		  prescribe a standard to preclude commercials from being broadcast at louder
		  volumes than the program material they accompany.</official-title>

		<section id="H0707FB46FA15400DB2224CFA41599F83" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Commercial Advertisement Loudness
			 Mitigation Act</short-title></quote>.</text>
		</section><section id="H6F5BE064D2F44EFC9BC64B5773204575"><enum>2.</enum><header>Rulemaking on
			 loud commercials required</header>
			<subsection id="H703259A7B4F444FE95B137D7D3BFBDC3"><enum>(a)</enum><header>Regulation
			 Required</header><text display-inline="yes-display-inline">Within one year
			 after the date of enactment of this Act, the Federal Communications Commission
			 shall prescribe pursuant to the Communications Act of 1934 (47 U.S.C. 151 et
			 seq.) a regulation that provides, in connection with any video programming that
			 is broadcast or that is distributed by any multichannel video programming
			 distributor, that—</text>
				<paragraph id="H8E3F6782E5694C149E86F0EED3365152"><enum>(1)</enum><text>advertisements
			 accompanying such video programming shall not be excessively noisy or strident;</text>
				</paragraph><paragraph id="H1B9CC7B9A9E047F98367CC200137538"><enum>(2)</enum><text>such advertisements
			 shall not be presented at modulation levels substantially higher than the
			 program material that such advertisements accompany; and</text>
				</paragraph><paragraph id="H82ABD695B1D848659997DED325B1DE4B"><enum>(3)</enum><text>the average
			 maximum loudness of such advertisements shall not be substantially higher than
			 the average maximum loudness of the program material that such advertisements
			 accompany.</text>
				</paragraph></subsection><subsection id="H4EBE95DD86A3445FA7A5A36F7F6F42D4"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the terms
			 <term>video programming</term> and <term>multichannel video programming
			 distributor</term> have the meanings given such terms in section 602 of
			 Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/522">47 U.S.C. 522</external-xref>).</text>
