<section commented="no" display-inline="no-display-inline" id="H3243CEC4FFA549A8A9E51D8C3DDB392D" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Designation of Lewis and Clark Mount Hood wilderness areas</header><text display-inline="no-display-inline">In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the following areas in the State of Oregon are designated as wilderness areas and as components of the National Wilderness Preservation System:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HD6FDFC83530540F8ADCA157E02181457"><enum>(1)</enum><header display-inline="yes-display-inline">Badger creek wilderness additions</header><text display-inline="yes-display-inline">Certain Federal land managed by the Forest Service, comprising approximately 8,136 acres, as generally depicted on the maps entitled <quote>Badger Creek Wilderness—Badger Creek Additions</quote>, <quote>Badger Creek Wilderness—Bonney Butte</quote>, and <quote>Badger Creek Wilderness—Boulder Lake</quote>, all dated April 2008, which is incorporated in, and considered to be a part of, the Badger Creek Wilderness, as designated by section 3(3) of the Oregon Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 98 Stat. 273).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC05775FC4656456582DF4719968447FF"><enum>(2)</enum><header display-inline="yes-display-inline">Bull of the woods wilderness addition</header><text display-inline="yes-display-inline">Certain Federal land managed by the Forest Service, comprising approximately 10,183 acres, as generally depicted on the map entitled <quote>Bull of the Woods Wilderness—Bull of the Woods Additions</quote> and dated April 2008, which is incorporated in, and considered to be a part of, the Bull of the Woods Wilderness, as designated by section 3(4) of the Oregon Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 98 Stat. 273).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H50B796A94E844F23BE778F7B5694E5D9"><enum>(3)</enum><header display-inline="yes-display-inline">Clackamas wilderness</header><text display-inline="yes-display-inline">Certain Federal land managed by the Forest Service, comprising approximately 9,470 acres, as generally depicted on the maps entitled <quote>Clackamas Wilderness—Big Bottom</quote>, <quote>Clackamas Wilderness—Clackamas Canyon</quote>, <quote>Clackamas Wilderness—Memaloose Lake</quote>, <quote>Clackamas Wilderness—Sisi Butte</quote>, and <quote>Clackamas Wilderness—South Fork Clackamas</quote>, all dated April 2008, which shall be known as the <quote>Clackamas Wilderness</quote>.</text> </paragraph>

Hatfield wilderness additions</header><text>Certain Federal land managed by the Forest Service, comprising approximately 25,963 acres, as generally depicted on the maps entitled <quote>Mark O. Hatfield Wilderness—Gorge Face</quote> and <quote>Mark O. Hatfield Wilderness—Larch Mountain</quote>, all dated April 2008, which is incorporated in, and considered to be a part of, the Mark O. Hatfield Wilderness, as designated by section 3(1) of the Oregon Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 98 Stat. 273).</text> </paragraph>

Kohnstamm Memorial Area</quote>, <quote>Mount Hood Wilderness—Sand Canyon</quote>, <quote>Mount Hood Wilderness—Sandy Additions</quote>, <quote>Mount Hood Wilderness—Twin Lakes</quote>, and <quote>Mount Hood Wilderness—White River</quote>, all dated April 2008, and the map entitled <quote>Mount Hood Wilderness—Cloud Cap</quote>, dated April 2008, which is incorporated in, and considered to be a part of, the Mount Hood Wilderness, as designated under section 3(a) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132(a)</external-xref>) and enlarged by section 3(d) of the Endangered American Wilderness Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 92 Stat. 43).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6B1F949E56724CE0B1620043F8BD6630"><enum>(6)</enum><header display-inline="yes-display-inline">Salmon-huckleberry wilderness additions</header><text display-inline="yes-display-inline">Certain Federal land managed by the Forest Service, comprising approximately 53,841 acres, as generally depicted on the maps entitled <quote>Salmon-Huckleberry Wilderness—Alder Creek Additions</quote>, <quote>Salmon-Huckleberry Wilderness—Eagle Creek Addition</quote>, <quote>Salmon-Huckleberry Wilderness—Hunchback Mountain</quote>, <quote>Salmon-Huckleberry Wilderness—Inch Creek</quote>, <quote>Salmon-Huckleberry Wilderness—Mirror Lake</quote>, <quote>Salmon-Huckleberry Wilderness-Roaring River</quote>, <quote>Salmon-Huckleberry Wilderness-Salmon River <quote>Keyhole</quote></quote>, and <quote>Salmon-Huckleberry Wilderness—Salmon River Meadows</quote>, all dated April 2008, which is incorporated in, and considered to be a part of, the Salmon-Huckleberry Wilderness, as designated by section 3(2) of the Oregon Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 98 Stat. 273).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H299D4089EB524D97B900448970849295"><enum>(7)</enum><header display-inline="yes-display-inline">Lower white river wilderness</header><text display-inline="yes-display-inline">Certain Federal land managed by the Forest Service and Bureau of Land Management, comprising approximately 2,870 acres, as generally depicted on the map entitled <quote>Lower White River Wilderness—Lower White River</quote> and dated April 2008, which shall be known as the <quote>Lower White River Wilderness</quote>.</text> </paragraph></section>

Kohnstamm Memorial Area</quote> and dated April 2008, is designated as the <quote>Richard L. Kohnstamm Memorial Area</quote>.</text> </section> 
<section id="HCF6D208493214064AE4C55C946DF748B"><enum>103.</enum><header>Potential wilderness area; additions to wilderness areas</header> 
<subsection id="H3E97EFCEC10A4A7A9E64566E00CEDEB"><enum>(a)</enum><header>Roaring river potential wilderness area</header> 
<paragraph id="H910967927629424581DAA5CF41469C15"><enum>(1)</enum><header>In general</header><text>In furtherance of the purposes of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), certain Federal land managed by the Forest Service, comprising approximately 900 acres identified as <quote>Potential Wilderness</quote> on the map entitled <quote>Salmon-Huckleberry Additions: Roaring River Wilderness</quote>, dated April 2008, is designated as a potential wilderness area.</text> </paragraph> 
<paragraph id="H3B5C06E92F4243AFBB8985795FBD35C3"><enum>(2)</enum><header>Management</header><text>The potential wilderness area designated by paragraph (1) shall be managed in accordance with section 4 of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133</external-xref>).</text> </paragraph> 
<paragraph id="H9A77DA582DD645FB9B9CD451C8DC8F31"><enum>(3)</enum><header>Designation as wilderness</header><text>On the date on which the Secretary publishes in the Federal Register notice that the conditions in the potential wilderness area designated by paragraph (1) are compatible with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the potential wilderness shall be—</text> 
<subparagraph id="H4ADFF1E05711468CB98839C0308E13C6"><enum>(A)</enum><text>designated as wilderness and as a component of the National Wilderness Preservation System; and</text> </subparagraph> 
<subparagraph id="H4ED346E370E74DA4AA6E7319C0109E4"><enum>(B)</enum><text>incorporated into the Roaring River Wilderness designated by section 101(6).</text> </subparagraph></paragraph></subsection> 
<subsection id="H326314BBE3B446B785919500F0A81B11"><enum>(b)</enum><header>Addition to the Mount Hood Wilderness</header><text>On completion of the land exchange under section 202, certain Federal land managed by the Forest Service, comprising approximately 1,710 acres, as generally depicted on the map entitled <quote>Mount Hood Wilderness—Tilly Jane</quote>, dated April 2008, shall be incorporated in, and considered to be a part of, the Mount Hood Wilderness, as designated under section 3(a) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132(a)</external-xref>) and enlarged by section 3(d) of the Endangered American Wilderness Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 92 Stat. 43) and section 101(5).</text> </subsection> 
<subsection id="H66D65ABF39B54E4EA892E809DB97EC2F"><enum>(c)</enum><header>Addition to the Salmon-Huckleberry Wilderness</header><text>On acquisition by the United States, the approximately 160 acres of land identified as <quote>Land to be acquired by USFS</quote> on the map entitled <quote>Hunchback Mountain Land Exchange, Clackamas County</quote>, dated June 2006, shall be incorporated in, and considered to be a part of, the Salmon-Huckleberry Wilderness, as designated by section 3(2) of the Oregon Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 98 Stat. 273) and enlarged by section 101(7).</text> </subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HE1BCC0D9949948BA88788DBF412EF9BB" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Maps and legal descriptions</header> 
<subsection commented="no" display-inline="no-display-inline" id="HADE2F976B0644978BF00C5745E58495D"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and a legal description of each wilderness area and potential wilderness area designated by this title, with—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H47005F99A1214E39AF40E8DFEDBFB7D"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Energy and Natural Resources of the Senate; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H31D9BA75F4674E5E9C3217F63E6B95D9"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HA9C2448EBCAA414B0061DD4791A4DDDE"><enum>(b)</enum><header display-inline="yes-display-inline">Force of Law</header><text display-inline="yes-display-inline">The maps and legal descriptions filed under subsection (a) shall have the same force and effect as if included in this Act, except that the Secretary may correct typographical errors in the maps and legal descriptions.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H3625E5F0E7554ECC8EECC9D8C8F96DB3"><enum>(c)</enum><header display-inline="yes-display-inline">Public Availability</header><text display-inline="yes-display-inline">Each map and legal description filed under subsection (a) shall be on file and available for public inspection in the appropriate offices of the Forest Service and Bureau of Land Management.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H38F56971D25C44A7B8FAFB54CA87C070"><enum>(d)</enum><header display-inline="yes-display-inline">Description of land</header><text display-inline="yes-display-inline">The boundaries of the areas designated as wilderness by section 101 that are immediately adjacent to a utility right-of-way or a Federal Energy Regulatory Commission project boundary shall be 100 feet from the boundary of the right-of-way or the project boundary.</text> </subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H63124E3E189F43869D5E6C231870A313" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Administration</header> 
<subsection commented="no" display-inline="no-display-inline" id="HB992E36CD0DC45EAA4003594838B2BB4"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Subject to valid existing rights, each area designated as wilderness by this title shall be administered by the Secretary that has jurisdiction over the land within the wilderness, in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H01F1EB27B68E4CFDB4DFD54B448629B2"><enum>(1)</enum><text display-inline="yes-display-inline">any reference in that Act to the effective date shall be considered to be a reference to the date of enactment of this Act; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H76531B8B57294964B3B5322DF56C3BC9"><enum>(2)</enum><text display-inline="yes-display-inline">any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary that has jurisdiction over the land within the wilderness.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC50E07B8C7A44C7BA7DF3EE92C9B4D7F"><enum>(b)</enum><header display-inline="yes-display-inline">Incorporation of Acquired Land and Interests</header><text display-inline="yes-display-inline">Any land within the boundary of a wilderness area designated by this Act that is acquired by the United States shall—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HE8705B6C262F4AB2B8CA84B02B44E3E8"><enum>(1)</enum><text display-inline="yes-display-inline">become part of the wilderness area in which the land is located; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6C47334A3046499FBA517400F7608ED8"><enum>(2)</enum><text display-inline="yes-display-inline">be managed in accordance with this Act, the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), and any other applicable law.</text> </paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H7BC1A10A477B4D1B8C47C8121DF8B53D" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Buffer zones</header> 
<subsection commented="no" display-inline="no-display-inline" id="H1A0C1BDE85ED4078ACCC0076EEC7994C"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">As provided in the Oregon Wilderness Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/98/328">Public Law 98–328</external-xref>), Congress does not intend for designation of wilderness areas in the State under this title to lead to the creation of protective perimeters or buffer zones around each wilderness area.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H14E1A92F12A7447A90061935202F1745"><enum>(b)</enum><header display-inline="yes-display-inline">Activities or Uses up to Boundaries</header><text display-inline="yes-display-inline">The fact that nonwilderness activities or uses can be seen or heard from within a wilderness area shall not, of itself, preclude the activities or uses up to the boundary of the wilderness area.</text> </subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HFDC988FCDCEE4F609EFF2B374DF82150" section-type="subsequent-section"><enum>107.</enum><header display-inline="yes-display-inline">Fish and wildlife</header><text display-inline="no-display-inline">Nothing in this Act affects the jurisdiction or responsibilities of the State with respect to fish and wildlife.</text> </section> 
<section commented="no" display-inline="no-display-inline" id="HFE1B8BEE7306460887027267C613257C" section-type="subsequent-section"><enum>108.</enum><header display-inline="yes-display-inline">Fire, insects, and diseases</header><text display-inline="no-display-inline">As provided in section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), within the wilderness areas designated by this Act, the Secretary that has jurisdiction over the land within the wilderness (referred to in this section as the <quote>Secretary</quote>) may take such measures as are necessary to control fire, insects, and diseases, subject to such terms and conditions as the Secretary determines to be desirable and appropriate.</text> </section> 
<section commented="no" display-inline="no-display-inline" id="H645649730DEC48E880219C00CFA5E243" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Withdrawal</header><text display-inline="no-display-inline">Subject to valid rights in existence on the date of enactment of this Act, the Federal land designated as wilderness by this subtitle is withdrawn from all forms of—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H468A9197B05F449000FC0406004184BC"><enum>(1)</enum><text display-inline="yes-display-inline">entry, appropriation, or disposal under the public land laws;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA6B3E5CEF6D944F3AE5E7F6F5B902D11"><enum>(2)</enum><text display-inline="yes-display-inline">location, entry, and patent under the mining laws; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H17DA3A3E7EAE4039B3028708722CC707"><enum>(3)</enum><text display-inline="yes-display-inline">disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text> </paragraph></section></subtitle> 
<subtitle id="H1761A3BFB16847598DDAFBE8FA05D4CC"><enum>B</enum><header>Designation of streams for wild and scenic river protection in the Mount Hood area</header>

<subtitle id="H3B02D7DDE22A4CC8B3201E49DAEAE7B2"><enum>C</enum><header>Mount Hood National Recreation Area</header> 
<section commented="no" display-inline="no-display-inline" id="HA634E522FBF44325A63EC9EDBA55DDA" section-type="subsequent-section"><enum>121.</enum><header display-inline="yes-display-inline">Mount Hood National Recreation Area</header> 
<subsection commented="no" display-inline="no-display-inline" id="H190C99164F1A4DF284BE5E803627667"><enum>(a)</enum><header display-inline="yes-display-inline">Designation</header><text display-inline="yes-display-inline">To provide for the protection, preservation, and enhancement of recreational, ecological, scenic, cultural, watershed, and fish and wildlife values, there is established the Mount Hood National Recreation Area within the Mount Hood National Forest.</text> </subsection> 
<subsection id="H5BFA82095E8F4D5A9425D3C9CDB6379B"><enum>(b)</enum><header>Boundary</header><text>The Mount Hood National Recreation Area shall consist of certain Federal land managed by the Forest Service and Bureau of Land Management, comprising approximately 34,550 acres, as generally depicted on the maps entitled <quote>National Recreation Areas—Mount Hood NRA</quote>, “National Recreation Areas—Fifteenmile Creek NRA”, and <quote>National Recreation Areas—Shellrock Mountain</quote>, all dated April 2008.</text> </subsection> 
<subsection id="H06D28EFDE918413CBF4EEFD4BA00FFD5"><enum>(c)</enum><header>Map and legal description</header> 
<paragraph id="H1D12B2F3AF3941DC8833AF3C2B7D9BC"><enum>(1)</enum><header>Submission of legal description</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and a legal description of the Mount Hood National Recreation Area with—</text> 
<subparagraph id="H8BD65AFD867947269FBB0263C11765E3"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </subparagraph> 
<subparagraph id="H89AD8115F96C4BDCA429EE54AECD4E2F"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </subparagraph></paragraph> 
<paragraph id="H85FACCC56E5D456CACD0ABDE7C8B8848"><enum>(2)</enum><header>Force of law</header><text>The map and legal description filed under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary may correct typographical errors in the map and the legal description.</text> </paragraph> 
<paragraph id="HA9AB412B92E744BA87A2EEACD64F6D3"><enum>(3)</enum><header>Public availability</header><text>The map and legal description filed under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Forest Service.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H02CD25C069FF4790BA61CAF8E3E6BF"><enum>(d)</enum><header display-inline="yes-display-inline">Administration</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H558DB488E9EC49F896CD8EC5571E76C5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H041CBE2AFAD444638D40694B94B20091"><enum>(A)</enum><text display-inline="yes-display-inline">administer the Mount Hood National Recreation Area—</text> 
<clause commented="no" display-inline="no-display-inline" id="H3FBC09CD3A054C6180494FA814DD2F8F"><enum>(i)</enum><text display-inline="yes-display-inline">in accordance with the laws (including regulations) and rules applicable to the National Forest System; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H3B03657AAD8E40D78343D88D7246DF01"><enum>(ii)</enum><text display-inline="yes-display-inline">consistent with the purposes described in subsection (a); and</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEF436769BCB048EC903B49E63E249EDA"><enum>(B)</enum><text display-inline="yes-display-inline">only allow uses of the Mount Hood National Recreation Area that are consistent with the purposes described in subsection (a).</text> </subparagraph></paragraph> 
<paragraph id="H0FBC13625C244D1497E2B7E54C600007"><enum>(2)</enum><header>Applicable law</header><text>Any portion of a wilderness area designated by subtitle A that is located within the Mount Hood National Recreation Area shall be administered in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>).</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC242E34E67904B16B83BD098F51972C"><enum>(e)</enum><header display-inline="yes-display-inline">Timber</header><text display-inline="yes-display-inline">The cutting, sale, or removal of timber within the Mount Hood National Recreation Area may be permitted—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H76BA7F89FF094809891FB3809D75DB00"><enum>(1)</enum><text display-inline="yes-display-inline">to the extent necessary to improve the health of the forest in a manner that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0B6BBA4FCF9C42329DE335D641F8BD7"><enum>(A)</enum><text display-inline="yes-display-inline">maximizes the retention of large trees—</text> 
<clause commented="no" display-inline="no-display-inline" id="H85CBC0BFC296405F83FB21B589157DB0"><enum>(i)</enum><text display-inline="yes-display-inline">as appropriate to the forest type; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H704FCAF2D42E4AA88E5907395DCCBBD0"><enum>(ii)</enum><text display-inline="yes-display-inline">to the extent that the trees promote stands that are fire-resilient and healthy;</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2289B37641A14D2FA716106B37628361"><enum>(B)</enum><text display-inline="yes-display-inline">improves the habitats of threatened, endangered, or sensitive species; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H6F4E0E65C3FB41C6BA9F10CD04A4E601"><enum>(C)</enum><text display-inline="yes-display-inline">maintains or restores the composition and structure of the ecosystem by reducing the risk of uncharacteristic wildfire;</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H48024A3A7F81483AA5F918B5D8E37997"><enum>(2)</enum><text display-inline="yes-display-inline">to accomplish an approved management activity in furtherance of the purposes established by this subtitle, if the cutting, sale, or removal of timber is incidental to the management activity; or</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8B33F17DECC44C29B9656ED78FFC576"><enum>(3)</enum><text display-inline="yes-display-inline">for de minimus personal or administrative use within the Mount Hood National Recreation Area, where such use will not impair the purposes established by this subtitle.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H4D7FDBD670924140ADC5FA4493B30052"><enum>(f)</enum><header display-inline="yes-display-inline">Road construction</header><text display-inline="yes-display-inline">No new or temporary roads shall be constructed or reconstructed within the Mount Hood National Recreation Area except as necessary—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H328123EEC4D8492F87EF99448754E97"><enum>(1)</enum><text display-inline="yes-display-inline">to protect the health and safety of individuals in cases of an imminent threat of flood, fire, or any other catastrophic event that, without intervention, would cause the loss of life or property;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE16D55EBA26142868838CFA428BF185C"><enum>(2)</enum><text display-inline="yes-display-inline">to conduct environmental cleanup required by the United States;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H076EB92677C8400600CC8500F36CC6CD"><enum>(3)</enum><text display-inline="yes-display-inline">to allow for the exercise of reserved or outstanding rights provided for by a statute or treaty;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD99CA34FC8404E4797000084C59F8301"><enum>(4)</enum><text display-inline="yes-display-inline">to prevent irreparable resource damage by an existing road; or</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC27CE08A15B141009286DAF614F86E01"><enum>(5)</enum><text display-inline="yes-display-inline">to rectify a hazardous road condition.</text> </paragraph></subsection> 
<subsection id="H6A30CF453A614361B67B76C8D24618AE"><enum>(g)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land within the Mount Hood National Recreation Area is withdrawn from—</text> 
<paragraph id="HFF3A06345CFA451FBD2EBFBFC27D009E"><enum>(1)</enum><text>all forms of entry, appropriation, or disposal under the public land laws;</text> </paragraph> 
<paragraph id="H9D4CD8956A7A4F72A003A6576C671BC0"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text> </paragraph>

<subsection id="HC1ACE98DC56541B89B142CB734EE4E80"><enum>(h)</enum><header>Transfer of administrative jurisdiction</header> 
<paragraph id="H9C1CCECD1A764E9A88E934DB4D6E9B9D"><enum>(1)</enum><header>In general</header><text>Administrative jurisdiction over the Federal land described in paragraph (2) is transferred from the Bureau of Land Management to the Forest Service.</text> </paragraph> 
<paragraph id="HAE978CD1CD3041538FAF6496B6A3A94E"><enum>(2)</enum><header>Description of land</header><text>The land referred to in paragraph (1) is the approximately 130 acres of land administered by the Bureau of Land Management within or adjacent to the Mount Hood National Recreation Area that is identified as <quote>BLM Lands</quote> on the map entitled <quote>National Recreation Areas—Shellrock Mountain</quote>, dated April 2008.</text> </paragraph></subsection></section></subtitle>

<section id="H42B1DC524FCD4C2788543E391E34D2B0"><enum>131.</enum><header>Crystal Springs Watershed Special Resources Management Unit</header> 
<subsection id="H2F3CED65277D4F9186E253C378405B5D"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H03439436BFAA4A91B35F13E1542970AA"><enum>(1)</enum><header>In general</header><text>On completion of the land exchange under section 202, there shall be established a special resources management unit in the State consisting of certain Federal land managed by the Forest Service, as generally depicted on the map entitled <quote>Crystal Springs Watershed Special Resources Management Unit</quote>, dated June 2006 (referred to in this section as the <quote>map</quote>), to be known as the <quote>Crystal Springs Watershed Special Resources Management Unit</quote> (referred to in this section as the <quote>Management Unit</quote>).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB7FE5AB308B74C088CD72BD2DE16248"><enum>(2)</enum><header display-inline="yes-display-inline">Exclusion of Certain Land</header><text display-inline="yes-display-inline">The Management Unit does not include any National Forest System land otherwise covered by paragraph (1) that is designated as wilderness by subtitle A.</text> </paragraph> 
<paragraph id="H6E176ABE7C6642BC81E135C36F009250"><enum>(3)</enum><header>Withdrawal</header> 
<subparagraph id="H4187D361C3F14870992CCB21C35B346C"><enum>(A)</enum><header>In general</header><text>Subject to valid rights in existence on the date of enactment of this Act, the Federal land designated as the Management Unit is withdrawn from all forms of—</text> 
<clause id="HF6CF007E158243F3B865CFCAB48F69E"><enum>(i)</enum><text>entry, appropriation, or disposal under the public land laws;</text> </clause> 
<clause id="H823F15DA7DA14026AE9C5C461383323E"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text> </clause> 
<clause id="HF1BC7D7E613549E5A7F4E78D8004D17"><enum>(iii)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text> </clause></subparagraph> 
<subparagraph id="HB71ED5D002894A99BEB5F0F7FD1C1539"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A)(i) does not apply to the parcel of land generally depicted as <quote>HES 151</quote> on the map.</text> </subparagraph></paragraph></subsection> 
<subsection id="H08C21BF4048D4F06B7FF00032F092BF0"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Management Unit are—</text> 
<paragraph id="H3E431843655942D1896841F9B147AB28"><enum>(1)</enum><text>to ensure the protection of the quality and quantity of the Crystal Springs watershed as a clean drinking water source for the residents of Hood River County, Oregon; and</text> </paragraph> 
<paragraph id="H9E744D73CA174DAD846FFC6486DF30A9"><enum>(2)</enum><text>to allow visitors to enjoy the special scenic, natural, cultural, and wildlife values of the Crystal Springs watershed.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H2428A12ABDAD47DA92001B71EFE1F7CE"><enum>(c)</enum><header display-inline="yes-display-inline">Map and Legal Description</header> 
<paragraph id="H9AF2975D05F2480ABF4EDC7229934107"><enum>(1)</enum><header>Submission of legal description</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and a legal description of the Management Unit with—</text> 
<subparagraph id="HB5E8085A24AD4B71A475323165ED8923"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </subparagraph> 
<subparagraph id="HA44ED0250FE740EC98614D2F279F611B"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </subparagraph></paragraph> 
<paragraph id="HB0E70479A736494DBED7B96EC9C93D1E"><enum>(2)</enum><header>Force of law</header><text>The map and legal description filed under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary may correct typographical errors in the map and legal description.</text> </paragraph> 
<paragraph id="H5EBB8AA0688E45A9BB4700C0AE5F6F42"><enum>(3)</enum><header>Public availability</header><text>The map and legal description filed under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Forest Service.</text> </paragraph></subsection> 
<subsection id="H6BFF6461BD5C4F8C9CDDCFD375ACC376"><enum>(d)</enum><header>Administration</header> 
<paragraph id="H731F5EEB4C494CF9AD8C5B58070898EB"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text> 
<subparagraph id="H402DCAA175A44AABA9823F00FDBF300"><enum>(A)</enum><text>administer the Management Unit—</text> 
<clause id="H4B9B7B6462F540949706D0085BA9FD44"><enum>(i)</enum><text>in accordance with the laws (including regulations) and rules applicable to units of the National Forest System; and</text> </clause> 
<clause id="H2EBE2000966E44E5945876BF5982A557"><enum>(ii)</enum><text>consistent with the purposes described in subsection (b); and</text> </clause></subparagraph> 
<subparagraph id="H61133454A7E0449587D3F9F26B952D43"><enum>(B)</enum><text>only allow uses of the Management Unit that are consistent with the purposes described in subsection (b).</text> </subparagraph></paragraph> 
<paragraph id="H77E9C3BBC32C463FB8F4FE164380EC67"><enum>(2)</enum><header>Fuel reduction in proximity to improvements and primary public roads</header><text>To protect the water quality, water quantity, and scenic, cultural, natural, and wildlife values of the Management Unit, the Secretary may conduct fuel reduction and forest health management treatments to maintain and restore fire-resilient forest structures containing late successional forest structure characterized by large trees and multistoried canopies, as ecologically appropriate, on National Forest System land in the Management Unit—</text> 
<subparagraph id="HCEC894A9625C47A3A8C8526EDDAED5FF"><enum>(A)</enum><text>in any area located not more than 400 feet from structures located on—</text> 
<clause id="H0BDF8C0E164948429920893E83A6D518"><enum>(i)</enum><text>National Forest System land; or</text> </clause> 
<clause id="H2F964A23E0EA49ECBBA0F0944B11B8A6"><enum>(ii)</enum><text>private land adjacent to National Forest System land;</text> </clause></subparagraph> 
<subparagraph id="H0955F9F514674C87986E5868E7C24F2B"><enum>(B)</enum><text>in any area located not more than 400 feet from the Cooper Spur Road, the Cloud Cap Road, or the Cooper Spur Ski Area Loop Road; and</text> </subparagraph> 
<subparagraph id="HB97AFBE39F284AEFB89C2D3DF45BB01F"><enum>(C)</enum><text>on any other National Forest System land in the Management Unit, with priority given to activities that restore previously harvested stands, including the removal of logging slash, smaller diameter material, and ladder fuels.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H033C0215A6F84A06924226669FBBA1DB"><enum>(3)</enum><header>Prohibited activities</header><text>Subject to valid existing rights, the following activities shall be prohibited on National Forest System land in the Management Unit:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2593A842F9524BA68BFDAE753761B500"><enum>(A)</enum><text display-inline="yes-display-inline">New road construction or renovation of existing non-System roads, except as necessary to protect public health and safety.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB57A6B6886A4475E923ED080B29CA203"><enum>(B)</enum><text display-inline="yes-display-inline">Projects undertaken for the purpose of harvesting commercial timber (other than activities relating to the harvest of merchantable products that are byproducts of activities conducted to further the purposes described in subsection (b)).</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H959A145ACD35402DB8CD25981ED0BE38"><enum>(C)</enum><text display-inline="yes-display-inline">Commercial livestock grazing.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0F7F8645BB7543F9AD8EBF6F5E001066"><enum>(D)</enum><text display-inline="yes-display-inline">The placement of new fuel storage tanks.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4BF27D4243DC4B308419E7BF4C4830F3"><enum>(E)</enum><text display-inline="yes-display-inline">Except to the extent necessary to further the purposes described in subsection (b), the application of any toxic chemicals (other than fire retardants), including pesticides, rodenticides, or herbicides.</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HB3EC56F6FB824A709CE87D1D03FDC4D7"><enum>(e)</enum><header display-inline="yes-display-inline">Forest Road Closures</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H86B9858960F344389F34052DEAFCC112"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Secretary may provide for the closure or gating to the general public of any Forest Service road within the Management Unit.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H93F5A70218704786AC012EEFF77B2D59"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Nothing in this section requires the Secretary to close the road commonly known as <quote>Cloud Cap Road</quote>, which shall be administered in accordance with otherwise applicable law.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC5B25D521DB94CF2ADAA9C98EF8DE24"><enum>(f)</enum><header display-inline="yes-display-inline">Private Land</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H9BB2EB35E0B24DD98324414F00C09C6E"><enum>(1)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this section affects the use of, or access to, any private property within the area identified on the map as the <quote>Crystal Springs Zone of Contribution</quote> by—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7CB2246A0B5D47C59D2882009DA1DC12"><enum>(A)</enum><text display-inline="yes-display-inline">the owners of the private property; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF745C5169B7A43B9B407C50D5CE7C4D"><enum>(B)</enum><text display-inline="yes-display-inline">guests to the private property.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H13B7BDE2DD1944B9B7168FE03CA774F2"><enum>(2)</enum><header>Cooperation</header><text display-inline="yes-display-inline">The Secretary is encouraged to work with private landowners who have agreed to cooperate with the Secretary to further the purposes of this section.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HCA95444F139F4BAE899923B440E09CDA"><enum>(g)</enum><header display-inline="yes-display-inline">Acquisition of land</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H09E7FD299294445293EF6A983D81E34"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may acquire from willing landowners any land located within the area identified on the map as the <quote>Crystal Springs Zone of Contribution</quote>.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE554E23FB6CD4B249C133FE13D886FA2"><enum>(2)</enum><header>Inclusion in management unit</header><text display-inline="yes-display-inline">On the date of acquisition, any land acquired under paragraph (1) shall be incorporated in, and be managed as part of, the Management Unit.</text> </paragraph></subsection></section> 
<section id="H62982FC8212F464D910282A8A1188087"><enum>132.</enum><header>Protections for Upper Big Bottom and Cultus Creek</header> 
<subsection id="H49CB55DC4F924797AD00C5CEAE27E47F"><enum>(a)</enum><header>In general</header><text>The Secretary shall manage the Federal land administered by the Forest Service described in subsection (b) in a manner that preserves the natural and primitive character of the land for recreational, scenic, and scientific use.</text> </subsection> 
<subsection id="HAA65D53BE4EE46AEBC989371486D49C9"><enum>(b)</enum><header>Description of land</header><text>The Federal land referred to in subsection (a) is—</text> 
<paragraph id="HED2444D9E7DA4526A7CEE301AC976F30"><enum>(1)</enum><text>the approximately 1,580 acres, as generally depicted on the map entitled <quote>Upper Big Bottom</quote>, dated April 2008; and</text> </paragraph> 
<paragraph id="H9FC76E3875694A1200E9001FBC82B984"><enum>(2)</enum><text>the approximately 280 acres identified as <quote>Cultus Creek</quote> on the map entitled <quote>Clackamas Wilderness—South Fork Clackamas</quote>, dated April 2008.</text> </paragraph></subsection> 
<subsection id="H2F608FEEEA0245BC96772E8B40965C39"><enum>(c)</enum><header>Maps and legal descriptions</header> 
<paragraph id="HD61A47916E054DE5AF00B62F39DF94D"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall file maps and legal descriptions of the Federal land described in subsection (b) with—</text> 
<subparagraph id="H947FF14D70584522A6155D5914D152C"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </subparagraph> 
<subparagraph id="H3D642CA550904661877763581C9405DC"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </subparagraph></paragraph> 
<paragraph id="H68973F0A2C88401EBF7427CA005EB1D3"><enum>(2)</enum><header>Force of law</header><text>The maps and legal descriptions filed under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary may correct typographical errors in the maps and legal descriptions.</text> </paragraph> 
<paragraph id="HEE309FF6746C44288DBAE5A4ED224CA3"><enum>(3)</enum><header>Public availability</header><text>Each map and legal description filed under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Forest Service.</text> </paragraph></subsection> 
<subsection id="H7660914EFA384DD390C787515D6C323C"><enum>(d)</enum><header>Use of land</header> 
<paragraph id="H708A8FBEFE4A4CACAFF412A3BDDE7E50"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights, with respect to the Federal land described in subsection (b), the Secretary shall only allow uses that are consistent with the purposes identified in subsection (a).</text> </paragraph> 
<paragraph id="H6B70F56C8D344BAD9D46C57F00308900"><enum>(2)</enum><header>Prohibited uses</header><text>The following shall be prohibited on the Federal land described in subsection (b):</text> 
<subparagraph id="HAF50D42BC37D498280FD5232E9FB96B"><enum>(A)</enum><text>Permanent roads.</text> </subparagraph> 
<subparagraph id="HF5780CCDA7D64C00BF00C40770693534"><enum>(B)</enum><text>Commercial enterprises.</text> </subparagraph> 
<subparagraph id="H5CF489D7960C40CBB67C31A1927ECA96"><enum>(C)</enum><text>Except as necessary to meet the minimum requirements for the administration of the Federal land and to protect public health and safety—</text> 
<clause id="H258EC6D2A41A4C1FB0C17255AEAA0039"><enum>(i)</enum><text>the use of motor vehicles; or</text> </clause> 
<clause id="H5E2ACA81F88B4D229414C11325926D30"><enum>(ii)</enum><text>the establishment of temporary roads.</text> </clause></subparagraph></paragraph></subsection> 
<subsection id="H830A05E9756D43C9A687C515F896DFE"><enum>(e)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the Federal land described in subsection (b) is withdrawn from—</text> 
<paragraph id="H2FDAE83B52094920A99600EA3EA3D480"><enum>(1)</enum><text>all forms of entry, appropriation, or disposal under the public land laws;</text> </paragraph> 
<paragraph id="H369D8941B78546B9A8540329A8A3AC68"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text> </paragraph> 
<paragraph id="H1EF97FE5B904488DB896ED91B286AC08"><enum>(3)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text> </paragraph></subsection></section></subtitle></title>

<paragraph commented="no" display-inline="no-display-inline" id="HFEBA7832DA754D7EA7104E0826FFA060"><enum>(1)</enum><header display-inline="yes-display-inline">County</header><text display-inline="yes-display-inline">The term <term>County</term> means Hood River County, Oregon.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HDC7CCB4E2C5A4781B0865FFF9D865CC"><enum>(2)</enum><header display-inline="yes-display-inline">Exchange map</header><text display-inline="yes-display-inline">The term <term>exchange map</term> means the map entitled <quote>Cooper Spur/Government Camp Land Exchange</quote>, dated June 2006.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HFAF09B3175FC4DBC92465E6C19C5473D"><enum>(3)</enum><header display-inline="yes-display-inline">Federal land</header><text display-inline="yes-display-inline">The term <term>Federal land</term> means the approximately 120 acres of National Forest System land in the Mount Hood National Forest in Government Camp, Clackamas County, Oregon, identified as <quote>USFS Land to be Conveyed</quote> on the exchange map.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD6E089B20F0F477300B487E9D025C29E"><enum>(4)</enum><header display-inline="yes-display-inline">Mt. Hood Meadows</header><text display-inline="yes-display-inline">The term <term>Mt. Hood Meadows</term> means the Mt. Hood Meadows Oregon, Limited Partnership.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6A32D29EBDD8432AA32DE41CA0D8DFC5"><enum>(5)</enum><header display-inline="yes-display-inline">Non-federal land</header><text display-inline="yes-display-inline">The term <term>non-Federal land</term> means—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEA9483A63E244F099984449B025C8E73"><enum>(A)</enum><text display-inline="yes-display-inline">the parcel of approximately 770 acres of private land at Cooper Spur identified as <quote>Land to be acquired by USFS</quote> on the exchange map; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE07CF2545D334519008BA7AC61FBDA74"><enum>(B)</enum><text display-inline="yes-display-inline">any buildings, furniture, fixtures, and equipment at the Inn at Cooper Spur and the Cooper Spur Ski Area covered by an appraisal described in section 202(d).</text> </subparagraph></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H3105854D973944128F68CB378896FF5F"><enum>202.</enum><header display-inline="yes-display-inline">Cooper Spur-Government Camp land exchange</header> 
<subsection commented="no" display-inline="no-display-inline" id="HD5C2C1291943408DB1EF8852395415AE"><enum>(a)</enum><header display-inline="yes-display-inline">Conveyance of land</header><text display-inline="yes-display-inline">Subject to the provisions of this section, if Mt. Hood Meadows offers to convey to the United States all right, title, and interest of Mt. Hood Meadows in and to the non-Federal land, the Secretary shall convey to Mt. Hood Meadows all right, title, and interest of the United States in and to the Federal land (other than any easements reserved under subsection (g)), subject to valid existing rights.</text> </subsection> 
<subsection id="HCEE7647814B547919300AE958BCCFCD6"><enum>(b)</enum><header>Compliance with existing law</header><text>Except as otherwise provided in this section, the Secretary shall carry out the land exchange under this section in accordance with section 206 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>).</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H29FAD73044AF4D81A566B1568D190099"><enum>(c)</enum><header display-inline="yes-display-inline">Conditions on acceptance</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HA1622B2A269C4274BB948F20ED10BB79"><enum>(1)</enum><header>Title</header><text display-inline="yes-display-inline">As a condition of the land exchange under this section, title to the non-Federal land to be acquired by the Secretary under this section shall be acceptable to the Secretary.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H99F6E3794D574EA2801D508262C97EEB"><enum>(2)</enum><header>Terms and conditions</header><text display-inline="yes-display-inline">The conveyance of the Federal land and non-Federal land shall be subject to such terms and conditions as the Secretary may require.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H4961E98E54A34447AB1CE01200D75D62"><enum>(d)</enum><header display-inline="yes-display-inline">Appraisals</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HC066A23332E34B40B4B95E00BB6FD541"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary and Mt. Hood Meadows shall select an appraiser to conduct an appraisal of the Federal land and non-Federal land.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H0239D603A39E4739B89832A0BC48DFB2"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">An appraisal under paragraph (1) shall be conducted in accordance with nationally recognized appraisal standards, including—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H1FF4AC83DF67451AB131BFD8246C6AF"><enum>(A)</enum><text display-inline="yes-display-inline">the Uniform Appraisal Standards for Federal Land Acquisitions; and</text> </subparagraph>

<subsection commented="no" display-inline="no-display-inline" id="HD42BE932762E462EADD7435441159BDA"><enum>(g)</enum><header display-inline="yes-display-inline">Reservation of easements</header><text display-inline="yes-display-inline">As a condition of the conveyance of the Federal land, the Secretary shall reserve—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H446C3EA8DBAC4F5685F28C4DABD47EFE"><enum>(1)</enum><text display-inline="yes-display-inline">a conservation easement to the Federal land to protect existing wetland, as identified by the Oregon Department of State Lands, that allows equivalent wetland mitigation measures to compensate for minor wetland encroachments necessary for the orderly development of the Federal land; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H87719E2DD6F54FC8898C8FA4FA4922BF"><enum>(2)</enum><text display-inline="yes-display-inline">a trail easement to the Federal land that allows—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB490EDDD47E14FAEB690A4BBFC65009B"><enum>(A)</enum><text display-inline="yes-display-inline">nonmotorized use by the public of existing trails;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC80F5A141E0E4FFAB6A07D4D2F60785F"><enum>(B)</enum><text display-inline="yes-display-inline">roads, utilities, and infrastructure facilities to cross the trails; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9C712AA986914214A8B82DF98B07658D"><enum>(C)</enum><text display-inline="yes-display-inline">improvement or relocation of the trails to accommodate development of the Federal land.</text> </subparagraph></paragraph></subsection></section></subtitle>

<paragraph commented="no" display-inline="no-display-inline" id="H7D55AC691572471692B0B80083B721E1"><enum>(1)</enum><header display-inline="yes-display-inline">Exchange map</header><text display-inline="yes-display-inline">The term <term>exchange map</term> means the map entitled <quote>Port of Cascade Locks/Pacific Crest National Scenic Trail Land Exchange</quote>, dated June 2006.</text> </paragraph>

<subsection commented="no" display-inline="no-display-inline" id="H039CAEB296DA4FFDB3DD405CA9EB952C"><enum>(a)</enum><header display-inline="yes-display-inline">Conveyance of land</header><text display-inline="yes-display-inline">Subject to the provisions of this section, if the Port offers to convey to the United States all right, title, and interest of the Port in and to the non-Federal land, the Secretary shall, subject to valid existing rights, convey to the Port all right, title, and interest of the United States in and to the Federal land.</text> </subsection>

<subsection commented="no" display-inline="no-display-inline" id="H76261C70B1214CC2B7D2B0E10400F45C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The boundary of the Mount Hood National Forest shall be adjusted to incorporate—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H7C37A0C4C5BE4E419FEA7800A452267"><enum>(1)</enum><text display-inline="yes-display-inline">any land conveyed to the United States under section 222; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H577F852C2175425CBEA9BDE33F690400"><enum>(2)</enum><text display-inline="yes-display-inline">the land transferred to the Forest Service by section 121(h)(1).</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC3900DD36BF0472E98FB21F039530865"><enum>(b)</enum><header display-inline="yes-display-inline">Additions to the National Forest System</header><text display-inline="yes-display-inline">The Secretary shall administer the land described in subsection (a)—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H43872F3FAA30466BB52BB60DDC03111"><enum>(1)</enum><text display-inline="yes-display-inline">in accordance with—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFFD12C2E97D8429595E17C96A0D00095"><enum>(A)</enum><text display-inline="yes-display-inline">the Act of March 1, 1911 (commonly known as the <quote>Weeks Law</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/480">16 U.S.C. 480 et seq.</external-xref>); and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDC79FA6047914C779EB231A059600DD"><enum>(B)</enum><text display-inline="yes-display-inline">any laws (including regulations) applicable to the National Forest System; and</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H403C74FF1E6C49E89D8C15D318923E8C"><enum>(2)</enum><text>subject to sections 103(c) and 121(d), as applicable.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1D02F47AE9BC40B09082E11094FB51E"><enum>(c)</enum><header display-inline="yes-display-inline">Land and Water Conservation Fund</header><text display-inline="yes-display-inline">For the purposes of section 7 of the Land and Water Conservation Fund Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-9">16 U.S.C. 460<italic>l</italic>–9</external-xref>), the boundaries of the Mount Hood National Forest modified by this Act shall be considered to be the boundaries of the Mount Hood National Forest in existence as of January 1, 1965.</text> </subsection></section></subtitle> 
<subtitle id="HBBF37F7B5C5D4099A11F4FA006AC40BE"><enum>D</enum><header>Conditions on development of Federal land</header> 
<section commented="no" display-inline="no-display-inline" id="HD33550E79DFE494A92191B57D24081A2"><enum>231.</enum><header display-inline="yes-display-inline">Improved natural disaster preparedness</header> 
<subsection id="H5DE190D9C5DE4784B2BECD2964A0AF75"><enum>(a)</enum><header>Requirements applicable to the conveyance of Federal land</header> 
<paragraph id="H183436E54150485DB870C55DE6012521"><enum>(1)</enum><header>In general</header><text>As a condition of each of the conveyances of Federal land under this title, the Secretary shall include in the deed of conveyance a requirement that applicable construction activities and alterations shall be conducted in accordance with—</text> 
<subparagraph id="H9587682DCB154BC2A2B7125596924EC"><enum>(A)</enum><text>nationally recognized building and property maintenance codes; and</text> </subparagraph> 
<subparagraph id="H450CA4821C2748BE8F931E4EA51B4DAA"><enum>(B)</enum><text>nationally recognized codes for development in the wildland-urban interface and wildfire hazard mitigation.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H11DB86F3001942D1842043451711BFA"><enum>(2)</enum><header display-inline="yes-display-inline">Applicable law</header><text display-inline="yes-display-inline">To the maximum extent practicable, the codes required under paragraph (1) shall be consistent with the nationally recognized codes adopted or referenced by the State or political subdivisions of the State.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBF75B2AAA7C943518575F65DB210ECB2"><enum>(3)</enum><header>Enforcement</header><text>The requirements under paragraph (1) may be enforced by the same entities otherwise enforcing codes, ordinances, and standards.</text> </paragraph></subsection> 
<subsection id="H8D1FD2B082774F76BE975F298E624B68"><enum>(b)</enum><header>Compliance with codes on Federal land</header><text>The Secretary shall ensure that applicable construction activities and alterations undertaken or permitted by the Secretary on National Forest System land in the Mount Hood National Forest are conducted in accordance with—</text> 
<paragraph id="HE64DF994F2934C3EB54F98386D933C65"><enum>(1)</enum><text>nationally recognized building and property maintenance codes; and</text> </paragraph> 
<paragraph id="H0DEDB0B77845487D9579C2D800E20002"><enum>(2)</enum><text>nationally recognized codes for development in the wildland-urban interface development and wildfire hazard mitigation.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H7C0893C350F54064B8F497FDECA69919"><enum>(c)</enum><header display-inline="yes-display-inline">Effect on enforcement by States and political subdivisions</header><text display-inline="yes-display-inline">Nothing in this section alters or limits the power of the State or a political subdivision of the State to implement or enforce any law (including regulations), rule, or standard relating to development or fire prevention and control.</text> </subsection></section></subtitle></title> 
<title commented="no" id="HB6BFF36FCA6A486B9B8C69E4E4044489" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">Tribal provisions; planning and studies</header>

<subsection commented="no" display-inline="no-display-inline" id="HF15823F660BA4F03AEAA6D9FBDC3C598"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">The Secretary shall seek to participate in the development of an integrated, multimodal transportation plan developed by the Oregon Department of Transportation for the Mount Hood region to achieve comprehensive solutions to transportation challenges in the Mount Hood region—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HE13EE8E462944840A0BB884927C2B78B"><enum>(1)</enum><text display-inline="yes-display-inline">to promote appropriate economic development;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H829CDCB41469460F8455C2EAC28F428"><enum>(2)</enum><text display-inline="yes-display-inline">to preserve the landscape of the Mount Hood region; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7F37331B85544792AD18A4652DACD6D8"><enum>(3)</enum><text display-inline="yes-display-inline">to enhance public safety.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H803F897044B24A4FB98F6CAF7267732B"><enum>(b)</enum><header display-inline="yes-display-inline">Issues To Be addressed</header><text display-inline="yes-display-inline">In participating in the development of the transportation plan under subsection (a), the Secretary shall seek to address—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HFDCBCF9325164103A9B43D6DE6A4569B"><enum>(1)</enum><text display-inline="yes-display-inline">transportation alternatives between and among recreation areas and gateway communities that are located within the Mount Hood region;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD4E7E92D96E6497BB5802923ADA499D7"><enum>(2)</enum><text display-inline="yes-display-inline">establishing park-and-ride facilities that shall be located at gateway communities;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H1C6B6C7F17B84F1AAFC3F2114F149188"><enum>(3)</enum><text display-inline="yes-display-inline">establishing intermodal transportation centers to link public transportation, parking, and recreation destinations;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H83CCABF2B2654CCF98CEE9B74801BA83"><enum>(4)</enum><text display-inline="yes-display-inline">creating a new interchange on Oregon State Highway 26 located adjacent to or within Government Camp;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA38FC04037E54CF6864898B2C972EF3"><enum>(5)</enum><text display-inline="yes-display-inline">designating, maintaining, and improving alternative routes using Forest Service or State roads for—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDB643AF499A04C2BBDAD4F7D00F6D7DD"><enum>(A)</enum><text display-inline="yes-display-inline">providing emergency routes; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD4FAACA043D340B4AC28799293097EB7"><enum>(B)</enum><text display-inline="yes-display-inline">improving access to, and travel within, the Mount Hood region;</text> </subparagraph></paragraph> 
<paragraph id="H196C12399BBD42AAB939919C9FC31C29"><enum>(6)</enum><text>the feasibility of establishing—</text> 
<subparagraph id="H82755F53C61A49D3961BE2BCA37C0D5"><enum>(A)</enum><text>a gondola connection that—</text> 
<clause id="HE074BCAABE7741F9948B4FE2CE9D599C"><enum>(i)</enum><text>connects Timberline Lodge to Government Camp; and</text> </clause> 
<clause id="HC04B8FAECA0A468A8606B264CEB18D47"><enum>(ii)</enum><text>is located in close proximity to the site of the historic gondola corridor; and</text> </clause></subparagraph> 
<subparagraph id="H21A8240F827541BCAB944E549D6EFDCF"><enum>(B)</enum><text>an intermodal transportation center to be located in close proximity to Government Camp;</text> </subparagraph></paragraph> 
<paragraph id="HAE852430332B45A7BE852B716F1FC824"><enum>(7)</enum><text>burying power lines located in, or adjacent to, the Mount Hood National Forest along Interstate 84 near the City of Cascade Locks, Oregon; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H209C492372B4462EB700D274004100FB"><enum>(8)</enum><text display-inline="yes-display-inline">creating mechanisms for funding the implementation of the transportation plan under subsection (a), including—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB5FEE1718F8A49D28B213F2D597EF332"><enum>(A)</enum><text display-inline="yes-display-inline">funds provided by the Federal Government;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD77A5A0A0F80433ABC4C5530DED1002E"><enum>(B)</enum><text display-inline="yes-display-inline">public-private partnerships;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3E635DB2491F4946AA8F4F0000B00060"><enum>(C)</enum><text display-inline="yes-display-inline">incremental tax financing; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFDC06F0CD36F462AA256B56F3528CB04"><enum>(D)</enum><text display-inline="yes-display-inline">other financing tools that link transportation infrastructure improvements with development.</text> </subparagraph></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H8105B1DE4B744A579CEA59A7C27D5924" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Mount Hood National Forest stewardship strategy</header> 
<subsection id="HCEFB42078C314F2487BD54A39BF49C6F"><enum>(a)</enum><header>In general</header><text>The Secretary shall prepare a report on, and implementation schedule for, the vegetation management strategy (including recommendations for biomass utilization) for the Mount Hood National Forest being developed by the Forest Service.</text> </subsection> 
<subsection id="H5DCD5E3D024B49A89E0118BEF4DB3E0"><enum>(b)</enum><header>Submission to Congress</header> 
<paragraph id="HF5D2C23226424D4488BE26BE03C1A785"><enum>(1)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit the report to—</text> 
<subparagraph id="H4A75DCCDD0CE40C0BF1FE36049AB00E8"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </subparagraph> 
<subparagraph id="H042E314F364546AF93C8442727953F98"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </subparagraph></paragraph> 
<paragraph id="H5AE4F3FA2AF245EFA6A9707BBBDC6BEC"><enum>(2)</enum><header>Implementation schedule</header><text>Not later than 1 year after the date on which the vegetation management strategy referred to in subsection (a) is completed, the Secretary shall submit the implementation schedule to—</text> 
<subparagraph id="H1CA7A151D97C4401A307BA6E768BF56B"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </subparagraph> 
<subparagraph id="H4076B67EC64845A982F7C0293A1C69D"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </subparagraph></paragraph></subsection></section> 
<section id="H0BAEC87CDC92436B8ECADE2B0D0B0B6"><enum>303.</enum><header>Local and tribal relationships</header> 
<subsection commented="no" display-inline="no-display-inline" id="H07ED73E7B63340DEA6D24B37D0FE357B"><enum>(a)</enum><header display-inline="yes-display-inline">Management plan</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HD3755CF6D802481B008DAF00BBA7BD5D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with Indian tribes with treaty-reserved gathering rights on land encompassed by the Mount Hood National Forest and in a manner consistent with the memorandum of understanding entered into between the Department of Agriculture, the Bureau of Land Management, the Bureau of Indian Affairs, and the Confederated Tribes of the Warm Springs Reservation of Oregon, dated April 25, 2003, as modified, shall develop and implement a management plan that meets the cultural foods obligations of the United States under applicable treaties, including the Treaty with the Tribes of Middle Oregon of June 25, 1855 (12 Stat. 963).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H4F71EC42F6DB452FA7CAC141B9598425"><enum>(2)</enum><header>Effect</header><text display-inline="yes-display-inline">This subsection shall be considered to be consistent with, and is intended to implement, the gathering rights reserved by the treaty described in paragraph (1).</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H343C808111A547ACAF8EA4EBCFD56544"><enum>(b)</enum><header display-inline="yes-display-inline">Savings provisions regarding relations with Indian tribes</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HF7179E17399D4A5396BFA1F82F25C900"><enum>(1)</enum><header display-inline="yes-display-inline">Treaty Rights</header><text display-inline="yes-display-inline">Nothing in this Act alters, modifies, enlarges, diminishes, or extinguishes the treaty rights of any Indian tribe, including the off-reservation reserved rights established by the Treaty with the Tribes of Middle Oregon of June 25, 1855 (12 Stat. 963).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8EFD02E5E7A5451AB4A0B689B7753519"><enum>(2)</enum><header display-inline="yes-display-inline">Tribal Land</header><text display-inline="yes-display-inline">Nothing in this Act affects land held in trust by the Secretary of the Interior for Indian tribes or individual members of Indian tribes or other land acquired by the Army Corps of Engineers and administered by the Secretary of the Interior for the benefit of Indian tribes and individual members of Indian tribes.</text> </paragraph></subsection></section> 
<section id="H32450084E2324CBF95FB754151E7F1E"><enum>304.</enum><header>Recreational uses</header> 
<subsection commented="no" display-inline="no-display-inline" id="HFC8C33713D8E4D9F8C6741E68100D41"><enum>(a)</enum><header display-inline="yes-display-inline">Mount Hood National Forest Recreational Working Group</header><text display-inline="yes-display-inline">The Secretary may establish a working group for the purpose of providing advice and recommendations to the Forest Service on planning and implementing recreation enhancements in the Mount Hood National Forest.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H3B3AAC59F98B43868814EE2974BF73DC"><enum>(b)</enum><header display-inline="yes-display-inline">Consideration of conversion of forest roads to recreational uses</header><text display-inline="yes-display-inline">In considering a Forest Service road in the Mount Hood National Forest for possible closure and decommissioning after the date of enactment of this Act, the Secretary, in accordance with applicable law, shall consider, as an alternative to decommissioning the road, converting the road to recreational uses to enhance recreational opportunities in the Mount Hood National Forest.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H03B51232C4CA4997AE261CFBAD9478D"><enum>(c)</enum><header display-inline="yes-display-inline">Improved trail access for persons with disabilities</header><text display-inline="yes-display-inline">The Secretary, in consultation with the public, may design and construct a trail at a location selected by the Secretary in Mount Hood National Forest suitable for use by persons with disabilities.</text> </subsection></section></title>
