<official-title display="yes">To provide for a land exchange involving certain National Forest System lands in the Mendocino National Forest in the State of California, and for other purposes.</official-title>

<section id="H4D68319250A34301AB344BFCE37C48F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deafy Glade Land Exchange Act </short-title></quote>.</text> </section>
<section id="H7BF5D12015A84FCC9B41D9F264D4FEFC"><enum>2.</enum><header>Land exchange, Mendocino National Forest, California</header>
<subsection id="HD1E2F875AC1845FEAA3EC58808F122B8"><enum>(a)</enum><header>Land exchange required</header><text display-inline="yes-display-inline">If Solano County, California (in this section referred to as the <quote>County</quote>) conveys to the Secretary of Agriculture all right, title, and interest of the County in and to four parcels of land consisting of a total of approximately 160 acres identified on the map entitled <quote>Fouts Springs-Deafy Glade Federal and Non-Federal Lands</quote> and dated July 17, 2008, the Secretary shall convey to the County, in exchange, all right, title, and interest of the United States in and to the parcel of land in the Mendocino National Forest in the State of California (including any improvements on the land) comprising approximately 82 acres and known as the Fouts Springs Ranch, as also depicted on the map. </text></subsection>
<subsection id="H5BBC2C625546402D9D06DAB9336CE1C"><enum>(b)</enum><header>Availability of map</header><text display-inline="yes-display-inline">The map referred to in subsection (a) shall be on file and available for public inspection in the Office of the Chief of the Forest Service. With the agreement of the County, the Secretary may make technical corrections to the map and the legal descriptions of the land to be exchanged under this section.</text></subsection>
<subsection id="H8700E100C71542C78D311BE4D181835D"><enum>(c)</enum><header>Land exchange process</header><text>Section 206 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>) shall apply to the land exchange under this section.</text></subsection>
<subsection id="H67BA2E3DED8B4635AAA816F89FA0DB91"><enum>(d)</enum><header>Survey and Administrative Costs</header><text display-inline="yes-display-inline">The exact acreage and legal description of the land to be exchanged under subsection (a) shall be determined by a survey satisfactory to the Secretary. The costs of the survey and any administrative costs related to the land exchange shall be borne by the County.</text></subsection>
<subsection id="H346968D7B6794D3B9B6566CDA8B0F9B3" display-inline="no-display-inline"><enum>(e)</enum><header>Condition on use of conveyed land</header><text display-inline="yes-display-inline">As a condition of the conveyance to the County under subsection (a), the County shall agree to continue to use the land acquired by the County under such subsection for purposes consistent with the purposes listed in the special use authorization for the Fouts Springs Ranch in effect as of the date of the enactment of this Act.</text></subsection>
<subsection id="H61D11162BEBD4610B56F82F34DE47DD9" display-inline="no-display-inline"><enum>(f)</enum><header>Easement authority</header><text display-inline="yes-display-inline">The Secretary may grant an easement to provide continued access to, and maintenance and use of, the facilities covered by the special use authorization referred to in subsection (e) as necessary for the continued operation of the Fouts Springs Ranch conveyed under subsection (a).</text></subsection>
<subsection id="HDD71547757C74198913CFF7217A05F1D"><enum>(g)</enum><header>Management of acquired land</header><text>The lands acquired by the Secretary under subsection (a) shall be added to and administered as part of the Mendocino National Forest and managed in accordance with the Act of March 1, 1911 (commonly known as the Weeks Act; <external-xref legal-doc="usc" parsable-cite="usc/16/480">16 U.S.C. 480 et seq.</external-xref>) and the laws and regulations applicable to the National Forest System.</text></subsection>
<subsection id="H20553B1A16984479BB1173F5896693DD"><enum>(h)</enum><header>Additional terms and conditions</header><text display-inline="yes-display-inline">The land exchange under subsection (a) shall be subject to such additional terms and conditions as the Secretary and the County may agree upon.</text></subsection></section>
<section id="HB8A2305A7C054BC0A7DB769838EC242E" section-type="subsequent-section"><enum>3.</enum><header>Sale or exchange of NOAA property in Norfolk, Virginia</header>
<subsection id="HCCFD2F18C291426FBEBA4DB644611006"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Secretary of Commerce may sell or exchange to the City of Norfolk, Virginia, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/13">chapter 13</external-xref> of title 40, United States Code, real property under the administrative jurisdiction of the National Oceanic and Atmospheric Administration (in this section referred to as <quote>NOAA</quote>), including land and improvements thereon, located at 538 Front Street, Norfolk, Virginia, consisting of approximately 3.78 acres, if the Secretary—</text>
<paragraph id="HCE07777A71734EAABD68F2358B331187"><enum>(1)</enum><text>determines that the conveyance is in the best interests of NOAA and the Federal Government; and</text></paragraph>
<paragraph id="HB6997CCABBF247DD933B825FC261CF6"><enum>(2)</enum><text>has provided prior notification to the Committee on Natural Resources and the Committee on Appropriations of the House of Representatives and the Committee on Commerce, Science, and Transportation and the Committee on Appropriations of the Senate.</text></paragraph></subsection>
<subsection id="H7A13424F1F594B73B6B0BE93B5075278"><enum>(b)</enum><header>Consideration</header><text></text>
<paragraph id="H5FF24CBE6B1E4EE59587C1F1A8C62812"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For any conveyance under this section the Secretary shall require the City of Norfolk to provide consideration to the United States that is not less than the fair market value of the property conveyed by the United States.</text></paragraph>
<paragraph id="HD1CCB7EA8D8B4F13BE5E5C4FD6614884"><enum>(2)</enum><header>Form</header><text>Consideration under this subsection may include any combination of—</text>
<subparagraph id="H6A5E37F6AB754078B8DE0048060000E7"><enum>(A)</enum><text>cash or cash equivalents;</text></subparagraph>
<subparagraph id="HFC1C2F27554F4A758CCA2FDF077E32C5"><enum>(B)</enum><text>other property (either real or personal); and</text></subparagraph>
<subparagraph id="HFA5DD69294BE4DFA83BAEC4DEA5DAD16"><enum>(C)</enum><text>consideration in-kind, including—</text>
<clause id="H3F6C763B71EF4133A08709E98419E3BB"><enum>(i)</enum><text>provision of space, goods, or services of benefit to NOAA including construction, repair, remodeling, or other physical improvements of NOAA property;</text></clause>
<clause id="HEAE1BFBF63DF441E9C31FFCAAC3DCC7"><enum>(ii)</enum><text>maintenance of NOAA property; </text></clause>
<clause id="H47F2959D9CFB4D6A98D887CC07CA76E1"><enum>(iii)</enum><text>provision of office, storage, or other useable space; or</text></clause>
<clause id="HA3AB8EA9D7434BFE99026B22205FE08"><enum>(iv)</enum><text display-inline="yes-display-inline">relocation services associated with conveyance of property under this section.</text></clause></subparagraph></paragraph>
<paragraph id="H40F47DA9C0E94F719BC71BC2EC7165DF"><enum>(3)</enum><header>Determination of fair market value</header><text display-inline="yes-display-inline">The Secretary shall determine fair market value for purposes of paragraph (1) based upon a highest- and best-use appraisal of the property conveyed under subsection (a) conducted in conformance with the Uniform Appraisal Standards for Professional Appraisal Practice.</text></paragraph></subsection>
<subsection id="H0D2F7BEAE3484F18B8CBC500CCC3A9C5"><enum>(c)</enum><header>Use of Proceeds</header><text display-inline="yes-display-inline">Amounts received under subsection (b)(2)(A) by the United States as proceeds of any conveyance under this section shall be available to the Secretary, subject to appropriation, for—</text>
<paragraph id="HDF8984AF9E0E4250A08D494D32A9DE42"><enum>(1)</enum><text>activities related to the operations of, or capital improvements, to NOAA property; or</text></paragraph>
<paragraph id="H0120A3E3242B4275B3C11CFA30AC0081"><enum>(2)</enum><text>relocation and other costs associated with the sale or exchange.</text></paragraph></subsection>
<subsection id="HD7701487B73A48948FB3AA00FBC94D3F"><enum>(d)</enum><header>Additional terms and conditions</header><text display-inline="yes-display-inline">The Secretary may require such additional terms and conditions in connection with the conveyance of property by the United States under subsection (a) as the Secretary considers appropriate to protect the interest of the United States, including the recoupment of any profit the City of Norfolk may realize within three years after the date of conveyance to the City due to resale of the property</text></subsection>
<subsection id="H1B5839D23C7E4CFABEF060B3E74AA07"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The authority granted to the Secretary under subsections (a) and (b) shall terminate at the end of the 24-month period beginning on the date of enactment of this Act if no contract for sale or exchange under subsection (a) has been entered into by the City of Norfolk and the United States.</text></subsection></section>
