			 <committee-name committee-id="HBA00">Financial Services</committee-name>, for a
			 period to be subsequently determined by the Speaker, in each case for
			 consideration of such provisions as fall within the jurisdiction of the
			 committee concerned</action-desc>
		</action>
		<legis-type>A BILL</legis-type>
		<official-title>To authorize appropriations for the Department of
		  Commerce and to prohibit Federal economic development funds to States that
		  carry out public takings for private purposes.</official-title>
	</form>
	<legis-body id="HEA13125EE7D743DC9E3F972B1D4882A9" style="OLC">
		<section id="HACB57AD519BD41C0B66CD74D894496C2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Private Property Rights Protection and
			 Government Accountability Act</short-title></quote>.</text>
		</section><section id="H2F7D30C718344DEBBA6816778CE172DA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="HDB2D114CD1F94A5186E1A58E2A1B5B0"><enum>(1)</enum><text display-inline="yes-display-inline">Congress has the power to regulate commerce
			 among the several States and Indian tribes;</text>
			</paragraph><paragraph id="HE97405E7B1F04E54A3CE821E3B506091"><enum>(2)</enum><text>property rights
			 are essential to interstate commerce, ensuring that individuals make the best
			 economic use of their property;</text>
			</paragraph><paragraph id="H1D3DD92488454827AC66003DAE002838"><enum>(3)</enum><text>potential
			 residents and businesses may avoid communities that have a record of taking
			 private property for private economic development;</text>
			</paragraph><paragraph id="H9BF5DD860A4045A59718492CAA7299C"><enum>(4)</enum><text>public takings for
			 private purposes are harmful to communities and to interstate commerce;</text>
			</paragraph><paragraph id="HDE5B8711A0E44FC9873F74CD77C2B802"><enum>(5)</enum><text>public taking of
			 private property for economic development is not a traditional nor sound
			 function of State or local government; and</text>
			</paragraph><paragraph id="H5562E4F52C294C0A97B8EE07697EBECE"><enum>(6)</enum><text>in order to
			 promote and protect interstate commerce, public takings for private purposes
			 should be prohibited.</text>
			</paragraph></section><section id="HAE28D3FC87FB4443AC946CCC1232DD4D"><enum>3.</enum><header>Prohibition on
			 economic development funds</header><text display-inline="no-display-inline">Any
			 State or political subdivision of a State that carries out a public taking for
			 any private purpose in or affecting interstate commerce shall not be eligible
			 to receive any Federal economic development funds for a period of 10 fiscal
			 years.</text>
		</section><section id="H2346E147A6DC4F34956CFDDD92131510"><enum>4.</enum><header>Injunctive relief
			 and restoration to owner</header>
			<subsection id="H2B09EAC4EDE74999B79DE3494760BCD1"><enum>(a)</enum><header>Cause of
			 Action</header><text display-inline="yes-display-inline">Any owner of private
			 property that is subject to a public taking described in section 3 may bring an
			 action in the appropriate Federal or State court to obtain injunctive and
			 declaratory relief.</text>
			</subsection><subsection id="H63D05BA059F44DD9A1530033B1BDABE2"><enum>(b)</enum><header>Attorney’s Fee
			 and Other Costs</header><text>In any action or proceeding under this section,
			 the court shall allow a prevailing plaintiff a reasonable attorney’s fee as
			 part of the costs, and include expert fees as part of the attorney’s
			 fee.</text>
			</subsection></section><section id="HBD87A19CCE484DF99ED30986FE76DB9D"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act, the following
			 definitions apply:</text>
			<paragraph commented="no" id="H1099061133B34B8EADD0BA00C09243C8"><enum>(1)</enum><header>Private
			 purpose</header>
				<subparagraph id="H4CAE47E88A3F45EDADFFA53E43BB879F"><enum>(A)</enum><header>In
			 general</header><text>The term <term>private purpose</term>, with regard to
			 property that has been acquired and conveyed through a public taking, means the
			 ownership, control, or use of such property by a private party or parties that
			 advances the economic interests of the private party or parties. Such term
			 includes but is not limited to the following:</text>
					<clause commented="no" id="H9D50723623914EE98EDEE249DF1BFEA3"><enum>(i)</enum><text>Any use of such
			 property in an economic development plan of which the benefit to the public is
			 increased tax revenue, increased employment, or other indirect benefit.</text>
					</clause><clause commented="no" id="H22703721B1254BFBB13B1E0388B9A5AE"><enum>(ii)</enum><text>The lease of such
			 property to a private party or parties for private development, including
			 commercial, industrial, or residential development.</text>
					</clause><clause commented="no" id="HE78DC200CF584256A917B65088BC1902"><enum>(iii)</enum><text>Any control of
			 such property by a private party that—</text>
						<subclause commented="no" id="H82A8183E677F402FBECC46A9F8A947F9"><enum>(I)</enum><text>excludes a general
			 public use or benefit; or</text>
						</subclause><subclause commented="no" id="H2A7DE801A505414B00379699ABCE08EE"><enum>(II)</enum><text>primarily
			 benefits the private party or parties and benefits the public
			 indirectly.</text>
						</subclause></clause></subparagraph><subparagraph id="H5D40BEF5F98F4642880000EEB5289BAF"><enum>(B)</enum><header>Exceptions</header><text>Such
			 term shall not include—</text>
					<clause commented="no" id="H212B19E5E96549BBAC873DE001C8A278"><enum>(i)</enum><text>conveying private
			 property to public ownership, such as for a road, hospital, or prison, or to an
			 entity, such as a common carrier, that makes the property available for use by
			 the general public as of right, such as a railroad, public utility, or public
			 facility, or for use as a right of way, aqueduct, pipeline, or similar use;</text>
					</clause><clause commented="no" id="HE5E38F40AD4D421593CC04A6579DFD1B"><enum>(ii)</enum><text display-inline="yes-display-inline">acquiring property to eliminate harmful
			 uses of the property, provided such uses present an imminent and substantial
			 danger to the public health;</text>
					</clause><clause commented="no" id="H074CE52FE13340ECA0CD1D23A7591583"><enum>(iii)</enum><text>leasing property
			 to a private person or entity that occupies an incidental part of public
			 property or a public facility, such as a retail establishment on the ground
			 floor of a public building;</text>
					</clause><clause commented="no" id="H21B4BC37BE6D49BFAEF016E6A9DF85A0"><enum>(iv)</enum><text>acquiring
			 abandoned property; and</text>
					</clause><clause commented="no" id="HABA3C7BA8F7F4B0C8364F46C07A94423"><enum>(v)</enum><text>clearing defective
			 chains of title.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" id="H8EFE2BD398E04494B83F2537CCC11B5"><enum>(2)</enum><header>Federal economic
			 development funds</header><text>The term <term>Federal economic development
			 funds</term> means any Federal funds—</text>
				<subparagraph commented="no" id="H5BE6E721E77843ACA87011D5CD2CB8D1"><enum>(A)</enum><text display-inline="yes-display-inline">administered by the Secretary of Commerce,
			 the Secretary of Energy, or the Administrator of the Environmental Protection
			 Agency, and distributed to or through States or political subdivisions of
			 States, to the extent such funds are not provided to assist States or political
			 subdivisions of States in complying with any requirements of Federal law or
			 regulation; or</text>
				</subparagraph><subparagraph commented="no" id="HF47F3FD0A0AC4767BCF510D791408F5F"><enum>(B)</enum><text display-inline="yes-display-inline">distributed to or through States or
			 political subdivisions of States under Federal laws and whose purpose is to
			 promote interstate commerce and improve or increase the size of the economies
			 of States or political subdivisions of States.</text>
				</subparagraph></paragraph><paragraph commented="no" id="H2581509908604D80B1E735A3D939EE1"><enum>(3)</enum><header>Public
			 taking</header><text display-inline="yes-display-inline">The term <term>public
			 taking</term> means an action by a State or political subdivision of a State or
			 by any person or entity to which such power has been delegated that transfers
			 all or part of the legal rights in property from a private owner to another
			 person or to public ownership without the consent of the private owner.</text>
			</paragraph></section><section id="HC38D349FAF4C45A8A1008CDA34D3746F"><enum>6.</enum><header>General
			 Authorization of Appropriations for Department of Commerce</header><text display-inline="no-display-inline">There is authorized to be appropriated to
			 the Secretary of Commerce to carry out the functions of the Department—</text>
			<paragraph id="H61583F3817484EDC859EFFF585E400FE"><enum>(1)</enum><text display-inline="yes-display-inline">$8,919,000,000 for fiscal year 2009;</text>
			</paragraph><paragraph id="HF7C8AA4EF20F4F369EB3B1E3FA5E065B"><enum>(2)</enum><text>$11,974,000,000
			 for fiscal year 2010;</text>
			</paragraph><paragraph id="H09E0815DE51242C3AB43644324C4035E"><enum>(3)</enum><text>$6,953,000,000 for
			 fiscal year 2011;</text>
			</paragraph><paragraph id="HCE60A85D8D754678926268436EAD4365"><enum>(4)</enum><text>$6,691,000,000 for
			 fiscal year 2012; and</text>
			</paragraph><paragraph id="H50786CB5C80C4534A1AD2F2353D68D17"><enum>(5)</enum><text>$6,780,000,000 for
			 fiscal year 2013.</text>
