<section id="HEACB5E3D042B44ECBCFE42A5F0A4CD47" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Commission to Assess the Threat to the United States from Electromagnetic Pulse Attack</header>
<subsection id="H9F70BC8162024C679E675870E035549B"><enum>(a)</enum><header>Revised deadline for submission of final report</header><text display-inline="yes-display-inline">Section 1403(a) of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 (as enacted into law by <external-xref legal-doc="public-law" parsable-cite="pl/106/398">Public Law 106–398</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/2301">50 U.S.C. 2301</external-xref> note), as amended by section 1052(f) of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3434) and section 1073 of the John Warner National Defense Authorization Act for Fiscal Year 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/364">Public Law 109–364</external-xref>; 120 Stat. 2403), is amended by striking <quote>September 30, 2007</quote> and inserting <quote>June 30, 2009</quote>.</text></subsection>
<subsection id="HA26BEC6802D54EB582C3FC09561CD694"><enum>(b)</enum><header>Authority of chairman</header><text display-inline="yes-display-inline">Section 1401(e) of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 (as enacted into law by <external-xref legal-doc="public-law" parsable-cite="pl/106/398">Public Law 106–398</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/2301">50 U.S.C. 2301</external-xref> note), as redesignated by section 1052(d) of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3434), is amended by adding at the end the following new sentence: <quote>The chairman shall be in charge of all financial and administrative matters relating to the Commission.</quote>. </text></subsection>
<subsection id="H61194710F2B649E99F694C55B1773F61"><enum>(c)</enum><header>Guaranteed funding for commission</header><text display-inline="yes-display-inline">Section 1408 of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 (as enacted into law by <external-xref legal-doc="public-law" parsable-cite="pl/106/398">Public Law 106–398</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/2301">50 U.S.C. 2301</external-xref> note), as amended by section 1052(i) of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3435), is amended—</text>
<paragraph id="H2A6A765D06B84AC49F794946EE211E15"><enum>(1)</enum><text>by striking <quote>Funds</quote> and inserting:</text>

<subsection id="H56B897C7AAD54EE093296F5DBEF54D2"><enum>(a)</enum><header>Funding source</header><text>Funds</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H12382C41BD4C45B086114567A5D200C1"><enum>(2)</enum><text>by inserting after the first sentence the following new sentence: <quote>For fiscal year 2008, the amount provided by the Secretary of Defense shall be equal to $5,300,000 or such lesser amount as the Commission may specify as necessary for the activities of the Commission.</quote>; and</text></paragraph>
<paragraph id="HE4F5B5FE3AB14AD888BC8965FA9F4081"><enum>(3)</enum><text>by striking <quote>Upon receipt</quote> and inserting the following:</text>

<subsection id="H1A2302EC830C46F18F76983E2D9B7887" display-inline="no-display-inline"><enum>(d)</enum><header>Additional members</header><text display-inline="yes-display-inline">During the 30-day period beginning on the date of the enactment of this Act, the chairman of the Committee on Armed Services of the Senate and the chairman of the Committee on Armed Services of the House of Representatives may jointly appoint up to three additional members to serve on the Commission to Assess the Threat to the United States from Electromagnetic Pulse Attack established pursuant to title XIV of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 (as enacted into law by <external-xref legal-doc="public-law" parsable-cite="pl/106/398">Public Law 106–398</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/2301">50 U.S.C. 2301</external-xref> note) and reestablished pursuant to section 1052(a) of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; 119 Stat. 3434). The appointment of the additional members of the Commission shall be made in consultation with the ranking minority members of such committees.</text></subsection></section>
