<official-title>To amend the National Defense Authorization Act for Fiscal Year 2006 to extend the deadline for the submission of the final report of the Commission on the Implementation of the New Strategic Posture of the United States, to provide for the appointment of additional members for the Commission, to ensure the availability of funds for the Commission, and for other purposes.</official-title>

<section id="H670C4759FBC344368FB17517BCF0CF12" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Commission on the Implementation of the New Strategic Posture of the United States</header> 
<subsection id="H5491455B26D545238400A13C61777C96"><enum>(a)</enum><header>Establishment and members</header><text display-inline="yes-display-inline">Subsection (a) of section 1051 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3431) is amended—</text> 
<paragraph id="HAC7F3CC7036E4511B725D873C5937B82"><enum>(1)</enum><text>in paragraph (1), by striking the second, third, and fourth sentences;</text></paragraph> 
<paragraph id="H37BAE7BF68E04E7D9C42EF04B763FFE"><enum>(2)</enum><text>in paragraph (3), by adding at the end the following new sentence: <quote>The chairman shall be in charge of all financial and administrative matters relating to the Commission.</quote>; and </text></paragraph> 
<paragraph id="H85CE6732D3F64F639CBF8D55A200FC19"><enum>(3)</enum><text>by adding at the end the following new paragraphs: </text> 
<quoted-block style="OLC" id="H528B0E52552442D5AA26098C3031FFD7" display-inline="no-display-inline"> 
<paragraph id="HD59D5729A1B645F0A3E34B69435691DA"><enum>(6)</enum><header>Pay and travel allowances</header><text display-inline="yes-display-inline">Members of the Commission shall serve without pay by reason of their work on the Commission. The members shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></paragraph> 
<paragraph id="H16758126B4C74D4F845093E965FE5E8D"><enum>(7)</enum><header>Postal and printing services</header><text display-inline="yes-display-inline">The Commission may use the United States mails and obtain printing and binding services in the same manner and under the same conditions as other departments and agencies of the Federal Government.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H195F0CFF233C4A579BCA8F00BEBAB383"><enum>(b)</enum><header>Submission of final report</header><text display-inline="yes-display-inline">Subsection (c) of section 1051 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3431), as amended by section 1072 of the John Warner National Defense Authorization Act for Fiscal Year 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/364">Public Law 109–364</external-xref>; 120 Stat. 2403), is amended to read as follows:</text> 
<quoted-block style="OLC" id="H985234562DD045B0A821484BE604BA7D" display-inline="no-display-inline"> 
<subsection id="HAC09B92B3CB64F359070DFB0DAA7CB"><enum>(c)</enum><header>Submission of report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the first meeting of the Commission, the Commission shall submit to the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives a report on the Commission’s findings and conclusions.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H52D8C05D84B242DD99A41C76E8B1BA08"><enum>(c)</enum><header>Staff</header><text display-inline="yes-display-inline">Section 1051 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3431) is amended—</text> 
<paragraph id="H7652833FADFB4D04B4071516D6F6C1C"><enum>(1)</enum><text>by redesignating subsection (d) as subparagraph (C) and transferring such subparagraph, as so redesignated, to the end of paragraph (3) of subsection (b);</text></paragraph> 
<paragraph id="H9D9AEF622B0C438C9CC3491B25294100"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after such subparagraph, as so redesignated and transferred, the following new subparagraph:</text> 
<quoted-block style="OLC" id="H8BE5D5EB475D492C009ED9D27977A21D" display-inline="no-display-inline"> 
<subparagraph id="H82ABF89B053E4057A1A42E96818621D"><enum>(D)</enum><header>Miscellaneous administrative and support services</header><text display-inline="yes-display-inline">The Secretary of Defense shall furnish the Commission, on a reimbursable basis, any administrative and support services requested by the Commission. </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7188F831DC094141BE10B3599EE209F1"><enum>(3)</enum><text>by inserting after subsection (c) the following new subsection (d):</text>

<subsection id="HADEBD1741E9846F2931DC202D99E1C38"><enum>(d)</enum><header>Staff</header><text display-inline="yes-display-inline">The chairman of the Commission may, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, appoint a staff director and such additional personnel as may be necessary to enable the Commission to perform its duties. The appointment of a staff director shall be subject to the approval of the Commission. The chairman may also procure temporary and intermittent services under section 3109(b) of such title at rates for individuals which do not exceed the daily equivalent of the annual rate of basic pay payable for level V of the Executive Schedule under section 5316 of such title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8B7277D70F2946508D41B95851D60411"><enum>(d)</enum><header>Guaranteed funding for commission</header><text display-inline="yes-display-inline">Subsection (e) of section 1051 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3431) is amended by adding at the end the following new sentence: <quote>For fiscal year 2008, the funds provided by the Secretary of Defense for activities of the Commission shall be equal to $4,500,000 or such lesser amount as the Commission may specify as necessary for its activities.</quote>. </text></subsection> 
<subsection id="HD9B20EC0E5894D43BDFA53FF7001EE4"><enum>(e)</enum><header>Termination of commission</header><text display-inline="yes-display-inline">Subsection (f) of section 1051 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3431), as amended by section 1072 of the John Warner National Defense Authorization Act for Fiscal Year 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/364">Public Law 109–364</external-xref>; 120 Stat. 2403), is amended by striking <quote>on November 30, 2007</quote> and inserting <quote>30 days after the date on which the Commission submits its report under subsection (c)</quote>.</text></subsection> 
<subsection id="H780A497292824494825ED5DF59D3B11"><enum>(f)</enum><header>Implementation</header><text display-inline="yes-display-inline">Subsection (g) of section 1051 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3431) is amended to read as follows: </text>

<subsection id="H05FAC20DA34D4CBAB9502CF9669C59D8"><enum>(g)</enum><header>First meeting</header><text display-inline="yes-display-inline">The chairman of the Commission shall designate the dates for the first and subsequent meetings of the Commission and may conduct Commission business in the absence of a quorum.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDEDE11E3C2BC48078852467C7E1273AA"><enum>(g)</enum><header>Additional members</header><text display-inline="yes-display-inline">During the 30-day period beginning on the date of the enactment of this Act, the chairman of the Committee on Armed Services of the Senate and the chairman of the Committee on Armed Services of the House of Representatives may jointly appoint up to three additional members to serve on the Commission on the Implementation of the New Strategic Posture of the United States established pursuant to section 1051 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3431). The appointment of the additional members of the Commission shall be made in consultation with the ranking minority members of such committees.</text></subsection></section>
