		<official-title>To amend title 49, United States Code, to prohibit the
		  transportation of horses in interstate transportation in a motor vehicle
		  containing 2 or more levels stacked on top of one another.</official-title>

		<section id="H0230DC151FC14C8FA71D9C3F43B37DDB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Horse Transportation Safety Act of
			 2008</short-title></quote>.</text>
		</section><section id="HCD3AA1B15E51438CA757E2A7A0F7F79" section-type="subsequent-section"><enum>2.</enum><header>Transportation of
			 horses</header>
			<subsection id="H76CEA9E3CEEC4E01B10071DC72A80003"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 805 of title
			 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H15116CD492B84FBDBEE7D079ECAE5E41" style="USC">
					<section id="H00C82EE6904A4F97993FA8C737C286AD"><enum>80505.</enum><header>Transportation
				of horses</header>
						<subsection id="H8FA0DA7C605B484E96AF4F3BAA8C6B06"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No person may transport, or cause to be
				transported, a horse from a place in a State, the District of Columbia, or a
				territory or possession of the United States through or to a place in another
				State, the District of Columbia, or a territory or possession of the United
				States in a motor vehicle containing 2 or more levels stacked on top of one
				another.</text>
						</subsection><subsection id="H6425D92CE5574809BF8DA378ECD75BB8"><enum>(b)</enum><header>Civil
				penalty</header><text display-inline="yes-display-inline">A person that
				knowingly violates this section is liable to the United States Government for a
				civil penalty of at least $100 but not more than $500 for each violation. A
				separate violation occurs under this section for each horse that is
				transported, or caused to be transported, in violation of this section. On
				learning of a violation, the Attorney General shall bring a civil action to
				collect the penalty in the district court of the United States for the judicial
				district in which the violation occurred or the defendant resides or does
				business.</text>
						</subsection><subsection id="H2C8A1FBD5E044E8D989E1B912F164445"><enum>(c)</enum><header>Motor vehicle
				defined</header><text display-inline="yes-display-inline">In this section, the
				term <quote>motor vehicle</quote> means a vehicle driven or drawn by mechanical
				power and manufactured primarily for use on public highways, but does not
				include a vehicle operated exclusively on a rail or rails.</text>
						</subsection><subsection id="H78B248EE0C414A08AF468D8BD5D19CD6"><enum>(d)</enum><header>Relationship to
				other laws</header><text>The penalty provided under this section shall be in
				addition to a penalty or remedy available under any other law or common law.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H21F24943F21E4F33B3AB356276F7C52"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>
