		<section id="HB1D243802D064FA9B8AE27449B003023" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Housing Enterprises
			 Transparency and Accountability Act of 2008</short-title></quote>.</text>
		</section><section id="HA48AB132012C4DA296C6D9A62B023200"><enum>2.</enum><header>Pilot program to
			 encourage risk reduction and accountability</header>
			<subsection id="H0D825290D3DF476587A0D3C77FA5CCA6"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Federal Housing Finance Board shall
			 require each Federal Home Loan Bank, and the Director of the Office of Federal
			 Housing Enterprise Oversight of the Department of Housing and Urban Development
			 shall require the Federal National Mortgage Association and the Federal Home
			 Loan Mortgage Corporation, to carry out a pilot program to reduce risk through
			 the use of electronic platforms to conduct transactions in interest rate swaps
			 and forward rate agreements. The pilot program required under this section
			 shall commence not later than the expiration of the 180-day period beginning on
			 the date of the enactment of this Act.</text>
			</subsection><subsection id="HFAA5399EFFFB4215B53D08AB0683A9B9"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out the pilot program required
			 under subsection (a), the Federal Housing Finance Board and the Director of the
			 Office of Federal Housing Enterprise Oversight shall require that—</text>
				<paragraph id="H99E353B3D4A543D98420751866F56540"><enum>(1)</enum><text>the Federal Home
			 Loan Banks, and the Federal National Mortgage Association and Federal Home Loan
			 Mortgage Corporation, respectively, conduct at least 5 percent of their
			 transactions in interest rate swaps and forward rate agreements for the
			 calendar years 2009 and 2010 on an electronic platform or platforms; and</text>
				</paragraph><paragraph id="HD799A7CC61664584A7FAD3E61FBDF00"><enum>(2)</enum><text>in
			 selecting the electronic platform or platforms, the Federal Home Loan Banks,
			 and the Federal National Mortgage Association and Federal Home Loan Mortgage
			 Corporation shall consider the extent to which such electronic platform or
			 platforms—</text>
					<subparagraph id="HC7BE267E7E2A4BB08D5CDCC9EE42B2CE"><enum>(A)</enum><text>keep accurate
			 records and provide an accurate audit trail for transactions executed on each
			 such platform;</text>
					</subparagraph><subparagraph id="HFA905FAF435E4730A16B04F3D9F32869"><enum>(B)</enum><text>enable users to
			 identify and net their mutually offsetting short term interest rate
			 risks;</text>
					</subparagraph><subparagraph id="HC5844AB3B53E462385002ECCC03DB15E"><enum>(C)</enum><text>are owned and
			 located in the United States and utilize technologies patented in the United
			 States; and</text>
					</subparagraph><subparagraph id="H9A94E210567B46FCB0682E041784BC24"><enum>(D)</enum><text>are not an
			 organized exchange, board of trade, or trading facility as those terms are
			 defined in the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1">7 U.S.C. 1 et seq.</external-xref>).</text>
					</subparagraph></paragraph></subsection><subsection id="HA2F567A359CD4AA39FAF176629DDB7CC"><enum>(c)</enum><header>Study and
			 report</header><text display-inline="yes-display-inline">Not later than March
			 1, 2011, the Federal Housing Finance Board and the Director of the Office of
			 Federal Housing Enterprise Oversight shall each conduct a study of the pilot
			 program required under subsection (a) and shall submit a report regarding the
			 results and conclusions of the study to the Committee on Financial Services of
			 the House of Representatives and the Committee on Banking, Housing, and Urban
			 Affairs of the Senate.</text>
