			 bill; which was referred to the <committee-name committee-id="HIF00">Committee

		</action>
		<legis-type>A BILL</legis-type>
		<official-title>To provide for the establishment of an interagency
		  working group to conduct a study to identify the factors that affect the
		  pricing of crude oil and refined petroleum products, and to make
		  recommendations on appropriate coordination of oversight and
		  regulation.</official-title>
	</form>
	<legis-body id="H90E4D8214DCE4CF68CB76348D981A830" style="OLC">
		<section id="H230F2FC1D34942F0BC777E17E1809073" section-type="section-one"><enum>1.</enum><header>Petroleum product
			 pricing</header>
			<subsection id="H0974A712AF8E4450A9920311789BEC6F"><enum>(a)</enum><header>Working
			 group</header><text>The Secretary of Energy shall establish, and serve as the
			 Chair of, an interagency working group consisting of representatives from the
			 Federal Energy Regulatory Commission, the Federal Trade Commission, and other
			 appropriate Federal agencies.</text>
			</subsection><subsection id="HC49CF43F0E72453A8B3B65CD4030DE22"><enum>(b)</enum><header>Study</header><text>The
			 working group established under subsection (a) shall conduct a study to—</text>
				<paragraph id="H7700F9B70D1E418EB12B55B0472EBD60"><enum>(1)</enum><text>identify the
			 factors that affect the pricing of crude oil and refined petroleum products,
			 including an examination of the effects of market speculation on prices;
			 and</text>
				</paragraph><paragraph id="HF1E0CF1DB14840DA87F9D8012D5B9473"><enum>(2)</enum><text>review and assess
			 the roles, missions, and structures of relevant Federal agencies, examine
			 interagency coordination, and identify and assess the gaps which need to be
			 filled for the Federal Government to effectively oversee and regulate crude oil
			 and refined petroleum product markets.</text>
				</paragraph></subsection><subsection id="HEEC1CCDF3DC14CEE862C00E187E7E214"><enum>(c)</enum><header>Elements of
			 study</header><text>Such study shall include—</text>
				<paragraph id="HE68AC029AEF74C788FE1C26E6200AACC"><enum>(1)</enum><text>an examination of
			 price formation with respect to crude oil and refined petroleum
			 products;</text>
				</paragraph><paragraph id="H2EEAC06AD9F74FC3A2F32600F1A3223D"><enum>(2)</enum><text>an examination of
			 the respective degree to which the regulation by national governments, or lack
			 thereof, in international markets may allow or tolerate excessive speculation,
			 market manipulation, or other abuses which impact crude oil or refined
			 petroleum product prices; and</text>
				</paragraph><paragraph id="HEFA1BE9E6773450489ACF7154CB2143C"><enum>(3)</enum><text>an examination of
			 the degree to which changes in transparency, liquidity, and structure have
			 influenced or driven abuse, manipulation, excessive speculation, or inefficient
			 price formation.</text>
				</paragraph></subsection><subsection id="HAE205CF755954F479852437828D25796"><enum>(d)</enum><header>Conduct of
			 study</header><text>In conducting the study, the Secretary shall—</text>
				<paragraph id="H6A04D38F327D4228B0C506B98FF20864"><enum>(1)</enum><text>utilize the
			 expertise and resources of the Office of Fossil Energy, the Office of Policy
			 and International Affairs, the Office of the General Counsel, and such other
			 offices in the Department of Energy that have expertise bearing on the
			 operation of and laws applying to crude oil and petroleum product
			 markets;</text>
				</paragraph><paragraph id="H0757ECBD554242DE985CE579AA84A6FC"><enum>(2)</enum><text>designate one such
			 office to serve as the Secretariat for the Task Force;</text>
				</paragraph><paragraph id="HC72352FA69934DBB97526CF2D592B76C"><enum>(3)</enum><text>utilize the
			 expertise and resources of the Energy Information Administration, particularly
			 in validating statistical data that may be relevant; and</text>
				</paragraph><paragraph id="H29C2F42E00BE4F73831F9F7BABCA40C4"><enum>(4)</enum><text>be authorized to
			 procure by contract such private commercial expertise and resources as are
			 required to complete the study in a complete, timely, and credible
			 manner.</text>
				</paragraph></subsection><subsection id="H64D789FBA4584BEA8E9DFE37F6595132"><enum>(e)</enum><header>Information from
			 Federal Agencies</header><text display-inline="yes-display-inline">Each
			 executive department, bureau, commission, agency, board, office, independent
			 establishment, or instrumentality of the Federal Government shall make
			 available to the working group upon request any data, information, estimates,
			 statistics, and access to any employee necessary for the conduct of the study
			 under this section.</text>
			</subsection><subsection id="H66188059A1674FFE8D264EC178DE5262"><enum>(f)</enum><header>Public
			 hearings</header><text>The Secretary of Energy shall provide for not less than
			 3 public hearings at locations across the country to take testimony, on the
			 record, as part of the fact gathering process to enable the working group to
			 perform its functions under this section.</text>
			</subsection><subsection id="H4C3F5897130C40D3B65160FEA4074F02"><enum>(g)</enum><header>Consultation</header><text>The
			 working group shall consult with domestic and international oil industry
			 participants, the financial services and futures industry, commodity exchanges,
			 industry and financial consultants, wholesale, retail, and consumer
			 organizations, academic and nonprofit organizations, and local, State,
			 national, and international governmental organizations.</text>
			</subsection><subsection id="H35A01476C1BE4F78B11B58B5F8F22F8D"><enum>(h)</enum><header>Subpoena
			 power</header><text>The Secretary of Energy shall have the power to compel the
			 production of records and testimony for the purposes of the working group, and
			 may exercise the powers of the Department of Energy to secure information and
			 data necessary to carry out the requirements of this section.</text>
			</subsection><subsection id="H59720D96B52E4AC2833F1EF7A2B37313"><enum>(i)</enum><header>Report and
			 recommendations</header>
				<paragraph id="H5626013A1172452F90DE5DFA5E5FA300"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">During the conduct of
			 the study under this section, the Secretary of Energy shall provide to the
			 Committee on Energy and Commerce of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate quarterly progress
			 reports, and not later than 1 year after the date of enactment of this Act the
			 Secretary shall transmit to such committees a report that—</text>
					<subparagraph id="HFBBE307DFCE74B4B966C77D9F82B7219"><enum>(A)</enum><text>describes the
			 results of the study; and</text>
					</subparagraph><subparagraph id="HB6C0BEF00C96448FB393A620F5AF9FF7"><enum>(B)</enum><text>provides options
			 and the recommendations of the working group for appropriate Federal
			 coordination of oversight and regulatory actions to ensure transparency of
			 crude oil and refined petroleum product pricing and elimination of excessive
			 speculation.</text>
					</subparagraph></paragraph><paragraph id="HB900814C8F164ACFA7456EA1C2B53B75"><enum>(2)</enum><header>Immediate
			 action</header><text>If at any time during the course of the preparation of the
			 study the Secretary of Energy determines that there is a basis for a policy
			 recommendation to Congress to modify United States laws or regulatory
			 authorities so as to protect United States energy consumers from the potential
			 for abuse and manipulation by activities taking place in energy markets or
			 exchanges, the Secretary shall make such recommendations immediately to the
			 Committee on Energy and Commerce of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate.</text>
				</paragraph></subsection><subsection id="H4B8E934CA857486ABD0582C55188B63C"><enum>(j)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated for
			 carrying out this section—</text>
				<paragraph id="HD69F06488534470495563C9818D880B4"><enum>(1)</enum><text>$21,000,000 to the
			 Secretary of Energy;</text>
				</paragraph><paragraph id="HB831D2FE412A445BA5F42266C878E431"><enum>(2)</enum><text>$1,000,000 to the
			 Federal Energy Regulatory Commission;</text>
				</paragraph><paragraph id="H6FD5BC7064E7405BAEABE4B4FF6F0095"><enum>(3)</enum><text display-inline="yes-display-inline">$1,000,000 to the Federal Trade Commission;
			 and</text>
				</paragraph><paragraph id="H945242C2678D441B8EB7AD7E3EEA4745"><enum>(4)</enum><text display-inline="yes-display-inline">$2,000,000 to other Federal agencies
			 participating in the interagency working group.</text>
				</paragraph></subsection></section></legis-body>
