<section id="H7B3347A3A6284CB185E9FA43B7E614ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Oil Speculation Reduction Act of 2008</short-title></quote>. </text></section> 
<section id="H52DDB2B1DA2A4243BF7CDBA8B0505EF2"><enum>2.</enum><header>Speculative limits and transparency for off-shore oil trading</header><text display-inline="no-display-inline">Section 4 of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/6">7 U.S.C. 6</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H3B594E42F4C743A0B2D1B7ED3215443" display-inline="no-display-inline"> 
<subsection id="H03E74B5E8F5844A9976270E322F398AC"><enum>(e)</enum> 
<paragraph id="H37391D0E271D43DFBFE896BFB57B727F" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Commission shall not exempt a board of trade, exchange, or market located outside the United States from the requirement of subsection (a) to become a designated contract market, derivatives transaction execution facility, or other registered entity, with respect to agreements, contracts, and transactions in crude oil to be physically delivered in the United States, unless the Commission determines that the board of trade, exchange, or market—</text> 
<subparagraph id="HA3240C504B0F49EE8358177017A55EF5" indent="up1"><enum>(A)</enum><text>applies principles or requirements regarding the daily publication of trading information and position limits or accountability levels for speculators in the agreements, contracts, or transactions that are comparable to those applied by a designated contract market, derivatives transaction execution facility, or other registered entity;</text></subparagraph> 
<subparagraph id="HBF0BEF098696480B8D23B04FA3A96B07" indent="up1"><enum>(B)</enum><text>provides information to the Commission, regarding the extent of speculative and nonspeculative trading in agreements, contracts, and transactions in crude oil that is comparable to the information the Commission determines necessary to publish a Commitment of Traders report for a designated contract market, derivatives transaction execution facility, or other registered entity with respect to the trading; and</text></subparagraph> 
<subparagraph id="H8F6BDB99E2CB4D90BD5F5E62F3136894" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">imposes margin requirements that are—</text> 
<clause id="H5D7FD4336A2140C0B3DF5813E7075FD1"><enum>(i)</enum><text>comparable to those imposed by a designated contract market, derivatives transaction execution facility, or other registered entity for other commodities; and</text></clause> 
<clause id="HD8EBB737432747328FAD1218A8C58754"><enum>(ii)</enum><text>sufficient to reduce excessive speculation and protect consumers.</text></clause></subparagraph></paragraph> 
<paragraph id="HDC49101AE9D04FB99E2E4D13E07CF504" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">During the 6-month period that begins 1 year after the date of the enactment of this subsection, the Commission shall determine whether to continue to grant any exemption described in paragraph (1) that was granted before such date of enactment to any board of trade, exchange, or market located outside the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="HDAD71C20822F4644A673D62033985E92"><enum>3.</enum><header>Report to the Congress</header> <text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commodity Futures Trading Commission shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report describing the effects of the amendment made by section 2 on the trading facilities, agreements, contracts, and transactions subject to the jurisdiction of the Commission.</text></section>
