		<section id="HBD37BB0D40954FC2B4CFC417EB2C952E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Assuring Access to Medicare Doctors Act of
			 2008</short-title></quote>.</text>
		</section><section id="HDB2FAC0CEBBC470EABC4596CFCB566DA"><enum>2.</enum><header>7-month extension
			 of Medicare physician payment rates</header>
			<subsection id="H52AE25B058624BF385B73E66178C95E7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1848(d) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(d)</external-xref>) is amended—</text>
				<paragraph id="H770DEFE8726A49C5B3EC1129667CC876"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (8)—</text>
					<subparagraph id="HC03C2995AFA9418F8EB505B7B5FB2DCE"><enum>(A)</enum><text>in the heading, by
			 striking <quote><header-in-text level="paragraph" style="OLC">a portion
			 of</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HC13AB0E0BA304B90B96C77F802550076"><enum>(B)</enum><text>in subparagraph
			 (A), by striking <quote>June 30, 2008</quote> and inserting <quote>December 31,
			 2008</quote>; and</text>
					</subparagraph><subparagraph id="H003EB9AC97AF4F60BE6B5E9B581F51E5"><enum>(C)</enum><text>in subparagraph
			 (B)—</text>
						<clause id="H5F066C3844574107B4F2AF2396CA2D80"><enum>(i)</enum><text>in
			 the heading, by striking <quote><header-in-text level="subparagraph" style="OLC">the remaining portion of 2008 and</header-in-text></quote>;
			 and</text>
						</clause><clause id="H0C44C2AB977C440800626B80007332EE"><enum>(ii)</enum><text>by
			 striking <quote>for the period beginning on July 1, 2008, and ending on
			 December 31, 2008, and</quote>; and</text>
						</clause></subparagraph></paragraph><paragraph id="H07DB02FC94E344B197818CA559262700"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H17E629B05ED341D085CD7C73EAEAE8E9" style="OLC">
						<paragraph id="HF7DE23E6BA5148A8A4A6C756ECF5AA9D"><enum>(9)</enum><header>Update for a
				portion of 2009</header>
							<subparagraph id="H8C68F170B7784FE892885D60E6E78DE1"><enum>(A)</enum><header>In
				general</header><text>Subject to paragraphs (7)(B) and (8)(B), in lieu of the
				update to the single conversion factor established in paragraph (1)(C) that
				would otherwise apply for 2009, for the period beginning on January 1, 2009,
				and ending on January 31, 2009, the update to the single conversion factor
				shall be 0 percent.</text>
							</subparagraph><subparagraph id="H2073184E3EF54148A89C5C3884C66B30"><enum>(B)</enum><header>No effect on
				computation of conversion factor for the remaining portion of 2009, 2010, and
				subsequent years</header><text>The conversion factor under this subsection
				shall be computed under paragraph (1)(A) for the period beginning on February
				1, 2009, and ending on December 31, 2009, and for 2010 and subsequent years as
				if subparagraph (A) had never
				applied.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H7A23D0EB40574217B19FDBB72CF31142"><enum>(b)</enum><header>Adjustment to
			 PAQI Fund</header><text>Section 1848(l)(2) of such Act (42 U.S.C.
			 1395w–4(l)(2)) is amended—</text>
				<paragraph id="H3781C32BA5704AA4B27000FBB2DB861"><enum>(1)</enum><text>in
			 subparagraph (A)(i)—</text>
					<subparagraph id="HF6050B347BE848D595E07DE008EFA00"><enum>(A)</enum><text>in subclause (III),
			 by striking <quote>$4,960,000,000</quote> and inserting
			 <quote>$1,660,000,000</quote>; and</text>
					</subparagraph><subparagraph id="HF97A2DD61C334CB5ADAB08CFCB5BA22"><enum>(B)</enum><text>by adding at the
			 end the following new subclause:</text>
						<quoted-block display-inline="no-display-inline" id="H520EAB997C18463A9945E1EA17B74C00" style="OLC">
							<subclause id="HD71BE55522904E23A62435AE5036BAD9"><enum>(IV)</enum><text display-inline="yes-display-inline">For expenditures during 2014, an amount
				equal to
				$1,185,000,000.</text>
							</subclause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H59ACF12B2704426FBFEAC4E3E09F3957"><enum>(2)</enum><text>in subparagraph
			 (A)(ii), by adding at the end the following new subclause:</text>
					<quoted-block display-inline="no-display-inline" id="H745953FE523F454EB800508101AB5195" style="OLC">
						<subclause id="HAFE9B673B89E4B44AE47335C482FB623"><enum>(IV)</enum><header>2014</header><text display-inline="yes-display-inline">The amount available for expenditures
				during 2014 shall only be available for an adjustment to the update of the
				conversion factor under subsection (d) for that
				year.</text>
						</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H331889B02F784480849E8E4032EA42F5"><enum>(3)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="HDA8C27CF4AD847D6A2FCA1C5F08B8FB"><enum>(A)</enum><text>in clause (ii), by
			 striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="H66828E5F75134D28A7132780C6E9EB3B"><enum>(B)</enum><text>in clause (iii),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="HFE788604E6524D4594FF28D74476436E"><enum>(C)</enum><text>by adding at the
			 end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="HB56EA33D1283412C97BE70238159A8A5" style="OLC">
							<clause id="H4C5454E35BC14D8E93908EB426DB944C"><enum>(iv)</enum><text display-inline="yes-display-inline">2014 for payment with respect to
				physicians' services furnished during
				2014.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H910D08B0519A405EAA834779FC7D8503"><enum>(c)</enum><header>Transfer of
			 certain remaining funds</header><text display-inline="yes-display-inline">Of
			 the amounts appropriated under subsection (a) of section 1011 of the Medicare
			 Prescription Drug, Improvement, and Modernization Act of 2003 (Public Law
			 108–173), any such amounts which have not otherwise been obligated as of
			 January 1, 2009, shall, as of such date, be transferred and deposited into the
			 Federal Supplementary Medical Insurance Trust Fund under section 1841 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395t">42 U.S.C. 1395t</external-xref>).</text>
