph id="HC814890770C74F3E811ED807465BBC8C"><enum>(B)</enum><header>Certiorari to the supreme court</header><text>The Government or an electronic communication service provider receiving a directive issued pursuant to paragraph (1) may file a petition for a writ of certiorari for review of a decision of the Court of Review issued under subparagraph (A). The record for such review shall be transmitted under seal to the Supreme Court of the United States, which shall have jurisdiction to review such decision.</text> </subparagraph></paragraph></subsection> 
<subsection id="HFE193165181449CBB01630D1B058DC"><enum>(i)</enum><header>Judicial review of certifications and procedures</header> 
<paragraph id="HFE4E8EA436874536859107B36BD6DD7E"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HFDCDB55A0AA347D9B31885F48D7DF645"><enum>(A)</enum><header>Review by the foreign intelligence surveillance court</header><text>The Foreign Intelligence Surveillance Court shall have jurisdiction to review a certification submitted in accordance with subsection (g) and the targeting and minimization procedures adopted in accordance with subsections (d) and (e), and amendments to such certification or such procedures.</text> </subparagraph> 
<subparagraph id="HF43A08F515BA483EB4FD7717E7168151"><enum>(B)</enum><header>Time period for review</header><text>The Court shall review a certification submitted in accordance with subsection (g) and the targeting and minimization procedures adopted in accordance with subsections (d) and (e) and shall complete such review and issue an order under paragraph (3) not later than 30 days after the date on which such certification and such procedures are submitted.</text> </subparagraph> 
<subparagraph commented="no" id="HF4690E921A5043BB9479833144379B05"><enum>(C)</enum><header>Amendments</header><text display-inline="yes-display-inline">The Attorney General and the Director of National Intelligence may amend a certification submitted in accordance with subsection (g) or the targeting and minimization procedures adopted in accordance with subsections (d) and (e) as necessary at any time, including if the Court is conducting or has completed review of such certification or such procedures, and shall submit the amended certification or amended procedures to the Court not later than 7 days after amending such certification or such procedures. The Court shall review any amendment under this subparagraph under the procedures set forth in this subsection. The Attorney General and the Director of National Intelligence may authorize the use of an amended certification or amended procedures pending the Court’s review of such amended certification or amended procedures.</text> </subparagraph></paragraph> 
<paragraph id="H69BDD846D6DC4ADCBD618E00DDFC2808"><enum>(2)</enum><header>Review</header><text>The Court shall review the following:</text> 
<subparagraph id="H07DF323879914CB4B22F22628D548B70"><enum>(A)</enum><header>Certification</header><text>A certification submitted in accordance with subsection (g) to determine whether the certification contains all the required elements.</text> </subparagraph> 
<subparagraph id="HF4C59DA151014D9F91687E5F35794E47"><enum>(B)</enum><header>Targeting procedures</header><text>The targeting procedures adopted in accordance with subsection (d) to assess whether the procedures are reasonably designed to—</text> 
<clause id="H24CD6ED444C74CF88650EFB97E6EA416"><enum>(i)</enum><text>ensure that an acquisition authorized under subsection (a) is limited to targeting persons reasonably believed to be located outside the United States; and</text> </clause> 
<clause id="H50D205991C1F4C52AE981FAE2981BA98"><enum>(ii)</enum><text>prevent the intentional acquisition of any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States.</text> </clause></subparagraph> 
<subparagraph id="H43D0EC9C2BD14AD695612463ED02E2B"><enum>(C)</enum><header>Minimization procedures</header><text>The minimization procedures adopted in accordance with subsection (e) to assess whether such procedures meet the definition of minimization procedures under section 101(h) or section 301(4), as appropriate.</text> </subparagraph></paragraph> 
<paragraph id="H083E7C131B584BF2BA298223A099B291"><enum>(3)</enum><header>Orders</header> 
<subparagraph id="HB289004E794042769500ABD4C63CEA00"><enum>(A)</enum><header>Approval</header><text>If the Court finds that a certification submitted in accordance with subsection (g) contains all the required elements and that the targeting and minimization procedures adopted in accordance with subsections (d) and (e) are consistent with the requirements of those subsections and with the fourth amendment to the Constitution of the United States, the Court shall enter an order approving the certification and the use, or continued use in the case of an acquisition authorized pursuant to a determination under subsection (c)(2), of the procedures for the acquisition.</text> </subparagraph> 
<subparagraph id="H920CCA7BB4E047019D47D7DE00E5070"><enum>(B)</enum><header>Correction of deficiencies</header><text>If the Court finds that a certification submitted in accordance with subsection (g) does not contain all the required elements, or that the procedures adopted in accordance with subsections (d) and (e) are not consistent with the requirements of those subsections or the fourth amendment to the Constitution of the United States, the Court shall issue an order directing the Government to, at the Government’s election and to the extent required by the Court’s order—</text> 
<clause id="HE5F4BD1DBEA64C8DAED5544728285736"><enum>(i)</enum><text>correct any deficiency identified by the Court’s order not later than 30 days after the date on which the Court issues the order; or</text> </clause> 
<clause id="HF35DE0E49C614F158D8F883E3B5E2759"><enum>(ii)</enum><text>cease, or not begin, the implementation of the authorization for which such certification was submitted.</text> </clause></subparagraph> 
<subparagraph id="HF1D0AAB9155347BDB1F8DA08BE962E68"><enum>(C)</enum><header>Requirement for written statement</header><text>In support of an order under this subsection, the Court shall provide, simultaneously with the order, for the record a written statement of the reasons for the order.</text> </subparagraph></paragraph> 
<paragraph id="HC1F68966F70C48AC9FE22733A604FFB1"><enum>(4)</enum><header>Appeal</header> 
<subparagraph id="H310C586FDD6F4A17B456BA7D6B43AD21"><enum>(A)</enum><header>Appeal to the court of review</header><text>The Government may file a petition with the Foreign Intelligence Surveillance Court of Review for review of an order under this subsection. The Court of Review shall have jurisdiction to consider such petition. For any decision under this subparagraph affirming, reversing, or modifying an order of the Foreign Intelligence Surveillance Court, the Court of Review shall provide for the record a written statement of the reasons for the decision.</text> </subparagraph> 
<subparagraph id="H22CD1D807A524A83AFABFF7B573661B"><enum>(B)</enum><header>Continuation of acquisition pending rehearing or appeal</header><text>Any acquisition affected by an order under paragraph (3)(B) may continue—</text> 
<clause id="HAB854B6FBCF34228B5C256DEF1795547"><enum>(i)</enum><text>during the pendency of any rehearing of the order by the Court en banc; and</text> </clause> 
<clause id="HFAE4AF2999AF4B5C9CDBB7879478FFCB"><enum>(ii)</enum><text>if the Government files a petition for review of an order under this section, until the Court of Review enters an order under subparagraph (C).</text> </clause></subparagraph> 
<subparagraph id="HF41BC35ECACB4230AC1EF9841500DA9"><enum>(C)</enum><header>Implementation pending appeal</header><text>Not later than 60 days after the filing of a petition for review of an order under paragraph (3)(B) directing the correction of a deficiency, the Court of Review shall determine, and enter a corresponding order regarding, whether all or any part of the correction order, as issued or modified, shall be implemented during the pendency of the review.</text> </subparagraph> 
<subparagraph id="H396AD05623174FB39F874CA11E27C94F"><enum>(D)</enum><header>Certiorari to the supreme court</header><text>The Government may file a petition for a writ of certiorari for review of a decision of the Court of Review issued under subparagraph (A). The record for such review shall be transmitted under seal to the Supreme Court of the United States, which shall have jurisdiction to review such decision.</text> </subparagraph></paragraph> 
<paragraph id="H9BF235268146436AA3BB902ED3E0B400"><enum>(5)</enum><header>Schedule</header> 
<subparagraph id="H4B6CFD2E1E6242EEBC00FC92DD86FE7D"><enum>(A)</enum><header>Reauthorization of authorizations in effect</header><text>If the Attorney General and the Director of National Intelligence seek to reauthorize or replace an authorization issued under subsection (a), the Attorney General and the Director of National Intelligence shall, to the extent practicable, submit to the Court the certification prepared in accordance with subsection (g) and the procedures adopted in accordance with subsections (d) and (e) at least 30 days prior to the expiration of such authorization.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2B7A461D55D84F3DB8212BDE840065D4"><enum>(B)</enum><header>Reauthorization of orders, authorizations, and directives</header><text display-inline="yes-display-inline">If the Attorney General and the Director of National Intelligence seek to reauthorize or replace an authorization issued under subsection (a) by filing a certification pursuant to subparagraph (A), that authorization, and any directives issued thereunder and any order related thereto, shall remain in effect, notwithstanding the expiration provided for in subsection (a), until the Court issues an order with respect to such certification under paragraph (3) at which time the provisions of that paragraph and paragraph (4) shall apply with respect to such certification.</text> </subparagraph></paragraph></subsection> 
<subsection id="HFDA2805C18664583A77E0830CA38DC73"><enum>(j)</enum><header>Judicial Proceedings</header> 
<paragraph id="H023E890DFEE14A02B4B323FAAD5100B4"><enum>(1)</enum><header>Expedited judicial proceedings</header><text>Judicial proceedings under this section shall be conducted as expeditiously as possible.</text> </paragraph> 
<paragraph id="HEA50F3DA4E3C4CBEA9A9A9AD13935C62"><enum>(2)</enum><header>Time limits</header><text>A time limit for a judicial decision in this section shall apply unless the Court, the Court of Review, or any judge of either the Court or the Court of Review, by order for reasons stated, extends that time as necessary for good cause in a manner consistent with national security.</text> </paragraph></subsection> 
<subsection id="H7D44184FF2E74E11A35D51EA539471C5"><enum>(k)</enum><header>Maintenance and security of records and proceedings</header> 
<paragraph id="HD0567B015288491D87F5A99BDAADFA2E"><enum>(1)</enum><header>Standards</header><text>The Foreign Intelligence Surveillance Court shall maintain a record of a proceeding under this section, including petitions, appeals, orders, and statements of reasons for a decision, under security measures adopted by the Chief Justice of the United States, in consultation with the Attorney General and the Director of National Intelligence.</text> </paragraph> 
<paragraph id="H6EBAE1595810494C9932F0350905903C"><enum>(2)</enum><header>Filing and review</header><text>All petitions under this section shall be filed under seal. In any proceedings under this section, the Court shall, upon request of the Government, review ex parte and in camera any Government submission, or portions of a submission, which may include classified information.</text> </paragraph> 
<paragraph id="H3636B5B9B2AF4F47A62623FC5ECDF51"><enum>(3)</enum><header>Retention of records</header><text>The Attorney General and the Director of National Intelligence shall retain a directive or an order issued under this section for a period of not less than 10 years from the date on which such directive or such order is issued.</text> </paragraph></subsection> 
<subsection id="HAA026B037C5B4251A208912C74E65E2C"><enum>(l)</enum><header>Assessments and reviews</header> 
<paragraph id="HBF13FEC77FB0406F969228595B7E30B"><enum>(1)</enum><header>Semiannual assessment</header><text display-inline="yes-display-inline">Not less frequently than once every 6 months, the Attorney General and Director of National Intelligence shall assess compliance with the targeting and minimization procedures adopted in accordance with subsections (d) and (e) and the guidelines adopted in accordance with subsection (f) and shall submit each assessment to—</text> 
<subparagraph id="HDFE0144536014324A56BB9F97BD416A3"><enum>(A)</enum><text>the Foreign Intelligence Surveillance Court; and</text> </subparagraph> 
<subparagraph id="H7EA0262D5F474F6F9CA7714177F32100"><enum>(B)</enum><text>consistent with the Rules of the House of Representatives, the Standing Rules of the Senate, and Senate Resolution 400 of the 94th Congress or any successor Senate resolution—</text> 
<clause id="HC9E8E5C2F6104EDFA2A7D0E55044A53"><enum>(i)</enum><text>the congressional intelligence committees; and</text> </clause> 
<clause id="H6EA47E120F53418BB8D551F5D8BAADDF"><enum>(ii)</enum><text>the Committees on the Judiciary of the House of Representatives and the Senate.</text> </clause></subparagraph></paragraph> 
<paragraph id="HDC09C7E052024411A4FF81F308BF3617"><enum>(2)</enum><header>Agency assessment</header><text>The Inspector General of the Department of Justice and the Inspector General of each element of the intelligence community authorized to acquire foreign intelligence information under subsection (a), with respect to the department or element of such Inspector General—</text> 
<subparagraph id="H2A05755EBD604AA9BEF49B7733CEA4E"><enum>(A)</enum><text display-inline="yes-display-inline">are authorized to review compliance with the targeting and minimization procedures adopted in accordance with subsections (d) and (e) and the guidelines adopted in accordance with subsection (f);</text> </subparagraph> 
<subparagraph id="H9420FAEE56F24C0EA7169CF452D3F2BC"><enum>(B)</enum><text>with respect to acquisitions authorized under subsection (a), shall review the number of disseminated intelligence reports containing a reference to a United States-person identity and the number of United States-person identities subsequently disseminated by the element concerned in response to requests for identities that were not referred to by name or title in the original reporting;</text> </subparagraph> 
<subparagraph id="H77C3F26AFEC840BD9D52AC5B923FCCE4"><enum>(C)</enum><text>with respect to acquisitions authorized under subsection (a), shall review the number of targets that were later determined to be located in the United States and, to the extent possible, whether communications of such targets were reviewed; and</text> </subparagraph> 
<subparagraph id="HEB401505BBB946F09841E47BA89388F"><enum>(D)</enum><text>shall provide each such review to—</text> 
<clause id="HF1AF876EB80C46D8B200BAB828A4663E"><enum>(i)</enum><text>the Attorney General;</text> </clause> 
<clause id="HC7F1E19F29794D54AAC6A011D3FA054E"><enum>(ii)</enum><text>the Director of National Intelligence; and</text> </clause> 
<clause id="H707452208CBF4341B01E03370471E220"><enum>(iii)</enum><text display-inline="yes-display-inline">consistent with the Rules of the House of Representatives, the Standing Rules of the Senate, and Senate Resolution 400 of the 94th Congress or any successor Senate resolution—</text> 
<subclause id="H6FAC001728EE4F75A1FF0427D1518B2B"><enum>(I)</enum><text>the congressional intelligence committees; and</text> </subclause> 
<subclause id="H3FD835EC1DBB46279D43C5C5FC164D74"><enum>(II)</enum><text display-inline="yes-display-inline">the Committees on the Judiciary of the House of Representatives and the Senate.</text> </subclause></clause></subparagraph></paragraph> 
<paragraph id="H59661D81DC4344C28F6C23C2D7A6329F"><enum>(3)</enum><header>Annual review</header> 
<subparagraph id="HFFFA57702A7F4EC5BFCFFAC8100D6D3"><enum>(A)</enum><header>Requirement to conduct</header><text>The head of each element of the intelligence community conducting an acquisition authorized under subsection (a) shall conduct an annual review to determine whether there is reason to believe that foreign intelligence information has been or will be obtained from the acquisition. The annual review shall provide, with respect to acquisitions authorized under subsection (a)—</text> 
<clause id="HA9EDC4073D4A4DE29CCF3B00001D7C3F"><enum>(i)</enum><text>an accounting of the number of disseminated intelligence reports containing a reference to a United States-person identity;</text> </clause> 
<clause id="H334ECCE603E3401A914144008D514D46"><enum>(ii)</enum><text>an accounting of the number of United States-person identities subsequently disseminated by that element in response to requests for identities that were not referred to by name or title in the original reporting;</text> </clause> 
<clause id="H1309F41B40D943C6B433E3C617745D97"><enum>(iii)</enum><text>the number of targets that were later determined to be located in the United States and, to the extent possible, whether communications of such targets were reviewed; and</text> </clause> 
<clause id="H4C07C9F535C342789E3598EF60B205DB"><enum>(iv)</enum><text>a description of any procedures developed by the head of such element of the intelligence community and approved by the Director of National Intelligence to assess, in a manner consistent with national security, operational requirements and the privacy interests of United States persons, the extent to which the acquisitions authorized under subsection (a) acquire the communications of United States persons, and the results of any such assessment.</text> </clause></subparagraph> 
<subparagraph id="H0804511D20B04819A0789D70F472C370"><enum>(B)</enum><header>Use of review</header><text>The head of each element of the intelligence community that conducts an annual review under subparagraph (A) shall use each such review to evaluate the adequacy of the minimization procedures utilized by such element and, as appropriate, the application of the minimization procedures to a particular acquisition authorized under subsection (a).</text> </subparagraph> 
<subparagraph id="H557538A9C7A544EDB59DE15FBA8D00BD"><enum>(C)</enum><header>Provision of review</header><text>The head of each element of the intelligence community that conducts an annual review under subparagraph (A) shall provide such review to—</text> 
<clause id="HEF8D872786FB44C18800C2D8F79F5543"><enum>(i)</enum><text>the Foreign Intelligence Surveillance Court;</text> </clause> 
<clause id="H70A0A734E2DE461BAC9881A399D38F06"><enum>(ii)</enum><text>the Attorney General;</text> </clause> 
<clause id="HD4D70FFD231B421288CCD36D0392077"><enum>(iii)</enum><text>the Director of National Intelligence; and</text> </clause> 
<clause id="H7B31BFC8AB794B4596D6ED70F7E4F6EE"><enum>(iv)</enum><text display-inline="yes-display-inline">consistent with the Rules of the House of Representatives, the Standing Rules of the Senate, and Senate Resolution 400 of the 94th Congress or any successor Senate resolution—</text> 
<subclause id="HF3F16244E1B6425F992825E1144E793F"><enum>(I)</enum><text display-inline="yes-display-inline">the congressional intelligence committees; and</text> </subclause> 
<subclause id="H3BA7C0C0FFAF424A8EF0C7FFFA2BC31E"><enum>(II)</enum><text display-inline="yes-display-inline">the Committees on the Judiciary of the House of Representatives and the Senate.</text> </subclause></clause></subparagraph></paragraph></subsection></section> 
<section id="H81CE66C0215A4791BC456549E357CA72"><enum>703.</enum><header>Certain acquisitions inside the United States targeting United States persons outside the United States</header> 
<subsection id="HA4F9FBF338F74537B2E137C6FCCACBC"><enum>(a)</enum><header>Jurisdiction of the Foreign Intelligence Surveillance Court</header> 
<paragraph id="H8E1243B4E36B4654A87226CC72A9B1BA"><enum>(1)</enum><header>In general</header><text>The Foreign Intelligence Surveillance Court shall have jurisdiction to review an application and to enter an order approving the targeting of a United States person reasonably believed to be located outside the United States to acquire foreign intelligence information, if the acquisition constitutes electronic surveillance or the acquisition of stored electronic communications or stored electronic data that requires an order under this Act, and such acquisition is conducted within the United States.</text> </paragraph> 
<paragraph id="HB24A5472952644599EF8D43B84D34FA"><enum>(2)</enum><header>Limitation</header><text>If a United States person targeted under this subsection is reasonably believed to be located in the United States during the effective period of an order issued pursuant to subsection (c), an acquisition targeting such United States person under this section shall cease unless the targeted United States person is again reasonably believed to be located outside the United States while an order issued pursuant to subsection (c) is in effect. Nothing in this section shall be construed to limit the authority of the Government to seek an order or authorization under, or otherwise engage in any activity that is authorized under, any other title of this Act.</text> </paragraph></subsection> 
<subsection id="H8F1D12D944EE44DFB512FE0061F5F241"><enum>(b)</enum><header>Application</header> 
<paragraph id="H20F61696F3AD448AB348CC3CD30662AB"><enum>(1)</enum><header>In general</header><text>Each application for an order under this section shall be made by a Federal officer in writing upon oath or affirmation to a judge having jurisdiction under subsection (a)(1). Each application shall require the approval of the Attorney General based upon the Attorney General’s finding that it satisfies the criteria and requirements of such application, as set forth in this section, and shall include—</text> 
<subparagraph id="H56C4887AB26544F69DF035E87B004752"><enum>(A)</enum><text>the identity of the Federal officer making the application;</text> </subparagraph> 
<subparagraph id="H70CE68A2D9A0474BA322A574C63FD7DA"><enum>(B)</enum><text>the identity, if known, or a description of the United States person who is the target of the acquisition;</text> </subparagraph> 
<subparagraph id="H9E42F93D5C2845EABCE131327850E889"><enum>(C)</enum><text>a statement of the facts and circumstances relied upon to justify the applicant's belief that the United States person who is the target of the acquisition is—</text> 
<clause id="H780C7FED3AD848C48759B9686966EBB4"><enum>(i)</enum><text>a person reasonably believed to be located outside the United States; and</text> </clause> 
<clause id="H3D23834BA22846DDADDF01EE2001CC1"><enum>(ii)</enum><text>a foreign power, an agent of a foreign power, or an officer or employee of a foreign power;</text> </clause></subparagraph> 
<subparagraph id="HCE754B5390F04BE1AFC497D6FC370175"><enum>(D)</enum><text>a statement of proposed minimization procedures that meet the definition of minimization procedures under section 101(h) or 301(4), as appropriate;</text> </subparagraph> 
<subparagraph id="H23B046C96EC54769A1C47311AD36707C"><enum>(E)</enum><text>a description of the nature of the information sought and the type of communications or activities to be subjected to acquisition;</text> </subparagraph> 
<subparagraph id="H3F17D31C76FD4722A2007BC8C5FC5882"><enum>(F)</enum><text>a certification made by the Attorney General or an official specified in section 104(a)(6) that—</text> 
<clause id="H6D7FFC95AE924391AE87AACC74959500"><enum>(i)</enum><text>the certifying official deems the information sought to be foreign intelligence information;</text> </clause> 
<clause id="HF2A22B75B3B540FDAB34183930236CE8"><enum>(ii)</enum><text>a significant purpose of the acquisition is to obtain foreign intelligence information;</text> </clause> 
<clause id="H85F070A81F774719B83720CE1949C148"><enum>(iii)</enum><text>such information cannot reasonably be obtained by normal investigative techniques;</text> </clause> 
<clause id="H8AF8DBD3D5744D45B723006CB18E08B4"><enum>(iv)</enum><text>designates the type of foreign intelligence information being sought according to the categories described in section 101(e); and</text> </clause> 
<clause id="H4CEAD8E96FB3419D85E180DAAE71BFB"><enum>(v)</enum><text>includes a statement of the basis for the certification that—</text> 
<subclause id="H04C908C2A13F4B4DB3C015DE61A4DAD"><enum>(I)</enum><text>the information sought is the type of foreign intelligence information designated; and</text> </subclause> 
<subclause id="HA737F9E5A8C64B7D9571F2F57F2E2BC1"><enum>(II)</enum><text>such information cannot reasonably be obtained by normal investigative techniques;</text> </subclause></clause></subparagraph> 
<subparagraph id="HDD7C131B89234DCC8BFB475100437DC1"><enum>(G)</enum><text>a summary statement of the means by which the acquisition will be conducted and whether physical entry is required to effect the acquisition;</text> </subparagraph> 
<subparagraph id="HAE0C2AA233634D26BCA284D8B947EDB4"><enum>(H)</enum><text>the identity of any electronic communication service provider necessary to effect the acquisition, provided that the application is not required to identify the specific facilities, places, premises, or property at which the acquisition authorized under this section will be directed or conducted;</text> </subparagraph> 
<subparagraph id="H37BAE81FDE394349B66B00FECA00EA2"><enum>(I)</enum><text>a statement of the facts concerning any previous applications that have been made to any judge of the Foreign Intelligence Surveillance Court involving the United States person specified in the application and the action taken on each previous application; and</text> </subparagraph> 
<subparagraph id="H937893E53AB34FF98EAA6E58D62E578D"><enum>(J)</enum><text>a statement of the period of time for which the acquisition is required to be maintained, provided that such period of time shall not exceed 90 days per application.</text> </subparagraph></paragraph> 
<paragraph id="H6B3D1213877C4D03B9B8AF6F2782931"><enum>(2)</enum><header>Other requirements of the Attorney General</header><text>The Attorney General may require any other affidavit or certification from any other officer in connection with the application.</text> </paragraph> 
<paragraph id="H4C5EBBFF36744BBCBAC7948D81CDC200"><enum>(3)</enum><header>Other requirements of the judge</header><text>The judge may require the applicant to furnish such other information as may be necessary to make the findings required by subsection (c)(1).</text> </paragraph></subsection> 
<subsection id="HE1CB8AFDF3D3493190C64E2D6195C2E"><enum>(c)</enum><header>Order</header> 
<paragraph id="H1BB86712A49843C6A1E2252751B438F2"><enum>(1)</enum><header>Findings</header><text>Upon an application made pursuant to subsection (b), the Foreign Intelligence Surveillance Court shall enter an ex parte order as requested or as modified by the Court approving the acquisition if the Court finds that—</text> 
<subparagraph id="H4BA00B3B499041EEA3EEAEA6EBF358C3"><enum>(A)</enum><text>the application has been made by a Federal officer and approved by the Attorney General;</text> </subparagraph> 
<subparagraph id="H5458E7959087404086897093751BCBE6"><enum>(B)</enum><text>on the basis of the facts submitted by the applicant, for the United States person who is the target of the acquisition, there is probable cause to believe that the target is—</text> 
<clause id="HE01F39BA504D40E8B5E83D002C793FBE"><enum>(i)</enum><text>a person reasonably believed to be located outside the United States; and</text> </clause> 
<clause id="HBC58757B2008448597C55DE5163098A5"><enum>(ii)</enum><text>a foreign power, an agent of a foreign power, or an officer or employee of a foreign power;</text> </clause></subparagraph> 
<subparagraph id="HD1A0D863D5B1416EAC4C0134E72425FF"><enum>(C)</enum><text>the proposed minimization procedures meet the definition of minimization procedures under section 101(h) or 301(4), as appropriate; and</text> </subparagraph> 
<subparagraph id="H324B6CD3D84F48BC90404DF100F344F2"><enum>(D)</enum><text>the application that has been filed contains all statements and certifications required by subsection (b) and the certification or certifications are not clearly erroneous on the basis of the statement made under subsection (b)(1)(F)(v) and any other information furnished under subsection (b)(3).</text> </subparagraph></paragraph> 
<paragraph id="H37F166FD54344FBCAA86F5E41929DCA5"><enum>(2)</enum><header>Probable cause</header><text>In determining whether or not probable cause exists for purposes of paragraph (1)(B), a judge having jurisdiction under subsection (a)(1) may consider past activities of the target and facts and circumstances relating to current or future activities of the target. No United States person may be considered a foreign power, agent of a foreign power, or officer or employee of a foreign power solely upon the basis of activities protected by the first amendment to the Constitution of the United States.</text> </paragraph> 
<paragraph id="H955255ABCE2848A5AEED24B07855C9E"><enum>(3)</enum><header>Review</header> 
<subparagraph id="HB4915F424FA64C8F8901AFA2DA094472"><enum>(A)</enum><header>Limitation on review</header><text>Review by a judge having jurisdiction under subsection (a)(1) shall be limited to that required to make the findings described in paragraph (1).</text> </subparagraph> 
<subparagraph id="H4F3D73B265F446A5B1292177E28F89BB"><enum>(B)</enum><header>Review of probable cause</header><text>If the judge determines that the facts submitted under subsection (b) are insufficient to establish probable cause under paragraph (1)(B), the judge shall enter an order so stating and provide a written statement for the record of the reasons for the determination. The Government may appeal an order under this subparagraph pursuant to subsection (f).</text> </subparagraph> 
<subparagraph id="HEA9494A680984D72BC5EB89459555CE0"><enum>(C)</enum><header>Review of minimization procedures</header><text>If the judge determines that the proposed minimization procedures referred to in paragraph (1)(C) do not meet the definition of minimization procedures under section 101(h) or 301(4), as appropriate, the judge shall enter an order so stating and provide a written statement for the record of the reasons for the determination. The Government may appeal an order under this subparagraph pursuant to subsection (f).</text> </subparagraph> 
<subparagraph id="HF674FEDFF4124A7A88A2A4BA5B40B348"><enum>(D)</enum><header>Review of certification</header><text>If the judge determines that an application pursuant to subsection (b) does not contain all of the required elements, or that the certification or certifications are clearly erroneous on the basis of the statement made under subsection (b)(1)(F)(v) and any other information furnished under subsection (b)(3), the judge shall enter an order so stating and provide a written statement for the record of the reasons for the determination. The Government may appeal an order under this subparagraph pursuant to subsection (f).</text> </subparagraph></paragraph> 
<paragraph id="H12D9CC5E216F45338FA1CC156B5BB5F"><enum>(4)</enum><header>Specifications</header><text>An order approving an acquisition under this subsection shall specify—</text> 
<subparagraph id="H0845757356FD4A1DB432A3E5AD32E9FB"><enum>(A)</enum><text>the identity, if known, or a description of the United States person who is the target of the acquisition identified or described in the application pursuant to subsection (b)(1)(B);</text> </subparagraph> 
<subparagraph id="HD0D6D6A1B63243AC9E47CAA151BC6200"><enum>(B)</enum><text>if provided in the application pursuant to subsection (b)(1)(H), the nature and location of each of the facilities or places at which the acquisition will be directed;</text> </subparagraph> 
<subparagraph id="HF971C055399F4C1CBDA4CA35766B051C"><enum>(C)</enum><text>the nature of the information sought to be acquired and the type of communications or activities to be subjected to acquisition;</text> </subparagraph> 
<subparagraph id="H5DC9397A24D04FBD9C502932CBD7B48F"><enum>(D)</enum><text>a summary of the means by which the acquisition will be conducted and whether physical entry is required to effect the acquisition; and</text> </subparagraph> 
<subparagraph id="H45E24513D5674662A48CB300BF08F232"><enum>(E)</enum><text>the period of time during which the acquisition is approved.</text> </subparagraph></paragraph> 
<paragraph id="H6D654B8871C749D19CEDB6B4F638A1E6"><enum>(5)</enum><header>Directives</header><text>An order approving an acquisition under this subsection shall direct—</text> 
<subparagraph id="H9D8FAD724FED417393FE28F000008013"><enum>(A)</enum><text>that the minimization procedures referred to in paragraph (1)(C), as approved or modified by the Court, be followed;</text> </subparagraph> 
<subparagraph id="H3299AD2F92084EFEA35C8CC25214C800"><enum>(B)</enum><text>if applicable, an electronic communication service provider to provide to the Government forthwith all information, facilities, or assistance necessary to accomplish the acquisition authorized under such order in a manner that will protect the secrecy of the acquisition and produce a minimum of interference with the services that such electronic communication service provider is providing to the target of the acquisition;</text> </subparagraph> 
<subparagraph id="HAB7343F6E31F479FA295BE9792FDCE8"><enum>(C)</enum><text>if applicable, an electronic communication service provider to maintain under security procedures approved by the Attorney General any records concerning the acquisition or the aid furnished that such electronic communication service provider wishes to maintain; and</text> </subparagraph> 
<subparagraph id="HE911AE124FC3480481690051C3D7208B"><enum>(D)</enum><text>if applicable, that the Government compensate, at the prevailing rate, such electronic communication service provider for providing such information, facilities, or assistance.</text> </subparagraph></paragraph> 
<paragraph id="H8D1A23373AC84FFEB4E7BE12082CA27D"><enum>(6)</enum><header>Duration</header><text>An order approved under this subsection shall be effective for a period not to exceed 90 days and such order may be renewed for additional 90-day periods upon submission of renewal applications meeting the requirements of subsection (b).</text> </paragraph> 
<paragraph id="HDEA2E6DE4D90488E9E01A888B300DAD7"><enum>(7)</enum><header>Compliance</header><text>At or prior to the end of the period of time for which an acquisition is approved by an order or extension under this section, the judge may assess compliance with the minimization procedures referred to in paragraph (1)(C) by reviewing the circumstances under which information concerning United States persons was acquired, retained, or disseminated.</text> </paragraph></subsection> 
<subsection id="H48A69BE014384F1B9899AB30DAD8D2B2"><enum>(d)</enum><header>Emergency authorization</header> 
<paragraph id="H4B428956299E4F5E90250548CEFC0002"><enum>(1)</enum><header>Authority for emergency authorization</header><text>Notwithstanding any other provision of this Act, if the Attorney General reasonably determines that—</text> 
<subparagraph id="H00ABC9470FD44E5CBA9B0917EFE657BA"><enum>(A)</enum><text>an emergency situation exists with respect to the acquisition of foreign intelligence information for which an order may be obtained under subsection (c) before an order authorizing such acquisition can with due diligence be obtained, and</text> </subparagraph> 
<subparagraph id="H7FFB466182BD48A8A7729FB3F1E7B3EB"><enum>(B)</enum><text>the factual basis for issuance of an order under this subsection to approve such acquisition exists,</text> </subparagraph><continuation-text continuation-text-level="paragraph">the Attorney General may authorize such acquisition if a judge having jurisdiction under subsection (a)(1) is informed by the Attorney General, or a designee of the Attorney General, at the time of such authorization that the decision has been made to conduct such acquisition and if an application in accordance with this section is made to a judge of the Foreign Intelligence Surveillance Court as soon as practicable, but not more than 7 days after the Attorney General authorizes such acquisition.</continuation-text></paragraph> 
<paragraph id="HCE23122A0F2C4A2C86F0523F34F44B8"><enum>(2)</enum><header>Minimization procedures</header><text>If the Attorney General authorizes an acquisition under paragraph (1), the Attorney General shall require that the minimization procedures referred to in subsection (c)(1)(C) for the issuance of a judicial order be followed.</text> </paragraph> 
<paragraph id="H215CA1A244C340D2931D947200141534"><enum>(3)</enum><header>Termination of emergency authorization</header><text>In the absence of a judicial order approving an acquisition under paragraph (1), such acquisition shall terminate when the information sought is obtained, when the application for the order is denied, or after the expiration of 7 days from the time of authorization by the Attorney General, whichever is earliest.</text> </paragraph> 
<paragraph id="H48690B406C3046E897D02BB5847D55ED"><enum>(4)</enum><header>Use of information</header><text>If an application for approval submitted pursuant to paragraph (1) is denied, or in any other case where the acquisition is terminated and no order is issued approving the acquisition, no information obtained or evidence derived from such acquisition, except under circumstances in which the target of the acquisition is determined not to be a United States person, shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from such acquisition shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text> </paragraph></subsection> 
<subsection id="H0102E007221A4740ACBC9BFBF7564078"><enum>(e)</enum><header>Release from liability</header><text>No cause of action shall lie in any court against any electronic communication service provider for providing any information, facilities, or assistance in accordance with an order or request for emergency assistance issued pursuant to subsection (c) or (d), respectively.</text> </subsection> 
<subsection id="HF0CF29D7D7794DA6964C8F005E91F7A9"><enum>(f)</enum><header>Appeal</header> 
<paragraph id="HBC9E4530B29B45E898B16D1C745FB383"><enum>(1)</enum><header>Appeal to the Foreign Intelligence Surveillance Court of Review</header><text>The Government may file a petition with the Foreign Intelligence Surveillance Court of Review for review of an order issued pursuant to subsection (c). The Court of Review shall have jurisdiction to consider such petition and shall provide a written statement for the record of the reasons for a decision under this paragraph.</text> </paragraph> 
<paragraph id="H98CA1D18F0604D38841F646973D624D"><enum>(2)</enum><header>Certiorari to the Supreme Court</header><text>The Government may file a petition for a writ of certiorari for review of a decision of the Court of Review issued under paragraph (1). The record for such review shall be transmitted under seal to the Supreme Court of the United States, which shall have jurisdiction to review such decision.</text> </paragraph></subsection> 
<subsection commented="no" id="H26123F5740224C3FB7115D16B54E54EF"><enum>(g)</enum><header>Construction</header><text display-inline="yes-display-inline">Except as provided in this section, nothing in this Act shall be construed to require an application for a court order for an acquisition that is targeted in accordance with this section at a United States person reasonably believed to be located outside the United States.</text> </subsection></section> 
<section id="HAF2BD9FB97FF41DA88490057D9C32E35"><enum>704.</enum><header>Other acquisitions targeting United States persons outside the United States</header> 
<subsection id="H9120E868B70C4D7CB1F8347CFD700AF"><enum>(a)</enum><header>Jurisdiction and scope</header> 
<paragraph id="H65A9E930D20F4A30B07CB13F46FD1C62"><enum>(1)</enum><header>Jurisdiction</header><text>The Foreign Intelligence Surveillance Court shall have jurisdiction to enter an order pursuant to subsection (c).</text> </paragraph> 
<paragraph id="HE70B379A7FF0462DB1AAB15287E14329"><enum>(2)</enum><header>Scope</header><text display-inline="yes-display-inline">No element of the intelligence community may intentionally target, for the purpose of acquiring foreign intelligence information, a United States person reasonably believed to be located outside the United States under circumstances in which the targeted United States person has a reasonable expectation of privacy and a warrant would be required if the acquisition were conducted inside the United States for law enforcement purposes, unless a judge of the Foreign Intelligence Surveillance Court has entered an order with respect to such targeted United States person or the Attorney General has authorized an emergency acquisition pursuant to subsection (c) or (d), respectively, or any other provision of this Act.</text> </paragraph> 
<paragraph id="HBE4B7F39288049EE947E8100C436C3C"><enum>(3)</enum><header>Limitations</header> 
<subparagraph id="HBA5658AAD5254246BF3F678C75BD075B"><enum>(A)</enum><header>Moving or misidentified targets</header><text>If a United States person targeted under this subsection is reasonably believed to be located in the United States during the effective period of an order issued pursuant to subsection (c), an acquisition targeting such United States person under this section shall cease unless the targeted United States person is again reasonably believed to be located outside the United States during the effective period of such order.</text> </subparagraph> 
<subparagraph id="H2B437023DB6C47D092F1954BB029A768"><enum>(B)</enum><header>Applicability</header><text display-inline="yes-display-inline">If an acquisition for foreign intelligence purposes is to be conducted inside the United States and could be authorized under section 703, the acquisition may only be conducted if authorized under section 703 or in accordance with another provision of this Act other than this section.</text> </subparagraph> 
<subparagraph id="HF8F4F95150EE4257A17270B7A6FEADC0"><enum>(C)</enum><header>Construction</header><text>Nothing in this paragraph shall be construed to limit the authority of the Government to seek an order or authorization under, or otherwise engage in any activity that is authorized under, any other title of this Act.</text> </subparagraph></paragraph></subsection> 
<subsection id="HE107583FFCF44D87BDA0E9E754253BB1"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Each application for an order under this section shall be made by a Federal officer in writing upon oath or affirmation to a judge having jurisdiction under subsection (a)(1). Each application shall require the approval of the Attorney General based upon the Attorney General’s finding that it satisfies the criteria and requirements of such application as set forth in this section and shall include—</text> 
<paragraph commented="no" id="H95929932B3A0496595E696EE27F468F"><enum>(1)</enum><text>the identity of the Federal officer making the application;</text> </paragraph> 
<paragraph id="H262218C9751440DD9CDA147F03FCFC80"><enum>(2)</enum><text>the identity, if known, or a description of the specific United States person who is the target of the acquisition;</text> </paragraph> 
<paragraph id="H25925C25832A414288592BC922481610"><enum>(3)</enum><text>a statement of the facts and circumstances relied upon to justify the applicant's belief that the United States person who is the target of the acquisition is—</text> 
<subparagraph id="HAA989FF1948A495B9DA83D6D5409A33E"><enum>(A)</enum><text>a person reasonably believed to be located outside the United States; and</text> </subparagraph> 
<subparagraph id="HC462A10A526A4BD200B63C84EF13BFBF"><enum>(B)</enum><text>a foreign power, an agent of a foreign power, or an officer or employee of a foreign power;</text> </subparagraph></paragraph> 
<paragraph id="H114B67FC69D44E6888344FCBE9D33065"><enum>(4)</enum><text>a statement of proposed minimization procedures that meet the definition of minimization procedures under section 101(h) or 301(4), as appropriate;</text> </paragraph> 
<paragraph commented="no" id="HBCE0FD6F170B4B47A3F3F7A51CD4646"><enum>(5)</enum><text>a certification made by the Attorney General, an official specified in section 104(a)(6), or the head of an element of the intelligence community that—</text> 
<subparagraph commented="no" id="H32DE7CE086484153908ED0D0928F5FA7"><enum>(A)</enum><text>the certifying official deems the information sought to be foreign intelligence information; and</text> </subparagraph> 
<subparagraph commented="no" id="H12BF0CB9FC6A455C8D674B6FAD174467"><enum>(B)</enum><text>a significant purpose of the acquisition is to obtain foreign intelligence information;</text> </subparagraph></paragraph> 
<paragraph id="H7487F5E1B15541F6AE4F4D00EB78079C"><enum>(6)</enum><text>a statement of the facts concerning any previous applications that have been made to any judge of the Foreign Intelligence Surveillance Court involving the United States person specified in the application and the action taken on each previous application; and</text> </paragraph> 
<paragraph id="H28D794F6A14742AE90012E27D5AE3C45"><enum>(7)</enum><text>a statement of the period of time for which the acquisition is required to be maintained, provided that such period of time shall not exceed 90 days per application.</text> </paragraph></subsection> 
<subsection id="HA5B5D8455ACE48C8B9E7123F9E075F07"><enum>(c)</enum><header>Order</header> 
<paragraph id="HAE737E42F106433B965B3633335CC7A1"><enum>(1)</enum><header>Findings</header><text>Upon an application made pursuant to subsection (b), the Foreign Intelligence Surveillance Court shall enter an ex parte order as requested or as modified by the Court if the Court finds that—</text> 
<subparagraph commented="no" id="H788F0179E66F4DE899FE5638A0E99900"><enum>(A)</enum><text>the application has been made by a Federal officer and approved by the Attorney General;</text> </subparagraph> 
<subparagraph id="HC0C68D61EB0644E6B8C062C480027BC1"><enum>(B)</enum><text>on the basis of the facts submitted by the applicant, for the United States person who is the target of the acquisition, there is probable cause to believe that the target is—</text> 
<clause id="H5B6D7C980EEE478F8E1B969FA43E9CBC"><enum>(i)</enum><text>a person reasonably believed to be located outside the United States; and</text> </clause> 
<clause id="HD430C7416C6A485A80BA18399687BB2"><enum>(ii)</enum><text>a foreign power, an agent of a foreign power, or an officer or employee of a foreign power;</text> </clause></subparagraph> 
<subparagraph id="H74E77A0128914B58B87C006455ECECFA"><enum>(C)</enum><text>the proposed minimization procedures, with respect to their dissemination provisions, meet the definition of minimization procedures under section 101(h) or 301(4), as appropriate; and</text> </subparagraph> 
<subparagraph id="H21ECC00A42D24FC9A6985070E5931844"><enum>(D)</enum><text>the application that has been filed contains all statements and certifications required by subsection (b) and the certification provided under subsection (b)(5) is not clearly erroneous on the basis of the information furnished under subsection (b).</text> </subparagraph></paragraph> 
<paragraph id="H625539A8E13F4CD99FF0F059A367D33"><enum>(2)</enum><header>Probable cause</header><text>In determining whether or not probable cause exists for purposes of paragraph (1)(B), a judge having jurisdiction under subsection (a)(1) may consider past activities of the target and facts and circumstances relating to current or future activities of the target. No United States person may be considered a foreign power, agent of a foreign power, or officer or employee of a foreign power solely upon the basis of activities protected by the first amendment to the Constitution of the United States.</text> </paragraph> 
<paragraph id="HA96C4E4D51784BA397DAD360A63D6883"><enum>(3)</enum><header>Review</header> 
<subparagraph id="HBB81E90FACE5412E99D90800F016F62"><enum>(A)</enum><header>Limitations on review</header><text>Review by a judge having jurisdiction under subsection (a)(1) shall be limited to that required to make the findings described in paragraph (1). The judge shall not have jurisdiction to review the means by which an acquisition under this section may be conducted.</text> </subparagraph> 
<subparagraph id="H4E20F16B1D5F4ED88147DB95758F2ED2"><enum>(B)</enum><header> Review of probable cause</header><text>If the judge determines that the facts submitted under subsection (b) are insufficient to establish probable cause to issue an order under this subsection, the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this subparagraph pursuant to subsection (e).</text> </subparagraph> 
<subparagraph id="H24CDB50922EF4D9F94BAE8D94FE63700"><enum>(C)</enum><header>Review of minimization procedures</header><text>If the judge determines that the minimization procedures applicable to dissemination of information obtained through an acquisition under this subsection do not meet the definition of minimization procedures under section 101(h) or 301(4), as appropriate, the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this subparagraph pursuant to subsection (e).</text> </subparagraph> 
<subparagraph commented="no" id="HAFE7925CECFF47C3816184A700DFBD95"><enum>(D)</enum><header>Scope of review of certification</header><text>If the judge determines that an application under subsection (b) does not contain all the required elements, or that the certification provided under subsection (b)(5) is clearly erroneous on the basis of the information furnished under subsection (b), the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this subparagraph pursuant to subsection (e).</text> </subparagraph></paragraph> 
<paragraph id="HCB75A92EEAC3425495C99D009C008709"><enum>(4)</enum><header>Duration</header><text>An order under this paragraph shall be effective for a period not to exceed 90 days and such order may be renewed for additional 90-day periods upon submission of renewal applications meeting the requirements of subsection (b).</text> </paragraph> 
<paragraph commented="no" id="HF8CC36769E7740C2B5C418464E1DAAEF"><enum>(5)</enum><header>Compliance</header><text>At or prior to the end of the period of time for which an order or extension is granted under this section, the judge may assess compliance with the minimization procedures referred to in paragraph (1)(C) by reviewing the circumstances under which information concerning United States persons was disseminated, provided that the judge may not inquire into the circumstances relating to the conduct of the acquisition.</text> </paragraph></subsection> 
<subsection id="HED3EA24A7378436EB66DC1FFA363A187"><enum>(d)</enum><header>Emergency authorization</header> 
<paragraph id="H94010B6B3C3940B784AB7308E9CFE822"><enum>(1)</enum><header>Authority for emergency authorization</header><text>Notwithstanding any other provision of this section, if the Attorney General reasonably determines that—</text> 
<subparagraph id="H69FB37E2049F4F99A3DF64D2636BAF99"><enum>(A)</enum><text>an emergency situation exists with respect to the acquisition of foreign intelligence information for which an order may be obtained under subsection (c) before an order under that subsection can, with due diligence, be obtained, and</text> </subparagraph> 
<subparagraph id="H8F80C3C80BD94B6B8C4078D323A56046"><enum>(B)</enum><text>the factual basis for the issuance of an order under this section exists,</text> </subparagraph><continuation-text continuation-text-level="paragraph">the Attorney General may authorize the emergency acquisition if a judge having jurisdiction under subsection (a)(1) is informed by the Attorney General or a designee of the Attorney General at the time of such authorization that the decision has been made to conduct such acquisition and if an application in accordance with this section is made to a judge of the Foreign Intelligence Surveillance Court as soon as practicable, but not more than 7 days after the Attorney General authorizes such acquisition.</continuation-text></paragraph> 
<paragraph id="HA8191A7F1B9D40E89E00CC63755EE725"><enum>(2)</enum><header>Minimization procedures</header><text>If the Attorney General authorizes an emergency acquisition under paragraph (1), the Attorney General shall require that the minimization procedures referred to in subsection (c)(1)(C) be followed.</text> </paragraph> 
<paragraph id="H7FF487C4C66C4FFEA21D84CFFFDE29D4"><enum>(3)</enum><header>Termination of emergency authorization</header><text>In the absence of an order under subsection (c), an emergency acquisition under paragraph (1) shall terminate when the information sought is obtained, if the application for the order is denied, or after the expiration of 7 days from the time of authorization by the Attorney General, whichever is earliest.</text> </paragraph> 
<paragraph id="H4F1A5EFA2DB94250B6A3DD82C4BCFD95"><enum>(4)</enum><header>Use of information</header><text>If an application submitted to the Court pursuant to paragraph (1) is denied, or in any other case where the acquisition is terminated and no order with respect to the target of the acquisition is issued under subsection (c), no information obtained or evidence derived from such acquisition, except under circumstances in which the target of the acquisition is determined not to be a United States person, shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from such acquisition shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text> </paragraph></subsection> 
<subsection id="HD724BD38913F401F81B2D34DE36FE35C"><enum>(e)</enum><header>Appeal</header> 
<paragraph id="H503457596AAD4D9D8E890833B5910752"><enum>(1)</enum><header>Appeal to the court of review</header><text>The Government may file a petition with the Foreign Intelligence Surveillance Court of Review for review of an order issued pursuant to subsection (c). The Court of Review shall have jurisdiction to consider such petition and shall provide a written statement for the record of the reasons for a decision under this paragraph.</text> </paragraph> 
<paragraph id="HA6754D17A8B04CCCB2107BFA4DC1B950"><enum>(2)</enum><header>Certiorari to the Supreme Court</header><text>The Government may file a petition for a writ of certiorari for review of a decision of the Court of Review issued under paragraph (1). The record for such review shall be transmitted under seal to the Supreme Court of the United States, which shall have jurisdiction to review such decision.</text> </paragraph></subsection></section></title><after-quoted-block></after-quoted-block></quoted-block> 
<quoted-block display-inline="no-display-inline" id="H2E1D6C49F8044CB6AB548E025EDC5CDC" style="OLC"> 
<section id="HD0C7BB8E33074A56AB00D9C10657C922"><enum>705.</enum><header>Joint applications and concurrent authorizations</header> 
<subsection id="H48BB8BDD753A4E4E98B9E082B9893291"><enum>(a)</enum><header>Joint applications and orders</header><text display-inline="yes-display-inline">If an acquisition targeting a United States person under section 703 or 704 is proposed to be conducted both inside and outside the United States, a judge having jurisdiction under section 703(a)(1) or 704(a)(1) may issue simultaneously, upon the request of the Government in a joint application complying with the requirements of sections 703(b) and 704(b), orders under sections 703(c) and 704(c), as appropriate.</text> </subsection> 
<subsection id="HE410B9B66B1E498A9B57BECC54CBBFFB"><enum>(b)</enum><header>Concurrent authorization</header><text display-inline="yes-display-inline">If an order authorizing electronic surveillance or physical search has been obtained under section 105 or 304, the Attorney General may authorize, for the effective period of that order, without an order under section 703 or 704, the targeting of that United States person for the purpose of acquiring foreign intelligence information while such person is reasonably believed to be located outside the United States.</text> </subsection></section> 
<section id="HDB1C47FA444D4A15A3624DDF69009830"><enum>706.</enum><header>Use of information acquired under title VII</header> 
<subsection id="HCAFA123AA6244500B431A408C4FE51F"><enum>(a)</enum><header>Information acquired under section 702</header><text>Information acquired from an acquisition conducted under section 702 shall be deemed to be information acquired from an electronic surveillance pursuant to title I for purposes of section 106, except for the purposes of subsection (j) of such section.</text> </subsection> 
<subsection id="H630548156E5C40B980C23402D6FD729B"><enum>(b)</enum><header>Information acquired under section 703</header><text>Information acquired from an acquisition conducted under section 703 shall be deemed to be information acquired from an electronic surveillance pursuant to title I for purposes of section 106.</text> </subsection></section> 
<section id="H0B39497AE91D4CBDB0176600C83E188B"><enum>707.</enum><header>Congressional oversight</header> 
<subsection id="HA8C0D758CD9E4988A5C593E91D5E181C"><enum>(a)</enum><header>Semiannual report</header><text display-inline="yes-display-inline">Not less frequently than once every 6 months, the Attorney General shall fully inform, in a manner consistent with national security, the congressional intelligence committees and the Committees on the Judiciary of the Senate and the House of Representatives, consistent with the Rules of the House of Representatives, the Standing Rules of the Senate, and Senate Resolution 400 of the 94th Congress or any successor Senate resolution, concerning the implementation of this title.</text> </subsection> 
<subsection id="H72EA5EBAF93944408F4740CB3B09EDDF"><enum>(b)</enum><header>Content</header><text>Each report under subsection (a) shall include—</text> 
<paragraph id="H24D215940E784332AE09859F5F3EA76"><enum>(1)</enum><text>with respect to section 702—</text> 
<subparagraph id="H6DE7435C5F8847C198007FA4462CD0F9"><enum>(A)</enum><text>any certifications submitted in accordance with section 702(g) during the reporting period;</text> </subparagraph> 
<subparagraph commented="no" id="H68935F29DE9E41DCA015D575A18E3132"><enum>(B)</enum><text>with respect to each determination under section 702(c)(2), the reasons for exercising the authority under such section;</text> </subparagraph> 
<subparagraph id="H4F38F23BDC5E4AF68709C20614BA0768"><enum>(C)</enum><text>any directives issued under section 702(h) during the reporting period;</text> </subparagraph> 
<subparagraph id="H4DED8FEFC07D4734974BFD806EB5D4E6"><enum>(D)</enum><text>a description of the judicial review during the reporting period of such certifications and targeting and minimization procedures adopted in accordance with subsections (d) and (e) of section 702 and utilized with respect to an acquisition under such section, including a copy of an order or pleading in connection with such review that contains a significant legal interpretation of the provisions of section 702;</text> </subparagraph> 
<subparagraph id="HF68B08E492DB47FF89F2ED8B91EC7069"><enum>(E)</enum><text>any actions taken to challenge or enforce a directive under paragraph (4) or (5) of section 702(h);</text> </subparagraph> 
<subparagraph id="H3C53E935A3ED4287AA1B0928B86D5900"><enum>(F)</enum><text>any compliance reviews conducted by the Attorney General or the Director of National Intelligence of acquisitions authorized under section 702(a);</text> </subparagraph> 
<subparagraph id="H049EEAE56E814BCCBD2587DCF18E85B5"><enum>(G)</enum><text>a description of any incidents of noncompliance—</text> 
<clause id="H9AB0AB2302FA456883EB695A857C49D"><enum>(i)</enum><text>with a directive issued by the Attorney General and the Director of National Intelligence under section 702(h), including incidents of noncompliance by a specified person to whom the Attorney General and Director of National Intelligence issued a directive under section 702(h); and</text> </clause> 
<clause id="HAB6D344D26BC45AA8E9C571C2DD40428"><enum>(ii)</enum><text>by an element of the intelligence community with procedures and guidelines adopted in accordance with subsections (d), (e), and (f) of section 702; and</text> </clause></subparagraph> 
<subparagraph id="H33F7E2E19474402BAE213E65445D0044"><enum>(H)</enum><text>any procedures implementing section 702;</text> </subparagraph></paragraph> 
<paragraph id="HA05490BE6E4C4942856993A8BDF8A6DD"><enum>(2)</enum><text>with respect to section 703—</text>

<section commented="no" id="HE78AE213C16C43E095E903C3DEE0737D"><enum>708.</enum><header>Savings provision</header><text display-inline="no-display-inline">Nothing in this title shall be construed to limit the authority of the Government to seek an order or authorization under, or otherwise engage in any activity that is authorized under, any other title of this Act.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>

<subparagraph id="HF609FCF12836498D821684B1A04063D3" indent="up1"><enum>(A)</enum><text>reasonably determines that an emergency situation exists with respect to the employment of electronic surveillance to obtain foreign intelligence information before an order authorizing such surveillance can with due diligence be obtained;</text> </subparagraph> 
<subparagraph id="H1AC8F70CF0D84CC7B2C328A4DB63C66B" indent="up1"><enum>(B)</enum><text>reasonably determines that the factual basis for the issuance of an order under this title to approve such electronic surveillance exists;</text> </subparagraph> 
<subparagraph id="H62E5757FCA20481AB059D656DF52C118" indent="up1"><enum>(C)</enum><text>informs, either personally or through a designee, a judge having jurisdiction under section 103 at the time of such authorization that the decision has been made to employ emergency electronic surveillance; and</text> </subparagraph> 
<subparagraph id="H40DDE4CE8FFD45D4AE7D54632E9DAD98" indent="up1"><enum>(D)</enum><text>makes an application in accordance with this title to a judge having jurisdiction under section 103 as soon as practicable, but not later than 7 days after the Attorney General authorizes such surveillance.</text> </subparagraph></paragraph> 
<paragraph id="HAA74402DD936415F92B30317DEC56BC2" indent="up1"><enum>(2)</enum><text>If the Attorney General authorizes the emergency employment of electronic surveillance under paragraph (1), the Attorney General shall require that the minimization procedures required by this title for the issuance of a judicial order be followed.</text> </paragraph> 
<paragraph id="H4378036182084DECA6001D4DD3B66C27" indent="up1"><enum>(3)</enum><text>In the absence of a judicial order approving such electronic surveillance, the surveillance shall terminate when the information sought is obtained, when the application for the order is denied, or after the expiration of 7 days from the time of authorization by the Attorney General, whichever is earliest.</text> </paragraph> 
<paragraph id="HD0098EDE097345829BC9259DBABF1983" indent="up1"><enum>(4)</enum><text>A denial of the application made under this subsection may be reviewed as provided in section 103.</text> </paragraph> 
<paragraph id="H9B82AF5C85F9489097C126BF15B446D2" indent="up1"><enum>(5)</enum><text>In the event that such application for approval is denied, or in any other case where the electronic surveillance is terminated and no order is issued approving the surveillance, no information obtained or evidence derived from such surveillance shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from such surveillance shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text> </paragraph> 
<paragraph id="H16060F36827A455681948BC45BD423F2" indent="up1"><enum>(6)</enum><text>The Attorney General shall assess compliance with the requirements of paragraph (5).</text> </paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="HE17038EBFA734D83860013D97200F060"><enum>(7)</enum><text>by adding at the end the following:</text>

<subsection id="H0EC950D04D9F4BDEA5115E4D8FC8452E"><enum>(i)</enum><text>In any case in which the Government makes an application to a judge under this title to conduct electronic surveillance involving communications and the judge grants such application, upon the request of the applicant, the judge shall also authorize the installation and use of pen registers and trap and trace devices, and direct the disclosure of the information set forth in section 402(d)(2).</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HF14B539E8BF348499B29ADEE386D1212"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 108(a)(2)(C) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1808">50 U.S.C. 1808(a)(2)(C)</external-xref>) is amended by striking <quote>105(f)</quote> and inserting <quote>105(e)</quote>;</text> </subsection></section>

<subparagraph id="HA6FBCD09F238440EB29D93D5849932F4" indent="up1"><enum>(B)</enum><text>reasonably determines that the factual basis for issuance of an order under this title to approve such physical search exists;</text> </subparagraph> 
<subparagraph id="HAE10435D363648EDB784BA5B07994EF6" indent="up1"><enum>(C)</enum><text>informs, either personally or through a designee, a judge of the Foreign Intelligence Surveillance Court at the time of such authorization that the decision has been made to employ an emergency physical search; and</text> </subparagraph> 
<subparagraph id="H341A7CD6CD0749809289946541D2ACBD" indent="up1"><enum>(D)</enum><text>makes an application in accordance with this title to a judge of the Foreign Intelligence Surveillance Court as soon as practicable, but not more than 7 days after the Attorney General authorizes such physical search.</text> </subparagraph></paragraph>

<subsection id="H8F1DC02144C6428CA245B34892DDCD83"><enum>(a)</enum><header>Designation of judges</header><text display-inline="yes-display-inline">Subsection (a) of section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended by inserting <quote>at least</quote> before <quote>seven of the United States judicial circuits</quote>.</text> </subsection> 
<subsection id="H8F812BD407474D159BCF933D9C60EF42"><enum>(b)</enum><header>En banc authority</header> 
<paragraph id="H7D1968BDAD3B4D149048E0F9C28C5DAF"><enum>(1)</enum><header>In general</header><text>Subsection (a) of section 103 of the Foreign Intelligence Surveillance Act of 1978, as amended by subsection (a) of this section, is further amended—</text> 
<subparagraph id="HD6A5BED1EBCF467B98D0C5A25DC29F9D"><enum>(A)</enum><text>by inserting <quote>(1)</quote> after <quote>(a)</quote>; and</text> </subparagraph>

<subparagraph commented="no" display-inline="yes-display-inline" id="HDFAE0B80A0594D50A8E3E39D5BA3D41"><enum>(A)</enum><text>The court established under this subsection may, on its own initiative, or upon the request of the Government in any proceeding or a party under section 501(f) or paragraph (4) or (5) of section 702(h), hold a hearing or rehearing, en banc, when ordered by a majority of the judges that constitute such court upon a determination that—</text> 
<clause id="HC3742B4CA3F046138D798E00E5FDA814" indent="up1"><enum>(i)</enum><text>en banc consideration is necessary to secure or maintain uniformity of the court's decisions; or</text> </clause> 
<clause id="HCB814C9EFF124D88AD94A9E42F228BAD" indent="up1"><enum>(ii)</enum><text>the proceeding involves a question of exceptional importance.</text> </clause></subparagraph> 
<subparagraph id="HF100C450550441A5A5A4C5EAEC6C5756" indent="up1"><enum>(B)</enum><text>Any authority granted by this Act to a judge of the court established under this subsection may be exercised by the court en banc. When exercising such authority, the court en banc shall comply with any requirements of this Act on the exercise of such authority.</text> </subparagraph>

<subparagraph id="H7AAC68154FBC4948A097350030294FE"><enum>(A)</enum><text>in subsection (a) of section 103, as amended by this subsection, by inserting <quote>(except when sitting en banc under paragraph (2))</quote> after <quote>no judge designated under this subsection</quote>; and</text> </subparagraph> 
<subparagraph id="HF49CF63C836A41FF91FD8687F19149A2"><enum>(B)</enum><text>in section 302(c) (<external-xref legal-doc="usc" parsable-cite="usc/50/1822">50 U.S.C. 1822(c)</external-xref>), by inserting <quote>(except when sitting en banc)</quote> after <quote>except that no judge</quote>.</text> </subparagraph></paragraph></subsection> 
<subsection id="H611C6353F7CB42A28C33C3D0DD75A1F0"><enum>(c)</enum><header>Stay or modification during an appeal</header><text>Section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended—</text> 
<paragraph id="HB9FFF78ED9F44E4A901269A7D8D200D1"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text> </paragraph> 
<paragraph id="HDB75C5DE6FA74B31BF71E340ECB53323"><enum>(2)</enum><text>by inserting after subsection (e) the following new subsection:</text>

<paragraph commented="no" display-inline="yes-display-inline" id="H6B6C5F072870489C88006E80BB5F193D"><enum>(1)</enum><text>A judge of the court established under subsection (a), the court established under subsection (b) or a judge of that court, or the Supreme Court of the United States or a justice of that court, may, in accordance with the rules of their respective courts, enter a stay of an order or an order modifying an order of the court established under subsection (a) or the court established under subsection (b) entered under any title of this Act, while the court established under subsection (a) conducts a rehearing, while an appeal is pending to the court established under subsection (b), or while a petition of certiorari is pending in the Supreme Court of the United States, or during the pendency of any review by that court.</text> </paragraph>

<paragraph commented="no" id="HFECD48F09DD748E5BB6CCF1E5100EFD"><enum>(2)</enum><text>any weapon that is designed, intended, or has the capability to cause death or serious bodily injury to a significant number of persons through the release, dissemination, or impact of toxic or poisonous chemicals or their precursors;</text> </paragraph> 
<paragraph commented="no" id="H3A7D6392E53C44139B4532077629D621"><enum>(3)</enum><text>any weapon involving a biological agent, toxin, or vector (as such terms are defined in <external-xref legal-doc="usc" parsable-cite="usc/18/178">section 178</external-xref> of title 18, United States Code) that is designed, intended, or has the capability to cause death, illness, or serious bodily injury to a significant number of persons; or</text> </paragraph> 
<paragraph commented="no" id="H55FDCCEC5AF848D283AB3BDB90D7243"><enum>(4)</enum><text>any weapon that is designed, intended, or has the capability to release radiation or radioactivity causing death, illness, or serious bodily injury to a significant number of persons.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>

<paragraph id="H5EB1D7D052A647BCBA2BD0FAC2FC0031"><enum>(6)</enum><header>Electronic communication service provider</header><text>The term <term>electronic communication service provider</term> means—</text> 
<subparagraph id="H241EA6F9E4B042F9941F2DDA364FB00"><enum>(A)</enum><text>a telecommunications carrier, as that term is defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>);</text> </subparagraph> 
<subparagraph id="H5D271EB384EE4033BBAE49A25480517E"><enum>(B)</enum><text>a provider of electronic communication service, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510</external-xref> of title 18, United States Code;</text> </subparagraph> 
<subparagraph id="H3FD2F4B338CA41E5AF45AADFE3BA6E7D"><enum>(C)</enum><text>a provider of a remote computing service, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2711">section 2711</external-xref> of title 18, United States Code;</text> </subparagraph> 
<subparagraph id="H08D155A6B038492B9FDAF25D8249ACA0"><enum>(D)</enum><text>any other communication service provider who has access to wire or electronic communications either as such communications are transmitted or as such communications are stored;</text> </subparagraph> 
<subparagraph id="H80486F219075496C83029DF9F1DA3FA2"><enum>(E)</enum><text>a parent, subsidiary, affiliate, successor, or assignee of an entity described in subparagraph (A), (B), (C), or (D); or</text> </subparagraph> 
<subparagraph id="H94F051670C3845EEA858639EAD930665"><enum>(F)</enum><text>an officer, employee, or agent of an entity described in subparagraph (A), (B), (C), (D), or (E).</text> </subparagraph></paragraph> 
<paragraph id="H8E4AC6AB0D124F1AB800550000B1E96D"><enum>(7)</enum><header>Intelligence community</header><text>The term <term>intelligence community</term> has the meaning given the term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>).</text> </paragraph> 
<paragraph id="HB9D14155E31B4E30859349FFF9E52047"><enum>(8)</enum><header>Person</header><text>The term <term>person</term> means—</text> 
<subparagraph id="HEA8D2EDB217D42C89BE1885D9513632C"><enum>(A)</enum><text>an electronic communication service provider; or</text> </subparagraph> 
<subparagraph id="HF0D9FCE5F51F47CABFD48B210061D2A6"><enum>(B)</enum><text>a landlord, custodian, or other person who may be authorized or required to furnish assistance pursuant to—</text> 
<clause id="H39A469699A15408CB7A105B166D8A35B"><enum>(i)</enum><text>an order of the court established under section 103(a) directing such assistance;</text> </clause> 
<clause id="HA02BFA1146E441B000266F03C5B326F4"><enum>(ii)</enum><text>a certification in writing under section <external-xref legal-doc="usc" parsable-cite="usc/18/2511">2511(2)(a)(ii)(B)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/18/2709">2709(b)</external-xref> of title 18, United States Code; or</text> </clause> 
<clause id="HE13D1D32E7CC4D5AB68C00C100AA001C"><enum>(iii)</enum><text display-inline="yes-display-inline">a directive under section 102(a)(4), 105B(e), as added by section 2 of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>), or 702(h).</text> </clause></subparagraph></paragraph> 
<paragraph id="HDE2F2348DF4A4668BF743118F7D06B23"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means any State, political subdivision of a State, the Commonwealth of Puerto Rico, the District of Columbia, and any territory or possession of the United States, and includes any officer, public utility commission, or other body authorized to regulate an electronic communication service provider.</text> </paragraph></section> 
<section id="H2206754633294332BA3BB3FC5C188918"><enum>802.</enum><header>Procedures for implementing statutory defenses</header> 
<subsection id="H53E63FCE99594E34BE99E3C30874152B"><enum>(a)</enum><header>Requirement for certification</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a civil action may not lie or be maintained in a Federal or State court against any person for providing assistance to an element of the intelligence community, and shall be promptly dismissed, if the Attorney General certifies to the district court of the United States in which such action is pending that—</text> 
<paragraph id="H14C69C8D7EF7493FBB01A23C6932A7D9"><enum>(1)</enum><text>any assistance by that person was provided pursuant to an order of the court established under section 103(a) directing such assistance;</text> </paragraph> 
<paragraph id="H42743548124841F7AC91B2B1D65DCE95"><enum>(2)</enum><text>any assistance by that person was provided pursuant to a certification in writing under section <external-xref legal-doc="usc" parsable-cite="usc/18/2511">2511(2)(a)(ii)(B)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/18/2709">2709(b)</external-xref> of title 18, United States Code;</text> </paragraph> 
<paragraph id="H038D566F55974D51A8B8CD00CE31D3E3"><enum>(3)</enum><text display-inline="yes-display-inline">any assistance by that person was provided pursuant to a directive under section 102(a)(4), 105B(e), as added by section 2 of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>), or 702(h) directing such assistance;</text> </paragraph> 
<paragraph id="H2CCEC7C24CFD45F1BCB9F617327CF58F"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of a covered civil action, the assistance alleged to have been provided by the electronic communication service provider was—</text> 
<subparagraph id="H49454BD320BC449092593495DE5126F3"><enum>(A)</enum><text>in connection with an intelligence activity involving communications that was—</text> 
<clause id="H6AE3F36BC283410D87814CA142297990"><enum>(i)</enum><text>authorized by the President during the period beginning on September 11, 2001, and ending on January 17, 2007; and</text> </clause> 
<clause id="H8E776FBC86A24F6A902B29F8E5200E5"><enum>(ii)</enum><text>designed to detect or prevent a terrorist attack, or activities in preparation for a terrorist attack, against the United States; and</text> </clause></subparagraph> 
<subparagraph id="H370159280AF644A982004CD354C3E93F"><enum>(B)</enum><text>the subject of a written request or directive, or a series of written requests or directives, from the Attorney General or the head of an element of the intelligence community (or the deputy of such person) to the electronic communication service provider indicating that the activity was—</text> 
<clause id="H89BAED1147594FEEAFAB22F9E39B3E3"><enum>(i)</enum><text>authorized by the President; and</text> </clause> 
<clause id="HAED8026ACDB24E7CB22316B764ED03E1"><enum>(ii)</enum><text>determined to be lawful; or</text> </clause></subparagraph></paragraph> 
<paragraph id="H8C3E8DA4CA2A478396EFBB252D8528FD"><enum>(5)</enum><text>the person did not provide the alleged assistance.</text> </paragraph></subsection> 
<subsection id="H58590B260DDC42EBB932AB8221D4EF4C"><enum>(b)</enum><header>Judicial review</header> 
<paragraph id="H65DBCF90535B4D9E8705F2ECEF303400"><enum>(1)</enum><header>Review of certifications</header><text display-inline="yes-display-inline">A certification under subsection (a) shall be given effect unless the court finds that such certification is not supported by substantial evidence provided to the court pursuant to this section.</text> </paragraph> 
<paragraph id="H0819BD4DA50F4B6997CD34907D9B5D3F"><enum>(2)</enum><header>Supplemental materials</header><text>In its review of a certification under subsection (a), the court may examine the court order, certification, written request, or directive described in subsection (a) and any relevant court order, certification, written request, or directive submitted pursuant to subsection (d).</text> </paragraph></subsection> 
<subsection id="H09074A8C87FD41819FDB50858DB8E952"><enum>(c)</enum><header>Limitations on disclosure</header><text display-inline="yes-display-inline">If the Attorney General files a declaration under <external-xref legal-doc="usc" parsable-cite="usc/28/1746">section 1746</external-xref> of title 28, United States Code, that disclosure of a certification made pursuant to subsection (a) or the supplemental materials provided pursuant to subsection (b) or (d) would harm the national security of the United States, the court shall—</text> 
<paragraph id="H54F88DE73BBF4C469C2571D9A7537900"><enum>(1)</enum><text>review such certification and the supplemental materials in camera and ex parte; and</text> </paragraph> 
<paragraph id="HD04D901453C7492C8E93C19B3D37A68D"><enum>(2)</enum><text>limit any public disclosure concerning such certification and the supplemental materials, including any public order following such in camera and ex parte review, to a statement as to whether the case is dismissed and a description of the legal standards that govern the order, without disclosing the paragraph of subsection (a) that is the basis for the certification.</text> </paragraph></subsection> 
<subsection id="H88C72CBDF67C4AA08CF8A4CD21F42193"><enum>(d)</enum><header>Role of the parties</header><text display-inline="yes-display-inline">Any plaintiff or defendant in a civil action may submit any relevant court order, certification, written request, or directive to the district court referred to in subsection (a) for review and shall be permitted to participate in the briefing or argument of any legal issue in a judicial proceeding conducted pursuant to this section, but only to the extent that such participation does not require the disclosure of classified information to such party. To the extent that classified information is relevant to the proceeding or would be revealed in the determination of an issue, the court shall review such information in camera and ex parte, and shall issue any part of the court’s written order that would reveal classified information in camera and ex parte and maintain such part under seal.</text> </subsection> 
<subsection id="H66449A6BA3604EB29EDE0701063B9E00"><enum>(e)</enum><header>Nondelegation</header><text>The authority and duties of the Attorney General under this section shall be performed by the Attorney General (or Acting Attorney General) or the Deputy Attorney General.</text> </subsection> 
<subsection commented="no" id="H55B54A560F664200B8AFEC40C113C92E"><enum>(f)</enum><header>Appeal</header><text>The courts of appeals shall have jurisdiction of appeals from interlocutory orders of the district courts of the United States granting or denying a motion to dismiss or for summary judgment under this section.</text> </subsection> 
<subsection id="H2658557124E54980BE642CA1D34EF27F"><enum>(g)</enum><header>Removal</header><text>A civil action against a person for providing assistance to an element of the intelligence community that is brought in a State court shall be deemed to arise under the Constitution and laws of the United States and shall be removable under <external-xref legal-doc="usc" parsable-cite="usc/28/1441">section 1441</external-xref> of title 28, United States Code.</text> </subsection> 
<subsection id="H6047B77741944E2586ABCFE491B5A408"><enum>(h)</enum><header>Relationship to other laws</header><text>Nothing in this section shall be construed to limit any otherwise available immunity, privilege, or defense under any other provision of law.</text> </subsection> 
<subsection id="HAEF61F6C89924FBB83641DF14951E26"><enum>(i)</enum><header>Applicability</header><text>This section shall apply to a civil action pending on or filed after the date of the enactment of the FISA Amendments Act of 2008.</text> </subsection></section> 
<section id="H6CF836FC867C4410A29509FDCD13BC7"><enum>803.</enum><header>Preemption</header> 
<subsection id="H0AD45710CD834897957D422FEDB2993"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No State shall have authority to—</text> 
<paragraph id="HF20BA5167C2E4C0FB0B8244B20587047"><enum>(1)</enum><text>conduct an investigation into an electronic communication service provider's alleged assistance to an element of the intelligence community;</text> </paragraph> 
<paragraph id="HCE96396677384C6E92CD2BFDD6BD645B"><enum>(2)</enum><text>require through regulation or any other means the disclosure of information about an electronic communication service provider's alleged assistance to an element of the intelligence community;</text> </paragraph> 
<paragraph id="H084200E7CCEA43B9B4CDB0AC8C7C3700"><enum>(3)</enum><text>impose any administrative sanction on an electronic communication service provider for assistance to an element of the intelligence community; or</text> </paragraph> 
<paragraph id="H7F4AF393A4214E0F9F76185398D7BCAC"><enum>(4)</enum><text>commence or maintain a civil action or other proceeding to enforce a requirement that an electronic communication service provider disclose information concerning alleged assistance to an element of the intelligence community.</text> </paragraph></subsection> 
<subsection id="H390178649B704D5EAD13654FF9B94D59"><enum>(b)</enum><header>Suits by the United States</header><text>The United States may bring suit to enforce the provisions of this section.</text> </subsection> 
<subsection id="HD9634B03FD564489B33FEF952EF2D46D"><enum>(c)</enum><header>Jurisdiction</header><text>The district courts of the United States shall have jurisdiction over any civil action brought by the United States to enforce the provisions of this section.</text> </subsection> 
<subsection id="H53DD251EB8F6448E8D26D91368D7984"><enum>(d)</enum><header>Application</header><text>This section shall apply to any investigation, action, or proceeding that is pending on or commenced after the date of the enactment of the FISA Amendments Act of 2008.</text> </subsection></section> 
<section id="H2E3DC130795043CABABAA644D9DB8A8"><enum>804.</enum><header>Reporting</header> 
<subsection id="H756BA10890AB4227BECA39804FEDA14D"><enum>(a)</enum><header>Semiannual report</header><text display-inline="yes-display-inline">Not less frequently than once every 6 months, the Attorney General shall, in a manner consistent with national security, the Rules of the House of Representatives, the Standing Rules of the Senate, and Senate Resolution 400 of the 94th Congress or any successor Senate resolution, fully inform the congressional intelligence committees, the Committee on the Judiciary of the Senate, and the Committee on the Judiciary of the House of Representatives concerning the implementation of this title.</text> </subsection> 
<subsection id="HC74CBF2ABCF74FB2BF78997721B43B86"><enum>(b)</enum><header>Content</header><text>Each report made under subsection (a) shall include—</text> 
<paragraph id="H8F1347315C9C4D18007440B108D2358B"><enum>(1)</enum><text>any certifications made under section 802;</text> </paragraph> 
<paragraph id="H5CA82D0D36A247D8A13D502919C679A5"><enum>(2)</enum><text>a description of the judicial review of the certifications made under section 802; and</text> </paragraph> 
<paragraph id="H464C0D2309D84E068223C9A9217E8BA6"><enum>(3)</enum><text>any actions taken to enforce the provisions of section 803.</text> </paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block> </section>

<subparagraph commented="no" id="H7D265332EA174E629B8C61C75200FFCC"><enum>(A)</enum><text>the Select Committee on Intelligence and the Committee on the Judiciary of the Senate; and</text> </subparagraph> 
<subparagraph commented="no" id="H4635811D597C45909363F1345C00F142"><enum>(B)</enum><text>the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives.</text> </subparagraph></paragraph> 
<paragraph commented="no" id="HB07E39F201364CE4B851D17B4B5184F7"><enum>(2)</enum><header>Foreign intelligence surveillance court</header><text>The term <term>Foreign Intelligence Surveillance Court</term> means the court established under section 103(a) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>).</text> </paragraph> 
<paragraph commented="no" id="H29E1D2C670CD42CB8BD584AE32D0F45C"><enum>(3)</enum><header>President’s surveillance program and program</header><text>The terms <term>President’s Surveillance Program</term> and <term>Program</term> mean the intelligence activity involving communications that was authorized by the President during the period beginning on September 11, 2001, and ending on January 17, 2007, including the program referred to by the President in a radio address on December 17, 2005 (commonly known as the Terrorist Surveillance Program).</text> </paragraph></subsection> 
<subsection commented="no" id="H3AF9EAFA164C4878BC1EA2CADF99E1E9"><enum>(b)</enum><header>Reviews</header> 
<paragraph commented="no" id="HC20E90482C1B40B08DB4C8F8E498034"><enum>(1)</enum><header>Requirement to conduct</header><text display-inline="yes-display-inline">The Inspectors General of the Department of Justice, the Office of the Director of National Intelligence, the National Security Agency, the Department of Defense, and any other element of the intelligence community that participated in the President’s Surveillance Program, shall complete a comprehensive review of, with respect to the oversight authority and responsibility of each such Inspector General—</text> 
<subparagraph commented="no" id="H1E7E394B7946430EB94F578900BD011"><enum>(A)</enum><text>all of the facts necessary to describe the establishment, implementation, product, and use of the product of the Program;</text> </subparagraph> 
<subparagraph commented="no" id="H5343C5C577CC4464B0841352D81C7169"><enum>(B)</enum><text>access to legal reviews of the Program and access to information about the Program;</text> </subparagraph> 
<subparagraph commented="no" id="HCFD981BC2790431D9D65E6ECAA4D8954"><enum>(C)</enum><text>communications with, and participation of, individuals and entities in the private sector related to the Program;</text> </subparagraph> 
<subparagraph commented="no" id="H5E22E5092BC44F71B5AF2DC72CB5A9BB"><enum>(D)</enum><text>interaction with the Foreign Intelligence Surveillance Court and transition to court orders related to the Program; and</text> </subparagraph> 
<subparagraph commented="no" id="HF70C7D35A3F344C19264AFE05900FC34"><enum>(E)</enum><text>any other matters identified by any such Inspector General that would enable that Inspector General to complete a review of the Program, with respect to such Department or element.</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H04A5E0D3A49245CB002DDE5200FE74AA"><enum>(2)</enum><header>Cooperation and coordination</header> 
<subparagraph commented="no" id="H83B16D6819924C47B21C552D006C716D"><enum>(A)</enum><header>Cooperation</header><text>Each Inspector General required to conduct a review under paragraph (1) shall—</text> 
<clause commented="no" id="H86EFA80D884840AE9EB50261E4FEA25"><enum>(i)</enum><text>work in conjunction, to the extent practicable, with any other Inspector General required to conduct such a review; and</text> </clause> 
<clause commented="no" id="HE8B61206D4B944B29BABA23214B891E"><enum>(ii)</enum><text>utilize, to the extent practicable, and not unnecessarily duplicate or delay, such reviews or audits that have been completed or are being undertaken by any such Inspector General or by any other office of the Executive Branch related to the Program.</text> </clause></subparagraph> 
<subparagraph commented="no" id="HE773FC6D16354248826521D2D62F4B1E"><enum>(B)</enum><header>Integration of other reviews</header><text>The Counsel of the Office of Professional Responsibility of the Department of Justice shall provide the report of any investigation conducted by such Office on matters relating to the Program, including any investigation of the process through which legal reviews of the Program were conducted and the substance of such reviews, to the Inspector General of the Department of Justice, who shall integrate the factual findings and conclusions of such investigation into its review.</text> </subparagraph> 
<subparagraph commented="no" id="HE67C60BB85884239A0E959A907B49F00"><enum>(C)</enum><header>Coordination</header><text>The Inspectors General shall designate one of the Inspectors General required to conduct a review under paragraph (1) that is appointed by the President, by and with the advice and consent of the Senate, to coordinate the conduct of the reviews and the preparation of the reports.</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" id="H283CA9B200544784AC490805E386AF26"><enum>(c)</enum><header>Reports</header> 
<paragraph commented="no" id="HFC4295861F674FB685905C0575AB22F"><enum>(1)</enum><header>Preliminary reports</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Inspectors General of the Department of Justice, the Office of the Director of National Intelligence, the National Security Agency, the Department of Defense, and any other Inspector General required to conduct a review under subsection (b)(1), shall submit to the appropriate committees of Congress an interim report that describes the planned scope of such review.</text> </paragraph> 
<paragraph commented="no" id="H639893753B4247BFBC468C00A78F602B"><enum>(2)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Inspectors General of the Department of Justice, the Office of the Director of National Intelligence, the National Security Agency, the Department of Defense, and any other Inspector General required to conduct a review under subsection (b)(1), shall submit to the appropriate committees of Congress, in a manner consistent with national security, a comprehensive report on such reviews that includes any recommendations of any such Inspectors General within the oversight authority and responsibility of any such Inspector General with respect to the reviews.</text> </paragraph> 
<paragraph commented="no" id="H5A98A5B272D245628940000000A40072"><enum>(3)</enum><header>Form</header><text>A report under this subsection shall be submitted in unclassified form, but may include a classified annex. The unclassified report shall not disclose the name or identity of any individual or entity of the private sector that participated in the Program or with whom there was communication about the Program, to the extent that information is classified.</text> </paragraph></subsection> 
<subsection commented="no" id="HE9B47AB38E6D40AABF213EA59E9DBAB3"><enum>(d)</enum><header>Resources</header> 
<paragraph commented="no" id="H43B8FAF9BB474D5D85EC02F435CAF7EF"><enum>(1)</enum><header>Expedited security clearance</header><text>The Director of National Intelligence shall ensure that the process for the investigation and adjudication of an application by an Inspector General or any appropriate staff of an Inspector General for a security clearance necessary for the conduct of the review under subsection (b)(1) is carried out as expeditiously as possible.</text> </paragraph> 
<paragraph commented="no" id="H4E680C191C524E8D9CB4D63E32ABD0FC"><enum>(2)</enum><header>Additional personnel for the inspectors general</header><text>An Inspector General required to conduct a review under subsection (b)(1) and submit a report under subsection (c) is authorized to hire such additional personnel as may be necessary to carry out such review and prepare such report in a prompt and timely manner. Personnel authorized to be hired under this paragraph—</text> 
<subparagraph commented="no" id="H42F21E6F2CBD4974936F29F53C862015"><enum>(A)</enum><text>shall perform such duties relating to such a review as the relevant Inspector General shall direct; and</text> </subparagraph> 
<subparagraph commented="no" id="H2A236A538B2E4BF5AAA40800017FEF00"><enum>(B)</enum><text>are in addition to any other personnel authorized by law.</text> </subparagraph></paragraph> 
<paragraph id="HA3AF44BBF16040A2B64DC6599630AE10"><enum>(3)</enum><header>Transfer of personnel</header><text display-inline="yes-display-inline">The Attorney General, the Secretary of Defense, the Director of National Intelligence, the Director of the National Security Agency, or the head of any other element of the intelligence community may transfer personnel to the relevant Office of the Inspector General required to conduct a review under subsection (b)(1) and submit a report under subsection (c) and, in addition to any other personnel authorized by law, are authorized to fill any vacancy caused by such a transfer. Personnel transferred under this paragraph shall perform such duties relating to such review as the relevant Inspector General shall direct.</text> </paragraph></subsection></section></title> 
<title commented="no" id="HC07A82E77C8B4B2E8CF4F190396C40F6"><enum>IV</enum><header>Other provisions</header> 
<section commented="no" id="HA937ABD0E9854F6FB5076DCB2CD1BEEC"><enum>401.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, any amendment made by this Act, or the application thereof to any person or circumstances is held invalid, the validity of the remainder of the Act, of any such amendments, and of the application of such provisions to other persons and circumstances shall not be affected thereby.</text> </section> 
<section commented="no" id="H65931B46DD1742BA996F53BDF1A8ECD2"><enum>402.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as provided in section 404, the amendments made by this Act shall take effect on the date of the enactment of this Act.</text> </section>

<subsection commented="no" id="H15E0B66494E54F22B3F4DF41B3D2BC4B"><enum>(a)</enum><header>Transition procedures for Protect America Act of 2007 provisions</header> 
<paragraph commented="no" id="H0FC39AB84202479BA3D423186D96C8EA"><enum>(1)</enum><header>Continued effect of orders, authorizations, directives</header><text>Except as provided in paragraph (7), notwithstanding any other provision of law, any order, authorization, or directive issued or made pursuant to section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>; 121 Stat. 552), shall continue in effect until the expiration of such order, authorization, or directive.</text> </paragraph> 
<paragraph commented="no" id="H345FF71A33204B8FAE987000DA032C5"><enum>(2)</enum><header>Applicability of Protect America Act of 2007 to continued orders, authorizations, directives</header><text>Notwithstanding any other provision of this Act, any amendment made by this Act, or the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>)—</text> 
<subparagraph commented="no" id="HFFB264876B4C4CECB5366964CC9CBE6C"><enum>(A)</enum><text>subject to paragraph (3), section 105A of such Act, as added by section 2 of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>; 121 Stat. 552), shall continue to apply to any acquisition conducted pursuant to an order, authorization, or directive referred to in paragraph (1); and</text> </subparagraph> 
<subparagraph commented="no" id="HD27340CD6ED941D9B7F6F00142A1A9D"><enum>(B)</enum><text>sections 105B and 105C of the Foreign Intelligence Surveillance Act of 1978, as added by sections 2 and 3, respectively, of the Protect America Act of 2007, shall continue to apply with respect to an order, authorization, or directive referred to in paragraph (1) until the later of—</text> 
<clause commented="no" id="H724F0F5DB84E4E03B57C8C73D5968499"><enum>(i)</enum><text>the expiration of such order, authorization, or directive; or</text> </clause> 
<clause commented="no" id="HBDD168D3F76D4921B84668E0D9E74D70"><enum>(ii)</enum><text>the date on which final judgment is entered for any petition or other litigation relating to such order, authorization, or directive.</text> </clause></subparagraph></paragraph> 
<paragraph commented="no" id="H98162A9901A44CE6AC22A9AD897B7A5"><enum>(3)</enum><header>Use of information</header><text>Information acquired from an acquisition conducted pursuant to an order, authorization, or directive referred to in paragraph (1) shall be deemed to be information acquired from an electronic surveillance pursuant to title I of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) for purposes of section 106 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1806">50 U.S.C. 1806</external-xref>), except for purposes of subsection (j) of such section.</text> </paragraph> 
<paragraph commented="no" id="HA8CD44F4FA344DE384E4F0D096C84BE"><enum>(4)</enum><header>Protection from liability</header><text>Subsection (l) of section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007, shall continue to apply with respect to any directives issued pursuant to such section 105B.</text> </paragraph> 
<paragraph commented="no" id="H3B257D2C958D465782C098F170BB9909"><enum>(5)</enum><header>Jurisdiction of Foreign Intelligence Surveillance Court</header><text>Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), section 103(e) of the Foreign Intelligence Surveillance Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(e)</external-xref>), as amended by section 5(a) of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>; 121 Stat. 556), shall continue to apply with respect to a directive issued pursuant to section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007, until the later of—</text> 
<subparagraph commented="no" id="H113B192BED274075B5109BDBA993097F"><enum>(A)</enum><text>the expiration of all orders, authorizations, or directives referred to in paragraph (1); or</text> </subparagraph> 
<subparagraph commented="no" id="H46A6E435CF4541E8A6AEBE4BF3165844"><enum>(B)</enum><text>the date on which final judgment is entered for any petition or other litigation relating to such order, authorization, or directive.</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H8BB24822435F40AD9C399B8E60246E8D"><enum>(6)</enum><header>Reporting requirements</header> 
<subparagraph commented="no" id="H3BB66C285F5A42D200AA35FAB972B1D2"><enum>(A)</enum><header>Continued applicability</header><text>Notwithstanding any other provision of this Act, any amendment made by this Act, the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>), or the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), section 4 of the Protect America Act of 2007 shall continue to apply until the date that the certification described in subparagraph (B) is submitted.</text> </subparagraph> 
<subparagraph commented="no" id="H1D260E03F2D04A29A9D6A8292C99A03F"><enum>(B)</enum><header>Certification</header><text>The certification described in this subparagraph is a certification—</text> 
<clause commented="no" id="HA36F295507554BB9AD52C5A500239EF6"><enum>(i)</enum><text>made by the Attorney General;</text> </clause> 
<clause commented="no" id="H9886E24AB6B942969EC7115F1124D0C5"><enum>(ii)</enum><text>submitted as part of a semi-annual report required by section 4 of the Protect America Act of 2007;</text> </clause> 
<clause commented="no" id="HE14403AF533E469D919D845BC8B9092F"><enum>(iii)</enum><text>that states that there will be no further acquisitions carried out under section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007, after the date of such certification; and</text> </clause> 
<clause commented="no" id="H65B3AA2DEBBE43388CDA16A7007F2D17"><enum>(iv)</enum><text display-inline="yes-display-inline">that states that the information required to be included under such section 4 relating to any acquisition conducted under such section 105B has been included in a semi-annual report required by such section 4.</text> </clause></subparagraph></paragraph> 
<paragraph commented="no" id="H56231A8839D04D9FAE25633560D50325"><enum>(7)</enum><header>Replacement of orders, authorizations, and directives</header> 
<subparagraph id="H75506C88ECBD4CFE846400D57547A652"><enum>(A)</enum><header>In general</header><text>If the Attorney General and the Director of National Intelligence seek to replace an authorization issued pursuant to section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>), with an authorization under section 702 of the Foreign Intelligence Surveillance Act of 1978 (as added by section 101(a) of this Act), the Attorney General and the Director of National Intelligence shall, to the extent practicable, submit to the Foreign Intelligence Surveillance Court (as such term is defined in section 701(b)(2) of such Act (as so added)) a certification prepared in accordance with subsection (g) of such section 702 and the procedures adopted in accordance with subsections (d) and (e) of such section 702 at least 30 days before the expiration of such authorization.</text> </subparagraph> 
<subparagraph id="H7190C7C0725C457CAC47FFB3289238D6"><enum>(B)</enum><header>Continuation of existing orders</header><text display-inline="yes-display-inline">If the Attorney General and the Director of National Intelligence seek to replace an authorization made pursuant to section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>; 121 Stat. 522), by filing a certification in accordance with subparagraph (A), that authorization, and any directives issued thereunder and any order related thereto, shall remain in effect, notwithstanding the expiration provided for in subsection (a) of such section 105B, until the Foreign Intelligence Surveillance Court (as such term is defined in section 701(b)(2) of the Foreign Intelligence Surveillance Act of 1978 (as so added)) issues an order with respect to that certification under section 702(i)(3) of such Act (as so added) at which time the provisions of that section and of section 702(i)(4) of such Act (as so added) shall apply.</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H71EEA993767340819453918C25B1D995"><enum>(8)</enum><header>Effective date</header><text>Paragraphs (1) through (7) shall take effect as if enacted on August 5, 2007.</text> </paragraph></subsection> 
<subsection commented="no" id="H1011DC647A8346FC9816F153D8E1F86"><enum>(b)</enum><header>Transition procedures for FISA Amendments Act of 2008 provisions</header> 
<paragraph commented="no" id="HA100C5AF533846509150E32DFA827BC5"><enum>(1)</enum><header>Orders in effect on December 31, 2012</header><text>Notwithstanding any other provision of this Act, any amendment made by this Act, or the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), any order, authorization, or directive issued or made under title VII of the Foreign Intelligence Surveillance Act of 1978, as amended by section 101(a), shall continue in effect until the date of the expiration of such order, authorization, or directive.</text> </paragraph> 
<paragraph commented="no" id="H8E3E07EF3A1444C2AE9146C8AFDCF1B"><enum>(2)</enum><header>Applicability of Title VII of FISA to continued orders, authorizations, directives</header><text>Notwithstanding any other provision of this Act, any amendment made by this Act, or the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), with respect to any order, authorization, or directive referred to in paragraph (1), title VII of such Act, as amended by section 101(a), shall continue to apply until the later of—</text> 
<subparagraph commented="no" id="HAD3FD799AA544BF38731E169ED9DDBE6"><enum>(A)</enum><text>the expiration of such order, authorization, or directive; or</text> </subparagraph> 
<subparagraph commented="no" id="H5EAEA4CD69ED4143B4B70064DAEDC7E5"><enum>(B)</enum><text>the date on which final judgment is entered for any petition or other litigation relating to such order, authorization, or directive.</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H4B7E3B15ACFF4978009EE6A23F77C037"><enum>(3)</enum><header>Challenge of directives; protection from liability; use of information</header><text>Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>)—</text> 
<subparagraph commented="no" id="H2DEA47F8AEE04E21B96E53AFFCE6E86F"><enum>(A)</enum><text>section 103(e) of such Act, as amended by section 403(a)(1)(B)(ii), shall continue to apply with respect to any directive issued pursuant to section 702(h) of such Act, as added by section 101(a);</text> </subparagraph> 
<subparagraph commented="no" id="H66E6E9DF090C4BF5A00957343100EBAE"><enum>(B)</enum><text>section 702(h)(3) of such Act (as so added) shall continue to apply with respect to any directive issued pursuant to section 702(h) of such Act (as so added);</text> </subparagraph> 
<subparagraph commented="no" id="H68187096B2CF4734BF00D000BB00DA1"><enum>(C)</enum><text>section 703(e) of such Act (as so added) shall continue to apply with respect to an order or request for emergency assistance under that section;</text> </subparagraph> 
<subparagraph commented="no" id="HCDF510AE0ED542F2A0576700C84030AE"><enum>(D)</enum><text>section 706 of such Act (as so added) shall continue to apply to an acquisition conducted under section 702 or 703 of such Act (as so added); and</text> </subparagraph> 
<subparagraph commented="no" id="H945E410666624283BB78E0297D2E09AD"><enum>(E)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/2511">section 2511(2)(a)(ii)(A)</external-xref> of title 18, United States Code, as amended by section 101(c)(1), shall continue to apply to an order issued pursuant to section 704 of the Foreign Intelligence Surveillance Act of 1978, as added by section 101(a).</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H9060668B44BA4E92A7B5AAC71D1041D1"><enum>(4)</enum><header>Reporting requirements</header> 
<subparagraph commented="no" id="HAA3B2E01574248D5BED615F7BE16FA52"><enum>(A)</enum><header>Continued applicability</header><text>Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), section 601(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871(a)</external-xref>), as amended by section 101(c)(2), and sections 702(l) and 707 of such Act, as added by section 101(a), shall continue to apply until the date that the certification described in subparagraph (B) is submitted.</text> </subparagraph> 
<subparagraph commented="no" id="H639B70CD322D4AAD880401192F9143FA"><enum>(B)</enum><header>Certification</header><text>The certification described in this subparagraph is a certification—</text> 
<clause commented="no" id="H6B03E1D3139E479D8DD2059854C1F20"><enum>(i)</enum><text>made by the Attorney General;</text> </clause> 
<clause commented="no" id="H9B03A243E90C46A181B01ECD3D697CB9"><enum>(ii)</enum><text>submitted to the Select Committee on Intelligence of the Senate, the Permanent Select Committee on Intelligence of the House of Representatives, and the Committees on the Judiciary of the Senate and the House of Representatives;</text> </clause> 
<clause commented="no" id="HC15131B6C4204CFE00173661831B6FE7"><enum>(iii)</enum><text>that states that there will be no further acquisitions carried out under title VII of the Foreign Intelligence Surveillance Act of 1978, as amended by section 101(a), after the date of such certification; and</text> </clause> 
<clause commented="no" id="H5516E81359AB44F39E2FC31100A66EC6"><enum>(iv)</enum><text>that states that the information required to be included in a review, assessment, or report under section 601 of such Act, as amended by section 101(c), or section 702(l) or 707 of such Act, as added by section 101(a), relating to any acquisition conducted under title VII of such Act, as amended by section 101(a), has been included in a review, assessment, or report under such section 601, 702(l), or 707.</text> </clause></subparagraph></paragraph> 
<paragraph commented="no" id="HDFAA99CB830B420AA001A9FD90E7DB47"><enum>(5)</enum><header>Transition procedures concerning the targeting of United States persons overseas</header><text>Any authorization in effect on the date of enactment of this Act under section 2.5 of Executive Order 12333 to intentionally target a United States person reasonably believed to be located outside the United States shall continue in effect, and shall constitute a sufficient basis for conducting such an acquisition targeting a United States person located outside the United States until the earlier of—</text> 
<subparagraph commented="no" id="HFF267107187944BA8929F1E800378432"><enum>(A)</enum><text>the date that authorization expires; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H1D22E31AB5E44934BFD35D07D8F6A4F8"><enum>(B)</enum><text>the date that is 90 days after the date of the enactment of this Act.</text> </subparagraph></paragraph></subsection></section></title>
