		<official-title>To amend the Homeland Security Act of 2002 to direct the
		  Secretary of Homeland Security to issue regulations that require that any award
		  fee under a cost-plus-award-fee contract entered into by the Department of
		  Homeland Security shall be determined and paid based on a successful
		  acquisition outcome that is specified in the contract, and for other
		  purposes.</official-title>

		<section id="H177FCE2C6A5C42DDB000D50036B03463" section-type="section-one"><enum>1.</enum><header>Regulations regarding award
			 fees under contracts of the Department of Homeland Security</header>
			<subsection id="H157B9E08F64D4C9680C175B9443E5452"><enum>(a)</enum><header>Regulations
			 required</header><text display-inline="yes-display-inline">Subtitle D of title
			 VIII of the Homeland Security Act of 2008 is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H5FC1909F38F84EA691B227BBA42BC51" style="OLC">
					<section id="HD1FD218E813C4E8FBC6BDD31556EA176"><enum>836.</enum><header>Regulations
				regarding award fees</header>
						<subsection id="H3C5CAE13A3724A30B4713913AD284B7E"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				issue regulations that require that any award fee under a cost-plus-award-fee
				contract entered into by the Department shall be determined and paid based on a
				successful acquisition outcome that is specified in the contract in terms of
				cost, schedule, and performance.</text>
						</subsection><subsection id="H92AFB9B49BFE458A9474C815004D526C"><enum>(b)</enum><header>Application</header><text>The
				regulations issued under this section shall apply with respect to any contract
				that is awarded or renewed by the Department after the end of the 30-day period
				beginning on the date of the enactment of this section.</text>
						</subsection><subsection id="HB8AA7E6CFD71451E9BC8EFAC44701492"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section each of the terms
				<quote>cost-plus-award-fee contract</quote> and <quote>award fee</quote> has
				the meaning that term has under subpart 16.405–1 of the Federal Acquisition
				Regulation, as in effect on the date of the enactment of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDD8D639E957140B0006E5F29D0F0BCA6"><enum>(b)</enum><header>Deadline</header><text>The
			 Secretary shall issue regulations under the amendment made by subsection (a) by
			 not later than 30 days after the date of the enactment of this Act.</text>
			</subsection><subsection id="H4FE52DB0901046C19BFC742DDDA49D6B"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 1(b) of such Act is
			 amended by inserting after the item relating to section 835 the
			 following:</text>
