		<official-title display="yes">To provide a mechanism for the construction
		  of petroleum refineries on military installations to provide a reliable source
		  of petroleum products for use by the Armed Forces, and for other
		  purposes.</official-title>
	</form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H80BCCA20422943789FD2180F8B200A" style="OLC">
		<section display-inline="no-display-inline" id="H13971900236B4B188BF3001D8DBF1227" section-type="section-one"><enum>1.</enum><header>Military use
			 refineries</header>
			<subsection id="H4A6209965B304B6591A242ED05D84305"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The President may authorize the design and
			 construction of one petroleum refinery for each of the Army, Navy, Air Force,
			 and Marine Corps that will be—</text>
				<paragraph id="HB38AAFC10D9449038322ABEB9D73035D"><enum>(1)</enum><text display-inline="yes-display-inline">located at a site—</text>
					<subparagraph id="H33D4CEF46A2A42E9B7E25DB27640AE02"><enum>(A)</enum><text>on a military
			 installation designated by the President, other than a closed military
			 installation or portion thereof; or</text>
					</subparagraph><subparagraph id="H0D81086E59AB4FCEBDDBE2F4D94858CA"><enum>(B)</enum><text display-inline="yes-display-inline">on a closed military installation, or
			 portion thereof, made available for the siting of a refinery in the manner
			 provided by the base closure law applicable to the installation; and</text>
					</subparagraph></paragraph><paragraph id="HB73B11E9A6B44834B10150F13B663CC4"><enum>(2)</enum><text>reserved for the
			 exclusive purpose of manufacturing petroleum products designated for
			 consumption by units and elements of that branch of the Armed Forces.</text>
				</paragraph></subsection><subsection id="HC6757CF1EB394A5891FDF2B03CC736C"><enum>(b)</enum><header>Solicitation for
			 design and construction proposals</header><text>The President shall solicit
			 proposals for the design and construction of a refinery under this section. In
			 selecting a proposal or proposals under this subsection, the President shall
			 consider—</text>
				<paragraph id="HB41C6FFD918B4520A18FC71417BBD678"><enum>(1)</enum><text>the ability of the
			 applicant to undertake and complete the project;</text>
				</paragraph><paragraph id="HD59BCF0E404045B087CE4D55F800005F"><enum>(2)</enum><text>the extent to
			 which the applicant’s proposal serves the purposes of the project; and</text>
				</paragraph><paragraph id="HED386DB2E48C4BEF93127B80D9E6D8C"><enum>(3)</enum><text>the ability of the
			 applicant to best satisfy the criteria set forth in subsection (c).</text>
				</paragraph></subsection><subsection id="H9A61DE26C2044C710000D8AA1D25F9BC"><enum>(c)</enum><header>Refinery
			 criteria</header><text>A refinery constructed under this section shall meet or
			 exceed the industry average for—</text>
				<paragraph id="H57C1FB846AC04BD0929E396DA66DCA7"><enum>(1)</enum><text>construction efficiencies; and</text>
				</paragraph><paragraph id="H9C736899EA4A43F3895F17A2B435DF00"><enum>(2)</enum><text>operational
			 efficiencies, including cost efficiencies.</text>
				</paragraph></subsection><subsection id="H07676459B0A54C5E84433EA76B76D730"><enum>(d)</enum><header>Operation of
			 refinery</header><text display-inline="yes-display-inline">In the case of a
			 site referred to in subsection (a)(1)(A), after the construction of the
			 refinery, the site shall be leased for operation, for its fair market value, to
			 an applicant selected in the manner described in subsection (b). In the case of
			 a site referred to in subsection (a)(1)(B), after the construction of the
			 refinery, the site shall be disposed of in the manner provided by the
			 applicable base closure law.</text>
			</subsection><subsection id="H3CBCAE6BD2944E1C96273336584300A7"><enum>(e)</enum><header>Use of
			 products</header><text display-inline="yes-display-inline">All petroleum
			 products manufactured at a refinery constructed under this section shall be
			 sold to the Federal Government, at a price not to exceed the fair market value
			 of the petroleum products, for use by the Armed Forces.</text>
			</subsection><subsection id="HBCE522E84CD54E9A95E2E31FC9777D90"><enum>(f)</enum><header>Funding</header><text display-inline="yes-display-inline">A contract for the design or construction
			 of a refinery may not be entered into under this section in advance of the
			 appropriation of funds sufficient for such purpose. Funds appropriated for the
			 Department of Defense or for Department of Energy national security programs
			 may not be used to enter into contracts under this section for the design,
			 construction, or operation of a refinery. Funds appropriated for the Department
			 of Defense may be used to purchase petroleum products manufactured at a
			 refinery constructed under this section for use by the Armed Forces.</text>
			</subsection><subsection display-inline="no-display-inline" id="H0674787A356C4739906314DA37C7855C"><enum>(g)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HCF1115D8207147668C76972226336E93"><enum>(1)</enum><text>The term
			 <quote>base closure law</quote> means the Defense Base Closure and Realignment
			 Act of 1990 (part A of title XXIX of <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2687">10 U.S.C. 2687</external-xref> note)
			 and title II of the Defense Authorization Amendments and Base Closure and
			 Realignment Act (<external-xref legal-doc="public-law" parsable-cite="pl/100/526">Public Law 100–526</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2687">10 U.S.C. 2687</external-xref> note).</text>
				</paragraph><paragraph display-inline="no-display-inline" id="HA887211121E74B3681A7A4A06F37F1A3"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>closed military
			 installation</quote> means a military installation closed or approved for
			 closure pursuant to a base closure law.</text>
				</paragraph></subsection></section><section id="H326EAF0B75454AC488FD14169E00F892"><enum>2.</enum><header>Repeal of
			 requirement relating to procurement and acquisition of alternative
			 fuels</header><text display-inline="no-display-inline">Section 526 of the
			 Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17142">42 U.S.C. 17142</external-xref>) is
			 repealed.</text>
