		<section display-inline="no-display-inline" id="H4DEBCF3EE2FE44D6991D74D8AECD3B98" section-type="section-one"><enum>1.</enum><header>High-performance green
			 buildings retrofit loan guarantees</header>
			<subsection display-inline="no-display-inline" id="HBB12A0DEF13B4EA4BA5BFC2F63B41E55"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H1504EAD9F1404079948021FE38567104"><enum>(1)</enum><header>Cost</header><text>The
			 term <quote>cost</quote> has the meaning given the term <quote>cost of a loan
			 guarantee</quote> within the meaning of section 502(5)(C) of the Federal Credit
			 Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a(5)(C)</external-xref>).</text>
				</paragraph><paragraph id="H86528AC0DD94409085F47406EED6EE8"><enum>(2)</enum><header>Guarantee</header>
					<subparagraph id="H6F886FF62E784095A84350479BB97649"><enum>(A)</enum><header>In
			 general</header><text>The term <quote>guarantee</quote> has the meaning given
			 the term <quote>loan guarantee</quote> in section 502 of the Federal Credit
			 Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>).</text>
					</subparagraph><subparagraph id="H779F22435DD64482B62169A63039279D"><enum>(B)</enum><header>Inclusion</header><text>The
			 term <quote>guarantee</quote> includes a loan guarantee commitment (as defined
			 in section 502 of the Federal Credit Reform Act of 1990 (2 U.S.C.
			 661a)).</text>
					</subparagraph></paragraph><paragraph id="H0A440705A5C742D587BFA120011F7BEB"><enum>(3)</enum><header>Obligation</header><text>The
			 term <quote>obligation</quote> means the loan or other debt obligation that is
			 guaranteed under this section.</text>
				</paragraph><paragraph id="H24CE099860E0455BA54316B3EE960707"><enum>(4)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Energy.</text>
				</paragraph></subsection><subsection id="H128A70217562449B866B4558340400C8"><enum>(b)</enum><header>Eligible
			 purposes</header><text>The Secretary shall make loan guarantees under this
			 section for renovation projects that are eligible projects within the meaning
			 of section 1703 of the Energy Policy Act of 2005 and that will result in a
			 building achieving the United States Green Building Council Leadership in
			 Energy and Environmental Design <quote>certified</quote> level, or meeting a
			 comparable standard approved by the Secretary.</text>
			</subsection><subsection id="H8D1A79C2F6D84BEB9B69607EB685C755"><enum>(c)</enum><header>Terms and
			 conditions</header>
				<paragraph id="H106E3C265A1B40969D1B22C6C1679EA9"><enum>(1)</enum><header>In
			 General</header><text>The Secretary shall make guarantees under this section
			 for projects on such terms and conditions as the Secretary determines, after
			 consultation with the Secretary of the Treasury, in accordance with this
			 section, including limitations on the amount of any loan guarantee to ensure
			 distribution to a variety of borrowers.</text>
				</paragraph><paragraph id="HBE81D386126F4B8F9CF10008FE6CA36"><enum>(2)</enum><header>Specific
			 Appropriation or Contribution</header><text>No guarantee shall be made under
			 this section unless—</text>
					<subparagraph id="H12ED737EEE764F5DB34EF68360FAE6A5"><enum>(A)</enum><text>an appropriation
			 for the cost has been made; or</text>
					</subparagraph><subparagraph id="HFB3EC619877940FBA0C6748241072EF2"><enum>(B)</enum><text>the Secretary has
			 received from the borrower a payment in full for the cost of the obligation and
			 deposited the payment into the Treasury.</text>
					</subparagraph></paragraph><paragraph id="H696E23FA992043AC82BEFCCD3268D971"><enum>(3)</enum><header>Limitation</header><text>Not
			 more than $100,000,000 in loans may be guaranteed under this section at any one
			 time.</text>
				</paragraph><paragraph id="H3AF8370DD64841159110F72EA24F7B82"><enum>(4)</enum><header>Amount</header><text>Unless
			 otherwise provided by law, a guarantee by the Secretary under this section
			 shall not exceed an amount equal to 80 percent of the project cost that is the
			 subject of the guarantee, as estimated at the time at which the guarantee is
			 issued.</text>
				</paragraph><paragraph id="HE0C24452E346491CBF611255D0E6FF9F"><enum>(5)</enum><header>Repayment</header><text>No
			 guarantee shall be made under this section unless the Secretary determines that
			 there is reasonable prospect of repayment of the principal and interest on the
			 obligation by the borrower.</text>
				</paragraph><paragraph id="H8BC0C1D842E4443C8507009E351F2F43"><enum>(6)</enum><header>Interest
			 Rate</header><text>An obligation shall bear interest at a rate that does not
			 exceed a level that the Secretary determines appropriate, taking into account
			 the prevailing rate of interest in the private sector for similar loans and
			 risks.</text>
				</paragraph><paragraph id="H956FE0C340EE4100AEA0CD759F4257F0"><enum>(7)</enum><header>Term</header><text>The
			 term of an obligation shall require full repayment over a period not to exceed
			 the lesser of—</text>
					<subparagraph id="H6886654FAC6A4AC8AB3DC544A7DF9075"><enum>(A)</enum><text>30 years;
			 or</text>
					</subparagraph><subparagraph id="H43DCB649E42341BFB5A9BAF0C41D11C"><enum>(B)</enum><text>90 percent of the
			 projected useful life of the building whose renovation is to be financed by the
			 obligation (as determined by the Secretary).</text>
					</subparagraph></paragraph><paragraph id="HA4B4024B82CE455381BA10DE36B93279"><enum>(8)</enum><header>Defaults</header>
					<subparagraph id="H82D75D6BBAFC41F2BF2DCA2FCECBB3C4"><enum>(A)</enum><header>Payment by
			 Secretary</header>
						<clause id="H73375CC53754460FA3D93EAD00E18D43"><enum>(i)</enum><header>In
			 general</header><text>If a borrower defaults on the obligation (as defined in
			 regulations promulgated by the Secretary and specified in the guarantee
			 contract), the holder of the guarantee shall have the right to demand payment
			 of the unpaid amount from the Secretary.</text>
						</clause><clause id="HCB624D86BFF74909B4E180DE195685C8"><enum>(ii)</enum><header>Payment
			 required</header><text>Within such period as may be specified in the guarantee
			 or related agreements, the Secretary shall pay to the holder of the guarantee
			 the unpaid interest on, and unpaid principal of the obligation as to which the
			 borrower has defaulted, unless the Secretary finds that there was no default by
			 the borrower in the payment of interest or principal or that the default has
			 been remedied.</text>
						</clause><clause id="H060C0B7D98634D17B6BCAB0048CB14AE"><enum>(iii)</enum><header>Forbearance</header><text>Nothing
			 in this paragraph precludes any forbearance by the holder of the obligation for
			 the benefit of the borrower which may be agreed upon by the parties to the
			 obligation and approved by the Secretary.</text>
						</clause></subparagraph><subparagraph id="HB6A08ABAF35946BD9637B6D1305D496E"><enum>(B)</enum><header>Subrogation</header>
						<clause id="HE2AF0A1E79384ADFAE5DEEBC8C07F304"><enum>(i)</enum><header>In
			 general</header><text>If the Secretary makes a payment under subparagraph (A),
			 the Secretary shall be subrogated to the rights of the recipient of the payment
			 as specified in the guarantee or related agreements including, where
			 appropriate, the authority (notwithstanding any other provision of law)
			 to—</text>
							<subclause id="H00F485365A80490EA24458B388755D65"><enum>(I)</enum><text>complete,
			 maintain, operate, lease, or otherwise dispose of any property acquired
			 pursuant to such guarantee or related agreements; or</text>
							</subclause><subclause id="H3B7EE2DA1ACF413BA46C006EB3D7DD9F"><enum>(II)</enum><text>permit the
			 borrower, pursuant to an agreement with the Secretary, to continue to pursue
			 the purposes of the project if the Secretary determines this to be in the
			 public interest.</text>
							</subclause></clause><clause id="HF4240F550AD9446F9332A2E879BEF694"><enum>(ii)</enum><header>Superiority of
			 rights</header><text>The rights of the Secretary, with respect to any property
			 acquired pursuant to a guarantee or related agreements, shall be superior to
			 the rights of any other person with respect to the property.</text>
						</clause><clause id="HCDA3AC9DEB5F4D72AA625256B4C9DBF6"><enum>(iii)</enum><header>Terms and
			 conditions</header><text>A guarantee agreement shall include such detailed
			 terms and conditions as the Secretary determines appropriate to—</text>
							<subclause id="H1D2FD0C2826D425AB67F23605DE1342F"><enum>(I)</enum><text>protect the
			 interests of the United States in the case of default; and</text>
							</subclause><subclause id="HE6A36902A2944292B615D6613EA2539E"><enum>(II)</enum><text>have available
			 all the patents and technology necessary for any person selected, including the
			 Secretary, to complete and operate the project.</text>
							</subclause></clause></subparagraph><subparagraph id="H546F2B39B0CF46F492A5C2007548ACBC"><enum>(C)</enum><header>Payment of
			 principal and interest by Secretary</header><text>With respect to any
			 obligation guaranteed under this section, the Secretary may enter into a
			 contract to pay, and pay, holders of the obligation, for and on behalf of the
			 borrower, from funds appropriated for that purpose, the principal and interest
			 payments which become due and payable on the unpaid balance of the obligation
			 if the Secretary finds that—</text>
						<clause id="HCD2856AD64464E70AF159E2282CFC9DE"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H965C6C5C36D8479AA4FD259000DF207E"><enum>(I)</enum><text>the borrower is unable
			 to meet the payments and is not in default;</text>
							</subclause><subclause id="H9052110D15DD40F98C32FBA72DE099CD" indent="up1"><enum>(II)</enum><text>it is in the public interest to permit
			 the borrower to continue to pursue the purposes of the project; and</text>
							</subclause><subclause id="H9C3DAEECD9824C97903300A992C6654D" indent="up1"><enum>(III)</enum><text>the probable net benefit to the Federal
			 Government in paying the principal and interest will be greater than that which
			 would result in the event of a default;</text>
							</subclause></clause><clause id="HB426115C42F144A5BF1340159FFD21E7"><enum>(ii)</enum><text>the
			 amount of the payment that the Secretary is authorized to pay shall be no
			 greater than the amount of principal and interest that the borrower is
			 obligated to pay under the agreement being guaranteed; and</text>
						</clause><clause id="H7AE5ECC6537643F4A0C33B985E73A241"><enum>(iii)</enum><text>the borrower
			 agrees to reimburse the Secretary for the payment (including interest) on terms
			 and conditions that are satisfactory to the Secretary.</text>
						</clause></subparagraph><subparagraph id="HDE2F3A1F80F740FAB182AFCC007F1544"><enum>(D)</enum><header>Action by
			 attorney general</header>
						<clause id="HD232AA84837F4D419CAE00CEC5788190"><enum>(i)</enum><header>Notification</header><text>If
			 the borrower defaults on an obligation, the Secretary shall notify the Attorney
			 General of the default.</text>
						</clause><clause id="H3C1C695D8A554727B60152A64054B3E4"><enum>(ii)</enum><header>Recovery</header><text>On
			 notification, the Attorney General shall take such action as is appropriate to
			 recover the unpaid principal and interest due from—</text>
							<subclause id="HA9CA9A21BB934E6CA47FC8BD4C09EF3B"><enum>(I)</enum><text>such assets of the
			 defaulting borrower as are associated with the obligation; or</text>
							</subclause><subclause id="H4F707CC354CC42EEBA01958BE1D5DDC5"><enum>(II)</enum><text>any other
			 security pledged to secure the obligation.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H5F028835FA3947739515002C1FA003D"><enum>(9)</enum><header>Fees</header>
					<subparagraph id="H8267161D79F64B559ED3CCE88DD3CB61"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall charge and collect fees for
			 guarantees in amounts the Secretary determines are sufficient to cover
			 applicable administrative expenses.</text>
					</subparagraph><subparagraph id="HFE3E73E62A3C45A78B5EC98434F5D643"><enum>(B)</enum><header>Availability</header><text>Fees
			 collected under this paragraph shall—</text>
						<clause id="H264FE41237FA43F19C9C9B0243E18CCB"><enum>(i)</enum><text>be
			 deposited by the Secretary into the Treasury; and</text>
						</clause><clause id="HCD93A6D9F35846F19B8219DDE6FEAFD8"><enum>(ii)</enum><text>remain available
			 until expended, subject to such other conditions as are contained in annual
			 appropriations Acts.</text>
						</clause></subparagraph></paragraph><paragraph id="HF22338A2AE064EAE9D80159264F194A4"><enum>(10)</enum><header>Records;
			 Audits</header>
					<subparagraph id="HE941AF0FAD2C42678133332331A615E3"><enum>(A)</enum><header>In
			 general</header><text>A recipient of a guarantee shall keep such records and
			 other pertinent documents as the Secretary shall prescribe by regulation,
			 including such records as the Secretary may require to facilitate an effective
			 audit.</text>
					</subparagraph><subparagraph id="H034BBE8DF63B44E28089B9D4651D8963"><enum>(B)</enum><header>Access</header><text>The
			 Secretary and the Comptroller General of the United States, or their duly
			 authorized representatives, shall have access, for the purpose of audit, to the
			 records and other pertinent documents.</text>
					</subparagraph></paragraph><paragraph id="H2ED2F27303674E31A6E698FDAB11DF27"><enum>(11)</enum><header>Full Faith and
			 Credit</header><text>The full faith and credit of the United States is pledged
			 to the payment of all guarantees issued under this section with respect to
			 principal and interest.</text>
				</paragraph></subsection></section></legis-body>
