		<section id="HD506B430142345CA86EAA0F52AB8535" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fairness in Nursing Home Arbitration
			 Act of 2008</short-title></quote>.</text>
		</section><section id="H51C8339BCDDA42EE8928C266053EA12B"><enum>2.</enum><header>Amendments</header>
			<subsection id="H5DFF839BD3C34CBABF66D9DE1398455B"><enum>(a)</enum><header>Arbitration of
			 certain controversies</header><text display-inline="yes-display-inline">Chapter
			 1 of title 9, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H0D6955A19FAF4342A541B1EE51D999A" style="USC">
					<section id="H4F8ECA199C6043C9B413DBFF34A53D7C"><enum>17.</enum><header>Validity and
				enforceability</header>
						<subsection id="H225831EC56D24A99948F3CE5FA49FD8B"><enum>(a)</enum><header>Definitions</header><text>For
				purposes of this section:</text>
							<paragraph id="H3D5ADFDC6EDB487AB96120FFB68BA799"><enum>(1)</enum><header>Long-term care
				facility</header><text display-inline="yes-display-inline">The term
				<quote>long-term care facility</quote> means—</text>
								<subparagraph display-inline="no-display-inline" id="HD077A7AA242942A59C9C423BEDD91FD"><enum>(A)</enum><text>any skilled nursing
				facility as defined in 1819(a) of the Social Security Act;</text>
								</subparagraph><subparagraph id="H04F00A0BCC764D05A740CCA481256CEC"><enum>(B)</enum><text>any nursing
				facility as defined in 1919(a) of the Social Security Act; or</text>
								</subparagraph><subparagraph id="H0BF32E7EAAFA471EAA7E06BEA4A19E45"><enum>(C)</enum><text>a public facility,
				proprietary facility, or facility of a private nonprofit corporation
				that—</text>
									<clause id="HD7D105C188EF4E26B8256E39B3F851F7"><enum>(i)</enum><text>makes available to
				adult residents supportive services to assist the residents in carrying out
				activities such as bathing, dressing, eating, getting in and out of bed or
				chairs, walking, going outdoors, using the toilet, or obtaining or taking
				medication; and</text>
									</clause><clause id="H18782E61818544B08322CE3FDED54CD"><enum>(ii)</enum><text display-inline="yes-display-inline">provides a dwelling place (which may
				contain a full kitchen and bathroom) for residents in order to deliver
				supportive services described in clause (i), that includes common rooms and
				other facilities appropriate for the provision of such services to residents of
				the facility;</text>
									</clause><continuation-text continuation-text-level="subparagraph">but
				excludes a facility, or portion of a facility, that either does not provide the
				services described in clause (i) or has as its primary purpose to educate or to
				treat substance abuse problems.</continuation-text></subparagraph></paragraph><paragraph id="H7794B4CBBB924381996DC9216062A82E"><enum>(2)</enum><header>Pre-dispute
				arbitration agreement</header><text>The term <quote>pre-dispute arbitration
				agreement</quote> means any agreement to arbitrate a dispute that arises after
				such agreement is made.</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="HA7E5AC6BCB50407ABD4FACC77602F107"><enum>(b)</enum><header>Invalidity of
				pre-dispute arbitration agreements</header><text>A pre-dispute arbitration
				agreement between a long-term care facility and a resident of such facility (or
				person acting on behalf of such resident, including a person with financial
				responsibility for such resident) shall not be valid or specifically
				enforceable.</text>
						</subsection><subsection id="H3BC93C49486E457E972FF7B9DFF5DA"><enum>(c)</enum><header>Application to
				agreements</header><text display-inline="yes-display-inline">This section shall
				apply to any pre-dispute arbitration agreement between a long-term care
				facility and a resident of such facility (or a person acting on behalf of such
				a resident, including a person with financial responsibility for such
				resident), and shall apply to a pre-dispute arbitration agreement entered into
				either at any time during the admission process or at any time after the
				admission process.</text>
						</subsection><subsection id="HBA09BE4766294B9BBD1990F89EDE8426"><enum>(d)</enum><header>Application of
				Federal law</header><text>A determination as to whether this chapter applies to
				an arbitration agreement described in this section shall be determined under
				Federal law. Except as otherwise provided in this chapter, the validity or
				enforceability of such agreement shall be determined by the court, rather than
				the arbitrator, irrespective of whether the party opposing arbitration
				challenges such agreement specifically or in conjunction with any other term of
				the contract containing such
				agreement.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC04188940615472BAC265C5CF37EA6B"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/1">chapter 1</external-xref> of title 9, United States Code, is amended by adding at
			 the end the following:</text>

			</subsection></section><section id="H6C0FB3805F1D4C0A83C391ECD562A5CF"><enum>3.</enum><header>Effective date;
			 application of amendments</header>
			<subsection id="HCDDBB5EB95C348A6A21C13D133E6E09B"><enum>(a)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Except as provided in
			 subsection (b), this Act and the amendments made by this Act shall take effect
			 on the date of the enactment of this Act.</text>
			</subsection><subsection id="HBB89888B784B47B391FAD7F1F9B2521"><enum>(b)</enum><header>Application of
			 amendments</header><text display-inline="yes-display-inline">The amendments
			 made by this Act shall apply with respect to agreements made, amended, altered,
			 modified, renewed, or extended on or after the date of the enactment of this
			 Act.</text>
